i waited an hour and a half to vote. i have to vote. >> it was my first time voting. >> nearly 40 million americans have already voted and they just keep coming. up next the final messages from each campaign and their push to win voters. plus, a stunning court ruling, san quentin ordered to cut its population in half to stop the spread of covid-19. coming up in a live report the response from prison leaders. and fire danger continues. we're monitoring the winds and potential power shutoffs within hours. "today in the bay" continues right now. there's a cliff rescue that is going on right now. we'll have more on that. first good morning to you and thank you for joining us. i'm laura garcia. >> and i'm marcus washington. mike is keeping an eye on the

commute, first the forecast for you. meteorologist kari hall has been tracking the conditions we can expect today throughout the bay area. kari, what is it looking like for us? well, we are starting out with two red flag warnings that will be in effect and watching conditions around both of those for this morning as we start out with this last day of heat for today. we're talking about highs reaching into the upper 80s. we'll have two time frames we're watching the potential of a high fire danger but it will be a much cooler weekend as we check out our temperatures and as well as the high wind gusts we've seen over the past 24 hours. we've seen some of those gusts yesterday afternoon picking up to 28 miles an hour in the east bay. as we head out the door to work, mike, how is it looking for the commute? kari, gusty wind, of course, especially as folks are traveling over bridges. no warnings from chp but we'll listen for kari's update as well.

no major problems but talking about a bridge, the antioch bridge, heading north out of brentwood and heading up there 160 where there's a disabled vehicle but only affecting the wilbur avenue off ramp, a truck and a trailer blocking one lane. to the bay bridge, on the span i think there's slowing. we'll check it out. right now back to you. all right, we want to see what rescuers can see at this point. it's very dark out there but there's a high-level risk rescue going on in san francisco right now. "today in the bay's" cierra johnson just got to the scene this morning. we understand they're trying to rescue one person. sounds like they're stuck out on a cliff, cierra. >> reporter: yeah, good morning. i literally just arrived on scene. one person in this area you can see where the light is in that direction, about 130 feet off of a cliff hanging in what is being

considered a very dangerous area. san francisco fire is working to rescue them and working on a plan to use a helicopter to do that. again right now we're at battery crosby. the area is still open but there is a lot of first responders, a lot of fire department personnel in this area. but point you in the direction to where that light is near that water. battery crosby, one individual 130 feet off of a cliff. we're still working to gather more information and as we do so we'll be available every half hour to bring you the updates. cierra johnson for "today in the bay." all right. we'll continue to check with you throughout the morning. we hope this person remains safe. thanks, creigh area. with just 13 days before election day, the final push for your vote. here is a live look outside belmont university in nashville

where tomorrow's final debate takes place. "today in the bay's" tracie potts live for us in washington tracking the latest on decision 2020 and the already surprising voter turnout. tracie? >> reporter: and that really seems to be the big story today, marcus, good morning, everyone. we're seeing it in swing states, we're seeing it in states where early voting is open and that's most states. these long lines, people wanting to be engaged, wanting their voice to be heard, and that is the big story 13 days before this election ends. long lines across america marking a surge in early voting with less than two weeks to go. >> i think now it's very important to do so. >> reporter: more than 30 million people have already voted, two-thirds of the early vote total from 2016. nbc tracks more democrats than republicans so far.

both candidates are honing in on pennsylvania where polls are deadlocked. >> if we win pennsylvania, we win the whole thing. >> reporter: president trump protesting a supreme court ruling allowing pennsylvania ballots to be counted up to three days after the election. and he's chiding the state for not reopening sooner. >> you guys aren't even open yet. what the hell is going on with your state? >> reporter: president obama campaigns in philadelphia today for joe biden who is behind closed doors preparing for tomorrow's debate. topics include families, race, climate, national security, leadership and covid-19. >> make no mistake, we are in the second surge. >> reporter: with much of the country overwhelmed with new cases, the candidates are hitting the airwaves -- >> joe biden -- >> reporter: and hitting the handful of states that could determine the outcome. tracie potts, nbc news.

>> and nbc's kristen welker moderating tomorrow's debate. our coverage begins tomorrow at 5:30. california is under court order to cut the number of inmates at san quentin prison. that's to protect inmates from the risk of coronavirus. the state appeals court yesterday ruled prison leaders acted with deliberate indifference to the health of inmates at san quentin which had 2,200 infections and 28 deaths. the prison must now transfer or release enough inmates to get to half of its population. that was back in june. the state department says it disagrees with the ruling and it's not yet clear when inmates will be moved. a milestone for san francisco. it is the first bay area county and the ninth county statewide to move into the yellow tier and is by far the most populous county to get there. as you see here on this map that

we have for you, most of those counties still in the red tier you see throughout the state. yellow means restaurants in san francisco can serve more customers indoors. starting november 3rd, election day, restaurants can reopen indoors at 50% capacity. also next week fitness centers can open at 25% capacity. and soon after museums, zoos, aquariums, movie theaters and places of worship can all operate indoors but at 50% capacity. and more details and despite the recent progress the city's public schools will not reopen anytime soon or for the rest of the year, for that matter. that's the decision following yesterday's school board meeting. the district superintendent says to reopen the district must meet three requirements, none of which are complete. so far there's no reopening time line. new details this morning. pg&e is reportedly not keeping up with its tree trimming

program. "the sacramento bee" is reporting utilities enhanced vegetation program is moving backwards since expanding in 2019 according to a court-appointed investigator who says the number of hazard trees is rising. the utility was ordered to clamp down on wildfire hazards after massive wildfires in 2017 and 2018. investigators are now still looking at faulty equipment as a possible cause for the recent zogg fire in shasta county. a follow-up on the devastating glass fire in wine country. we're now learning just how much of the grape harvest was affected. so mo ma county expects to lose 152 million dollars from this year's harvest due to wildfire smoke. at least 70% of growers say they have fruit rejected due to the smoke. wine growers in sonoma, lake and mendocino counties could lose more than $470 million from this

year's wine harvest. the timing of the fires always in the fall when they do the big harvest there. hard to see. >> absolutely. i know we've been talking about conditions there still threatening right now. meteorologist kari hall has been tracking that. what are we looking at for conditions when it comes to the north bay right now? usually when we have some of these fires burning, it happens after the harvest but we have the fires so early this year that it happened before the harvest. so, yes, really unfortunate to see that. as we get ready to head out the door this morning we do still have the concern of high fire danger can san jose starting out with temperatures in the upper 50s. we are going to be at about 57 degrees for the next couple of hours and then warming up as we head through late morning. we'll be in the upper 60s. it will be a warm afternoon with our high temperatures reaching into the upper 80s for the

inland east bay. in martinez expect a high of 84 degrees. we'll talk about the cooling and the wind that will come along with that coming up. mike, how is it looking for the commute? kari, a live look and show you because we saw slowing on the sensors for the bay bridge but our view is showing us the span, the taillights over to treasure island in san francisco with no delays. back at the maps everything back in the green zone for the bay bridge. a little slowing for highway 13. no major issues through the area but i'll check for the freeway. the rest of the bay moves nicely, laura. you have breaking news and a follow-up. listen to this follow-up. the breaking news a cliff rescue we've been following in san francisco this morning, we're now told it's already over. one person has been rescued. this is a live look at the scene out here. we're surprised because it's so dark out there and they were saying what a precarious situation that this person was in below a cliff at battery

crosby in the presidio. they first got a call of this person needing help at about 1:30 this morning. they were 100 feet below a cliff. they had planned on having helicopters overhead and boats in the water as well to try to attempt what was the best way to get this person would be. eventually crews used kayaks to reach the person and bring them to safety. we have the rescue on tape, and we'll bring it to you as soon as we can. good news there the person has been rescued. we don't know their condition so far. 5:11 this morning. not backing down. still ahead on "today in the bay" at 5:25, breonna taylor's mother speaks out one day after new details emerge about what happened during closed door deliberations. and a washington politician sets new online records as she tries to get out the vote. one of your little secrets, too?

of hours. you may see 10 to 20 per hour but up to 30 if you're looking in the right direction. we'll talk about our sky conditions, a red flag warning and all of this in the forecast coming up. and hopefully folks are driving in the right direction. so far no other counter information other than that. a smooth drive across the golden gate bridge where we can clearly see a nice drive and no fog this morning, at least not right now. another live look outside shows us how things are shaping up out of the altamont westbound with the headlights going all the way through pleasanton. good volume of traffic. we'll see how everyone is getting along coming up. well, good morning, everybody. happy wednesday to you as well. nancy pelosi's deadline for the white house to come to an agreement on the stimulus came and went last night and then several news agencies are also reporting senate leader mitch mcconnell is telling the white house if the trump administration did come to an agreement the republican-led senate would not vote on a

stimulus before election day. mcconnell simply won't bring it to the senate floor. as you know you need all three house, senate and white house to agree on everything to get anything done. so the negotiations we've seen between pelosi and members of the trump administration aren't enough to get this thing passed. dan primack at axios sums up the situation well. these stimulus negotiations, without the involvement of mcconnell, is kind of like my daughter and her friend spending time deciding what time of pizza and ice cream they want. great plan except i haven't agreed to buy it or drive them. amazon is the latest company to tell its employees they're going to stay at home longer, programmers and what not, obviously. not the folks who work at the warehouses. this will be through june of next year. this is a good reminder corporate america does not expect to get back to normal for at least, almost, another year yet. amazon also launching one-hour curbside pick yum for

>> i'm always open to opportunities to work with these people. >> i'm just riding their coattails, so whatever they say. >> you can watch the full interview at 7:00 this morning on the "today" show right after "today in the bay." >> that was a pretty classic movie or series. >> it was. a funny one, too. well, maybe we can be reunited one day. next june, according to scott mcgrew. >> just riding your coattails. all right, kari. >> let's talk about the red flag warning we have going on. the high fire danger that we'll have for today, of course, the top of concern as we'll see this red flg warning for the north bay continue until 8:00 this morning and then we'll have another one going into effect for tonight which also includes the east bay as well as the santa cruz mountains. and this is during the time we're expecting another burst of winds starting late tonight

through friday, and we may see some of the gusts top 40 miles an hour in the upper elevations. in fact, i just saw a wind gust from mt. diablo at 38 miles an hour. but overall in a lot of our valleys we're not feeling the high winds. as we go through the forecast we're going to see the wind speeds picking up this evening up to about 20 to 25 miles per hour in parts of the north bay and along the coastline for this evening and staying windy for the overnight hours. and we have high pressure that's just off the coast giving us a northerly wind and that northerly wind is very dry. we'll also see a storm system passing to our north and that storm system close to high pressure will make the air move very rapidly across the bay area. so with the high winds, very low vegetation -- or very dry vegetation as well as a severe and extreme drought going on that creates those wildfire conditions that we do not want to see. the good thing is that we will see significant cooling over the next few days. so in spots like concord as we go through the seven-day forecast we'll be in the upper

80s and then dropping back to the mid-80s tomorrow and then we'll see some 70s throughout the weekend even though it might still be breezy, we are going to have higher humidity as well as some much cooler temperatures. overall across the bay area once again some big cooling coming our way after the next couple of days. how is it looking right now for the commute, mike? we have some big traffic coming. it's pretty smooth. we'll check in on oakland. let's get a look at the big ma'am and your route. most of our viewers are somewhere along this route. we have folks heading out of the altamont pass. this is west 580. a little slowing off the merge of 205. a little build, a little slowing. over to the bay bridge no problem. we do have a little slowing that showed up on highway 13. it's now cleared. i have no incidents and no construction. back to you. looks good.

>> reporter: good morning. antoinette told us she couldn't get her money back for a flight to mexico after she canceled the trip. she paid about $1,000 for airfare and travel insurance when she booked through aarp. but when she asked for a refund, antoinette said the agency only offered an airline credit of $350. she turned to us because she expected a full cash refund.

battlefield. the two candidates running for utah working together for civil discussion of the issues. take a look. >> there are some things we both agree on. >> we can debate issues without degrading each other's character. >> we can disagree without hating each other. >> in this day and age the ad is considered so unusual it's been watched more than 2 million times on social media. well, developing now for you in a rare rebuke an anonymous grand juror in the breonna taylor case said they were told there would be no additional charges because, quote, the prosecutors didn't feel they could make them stick. they also say the jury never considered homicide charges because they were not given the option. taylor was shot and killed in her apartment in march during a botched drug raid. no officers were charged in the death. taylor's mother is speaking out. what she says, and she really hopes, can come from those allegations.

breaking right now for you at 5:30, a person back on solid ground after needing rescuing. they had been stuck on rocks 100 feet below a cliff in san francisco for hours. a live report on how that rescue happened coming up. flag warning that will go into effect for tonight. much cooler this weekend. we've had well above normal temperatures. today we'll see some of our inland valleys reaching into the upper 80s. we'll talk more about this coming up. mike, how is it looking now for the commute? kari, getting a little more busy. we're looking on the peninsula side. look at the map. it's 101 and we typically have construction and a little build. construction clearing the build for san jose traffic shows up. we do have one incident over here in the north bay. highway 37 as it makes the junction with 101 there was a crash. everything sounds like it's over to the shoulder but a critical point in the north bay part of the commute so we'll track that as well. so far no backup, marcus. back over to you. >> thanks. we want to get to the breaking news, mike. one person is safe after being rescued from a san francisco cliff overnight. this was in this area here of the presidio near battery crosby. when they arrived there, that person was unresponsive.

h let's go live. cierra? >> reporter: it is quite chilly out here. we have a chance to talk to the fire department. this ordeal began at 1:30. it was at that time some passersby heard a person needing help. they all called 911 for assistance. at that point san francisco fire made their way out to begin the rescue. now they used three different types of rescue methods, one of them being marine rescue. they had called for the coast guard for air rescue as well as another rescue. the crew in the water was able to essentially catch a wave pushing that individual up and they were able to paddle in the 200 yards to safety.

something else that played into effect was thermal imaging. they used thermal imaging to scan the perimeter, the area and water around it, to help rescue that individual. he says where that person was found is not really accessible by water, so you would have to essentially climb down to get there. we're really not sure how the individual got down there but right now -- we don't know the gender but the individual was transported, unsure of the condition, but quite the ordeal out here spanning a couple of hours for that water rescue. we're live in san francisco at the presidio. >> so glad they were able to complete the rescue. thank you, cierra. we saw from the breaking news the winds out there really picking up and that means the risk of wildfires will increase as the humidity levels pick up. bob redell is live for us in pleasanton. bob, i know thousands of people

are talking about this, they could lose power as a result. >> reporter: correct, marcus. pg&e has warned during the public safety power shutoffs for customers in the east, south and north bay this is to reduce the risk of the winds knocking down their equipment and starting a wildfire. the national weather service has issued a red flag warning that goes into effect starting at 10:00 tonight and lasts until 8:00 friday morning and that is for the hills and interior valleys in the east bay, the san mateo coast and the mountains in the north bay. meteorologists are concerned about low humidity and 40-mile-an-hour wind gusts. those are conditions that are obviously conducive to wildfire activity. pg&e would shut off power after midnight for a few hours depending on where you live. this would impact over 1,000 customers here in alameda, contra costa and santa clara counties, well over 5,000 customers in napa, solano and sonoma counties. for some this would be the fourth time this year power has

been shut off as a precaution to prevent wildfires. >> you know, we just have to deal with it. just one more thing being safe. >> i would rather pg&e shut down the power and keep us safe than worry about more fires and having our homes burned. we can adjust. it's an inconvenience but, you know, they're doing the best they can. >> reporter: those people you just heard from, they're from calistoga which has lost power already twice this year. a pg&e spokesperson tells us that downtown calistoga should be able to keep the lights on this time around thanks to a recently involved micro grid that's providing power to 1,500 residents in the area with the help of temporary generators. report be live in pleasanton, bob redell, "today in the bay." >> thanks so much, bob. 5:36 right now. indoor dining continues to make a comeback. not everywhere just yet. one bay area county is putting that on the back burner while

allowing people to eat outdoors if they're looking for a late night snack. we'll check in with "today in the bay's" kris sanchez live in san pedro square where if you want to eat outside you can a little bit later at least now. >> reporter: the state of california made some changes. they pushed back, a little bit of confusion but we'll start with the good news which is you can now dine outside a little bit longer here in san jose. we're out here working with all the other folks working the early morning hours. to clear up confusion in the al fresco dining policy, the city of san jose came up with that led to san jose police shutting down service this weekend. the rule is 10:00 that service needed to stop but the city now clarified that restaurants can serve outdoors until midnight. 49ers fans may spend that time crying into their beer after their hopes of going to a game at levi's stadium were dashed by

santa clara county. in case you missed it yesterday the state eased restrictions allowing counties in yellow and orange tiers to start allowing a limited number of fans in the stadium. within an hour's time santa clara county says that would amount to a super spreader event. >> no question this is dangerous. this is the worst thing in the world to be doing at a time periodicalcal is beginning to see some light. this amounts to another step backwards. >> we've been doing what we're supposed to be doing, let us reap the rewards of that level. >> reporter: the niners fans and san jose earthquake say they will continue to work with the county on those restrictions. santa clara county's positivity rate is favorable but, as we know, fans come from all over the bay area and some of them could be coming from hot spots, and that's the cause for concern. in san jose, kris sanchez, "today in the bay."

>> all right. on that note a lot of people come to san francisco to visit all the sights. happening today a 150-foot observation wheel will start to spin in san francisco's golden gate park. it's a long-awaited attraction delayed by the pandemic. it's here to celebrate the park's 150th anniversary. the 15-story wheel will provide a pretty spectacular view of the city and the bay from inside temperature controlled gondolas. there will be a strict safety precaution due to covid. riders will also need to book their times to limit some of the lines out there. it looks pretty sturdy but you would hope one of the san francisco winds won't come through and rattle your ride. kari has a look at your forecast. that just makes it more fun when it's rocking back and forth, right? maybe not. let's get you out the door ready for the commute. in the east bay nice and cool. no fog for you as you're making your drive and we'll see

temperatures mostly in the upper 50s through the next couple of hours. but it's going to warm up again today. we go from maybe having the heat on to the air conditioner inside the car as we reach up to 80 degrees at lunch time. all of our microclimates will have a warm afternoon especially for the inland east bay, down to the south county as we head through 4:00. morgan hill at 88 degrees but then cooling down quickly once the winds pick up. we'll talk more about this and what's ahead in the forecast coming up in a few minutes. sounds good. it's 5:40 right now. a new twist in the battle over unauthorized ballot boxes in california. state leaders escalate the conflict. coming up on "today in the bay," why so far the gop is refusing to cooperate. president trump in an unusual spat with "60 minutes." we'll tell you all about it coming up. plus, the big world series question this morning is not who won game one.

construction zone clearing from the northbound side. we also have a crash in that area. we'll get more details and see if it's blocking any lanes, laura. over to you. all right. thanks so much, mike. 5:44 right now. to decision 2020 california's attorney general is suing the republican party over its use of unauthorized ballot drop boxes. xavier becerra yesterday asked a judge to order the names and contact information be handed over for each voter who used the boxes along with each box location. until now the gop refused insisting the boxes are legal under a recent state law. teams have been able to salvage most of the ballots set fire over the weekend in southern california. election leaders say voter information for just about all 230 ballots have been recovered if not the actual ballots themselves. voters are being notified. a fifth of americans have already cast their vote.

minutes." apparently the president refused to finish an interview set to air this sunday. this is video of a past interview between president trump and leslie stahl. they've talked twice before. the president says he ended the interview. insiders tell "the washington post" there was nothing particularly unusual about the interview. no bombshells. certainly not like the catastrophe the president experienced with jonathan swann of axios when the president said, it is what it is, when he pointed out 1,000 americans were dying every day. nonetheless, it is the president who is pointing to the most tension at the yet to air "60 minutes" interview mentioning to the crowds in a rally. he's sort of promoting it. >> oh, and you have to watch -- you have to watch what we do to "60 minutes." you'll get such a kick out of it. you're going to get a kick out of it. leslie stahl is not going to be

that will reach into the low 70s. in concord expect a high of 89 degrees. napa will reach into the upper 80s. so we are going to have some warm weather today, and as we go into this afternoon the winds will start to pick up, and it's going to be quite gusty out there. i want to show you that red flag warning that's still in effect until 8:00 this morning for the north bay. we'll take a break for a few hours from the high fire danger but then later on this evening we'll not only have the north bay but we'll include the east bay as well as the santa cruz mountains. and another red flag warning that will go up at 10:00 tonight and that will go nool friday, so we do have a couple of events where we are expecting those winds to pick up in the upper elevations. we may not feel it in the valleys. as you go up about 2,000 to 3,000 feet those winds at times will reach above 40 miles per hour. let's take a look at our wind speed forecast. here we are taking it into the evening and we're seeing that northerly wind even in some of our valleys that could pick up to 20 to 25 miles per hour.

it will stay breezy tomorrow mainly because we have high pressure off to our west and a couple storm systems passing to the north. when you have high and low pressure, that air rushes by very quickly and we're going to see at times those high winds picking up not only for the next couple of days but possibly again for the weekend. we will transition to some cooler temperatures. i want to show you what that looks like for concord as well as much of the bay area as we'll see upper 80s in the forecast while our inland areas will have those upper 80s. we'll come down to the 70s for the weekend. some of the coolest temperatures we've had in quite a while. mike, how is it looking now for the morning commute? well, kari, there were little mysteries going on. to the south bay the bottom of your screen as we take the map, i circled it for you. that's your traditional slower spot north 101 and that's not a mystery. it's predictable as you get through san jose.

and then he gets right back on the road. this video is from a news chopper. apparently there weren't enough ground units following him. he allegedly robbed a home de t depot. new research indicates more sharks are popping up off the coast near san diego. the shark lab at cal state long beach tells the "l.a. times" it's tagged 38 white sharks just this year alone. more than three times last year's amount. one expert says the reason could come down to legislation put into place in the mid-90s aimed at protecting the species and cracking down on over fishing. >> maybe some of the improvements we've been making are, in fact, working. i think that's important to see. >> he says climate may play a part with warmer waters off the coast this summer attracting more prey for hungry sharks. well, it's now official and still controversial. san francisco's lowell high school will switch to a random

lottery to admit nexti year's freshman class. it is an elite public high school that normally admits based on gpa and state test results. but the pandemic made most schools switch to a pass/fail system and the state canceled standardized tests. the change accomplice to the next admission cycle only although some board members talked about it being permanent. now you may want to pump the brakes in san francisco. city leaders there are pushing for more red light cameras. according to "the examiner" they plan to install eight more around the city. data presented to the san francisco county transportation authority says the red light crashes are down by one-third since the program started. currently there are 19 cameras at 13 city locations up and running. the new cameras won't be up and running until 2022. want to get away?
