hours. that's going to be the issue, some drifts of smoke coming into parts of the bay area. not all of us will start to see that smoke today as we look at what we're expecting mostly for the north bay as well as the inland east bay. that's where we will have the moderate air quality looking better for the south bay. we'll talk more about what's ahead in the forecast coming up. mike, how is it looking now for the morning commute? the big view, kari, shows us green sensors as we would imagine. in oakland we don't have the overnight construction but we did have a crash, the second one of the morning for the nimitz. it's on the shoulder. over here a look at 680 south of 24 heading out of walnut creek we've gone to green from red over the last ten minutes. i think the overnight crew there has cleared from just south of the walnut creek interchange and things are moving nicely on the freeways.

slowing out of the altamont pass. back to you. americans remembering and reflecting on justice ruth bader ginsburg. a live look in washington where mourners have placed flowers and candles on the steps of supreme court. her death friday prompting a new fight on capitol hill over whether a replacement justice should be considered now or following the presidential election. >> tracie potts joins us with an update on some of the names already in play. good morning, tracie. >> reporter: good morning. a couple people the president has nominated to the bench are now on his short list, and it's something that he and the republican leader are trying to get done quickly. the replacement for justice ruth bader ginsburg already turning political. >> i will be putting forth the nominee next week. it will be a woman.

>> reporter: front-runners include two conservative trump appointees within hours of ginsburg's death friday senate majority leader mitch mcconnell announced there will be a vote. >> the way this happened so close to the election that the next president should be able to make the decision. >> reporter: it's an about-face from four years ago when democrats pushed and republicans blocked president obama's supreme court nominee months before the election. >> let's let the next president do it, whoever it might be, make that nomination. and you can use my words against me. >> reporter: today republicans are defending a different approach. >> when you have both parties in the white house and the senate historically the confirmation goes forward. and that's what's going to happen here. >> reporter: democti presidential nominee joe biden appealing directly to republicans. >> please follow your conscience. if i win this election, president trump's nominee should be withdrawn. >> reporter: house speaker nancy pelosi is hinting at possibly

using impeachment to stop it. >> we have our options. we have arrows in our quiver. >> reporter: a political and legal showdown 43 days before the election. and a lot of people already voting by mail, of course. two republicans have said they will not go along with it. they won't confirm someone before the election. it will take two more to block it. >> a lot going on there. certainly we will be watching, tracie. thank you. >> very much so. local memorials are also growing for the late supreme court justice. this celebration was held at lake merritt. many who attended believe this is not the time for politics. >> i don't want it to be about other sides. this is about humanity. this is about justice. this is about all of us having rights, and that is what the notorious rbg stood for.

>> the events this weekend also held in san francisco, palo alto and martinez. the "today" show following the replacement battle on the late justice ginsburg's legacy, the co-director of the oscar winning documentary "rbg" reflects on her experience capturing the supreme court justice's life on camera right after "today in the bay." new overnight a police officer is in the hospital after a crash in san jose. here is a live look for you right now at third and taylor streets. that intersection, of course, closed now while police investigate. so police say a little before 1:00 this morning a driver ran the stop sign on taylor t-boning that patrol car. both drivers were taken to the hospital. police have not updated their conditions and they are not saying if the driver was under the influence. it's also not clear how soon that intersection will reopen. well today marks another milestone in easing some of the covid-19 restrictions. "today in the bay's" cierra johnson is live for us in san

francisco to break down what businesses are able to open under the latest phase. cierra? >> reporter: yes, good morning. today marks the day that three main business types are able to open, indoor museums, zoos and aquariums and sixth grade in-person learning. and like every step of this process it will come with some caveats. they are able to reopen on a limited capacity and are only able to do so if they have submitted a health plan. right now let's take a focus on education. the in-person learning for pre-k through sixth grade is being done on a rolling basis. mayor breed says the goal is to bring middle schoolers in for in-person learning by october and in november high schoolers and some other educational programs. and for those insight into just when that could happen. her office will be working with the county public health officers to move indoor dining

by october 1st. at that point it would be 25% or 100 people and october 1st is the day the county would move into that orange tier. so a lot to remember but we do have all of this information posted to our webwebsite. >> cierra, thank you. it is hard to keep track of what's open and where. we'll make it easy for you. we put together a list of what's open county by county. head over to our website nbcbayarea.com, click on the county easing restrictions at the top of our home page. california now has surpassed 15,000 coronavirus deaths. the grim milestone passed yesterday. california has the fourth highest number of deaths in the country following new york, new jersey and texas. along with 780,000 confirmed cases. so it turns out now that six feet of distancing may not protect you after all. the cdc is now saying droplets can actually hang in the air for

some time. but they can also travel. the new guidance warns droplets can be inhaled by someone further than six feet away. previous guidance suggested the spread was mostly within six feet. the cdc also says your best defense is to wear a mask. >> mask up. always wearing those masks. as you head outside, kari, make sure you're protected. >> oh, my goodness, we're too close. just think about that as you head out this morning. air quality still pretty good. let's head out the door in fremont as we are starting out with temperatures in the upper 50s and then as we go through the day it looks pretty nice. it will actually be cooler toda. we're at 75 degrees here. and then lookingality our high temperatures around the bay area, we're up to 86 degrees in concord and napa today reaching 81. and 68 degrees in san francisco. now as we go through the forecast, a nice week ahead but we will see some changes in our

right now at 5:12 let's get you out the door in parts of the east bay checking out brentwood and our temperature trend. we're going to see our mornings start in the low 60s and then quickly warming up by late morning into the afternoon. we'll be in the upper 70s at lunch time. we'll talk about all of our microclimates, a nice week ahead and also an update on the air quality coming up. and i've been looking closely, we should just show you, highway 84 we're talking about. the.w a little extra slowing. that's a standard drive. coming out of the altamont pass, 24 minutes from grant line road over to the dublin interchange. it looks like those numbers are fine with nothing unusual scheduled for the area or on chp incident report. we'll give you the bigger look coming up.

good morning. i'm contessa brewer from cnbc. here are today's top business headlines. get ready for a manic monday on the markets. wall street deeply in the red. the dow down 500 points this morning. the market's on a three-week losing streak, the longest stretch in about a year. the declines led by tech stocks which have struggled in recent weeks, so there's the big name, facebook, apple, amazon, netflix, google, microsoft all with big losses. in focus this week reports on home sales and durable goods and traders watching washington with some analysts saying a new stimulus bill is unlikely until after the election because the fight over the supreme court will overshadow all else. mba grads may be feeling th. demand returning. about 90% of consulting firms, banks and large tech groups plan to hire mbas next year, up from 77% in july.

just 8% say they're pulling job offers although the start date has been delayed. a majority say they will honor salaries offered before the pandemic but pay likely next year will be lower. and walmart is launching a new private label clothing line for men and women called free assembly sold both in stores and online. items priced from $9 to $45. walmart is looking to take market share in apparel. many major clothing retailers will hurt badly during the pandemic and the recession. others like jcpenney filed for bankruptcy. a tough go for smal and business box stores as well. thank you so much. new details this morning if you use that messaging app wechat, you can actually keep using it for now after a judge temporarily blocked a ban set to

take effect last night. the original ban involved tiktok and wechat. it was halted with a deal made with oracle and walmart. wechat says it offered a life line. they say president trump's order will restrict free speech. a judge agreed allowing the case to play out in court. a bona fide bay area star makes history on television's biggest night. >> the 72nd annual emy awards took place last night. jimmy kimmel hosted the show in an empty staples center while the winners and nominees from home. the 24-year-old became the youngest ever to win best actress in a drama for her role in "euphoria. you see the name right there on your screen. i can't say it so much but you can see how it's spelled there. it won sweeping all of the awards in the comedy category including best show, best actor and actress. hbo's "succession" named best drama. i've seen all of those shows and they are all good. well-deserved. >> i haven't seen "succession" but i've seen the other one. oh, my gosh, it is so funny. and they're not that long so you can watch them over and over. >> if you get a chance watch all of those. let's get a look at the forecast for you today. meteorologist kari hall has been tracking that, hour by hour. how is it looking? >> it looks pretty good for us today. got a little hot yesterday afternoon. it's going to be cooler this afternoon. let's go hour by hour as we check it out heading through

noon with cupertino at 74 degrees at lunch time. we'll be at 70 degrees in napa and then along the coastline we're still in the 60s in san francisco and half moon bay. then as we go into 3:00 we're at 76 degrees if fremont and some upper 70s for antioch. we're going to briefly go into the low 80s by this afternoon. then as we go into this evening a nice little cooldown as the winds pick up. expect it to be a windy evening, and that's because we will see an approaching storm system from the north that's going to increase our winds coming in from the west. but this will actually help mix out the smoke just a little b drifts of smoke coming in to parts of the north bay and east bay until this moves in. as we go to the end of the week, unfortunately, a large area of high pressure that will be pretty intense could ramp up our temperatures and may give us some gusty wind, so that's not good for the wildfire conditions as we can see by saturday and sunday some hot weather

returning. as we look at our five-day forecast for the air quality we are going to see unhelpy air quality for parts of the north bay and inland east bay. it looks like we'll continue to see the drifts coming in. improving air quality as we are going to see a lot of green sensors meaning it will be safe to spend long periods of time outside. and of course we'll be watching some of the inland areas that have to deal with that smoke. temperature wise we're looking good here. a lot of 80s for our warmest spots over the next few days. how is it looking out there for the commute now, mike? kari, the silicon valley freeways are over my shoulder and they're moving just fine at or probably over the limit. i mark right in the jose, the p activity we're talking aboutecd third, right around there, an officer involved crash earlier. the investigation continues

5:23 this morning and developing right now louisville federal courthouse will be closed the entire week. this is in anticipation of a potential decision in the breonna taylor police shooting investigation. the attorney general daniel cameron will announce i homicide or other crimes tied to taylor's death. officers shot and killed her after breaking down her apartment door in march to serve a signed no knock search warrant. her death i go nighted more than 100 days of protests. new details this morning on

a call president trump made to the two deputies recently ambushed in compton. the l.a. county sheriff's department posted the president wished both of them a speedy recovery. both deputies are now in the long process of recovering from the attack. the male deputy is recovering at home. the female deputy is still in the hospital. the shooter remains on the loose. jerry harris of "cheer" will be in court today. harris is expected to appear for a hearing after being arrested on a child pornography charge. the parents of young twin boys say harris inappropriately touched them and sent lewd president clint pictures. back to covid-19. airlines insist flying is safe but what about long-distance flights. as more countries lift restrictions and international

flights resume there are going to be growing concerns about the spread. there are reports 15 people were infected by one person on the flight from london to vietnam and two flight attendants became ill from a passenger on a flight from boston to hong kong. both happened earlier in the pandemic. meantime "the washington post" cites the cdc which believes more than 10,000 air travelers may have been exposed since the pandemic began. an eighth death in maine linked to covid-19 outbreak following a wedding, the latest is a man in his 80s. the event is linked to 270 cases including an outbreak at a nursing home and jail. retired boston red sox player david ortiz announced on friday that he is recovering after also becoming infected withtrending morning "the ellen degeneres show" is returning for its 18th season. she does plan to talk about the

right now. and it's monday morning. thanks for making us a part of that morning. i'm marcus washington. >> and i'm laura garcia. we'll check in with mike in just a moment. first to kari because looks can be deceiving. the weather looks so much clearer out there with less smoke. you say we should still take heed. >> absolutely. you should limit your time outside. we are still going to see drifts of smoke coming in. air quality has been good in the south bay but it's the north bay and the east bay we'll really have to monitor today as we've seen the way that the winds are carrying that smoke makes it go into those areas. spots like santa clara valley we will have some moderate air quality, but the worst of it will be in the east bay. we're also going to have a cooler afternoon so i know people will want to go outside but if you have asthma or breathing problems you do want to make sure you're being very careful today. we'll talk more and what's ahead for the rest of the week coming up.

"today in the bay's" cierra johnson is live to break down how her legacy is being honored here at home. cierra? >> reporter: she was a fighter for gender equality as well as women's rights. she did that for decades and

across the bay throughout the week folks gathered to honor the life she lived now. one of the first celebrations in the city. mayor breed joined dozens of others in the castro to honor the late justice with candles and in the peninsula a moment of silence was held. 60 seconds of silence in reflection held by more than 120 people who gathered there for a vigil at the city courthouse. the folks that gathered told us it was a chance to honor her work as a civil rights attorney and the strides she made. take a look at what one person had to say. >> i don't want it to be about other sides. this is about humanity. this is about justice. this is about all of us having rights and that's what the notorious rbg stood

reflected on what life would have been like had she not fought with that equality even noting because of ginsburg women could have their own check books and their own credit cards. weird to even think about in this day and age. folks across the bay for several days honoring the life she lived and the folks she fought for. she had a battle of her own for years battling cancer and she gradually succumbed to pancreatic cancer at age 87, but what a life she lived. cierra johnson for "today in the bay." house speaker nancy pelosi paid her respects yesterday visiting the supreme court. she indicated democrats are ready to fight. the courtroom chair, the court bench and the door leading into the marble floor house. the court also said you will

continue to fly the flags in front of the building at half-staff. justice ginsburg's legacy will be covered all morning long. you can fine more on our website nbcbayarea.com. california is suddenly hitting the pause button on the state's problem plagued unemployment development department. more than 2.5 million californians lost jobs during the first two months of the pandemic. the current jobless rate down about two percentage points from august. "today in the bay's" sharon katsuda joins us live in martinez this morning to explain what's happening between now and then that may leave people really stretched thin, sharon. >> reporter: it's very true, laura. hopefully if you lost your job

or had hours reduced due to the pandemic you'll already have filed a claim. if you haven't, you'll have to wait. more than 591,000 californians are still waiting for their unemployment checks after filing claims more than three weeks ago. julia filed her claim june 7th and still has not received a check or response despite calls and emails to the department. she was counting on about $400 per week. >> i haven't heard anything and i just want to know was i turned down? was i denied? is my money going somewhere else? >> reporter: the edd website says from september 20 to october 4 edd will not be accepting new online applications for unemployment benefits. it says it will improve the system to verify identities and an easier, faster way to cut down on fraud. the assemblyman says he has

and happening today we are expecting new details on exte extending quarantine to 15 cities for those who are homeless or condition isolate at home. since june the program provided motel rooms for hundreds of people exposed to coronavirus. a rally is set for this morning as thousands of san francisco's renters tried to make it in the bay. demanding the city stop evictions for those who are out of work who can't support themselves during the pandemic. the rally will start at 8:30 at the courthouse and then turn into a car caravan going from the courthouse. to the fires burning statewide, nearly 30 major wildfires continue to burn. among them the el dorado fire in san bernardino and riverside counties. that's the one that was started during the gender reveal party and claimed the life of a firefighter.

the three fires that have burned in and around the bay area are almost fully contained. the creek fire is 27% contained. we talk about the air quality across the bay area starting to improve. an unhealthy air advisory is still in effect today. a live look outside. you can see it looks a lot clearer. that's what could be so deceptive about it. san francisco, san jose live looks there. that's the thing, kari. we're all tempted to go outside but we still have to be careful. it does depend on what time you go. good air quality this morning if you wan to head out for an early walk as soon as the sun rises, that looks good. if you have breathing problems you want to limit your time outside for this afternoon. let's head over to pleasanton with our temperatures that will start out in the upper 50s. as we go into today it will start to warm up in the upper

70s there by early in the afternoon. eventually reaching into the upper 80s in livermore. 77 will be the high in palo alto. we're looking at some low 80s in parts of the north bay from napa to santa rosa. we'll continue to monitor the air quality and talk about our forecast and the weekend ahead as well. mike, how is it looking for the morning commute? happy monday, folks. the metering lights were turned on at 5:30. no incidents on the span. metering lights on and a very quick build. nine minutes to fill in all lanes there. as we look at your map the incline holding steady only at the toll plaza where there's the backup and the build. we'll see how that traffic volume in off the maze and off the east shore freeway. the rest of the bay moves smoothly. still slow through the road work zone.

shows you the effects of the metering lights turned on promptly at 5:30. this will slow down a bit as you travel out of oakland. >> thanks so much, kari and mike. it is 5:43. developing now firefighters in southern california are focused on trying to save homes after erratic winds really pushed that bobcat wildfire closer to a lot of communities there. the bobcat fire is burned over 103,000 acres doubling in size over the last week. firefighters have it at about 15% contained so far and it certainly has been a very challenging fight for them since the fire is burning in areas that are so dry, so much brush they haven't burned in decades. the gulf coast is preparing for tropical storm beta he can pecked to make landfall some time tonight in texas and then move to louisiana. the rain from the storm already falling in parts of texas.

beta isn't likely to turn into a hurricane. when it comes to concerns in the census 2020 count the pandemic is the tip of the iceberg, dealing with many challenges as teams try to wrap up the once every decade count. the problems include wildfires here in the west and hurricanes along the gulf coast where it's believed hundreds of thousands of people are still not counted. they face a tighter deadline, nine days from now. a recent lawsuit to extend the deadline through october. new overnight a woman suspected of sending the poison ricin to the white house was arrested at the new york/canadian border. she was taken into custody by u.s. customs and borpd border protection. the letter appeared to have originated in canada. she faces several federal charges.

now to decision 2020 the presidential race, president donald trump and joe biden hosting campaign rallies today in battleground states. the president is scheduled to hold two airport rallies. he will not attend the general assembly in person this week. it's not clear if he will record a virtual message for the meeting. in the meantime former vice president joe biden will be in wisconsin. it is biden's second visit to the battleground state in two weeks. >> and both presidential campaigns and their parties raking in a lot of cash. the biden camp a have more than million in cash on hand. president trump and the rnc have $325 million. last month the biden campaign brought in $365 million. the trump campaign took in $210 million bringing its total so far to $1.3 billion. the campaign has already spent much of that. both parties are seeing a spike

in donations after the death of justice ginsburg. the presidential candidates have three debates coming up. the first is set for september 29th and will be moderated by fox news anchor chris wallace. the second is set for october 15th moderated by steve scully, a political editor at c-span. another scheduled for october 22nd. it will be moderated by nbc's kristen welker, her first time moderating. welker is both white house correspondent and co-anchor of the "weekend today" program. san diego county may get a better sense tomorrow where it stands on reopening. that's when the state will update every county's color coded ranking status. the county will slide back into the most restrictive purple tier. frustrated parents want public schools to resume in-person classes and they're afraid if the county moves back to the purple tier the wait will last longer. one single mother of four says she's on a leave of absence at work that's ending soon.

course happy to be with you guys. >> always, always. i know the air quality isn't the best right now, kari, but this weekend just looked good. yeah, we are seeing blue skies in parts of the bay area but seeing more drifts of smoke in the north bay and east bay. as we get a live look outside in san francisco it's mostly clear here. you can see the fog in the distance as it rolls across the bay and the golden gate bridge. so for most of the city it's a clear start. let's head to the south bay and check out our high temperature for this afternoon in spots like cupertino we're reaching up to 83 degrees and you head to the south county it will be in the upper 80s. more upper 80s as you go to the east bay. this is actually cooler compared to what we had yesterday reaching 87 in pittsburg and oakland only in the mid-70s today. we're going to see those high temperatures in palo alto reaching 77. very comfortable there.

some low 70s in the mission district today and our north bay temperatures reaching up to 84 in novato. we're up to 86 degrees in clear lake. a little bit warmer the farther north and inland you go. we will see an approaching system that will bring in a few more clouds this evening. you can see it moving closer to portland right now with some rain, but by the time it gets here it's going to give us a stronger ocean breeze and more fog over the next couple of days. it's going to be a nice and comfortable week but by the weekend we'll see a strong area of high pressure building, and that's going to make it hot. we may also have some offshore winds which will be a concern for more fires developing. then as we look at our five-day air quality forecast there will be a lot more green here. look at your microclimate in spots like the coast and the bay. we'll see a lot more improvement after today. so really good news ahead. as we head over to you, mike, i know you have some breaking news going on right now. i do, kari. this is on city street in san francisco. there's a police investigation,

our news desk is following the details. it affects the location where we are with our camera in santa clara near 7th and santa clara just off campus, just off the san jose state campus. you will likely have to reroute a few blocks to get around if not all the way around campus if you're going to the south side of that. do keep that in mind if you're traveling into the area. a police investigation as we look at the map, again, santa clara at seventh. there's a perimeter there. of course the story that's developing with that police activity. meanwhile getting out to the freeways in the area 87 just fine. 280 in problem. silicon valley just shows your typical northbound 101 slowing. north 680 coming up in toward the sunol area out of fremont. we still have that construction zone with a little slowing there suld clear up as the crews clear. we'll track that getting north in toward the tri-valley area. to the bay bridge we have the backup at the toll plaza.

bay" continues right now. a very good monday morning. thanks for joining us. i'm laura garcia. >> and i'm marcus washington. we'll get to mike in a bit with that commute. first meteorologist kari hall with a look at the forecast today and what we can expect. kari, how is it looking for us out there? looks pretty good on this monday morning. our air quality is better but we will see it changing as we go into today. mostly for the north bay and east bay are the spots for the worst of the air quality. we still have fires burning just to the north of us especially as we watch the air quality in lake and mendocino counties. and for the south bay looking a little bit better today but then our temperatures are coming down as well. a lot of people want to spend time outside but if you are sensitive to the smoke, you do need to limit your time outdoors. we're up to 88 degrees in antioch tay
