spawning outrage as they move to phase four on monday. in texas cases keep ticking up especially in houston where they are above icu capacity but physicians are promising not to turn anyone away. three hours away, one texas county said 85 babies tested positive for covid-19. and in california, and an investigation showed a thousand cases of the virus at day care facilities across the state. roughly 20% of which involved kids. raising new concerns. >> we don't know what the long-term consequences will be for these young children. >> reporter: in florida schools are set to open next month so governor ron desantis wants a virtual option if they're more comfortable with that. >> thank you very much. now to the latest in the raging debate over masks. they are now required in more than half of all states. walmart, the nation's largest retailer, and other stores are

now making them mandatory for shoppers. morgan chesky is live with the latest on that story. good morning. >> reporter: good morning. this a decision that's going to have some serious impact because more than a third of the 5,000 stores are in places that do not have any mandated mask policies. but today for the first time an employee will be standing out front making sure everyone who walks inside has a mask on. this morning shoppers at walmart and sam's club now required to wear masks at stores nationwide. the move the latest at the same time from a growing list of national retailers to slow the spread of covid-19. as lowe's, walgreens, cvs, and kohl's are also starting requiring masks today. >> i don't see a good reason not to wear a mask. >> reporter: but six months into

a delivery man opened fire at a federal judge's house early sunday evening this morning the question is why. this morning a massive manhunt is underway after a gunman shot and killed the 20-year-old son of a prominent federal judge at their new jersey home. her husband was also seriously injured in the attack. he's in critical condition >> my neighbors said they heard five or six gunshots happen. >> reporter: a source telling wnbc esther salas was in the basement when it went down and was not harmed her husband was shot multiple times. their son daniel a college student is believed to have been shot moments later >> he heard this shot and he ran to help his father and that does not surprise me at all, because that is the kind of family that were >> reporter: the mayor of north brunswick confirmed the son's death.

the fbi tweeted it is looking for one suspect in the shooting. one source telling nbc that the shooter was believed to be disguised as a fedex driver. judge salas is the first to serve in new jersey. she was appointed by barack obama in 2010 and has presided over a number of high-profile trials including the fraud trial of former real housewife teresa giudice and her husband joe. she presided over a case claiming the company made false and misleading statements about its money laundering policies and -- bob menendez releasing a statement which reads, my prayers are with judge salas and her family and that those are swiftly brought to justice

his honor. >> thank you so much senator cory booker served in congress with john lewis and like so many others have called him one of his heroes senator, good morning to you i was just thinking about our correspondent standing in front of that giant mural and just thinking about what a towering figure john lewis was. but for you, what did he mean to you personally >> well, you know, i found out when i became a senator when i went back to interview the lawyer -- one of the principle lawyers who represented my family when i first tried to move to new jersey, i was just a baby but my parents were denied housing and turned away because of the color of their skin it was a lawyer that designed the sting operation have a white couple pose as us. led to an altercation where a lawyer was physically attacked but eventually we moved into the house and integrated this area of new jersey. and i called the lawyer and talked to him and asked him why

he would do that as a white man, take time to represent black families and he told me about sitting on a couch in 1965 watching the edmund pettus bridge, seeing john lewis get beaten. and that he decided right then that he couldn't just sit on a couch comfortably in america while there was so much tragedy going on that's the power that john lewis has unleashed in his entire life ripples and waves of love and hope and change. and knowing him personally when i eventually became a mayor, he and i were both the subjects of finding your roots show and it began a mentorship where he just really showed me an extraordinary kindness and love and partnership on so many things in fact, the day i got sworn in as a senator, my dad had just died days earlier. and my last meeting before i got sworn in was with him. and as he welcomed me to the senate as only the fourth person elected to the senate, he told me what it meant to him with

such humility and such grace so so much of my life even before i was born was altered by a man who showed all of america that the most powerful force on the planet will always be unarmed truth and love the grace with which he lived, most people focus their lives or measured their lives on their possesons or their titles. but he showed the way you should live your life is with virtue and grace. and an undeterred invincible commitment to justice for all. >> and he was -- i mean, one of the things he was known for was his ability to forgive he forgave klansmen, segregationists. what do you think forgiveness meant to him

good morning. it's 8:26. i'm marcus washington. high school athletes across california will likely learn today if they'll be playing football in the fall. california interscholastic federation is supposed to announce its plans for the upcoming quarter. football practice at most schools begins two weeks from now and games kick off at the start of september. it's possible football could be played during the winter quarter. other fall sports now in limbo include girl's volleyball, field hockey and water polo. let's get a look at the forecast for you on this monday. kari hall has been tracking that. >> we're seeing some clouds over the east bay and much of the bay area to start out. but we're also going to have a slightly cooler day.
