we'll get you updated on this tuesday morning, the 1st day of september as well. good morning to you and thank you for joining us. i'm laura garcia. >> and i'm marcus washington. mike is keeping an eye on the commute. first meteorologist kari hall looking at this forecast we can expect on this tuesday. kari, how is it looking? it's looking good for today. it won't be extremely hot, but we are starting out nice and cool all around the bay area. let's head to concord and look at our temperature trend where we're going to have some upper 50s and low 60s this morning leading into some mid-70s going into today. we are still looking at some 90s, but this is a break from the extreme heat that's coming this way by the end of the weekend. so we'll talk more about that coming up in a few minutes. mike, any issues for the drive this morning? well, the second of the bridges here, the dumbarton, the slowing looks like it's cleared and no incident or construction scheduled. head over from east palo alto to

fremont, so i'm going to say that was just a sensor had to wake up. we're looking at northbound 680 and 84, the crash near that connector may be an issue, heading into livermore and at west 580, the off ramp for isabel, there may be activity there. we're tracking that. no slowing shows up. back to you. thank you very much, mike. decision 2020 and president trump plans to visit kenosha, wisconsin, against the wishes of democratic leaders there. the city has erupted in protests and violence after police shot a black man in the back and a white teenager was charged in the shooting death of two demonstrators. "today in the bay's" tracie potts is live for us in washington with a look at what's on tap for today. tracie? >> reporter: yeah, marcus and laura, good morning. what's on tap today president trump heading to kenosha even though local leaders there do not want him to come.

they're concerned his visit could cause trouble. the president is expected to survey riot damage and is expected to meet with officers there after appearing to defend 17-year-old kyle rittenhouse, the teenager now facing murder charges after killing two poem and shooting another in the middle of the chaos. vice presidential -- or presidential nominee joe biden has blamed the president for this. the president says that it's biden who is actually stoking the unrest. >> he was trying to get away from them, i guess, it looks like, and he fell and they violently attacked him. >> the violence seen in donald trump's america. >> reporter: meantime, the president visiting against the advice of local leaders, the governor, the mayor, and others saying that this is not a good idea and not good timing for

president trump. >> i felt the timing was wrong. >> this is not about politics. this is about my son. >> reporter: that was the father of jacob blake, the man shot in the back seven times by police when he was reaching into his car. they later said they thought he had a knife. the president has yet to speak to the blake family. he spoke to their pastor but the president said a phone call that they wanted to do he declined. he said he thought it was inappropriate that they wanted their lawyer on the call. laura, marcus? >> very interesting, tracie potts. thank you so much. a for you now. officers arrested two dozen people in three separate protests tied to the shooting in wisconsin. 11 other people arrested are oakland residents. windows were broken at 21 downtown businesses.

c coverage days after governor newsom unveiled the state's new color code reopening system many businesses and cities have new lives. san francisco moving slower in its reopening plan, at least when it comes to certain businesses. "today in the bay's" cierra johnson is live. i'm sure a lot of those business owners out there are happy to start opening businesses again. >> reporter: good morning. exactly. some reopening is better than no reopening. for five and a half months they haven't been able to do any work. but starting today, september 1st, some businesses will be able to resume operation outdoors. those businesses include hair salons and barber shops. but with the small victory of being able to open outdoors it comes with some challenges. some discussed many salons don't have the outdoor space in the city necessary to conduct a proper haircut. the cooler, windy temperatures make that even more difficult.

another issue, the city's homeless population. a few weeks ago we introduced you to a city business owner. now other counties have begun reopening other businesses outdoors. salons and barber shops in alameda county are open outdoors and in contra costa county those salons and barber shops can resume styling indoors. cierra johnson live for "today in the bay." >> thank you for that. malls and indoor shopping are now being allowed in every bay area county except san francisco. food courts are still not allowed to open. several south bay businesses may be allowed to open outdoors. they will decide whether to allow the city to recoup some tax revenue. an nbc bay area exclusive, a south bay man expected to enter

pleas on sending 24 threatening letters to dr. sara cody. 55-year-old alan viarenga is being held without bail. investigators believe he may be connected to a right-wing extremist group. and another member of the same group is now charged with killing santa cruz sheriff's deputy sergeant damon gutzwiller and dave underwood in june. >> the investigation linking both the language and the symbols used in the multiple letters he sent. >> documents also indicate viarenga sent taunting letters to the defensemenputy's widow. more than and firearms were at his home. developing for you that morning firefighters are now making new grounds tackling the bay area wildfires. later today leaders in several

bay area counties will tackle what's happening next, not just with the fires but with the pandemic. when they hold their regular meetings tuesday that will happen. here is the latest on the containment. the czu fires are now 41% contained. the national guard arrived yesterday to assist in the firefight. 893 homes have been destroyed. in the north bay the lnu fires are now 66% contained with some 3,300 structures still threatened. 1,200 structures destroyed there. similar containment levels for the scu fire, 65% containment there with full containment expected by thursday. all evacuations in alameda county are now lifted along with some in santa clara county. a great way to stay informed is our free nbc bay area app. we'll send you out the latest evacuation updates, weather

alerts and other breaking news stories that happened throughout the bay area. google's planned downtown campus in san jose has hit a new snag. after the draft environmental report was not submitted before last week's deadline. mayor sam liccardo says it's due to legal issues tied to the submission of the document. according to the san jose spotlight the report is expected to be submitted this fall. san jose leaders are now asking the state to push back its approval deadline for that development. another obstacle for those trying to make it in the bay, real estate prices are climbing. "the mercury news" cites a study by real estate firm and dq news the average home prices rose nearly 9% in july compared to last year. the findings also show costs soaring, most in contra costa and san mateo counties. the average bay area home price now $950,000.

right now at 5:13 let's get you up and out the door in livermore. we'll see our temperatures nice and cool with some upper 50s and a few clouds this morning and some upper 70s at noon. we're going to have a warm afternoon. we'll take a look at that and our air quality heading into the weekend coming up in a few minutes. and we're looking at a smooth flow of traffic for the most part. yesterday, monday, metering lights were turned off just after 5:30 at the bay bridge. the toll plaza sees a bump up in the volume of traffic. i'm just observing that but we'll see if the metering lights are turned on at the same time just after 5:30 today. we'll track it.

well, good morning and a very happy tuesday to you as well. twitter has removed a video published by the white house assistant press secretary that purports to show a tv interview with joe biden where biden is asleep. this is fake. the picture is a still captured when he blinked and then added into a real tv newscast from some years ago. twitter originally marked this as manipulated video and took it down altogether when the tv station it was taken from complained. now it really should go without saying but a reminder the white house press office is not the pr department for donald trump. it represents the executive branch of the government and is expected to tell americans the truth and certainly not distribute fake de. other news, wall street wrapped up august with its best performance in decades. there may have been red arrows yesterday but all the losses are gone for the year. apple and tesla did extremely well rising after their stock splits took effect.

but this morning tesla has indicated it's willing to sell more stock. investors do not like this. you buy shares based on the idea there's a limited number of them. it's like buying a limited edition of something. you don't expect the company to then say, wow, these are selling really well, we should sell more of them. it tends to depress the price. but that's what tesla is going to do again selling 5 billion shares based on today's price. and finally, marcus and laura, take a look at this. mcdonald's has responded to a video that was posted to tiktok, a pulling pulling a decades oldham burger out of her closet. the advertising indicates it's from '96 and the video has been watched millions of times. >> the hamburger itself, the bread has never molded.

it's really a back-and-forth battle. one plays this song and you're like this all night. it depends on who you really love. if you love brandy, you're going to say brandy won. >> i think we need a whole sideshow on this topic. >> it's worth it. we do have another topic, the forecast right now. we are in a spare the air alert day. yeah, another day with drifts of smoke coming in. the fires are still burning, but we are getting more containment which, of course, is great news as we start out this rng mmorni let's go to pleasant hill. a morning where you may be wearing long sleeves or a light jacket. temperatures in the upper 50s. as we go through the day we know it's going to be another warm one as we reach into the mid-70s by noon, continuing to go up from there as we reach up to 87 in morgan hill today. it's also going to be still in the low 90s for parts of the

east bay. we're up to 92 today in antioch and in walnut creek a high of 88 degrees. still cool along the coastline with some fog and clearing today in half moon bay. we'll see temperatures in palo alto reaching 80 degrees and some upper 60s in san francisco. north bay high temperatures anywhere from 63 in point reyes to 83 today in napa. so as we go through this forecast we are looking at still unhealthy air quality for today but some improvement tomorrow as we get a little bit more of a breezy wind and that will help us out quite a bit going into the next few days. then as it heats up once again this weekend most likely that air will become very stagnant once again and high temperatures are heading into the upper 90s and into the triple digits for the labor day weekend. we'll have more on that coming up. mike, how is it looking right now for the commute? well, right now, kari,

>> reporter: yes, governor newsom signed this just before midnight. you ask why before midnight, because yesterday was the last day of the legislative that hen for renters from eviction. it gives renters who have lost income because of the pandemic extra time to pay their rent. under the new law a landlord cannot evict a tenant before february 1st of next year. if the renter was not able to pay rent between march 4th and august 1st of this year because of covid-19 income loss. the renter must provide a declaration of that hardship. between now and january 31st renters must pay 25% of their rent to avoid eviction. landlords can begin to recover the unpaid back rent starting march 1st of next year. now some landlords have expressed concern they won't be able to pay their own bills without the rental payments.

it will provide landlords who own a small number of properties protection from foreclosure if they were to default on their end. tonight the city of dublin where we're at now will discuss a moratorium on rent increases and late fees that are taking place. bob redell, "today in the bay." bob, thank you. developing for you right now another big step for firefighters facing the epic task of the northern california fires. a look at those fires burning closest to the bay area. unfortunately, the job turned deadly. this is when an unidentified firefighter on the front lines of the august complex fire in mendocino county. another firefighter was injured as well. at least eight deaths now tied to the lightning-sparked fires. as for the three bay area complex fires the lnu and scu fires are now about two-thirds contained. the czu fire is now about 40% contained. and all those fires create

so much smoke. happening now the bay area has, in fact, hit an all-time record. today marks the 15th straight spare the air day here, topping the record set in the days after the 2018 campfire. "today in the bay's" kris sanchez joins us live. more on i guess you could call it a milestone certainly affecting everyone in the bay area, kris. >> reporter: yeah, this is the kind of record we want to break. we came out here earlier this morning the moon still had the orange hue we've gotten used to the last couple of weeks and we know the air quality will be bad once again today. that same smoky air making nor some really gorgeous sunsets and sunrises is making for hazardous breathing conditions and not just for folks who are in the sensitive category. weeks of wildfire smoke put that particulate matter in the air that makes it really tough to breathe. >> spare the air alert for tomorrow will be 15 days in a row, and that breaks our records for the bay area. someone described it as a fire

hose spewing smoke into marin co folks in marin county but all around the bay area. during spare the air alert you should try to keep that smoky air outside your home by keeping windows and doors closed, if you can. if you have air conditioning set it to recirculate, avoid strenuous outdoor activities. if you have asthma, are pregnant or have covid. at this point there is no sparp the air alert for tomorrow. speaking of fire today santa clara county supervisors will discuss how to better respond to wild land fires in the county which has more than half a million acres of wild land area. the fire district consolidation is happening in october. we'll be part of that discussion as will a plan for faster detections and a rapid response system hiring more personnel and tools. with all of that a discussion

about how do we pay for it all. with the scu fire now becoming the second largest in california, certainly the discussion will take on a lot more urgency. in san jose, kris sanchez, "today in the bay." kris, thank you. new overnight an earthquake hits the coast of northern chile. no tsunami threat and so far mo injuries or major damage report. there have been aftershocks as strong as 6.2 and 5.5. happening today t gapined n for illegally living home in the east bay will demand defunding for law enforcement. deputies in january forcefully evicted moms for housing members from a west oakland home. today leaders plan to protest outside the supervisor's office

calling for tens of millions for alameda county sheriff's officers to be used to help house the homeless instead. continuing our coronavirus coverage last month was the deadliest in california since the pandemic started. the "l.a. times" counted more than 3,700 deaths in august and an 18% increase over july. now despite the numbers the data shows a drop in infection and hospitalization rates. the average number of daily deaths also dropping statewide. santa rosa memorial hospital is reportedly dealing with an outbreak among staff and members. "the press democrat" reporting 14 members have become infected and up to 200 may have been exposed. the main impact area in the surgical unit and not the covid ward was impacted. sonoma county health leaders are now assisting the hospital to avoid further spread. here is a second chance for california high school seniors who couldn't graduate because of the pandemic.

under a bill sitting on governor newsom's desk right now school districts could retroactively grant high school diplomas to both stuns. the governor is expected to sign another bill aimed at expanding family leave. it would allow those workers to take up to 12 weeks off if they have a baby or need to care for a sick relative. >> that's so important. it is time to get a look at that forecast and a look at the traffic for you that morning. meteorologist kari hall has been tracking what we can expect from this weather. air quality still a big concern? absolutely. it looks like we should see some improvement the next couple of days as our temperatures come down a few degrees and we get the winds mixing things out. still unhealthy today as we look at our temperature trend, san jose will start out nice and cool with mid-50s but then going into late morning and into the afternoon we'll start to warm up. a fairly nice day with some

they attempted to stop him and a fight took place. the sheriff confirming two deputies fired their weapons when the cyclist ignored their commands. they say the man had a handgun. he has not been identified. california's ban on carrying guns in public will remain in place. a new ruling out of sacramento jo upholds the law. a teenager in wisconsin faces charges after police say he shot and killed two protesters and injured one during demonstrations over the police shooting of jacob blake. it now looks like next month investigators will reveal their findings in a deadly southern california dive boat fire. the "l.a. times" reporting that's when the ntsb will hold a final hearing. 34 passengers died last year in the fire which happened near channel islands. all were asleep below deck. they became trapped as flames engulfed the boat.

five crew members escaped and survived. the president says he is going to kenosha, wisconsin, today despite pleas from the mayor and governor there to stay away. >> scott mcgrew, i know the president has been warned his presence may stoke more violence. yeah. he says it will stoke enthusiasm, so that's his side of it. good morning. he says he will not meet with the family of jacob blake. the president says he offered to call but the family wanted a lawyer on the line and the president said he did not want to have a conversation with a lawyer listening. the president also claims to have spoken with the family's pastor. jacob blake's uncle says the family does not have a pastor. the president spoke in defense of kyle rittenhouse, the 17-year-old that laura mentioned who traveled from out of state with his rifle to kenosha and then police say shot three people, killing two.

the president speculated righten house acted in self-defense. the president defended people in pickup trucks in portland who pepper sprayed and shot paint balls at protesting police violence. you'll hear two soundbites. the first from the white house press secretary saying the president condemns all violence, and then the president doing quite the opposite. >> the president condemns violence in all its forms. >> i understand they had large numbers of people that were supporters but that was a peaceful protest. and paint is a defensive mechanism not bullets. >> in an interview with fox news the president compared police shootings to a golf tournament. i will let tracie potts show that to you at the top of the hour. he also went on a very strange tangent repeating an urban myth about mysterious troops on a plane that he says intended to interfere with the republican national convention, but he

offered categorically no proof. >> and in the plane it was almost completely loaded with thugs wearing these dark uniforms, black uniforms with gear and this and that. they're on a plane. >> now while the president spreads conspiracy theories and compares the shooting of a black man to golf, the other parts of the government may go unnoticed, for instance congress gave the postmaster general until last wednesday to turn over documents related to the slowdown in mail service. the postmaster general did not turn over those documents. congress will now subpoena him. and the full appeals court in the michael flynn case doesn't have to throw out flynn's conviction because prosecutors asked them to. he was fired after flynn admitted to lying to the white house about his contacts with russians. the case goes back to the original judge who voiced suspicions about why the department of justice, which

prosecuted flynn, now wants those charges erased. we'll be watching all of those things, of course. i'm on twitter @scottmcgrew. >> scott, thanks. 5:48 this morning. chico state canceling all in-person classes and telling students they need to leave campus housing by this weekend. about 30 people including students in every dorm have tested positive for the coronavirus. the university will help students who need housing. they are holding about 7% of classes in person including those labs. covid cases have also been reported at cal state east bay, san jose and san diego state. so far no class cancellations at those schools. okay, for the next story you have to bear with new video shows a wild encounter for shoppers last week at a lake tahoe safeway at kings beach where a bear wandered into the produce aisle and ended up showing itself out. but it's not the first wild

encounter for that safeway. just a few days ago, august 18th, a bear vis t tortilla chi. i don't know if it was the same one. the thing is when bears get in, they come back. a bear broke into a restaurant four times, yanking off the door, going through the window. in the bear's defense they do have good ice cream there. >> if the bear goes somewhere and don't come back, don't go to that restaurant. >> wow. i'm glad everyone was safe. to see somebody that close filming, that was the scary part for me. hmm. i don't know. >> i've been known to do that because you're so fascinated by them and they're so into the food. hey, it's labor day weekend

coming up next weekend. a lot of people do like to head up to tahoe. the air quality up there is a concern as well. right. it's not just the bay area. we've seen it moving over to the sierra as well. and while we have some really hotes they're also going to have some hot weather there. let's get a look at the way we shape up in walnut creek for the morning. we are starting out with some 50s. at least we do have a nice, cool start to the day, but we're still dealing with the drifts of smoke, the unhealthy air quality, and even after a few morning clouds clear out we're still going to have still a hard time even seeing the sunshine today. let's head through noon and our lunch time temperatures. we'll be in the upper 70s for the south bay while in santa rosa we're at 69 degrees. a nice warm-up there for the afternoon with some upper 70s. oakland will be in the upper 60s. livermore will be at 88 degrees. and for palo alto we're in the low 80s as well. as we head into the evening if you want to go out for a walk we'll start to see that fog

rolling back into the coastline in san francisco and it cools the rest of the bay area down with a nice, brisk westerly wind. air quality is the concern for the day as we once again have our 15th spare the air alert day. and we're seeing that unhealthy air quality across the board today but there should be some improvements tomorrow as we start to see much more of an ocean breeze picking up. that will help clear it out just a little bit. it still will be moderate. and if you have unhealthy -- if you are having breathing problems you still may find it a little bit bothersome. it comes down a few degrees for the inland areas. as we look ahead to this long holiday weekend for some, we are going to have some really hot weather returning once again. mike, you've been keeping an eye on the commute, those metering lights are on. any other issues? >> well, you know, no surprises, i guess. we do have that build. the metering lights kari was

bacion 2020 spresidential elect. now the city says the ballots should arrive in the mail between october 5th and the 9th while replacement ballots until october 30th. the city has been in contact with the postal service. new details a new bill would exempt more professionals from california's gig economy law designed to treat more workers like employees instead of independent contractors. the legislation would affect freelance photographers, photojournalists, writers, editors and cartoonists. ab-5 approved by california voters would primarily be aimed at ride shares and app delivery companies. a new snag after the draft environmental impact report was not submitted before last week's deadline. mayor sam liccardo says the

holdup is due to legal issues tied to submission of the document. according to san jose spotlight the report is expected to be submitted this fall. san jose leaders are now asking the state to push back its approval deadline for the development. another obstacle for those trying to make it in the bay real estate prices are climbing in parts of the bay area.
