right now at 4:30, high fire danger. another red flag warning for bay area hills and mountains about to go into effect in just about 30 minutes. we are tracking those diablo winds, the hot temperatures and the possible planned power outages. plus, day three of judge amy coney barrett's supreme court nomination hearing. how the judge is handling questions about health care and the election from senators such as kamala harris. and many restaurants and cafes have been waiting for the time they can open their doors to indoor dining.

it starts today but that's not all. more restrictions that are also loosening. "today in the bay" starts right now. i'm kris sanchez in for marcus washington. >> good wednesday morning to you. i'm laura garcia. we'll check in with mike in just a moment. let's check in with kari and see what our temperatures will be hatchway through the workweek. yeah, it's all about the red flag warning and the high fire danger for today and that's what we're looking at. all of this shaded in red. included in the red flag warning, it's not just for some of the hills but now it's also for the valleys and the north bay. we're also going to see that continuing for the diablo range, parts of the oakland hills, the santa cruz mountains. as our winds will increase today along with the hot temperatures that we're going to see. upper 80s and low 90s.

santa cruz will reach the low 80s and we'll see warm temperatures in san francisco as well. we'll talk more about when our winds will pick up and when we're expecting better weather in the forecast coming up. how is it looking for the commute now, mike? kari, overall things are light. at the bottom of the screen we do have one crash marked off lawrence expressway. a car into the roadside ditch. no major injuries. it looks okay as far as the commute goes. there's some slowing 880 coming up to 29. 23rd in the southbound direction is where you'll find the start of the construction zone as well. typical overnight we'll watch as the sensors change. so far no problems getting to or from the bay bridge. back to you. sounds good. just over the bay bridge you find oakland this morning. here's a live look. one of the many places expected to see high fire danger today, a red flag warning goes into effect in less than 30 minutes. pg&e is warning an estimated

22,000 customers could soon be in the dark. so highlighted in yellow on that map public safety power shutoffs that could happen today. "today in the bay's" cheryl hurd has more on customers' mounting frustration. >> reporter: an estimated 4,100 pg&e customers here in alameda county could be affected by the latest round of psps. i talked to a lot of people tonight. they've been through this before but, they say, no one is really ready for it. >> can you believe that? >> last year we had to throw everything away. >> reporter: so if a public safety power shutoff happens again, ashley says they just have to roll with it. >> super frustrating but i understand why it needs to happen. >> reporter: letting customers know where things stand in a public briefing. >> we've been a month now from the first psps event in early september and the fuels are actually much drier, so the fire

starts in about an hour and a half. yesterday senators grilled the federal judge for more than 12 hours. president trump's nominee can expect more of the same today. many lawmakers are finding it tough to get the answers that they want. barrett spent much of yesterday promising that the constitution will guide her decision. senator kamala harris questioned the judge about how she would rule if the affordable care act goes before the court. judge barrett says she hasn't been influenced by the president. >> i'm not here on a mission to destroy the affordable care act. >> people are scared of what will happen if the affordable care act is destroyed in the middle of a pandemic. >> yesterday democrats aimed some of their sharpest questions at her public opposition of abortion rights. a vote could come in two weeks. let's take a live look at san jose this morning. one of the cities in the bay area's biggest county seeing some major changes today. both santa clara county and

alameda county enter the orange tier of the state's covid monitoring system which means that restaurants can serve customers indoors at up to 50% capacity. but for now santa clara county is capping that keeping things stricter as they have. that will mean 25% capacity for restaurants. indoor services at places of worship will also be allowed and members of one san jose church say they've enjoyed outdoor services but they're glad to be headed back inside. >> now little by little open the doors. >> capacity at churches is capped at 25% or 100 people, whichever is fewer, and the same goes for movie theaters. as those businesses prepare to welcome back customers, restaurants fortunate enough to survive the pandemic and a brutal wildfire season are facing yet another hit this morning. this year's california's addition of the michelin guide

will not award its coveted stars or other usual honors. the director says the decision follows feedback from top chefs. he wants the industry to get back on its feed before resuming that tradition. leaders in the north bay reached an agreement to help people affected by the tubbs fire just make it in the bay. santa rosa city council has approved the money to start rebuilding affordable housing after the 2017 firestorm. santa rosa is one of the first cities to reach an agreement with housing and urban development department to use $40 million to create new homes. the fire destroyed more than 5,000 structures in sonoma and napa counties and more than half of those homes were in santa rosa. certainly never want a repeat of that. but with the highatures, a litt frightening for people. absolutely. that's something we'll have top of mind. we are starting out with warmer

weather, much warmer in parts of the north bay. one of the indications the winds are starting to gust in those areas and keeps those temperatures up as well. so we're looking at some upper 60s in santa rosa. much cooler in napa and we head over to the tri-valley where it's 60 degrees. the red flag warning means we will see the potential of some low humidity and high winds and some of the wind gusts could reach over 25 miles per hour. we'll talk more about that coming up. mike, what's the update on the morning commute? well, things are moving smoothly where you're talking about the gusty winds. i guess that's why they have the windmills, too. no major issues for the map. i did talk about lawrence expressway. the off ramp from north 101 is temporarily closed. you cecil con valley at speed but that particular off ramp

for an all-over freshness you'll love. good morning to you. looking live outside at walnut creek. it's going to be toasty there, pretty much around the bay area as we are tracking some high fire danger headed our way in some areas you could even lose your power. be ready for that.

in order to do that you'll probably need to hear your forecast with meteorologist kari hall. good morning, kari. good morning. a lot of us looking for those opportunities to get outside, and we know it's going to be hot later today. we're checking out livermore and the temperature trend. temperatures in the low 60s and we'll have some good air quality for those early hours so it's the best time to get out there. at 10:00, 74. it will start to heat up around noon and if you're like me, it's like touching the slides to make sure they're still comfortable. and it will start to get warm out there. we do have concern of the red flag warning including the north bay and pretty much covering much of the north bay into the east bay. included in that high fire danger if we do see any fire starting it could spread rapidly

because the winds will be gusting and some of our upper elevations we could see wind gusts over 50 miles an hour. we're looking at winds that at times will pick up to about 30 miles an hour and when you have that and very low humidity, that once again makes any fire spread rapidly. we are looking at our temperatures in the south bay that will reach into the upper 80s and low 90s, up to 92 in gilroy today. we'll also see some low 90s for much of the east bay reaching up to 95 degrees in antioch and for oakland, 83 degrees will be the high, also a high of 83 in san mateo and san francisco reaching into the low 80s there. it's going to be warming up in the city as well as the north bay reaching up to 95 in napa today. as far as when we'll see the winds picking up i do think it will be later on this afternoon but we are already in some spots seeing higher wind gusts but wind speeds at 20 to 25 miles per hour with some higher gusts. and then as we go through the forecast this high pressure will

slowly move on and once that moves away from the bay area we'll get a chance to cool off. that doesn't happen until early next week. mike, you've been tracking the commute. a few more smaller incidents popping up for the south bay. if we look at the big map you get an overview and everywhere you go for the main commute of the bay and the south bay just off 101 as well as 280. no major problems. i'll let you know if they develop into anything. north 880 and whipple a crash reported through hayward. that's a sensitive spot. no lane information. not showing any slowing toward 29 and there's the bay bridge toll plaza with no problem. no buildup yet. back to you. a follow-up on the toppling of the father junipero serra

outside mission san rafael in the north bay. this is what's left. the base of the statue after activists tore it down monday night. another demonstration outside the mission. >> when we looked out upon those here last night we looked upon people that need to be loved. >> junipero serra was a figure head in the early efforts to oppress the indigenous people. it was the coast miwok tribe. six people involved in the statue's removal and it is possible they could face felony vandalism charges. the governor's office is out with a new report urging more restraint by police officers. that is the result of a special panel convened in the wake of the death of george floyd following all the protests that

followed as well more than three months ago. it contains 3 dozen recommendations including better communication and a warning, tactical weapons against crowds can escalate the violence it's meant to deter. california's largest police unions are calling the recommendations unrealistic. the author of a tell-all book about the first lady, melania trump, now in hot water. the justice department sued stephanie winston wilfolk claiming she broke a nondisclosure. the lawsuit says the nda she signed had no end date and she never gave a draft to the first lady. she refutes the claims. if the justice wins the lawsuit all the profits will go to a government trust. a joyous occasion now going viral. up next on "today in the bay," a man says i do, gets a big
