and then we'll warm up. mike? we may have a new crash in milpitas. i'm checking that out off 680. the map doesn't show any slowing down there. i did mark it there with an incident. zooming in to another area, the alemany project 101, you may be down to one lane for a few minutes here and also slowing heading up to lincoln and toward the golden gate. you see that just popped up. crews on the move, i believe, from overnight road work. that's about it. back to you, laura. all right, thank you very much, mike. breaking news while were you sleeping, big changes coming to the berkeley police department. councilmembers early this morning approved a reform plan to take place there that includes taking traffic stops out of the hands of police officers. i want to check in with "today in the bay's" cierra johnson live in berkeley with a look at what happened and what happens now. good morning. >> reporter: yes, good morning. it was a really long night for many residents here in berkeley

as well as those councilmembers because that meeting started at 6:00 and didn't wrap up until about 3:00 a.m. the final decision was changes in policing here in the city of berkeley were necessary, so those councilmembers voted to proceed with making those changes. let's break this down. last night a total of five proposals related to policing which will combine into one omnibus measure. many which created the creation of the new department to handle traffic-related stops and duties, an audit of police calls and response and the creation of specialized care units to handle the nonpolice trauma calls were all lumped into one. one of the more drastic proposals, was not included in that all-encompassing proposal. after hours of public comment, every councilmember but one who proposed a budget cut voted yes.

she said the items did not reflect what the people wanted and did not offer enough change. take a listen to what residents had to say outside of the meeting. >> they won't be able to beat people no more. >> i think the police do somewhat need to be armed. they need more accountance and need to work on cameras, having that camera on. >> reporter: in terms of time line, councilmembers agreed the changes would not happen overnight and want to align the conversation with the 2021 is budget discussion. the conversation started after the death george floyd. a lot of conversation abouts racial inequality and racial justice began so a lot of eyes nationwide are going to be on berkeley because this is considered groundbreaking.

i will, of course, bring you the latest. we're live in the city of berkeley. cierra johnson for "today in the bay." 5:02. happening tonight concord leaders take the first steps in possibly readjusting their police department's budget. councilmembers recently approved a $100 million plan, but they also left room for changes on calls for defund and reform. tonight they'll hold a study session. the chief of police will also be on hand. new signs america's road to recovery could be a long one. the head of the cdc warns this fall and winter could be rough when coronavirus collides with the flu season. but we learned overnight that soon the agency experts won't be in charge of tracking those numbers. "today in the bay's" tracie potts live for us in washington to explain that and much more. tracie, that concerns me a little bit. do we know who will keep track of those numbers?

>> reporter: well, it's still going to be health and human services which oversees the cdc, so that function will be pulled to washington as opposed to scientists and experts down in atlanta. some people kind of concerned are they going to tinker with the numbers here. we could hear more about that today. president trump headed down south to the cdc home base. he's supposed to talk about infrastructure, but he's also talking about why he wants students to go back to class in the middle of a pandemic. president trump lands in georgia. atlanta is starting school online despite his insistence kids go back to class. >> it is a balancing act, but we have to only our schools. i also say a decision like that is politics. we're doing very well in the polls. >> reporter: a stockpile of

personal protective equipment is critically low. new overnight the cdc will no longer control coronavirus numbers. the trump administration is asking hospitals to bypass the agency and send daily reports directly to a new system set up by the administration. unemployment is expiring. >> the last checks will be going out the last week in july. so it's absolutely urgent that we pass legislation. >> reporter: democrats and republicans have different priorities. >> liability protection, kids back in school, jobs/unemployment, and health care. >> reporter: democrats promise relief by the end of the month. tracie potts, nbc news. nearly 1,100 new cases are being reported across the bay area of coronavirus. now the hot spot remains alameda county which added 345 new cases. 11 new deaths brings the bay area total of deaths to 657.

and you know, marcus, with the recent spike in cases california testing labs are actually getting pretty overloaded as well. long lines for testing. a very common site in the bay area, some waiting longer for test results to come back. experts say a backlog and a shortage of testing supplies making it more difficult to contain the virus. one expert believes the federal government needs to provide more oversight. >> providing funding for the testing in terms of managing the situation around the country to have a good handle on what are the needs and the capacity and to be able to manage the global supply chain and then to direct those supplies. >> california leaders are now calling on medical providers to increase testing access. they're looking to expand lab options. another large east bay school district likely to make a

decision to start the school year home learning. distance learning only at tonight's school board meeting. this decision comes after teachers yesterday took part in a caravan demanding all fall classes be held online with at least one saying it's a matter of life and death. the superintendent does say a lot of progress has been made in expanding safety measures, and he still sees a possible return to the classroom later in the school year. you may want to make sure you carry spare change. parking enforcement will resume meaning paying to park at meters and in downtown garages. street sweepers will also be back in action starting today. all right. we want to get a look at the forecast out there. street sweepers are out there

working hard. a lot of people will be out there so we have to do our part and keep it clean as well. yes. it's going to be one of those days where we'll see the fog around the coastline. it will be comfortable because we're more seasonable now for this time of year. not as hot as we experienced last week but still pretty warm in some areas. let's take a look at today's forecast. in the south bay comfortable 80s. of course if you live further inland in areas like concord, livermore and antioch, we're still going to be in the upper 80s, a couple 90s, and up through clear lake, santa rosa and napa expect to also see some of those upper 90s at times. around the coastline, though, and into san francisco, we have 60s and 70s, so a good spread of micro climates. i'll have a closer look at what you can expect heading into tomorrow and the weekend in a few minutes. mike? all right, vianey. we do have this crash in the south bay. i want to point this out to folks who travel north out of

and united health. best buy requiring customers to wear a face covering at all stores even in states or cities where they are not required. last week starbucks announced a similar measure. the new policy goes into effect today. best buy will provide a face covering to customers who don't have one while young kids and those unable to wear a covering for health reasons can enter stores without one. customers who have concerns about wearing a face covering can still buy online and get home delivery or curbside pickup. nissan builds a crossover vehicle, the aria. it will hit showrooms by the end of next year. a range of up to 379 miles on a single charge depending on the type of battery and several autonomous features including self-parking. it will cost $46,000 and compete directly against tesla's model y. crossovers have been selling well accounting for 40% of recent u.s. auto sales. back over to you. >> thanks so much, frank. good to see you. hey, trending this morning, no one could have seen this coming during the summer of love.

marcus, you will definitely be enjoying a nice stroll at least the first half of the day. the coast, the peninsula, you can enjoy a stroll all day long. san jose, a beautiful view there. look at the sky. you can start to see those clouds forming there. and over walnut creek as well. if you live around the coast you're probably waking up to that fog as well. and we can expect to see mostly sunshine today so don't worry. that fog will not stick around all day long but will help keep our temperatures cooler. very similar to yesterday. more normal for this time of year. microclimate highs for this afternoon, san jose, 85. milpitas, 84. los gatos, 84. concord, 87. walnut creek, 86. again, if you live further inland, definitely take your stroll before 1:00 because between 1:00 and 3:00 typically some of our hottest peak hours of the day. you want to take a stroll or maybe later in the evening. your microclimate highs 73. san francisco will be comfortably in the 60s, up

through the north bay, santa rosa, 82. if you will be going outside keep in mind that grass pollen is high. weeds are moderate. tree and mold is low. don't forget to take that allergy medication. my allergies have been acting up for sure. over the next seven days look at what we're tracking, thursday, friday, saturday, you notice what happens to the temperatures, we see an increase yet again into the mid-90s throughout the inland areas. it will get hotter heading into the weekend. at least it will be sunny. now we'll keep that morning fog for today, and then by tomorrow also notice what happens to the temperatures in san francisco. we get upper 60s, possibly even some low 70s. so we have a warm-up on the way heading into the weekend. mike? all right. so we're just looking forward to the weekend, not necessarily the temperature in the inland areas. over to all the areas, the maps show you your entire commute or most of your bay commute is good. i'm still concerned about this crash in the south bay, north 680 approaching jacklin.

doubt. this was caught on dash cam video. the 3-week-old baby was choking at the time the officer arrive. the officer flipped the baby on its stomach to deliver a few strategic taps on the back. the baby then started crying, thankfully breathing again. i'm sure that mother is so happy this morning. developing this morning bail denied for jeffrey epstein's former confidant ghislaine maxwell who prosecutors are calling a flight risk. maxwell pleaded not guilty yesterday to charges of helping epstein sexually abuse underaged girls. her attorneys argued she should be released due to the coronavirus. when maxwell was arrested she ran from officers and a cell phone wrapped in tinfoil was found in her home in an effort to avoid detection. the trial likely won't start before the end of the year.

president trump. he lost to former auburn football coach tommy tuberville. president trump tweeted he will be a great senator. nbc bay area responds to an anti-yok man who actual ly needd help getting his money back from an airline. >> a lesson for anyone who flies. >> reporter: good morning. bob was set to fly from oakland to honolulu in june on hawaiian airlines. bob wanted to cancel and get a full refund, but hawaiian airlines was only offering a flight credit. so he turned to us. we noticed something that hawaiian airlines had changed his trip. instead of flying from oakland to honolulu they had him flying from sfo to honolulu and that was our in. we knew there was a contract of carriage, a contract that nobody reads.

and a very good wednesday morning to you. thanks for joining us. i'm laura garcia. >> and i'm marcus washington. mike is keeping an eye on that commute for us this morning. vianey arana in for kari with a look at the forecast. how are we shaping up today, vianey? it's going to be a good one. aside from the fact we're in the middle of the week, have two more days left for the weekend, plenty of sunshine and the temperatures are going to be pretty comfortable overall. now right now we do have that fog. temperatures are staying cooler. look at san francisco, 57 degrees. you can see that fog sort of sticks around through about 7:00 a.m., pushing that time line all the way through about 12:00 is when we start to notice more sunshine but also a warm-up into the 80s. a closer look at your daytime highs coming up in a few minutes. mike? all right, vianey. a pretty smooth drive around the bay as we look at your map, we'll talk about the north bay, vallejo and san rafael moving nicely down to the bridges.

if you're heading into the city, you're just fine. heading out of the city a little slowing down to the alemany project on 101. the rest of the bay looks good. following this crash in milpitas. >> thanks, mike. new questions on the road to recovery when it comes to eating out. alameda county officially requesting permission from the state to resume outdoor dining which has shut down. a city that is allowing outdoor dining to continue. >> reporter: as you see behind me they're allowing some of their streets to remain shut down so they continue outdoor dining even though the state issued an order friday night for outdoor dining to shut down until the county receives a variance from the state.

yesterday the alameda county board of supervisors gave permission to apply for the variance to allow outdoor dining. not clear when the application will be submitted and when the state will issue its decision. late last week, friday night, the state said it must stop because the county had never aplayed for that variance. the pushback from cities like livermore is where we're at now. waiting for the oakland zoo to reopen for the first time since it shut down in march. the zoo desperately needs paying customers in order to stay afloat. the observiakland ceo says thei situation is dire. they've run out of their federal ppe money and still have $2.5 million a month in operating expenses.

the zoo would limit attendance to 2,500 people per day. reporting live here in downtown livermore, bob redell, "today in the bay." today the state superintendent will publicly support the district's efforts to roll out the new school plan for next year. it will do so in a news conference this morning. in the meantime last night san francisco schools decided to follow many other districts by following the fall semester with distance learning. it would allow them to return to campus in eight weeks. at 3:00 p.m. a group of families will hold a car caravan starting at san francisco city college to protest the possibility of students returning to the classroom. a follow-up and possible new fallout for one of the contractors tied to san francisco's public works scandal. city attorney dennis herera now wants contractor hernandez and its company to be banned from doing business within the city.

hernandez is accused of bribing muhammad nuru and could face up to ten years in prison if convicted. herera has begun proceedings to have the company banned from competing for any contract in the city for at least five years. new controversy in an already controversial police shooting. relatives of san francisco's sean monterrosa say authorities in vallejo have destroyed evidence tied to his killing six weeks ago. that's when officers responded to a lotting report and investigators say one officer mistook a hammer for a gun. relatives learned most of it is gone. >> now the evidence is gone forever. >> we did reach out to the police chief and the city for comment, but they did not respond. last week police released body

camera video of the shooting and that sparked new controversy because the camera was off until after the shots were fired. new details for you and the possible fallout in the recent vandalizing of a black lives matter mural in martinez. two people you see here in the video are facing misdemeanor charges with hate crime enhancements. "the east bay times" is reporting the d.a. has received death threats ever since she filed for those charges. authorities have been alerted in the area where she lives. every threat is being taken seriously. the kincade fire burned 78,000 acres in sonoma county last october. "the press democrat" reports more than 50 businesses and individuals are now seeking compensation. cal fire has not yet determined the cause of the fire or whether pg&e equipment played a role. >> caltrain says it is in danger of shutting down entirely.

yesterday san francisco supervisors rejected putting a sales tax on the ballot to fund caltrain. the plan would have to gain approval from the transit board and three-county supervisor boards. caltrain says that the pandemic is cutting 95% of the ridership. and unless it can restore roughly 30% of riders by the end of the year, it will have to make serious service cuts. 5:38. taking a look at what's outside for us, vianey arana in for kari this morning with a look at what we can expect. you say a nice one like yesterday, vianey. we're going to see the sun take over your wednesday and temperatures will be seasonable but depending on where you live quite comfortable, i might add. let's talk about san francisco in the 60s. half moon bay also in the 60s. we are seeing some fog out there. once we get the clearing we'll see our temperatures warming up.

talk later today about what is called the fair juries act. state senator scott wiener authored it. it would expand jury pools to be more racially diverse. he's organizing a news conference for later today. today is the day, tax day. the end of the extended deadline because of the pandemic. state and federal tax returns must be submitted or postmarked by the end of the day. listen up, everyone was given that extra 90 days to file. just like in other years that deadline passed back in april. get to filing. despite california's most recent rollback, more restaurants in san diego are allowed to offer outdoor dining. the mayor there says that she signed an executive order allowing restaurants to install dining areas on sidewalks,

5:56. gilroy police looking for three men who blew up a mailbox. officers released photos to try

to help catch the suspect. police say the men used an explosive device to destroy the mailbox at a home on rancho hills drive on july 6th. relief for a lot of people who can't pay their rent. a moratorium on evictions and rent increases has been extended in contra costa county. the moratorium was set to expire today. supervisors also extended the period in which tenants must pay back missed rent to january 31st. the protections are for tenants who have lost income or had out-of-pocket medical bills tied to the pandemic. the food bank of contra costa is having a food drive. this is for people so they can -- they have food because the restrictions, i should say are starting to tighten around the bay area. this starts in pittsburg.
