>> reporter: speaking outside the white house today, president don don made his intentions very clear on picking a supreme court nominee. >> we have an obligation. we won and we have an obligation, as the winners to pick who we want. >> he says he disagrees with senator collins from maine who tweeted she does not support a rush to replace ruth bader ginsburg. the decision should be made by the president who is elected on november 3rd. collins, along with cory gardner and martha mcsally are currently behind in their races and could lose their seats if they're forced to confirm an ultraconservative supreme court nominee. tom tillis seems comfortable moving ahead. >> the time is up to the president. >> reporter: and south carolina republican senator, lindsey graham, who was in a dead heap race against his challenger and criticized his own party when

made decisions i disagree with but that's okay. that's why we are governed by the people. >> reporter: across the street a small group of counterdemonstrators showed up. they hope republicans remember what party leaders said before the last election. >> mitch mcconnell's reasoning was that the american people should elect a president and let that president choose who should fill the remaining seat and i totally agree mitch mcconnell should do the same thing here. >> reporter: downtown people spending time outside but reflecting. >> i was very sad and she really paved the way for a lot of women. i would like to see the next president make that appointment. and i think it's also important to respect the fact that she was a life-long liberal justice. >> reporter: laura steed agrees and also thinks keeping the folk on her legacy is key.

the >> devastation and grief and just really wanting to honor all that she's done for our lives. for the inclusion, for the rights of women, for all those who are living within the margins. >> reporter: in pleasanton, crissy smith. former secretary of state and director of the hooverered institution of stanford also remembering justice ginsburg. she posted a photo from 2005 where justice ginsburg swore her inads secretary of state. rice is now writing ruth bader ginsburg was an inspiration to so many, including to me. she was my neighbor in washington d.c. a fellow music lover, and a friend. tribute to the late justice pouring in from around the world. and french president posted this photo along with a truly

we're under another spare-the-air alert. our air quality still so much better than it was last week. peninsula and south bay in green. that means good air quality. last week, i guess. middle of last week, it was so bad, relative, it's not bad at all. rob. >> we got used to it over a 30-day period. nothing like that today. still high enough for a spare-the-air alert. we take a look at some of the numbers. a little closer view. we're seeing moderate air quality levels in the north bay and the entirier east bay. notice the time lapse on the near surface smoke heading to tomorrow morning. may see locally and unhealthy levels. as the winds continue to pick up though, late tomorrow, that

should help us out. for sunday, we do not have a spare-the-air alert. moderate levels of air pollution for sunday and a five-day outlook as the sea breeze brings green across most of the bay area. so, some improvement in terms of air quality to wrap up the weekend. but what might get you by surprise is 90-degree temperatures. and how much that could be sticking around in our forecast in about 10 minutes. back to you. >> and speaking of the hot temperatures a live look at dublin. the trivalley always one hottest spots and air quality is always a concern there. in pleasanton many were out and about as the air quality remained moderate. the mood at farmer's market wildly different from last weekend when the smoke kept people at home. >> here we go again.

it's enough to deal with the covid, but to deal with this on top of it, it's dev stating. >> we're not looking forward to it because we don't want our pickers throughout when the air quality is poor because we care about their lungs and work quality and all that stuff. >> again, no spare-the-air day is in effect tomorrow. our air quality has improved this week, things look very different add yosemite national park. it is shut down because of what you see right here, thick smoke from the nearby creek fire blanketing the valley. you see a look at yosemite falls yesterday and on the right the same camera today, a little bit of imprivement. inpark says it's monitoring conditions and will reopen when they feel it's safe. the country has reached a milestone in the fight against covid-19. more than 200,000 americans have now lost their lives to the virus.

it's more than the number of american whose lost their lives in world war i and vietnam combined. there have been more than 6.1 million cases so far. and reporting more than 20,000 cases of the virus. and so far the bay area has reported more than 96,000 infections. while cases in the bay area are still climbing, hospitalizations, they're falling. let's take a look at the latest numbers. 2600 are now hospitalized with the virus. you can see that is the lowest since early april and down significantly from the peek that was in july, when just more than 7,000 people were in hospitals across the state. still ahead on this special edition of nbc bay area news. a popular app still trying to strike a deal but now the president is giving his blessing. what it means for the future of tiktok.

we're following news out of ricen -- tested it twice and both came back pauositive for ricen. this was at a facility that screens all letters to the white house. at least one other one was sent to a political figure. president trump says he's giving his blessing to a deal between oracle and walmart. are lists them responsible in making sure security requirements are met and walmart would control other aspects of the popular app. tiktok won't be restricted tomorrow. another week has been added to the deadline for a deal. commerce department restrictions

are also targeting wechat. a federal judge in san francisco heard a motion by a we chat user group and six users. they're hoping to block the president's executive order, blocking new software and download updates. the judge expressed concern that the order was a burden on protected speech of users but acknowledged security concerns. a decision could come as early as next week. you can now get tested for covid-19 and get your flu shot at the very same place. they're offering free walk-up flu shots and testing. this is all at the county fair grounds. a push to insure people get a flu shot this year. something considered especially important during the pandemic. >> right now there's no vaccine against covid but there is a virus you can profect yourself against and that's the influenza virus with a flu shot.

>> hope is it could relieve strain on the medical system. the site will be open saturdays from 9:00 until 4:00. until the end of the year. anyone with small children knows it's been really tough to have playgrounds closed. but really soon they'll be able to play on the equipment again. they announced that playgrounds can reopen starting friday, october 2nd. in the meantime, workers will be out over the next two weeks getting the playgrounds ready and cleaning up all the ash left on play trucktures from the wildfires. stay with us for coverage on the pandemic and how it effects you. just head over to our website, nbcbayarea.com/coronavirus. they're getting playgrounds preddy but they're not yet. the air has been pretty darn good. it was in most places. >> especially compared to last

weekend. technically it was a spare-the-air day today. considering where we were in the 30-day stretch, you probably noticed a bit of a smoke in the air. it is quite different than what we endured over the last couple of weeks. looking west to san francisco, a few high clouds. patchy low clouds. we're still seeing 80s inland. san friv san francisco down to 65 and 74 in san jose. i think thamts going to back off a little tomorrow and that's going to lead the big jump in temperatures that we're expecting to kick in for one day. we do have moderate levels of smoke pollution and really similar conditions heading towards tomorrow morning. i think if you're heading to mendocino or lake county, they may see unhealthy for sensitive groups. watch for that if you're in the counties for tomorrow.

we'll have 60s by 9:00 for most folks and what we do by lunchtime will be similar to the high temperatures we saw today. er for it's going to be warming up rather kwilkly. 90. so, that's almost a 10-degree jump in temperatures. mid-80s for san jose. the warm up won't last long and there you go. fall officially gets underway on tuesday. the stronger sea breeze will help to clear our skies out. where we go back to good air quality. then as we head towards next weekends, we might see showers across on friday. we'll have a closer look. >>ing up in the next half hour and taking a look at what impacts you could see and bottom line, brief warm up as we finish off just like that. the final weekend of summer.

mural made headlines but it's not going to be there anymore. what they're saying about the city's plan to pave it over. - i'm norm. - i'm szasz. [norm] and we live in columbia, missouri. we do consulting, but we also write. the black lives matter street mural that put the city of martinez in the national spotlight won't be around much longer. they plan to pave over it, as part of a wider paving project they say has been planned for some time. the mural's removal is bringing an emotional response. >> i think it's black lives matter mural is extremely important, especially to the youth. >> reporter: 16-year-old elijah says the plaqblack lives matter mural has been a signal that he's valued. he says he's never forgotten being chased by a knife-wielding teenager on the very same street when he was 10 years old. >> he came after he, called me

the "n" word and it was something that stuck with me since i was 10 years old. >> reporter: but the mural's days are numbered. after gaining national attention, the artwork is about to get paved over. the city says it's part of a paving project planned long ago. >> it's made a great impact and the next sense of creating a sense of belonging is on the city government. >> reporter: he says it's time to focus on a new antiracism task force and says the city is also looking at several possible sites for a permanent civil right mural. local black lives matter movement doesn't understand why it's taken so long to find a permanent home. supporters are planning next step. >> that just says they're not standing in solidarity for their citizens of color.

and looking for them to do the right thing. >> now is a time make a stand for our future. >> the city says it could take months to find a new location. jody hernandez, nbc bay area news. returning to the coverage of the death of ruth bader ginsburg. memorials are happening at court houses across the country tonight. >> people gathered outside the supreme court in washington earlier this evening. senator elizabeth warren remembered ginsburg as an icon, trail blazer, friend, and fighter. >> we are here tonight to breathe but not to despair. there is too much at stake going forward. >> reporter: she told the crowd democracy itself is on the line and urged voters to fight for the issues ginsburg herself fought for.

>> as people across the nation remember the impact justice ginsburg had on the fight for gender equality, jim wallace of san francisco says in 1972, his high school math teacher, paula wisenfeld died from child birth but her husband was not a widow. at that time only women who lost a spouse were eligible. justice ginsburg took the landmark case and won. >> she sued up to the supreme court and she won equal rights for this man and his son for his ability to be able to collect full social security benefits the same as a woman would be under the same circumstances. >> reporter: justice ginsburg also argued wisenfeld's contrabugdss were not equal. it was one case of several where

she proved to be a pioneer in the race for gender equality. democratic party has seen a big surge in donations since justice ginsburg passed away. act blue says it's raised more than sae70 million in a little e than 24 hours. they say it shows how it's ga g galvanizing the party's base. act blue has not disclosed what races and issues it will spend the money on. president trump promised to nominate a woman to take ruth bader ginsburg's place. he made the announcement in front of a crowd in fayette vill, north carolina. he also characterized his right to fill the seat as a, quote, moral duty to pull fill promises he made to voters. >> so, we will uphold equal justice under the law for citizens of every race, color, religion and creed.

i will be putting forth a n nominee next week. it will be a woman. >> reporter: from jobs in the economy to protecting law enforcement and ending covid-19 shutdown. dozens of immigrant said and their supporters marched from central park to veteran's memorial park where they spoke about waiting for decades to get a green card. and limits on highly skilled immigrants who can get a green card. it's currently being blocked in the senate. >> if we want our voices heard so the bill gets cleared up faster and hopefully we get a fair chance. >> reporter: what they're specifically talking about is senate bill 386 being blocked by senator rick scott of utah. he argus there should be more scrutiny before they get, what they call a major overhall.

south bay family devastated tonight because their classic bicycles were stolen. they were handmaid and started a long, historic tradition that is still alive today. in gilroy with the pieces of history you may be able to help to find. >> reporter: this bike is called a boy's dream. somebody found it on the internet, bought it and returned it to the owner. this is a family heirloom, but might be a piece of chi cono history. >> it's all balance. >> reporter: this is one of the bikes someone stole from the sandoval family home this week that ended up for sale online and now has made its way back home but two others are still missing. >> like a piece of your history

mark on chicono history, simply making his children had a bike to ride. nbc bay area news. the san francisco police department is investigating a number of sexual batteries they say happened over the last few months. police say it happened in the upscale sea cliff neighborhood. the department is stepping up patrols in that neighborhood. >> a casual morning hike turning dangerous for a father and son. the two men tried to hike to get down the beach. you see what happened. they got stuck. couldn't go back up. father called 911. firefighters gave him directions on how to reach them. emergency crews had to use rope lines to pull them back up. nice pictures from the fire department. say it took about an hour. both enough men are safe and sound this evening. runners may be allowed to

exercise in san francisco but it's still unsafe to hold marathons. this year it was moved to november from july, because of the pandemic. and now they've decided to cancel altogether. they say there's too much s uncertainty surrounding the spread. run krz participate virtually or wait till next year. th the pandemic did not stop cyclists in missouri. it's a five-day festival begins wednesday, ends tomorrow and now there are concerns there could be an increased spread of the virus. >> right. it doesn't stop us. you could ask every biker or whatever, it ain't going to stop us riding. >> well, the state also lifted its covid restrictions in june, meaning attendees do not have to

wear face masks and we saw many did not. the golden state warriors and the american red cross wrapped up another blood drive. they attracted a more diverse group of blood donors. this will help with inherited diseases like sickal cell anemia. >> we tie troomake it as safe and convenient as possible. >> reporter: they're still looking for blood donations, especially from african-americans, given the toll covid-19 took on the community. assistant coach mike brown, 4e7ing out. and you know, i guess it was a spare-the-air day and the os middle of last week were devastating and today didn't seem so bad, really. >> if it was an average summer,

incredible pictures the burn area in smoke. now it's mixing with the storms on the east coast. these were taken over three-day span this week. they show the trail of smoke from the wildfires on the west coast, stretching all the way the other side of the country. hurrican hurricanes paul ette and sally kept the skies clear and now they're trapping the smoke in the northeast according to nasa. but the good news is it's higher in the atmosphere. and now for more good news about the fires with the lnu fire pretty much out, it is clean up time but many are in need of a helping hand. these are pictures of correctional officers pitching in to help an elderly couple. they're in their '80s. the wife fell down and broke her

nose. anyway, the officer put a call out to help and got some response to that. several coworkers, their family came out. no easy task to clear away the dead trees and build a temporary fence. and local businesses donated pizza and beer to the crew. today felt like we could finally go outside, maybe take a deep breath. we saw the map from the air quality levels in the green. joining us to explain that this is going to continue. we like this. >> yeah, it's a relief compared to where the last four weekends were like. we were seeing maps in red and all shatsdes of purple. not nearly the levels we saw for the span of 30 days that lead to all-time record for consecutive wildfire smoke, spare-the-air days.

walnut creek, moderate air pollution into walnut creek and concord, 77. and he can see san jose after a high of 81. tracking five degrees warmer tomorrow. good bet of finding 90s to wrap up the weekend. out towards liver more and closer to the moderate range. here's the time lapse animation. sonoma county, napa county. and notice the little bit of clearing into monday and that will be instronger sea breeze. so, for tomorrow, similar to right now. it's just officially not a spare-the-air day. areas closer the august complex fire that may be dealing with briefly unhealthy air solution.

morning temperatures will begin in the upper 50s. here is the different part of the forecast tomorrow. back into the 90s we think around gilroy, east san jose. close to 90. similar temperatures up to walnut creek. 92 in liver more and antioch. 70 degrees, half moon bay. san francisco should be in the mid-70s tomorrow and the north bay goes into the upper 80s and low 90. so, that is the trend we're seeing for monday. good news for the wildfires in oregon. more rain moving in. typical for this time of year, it's just a little too far to the north. this is the time frame we have to watch. as the system moves out, high pressure moves in and if the high does go back that strongly by next sunday, that dd be some
