and we have a really nice day ahead. basically a repeat of yesterday with our highs reaching into the 70s. we'll have one more warm day tomorrow. you my want to head to the coastline and enjoy it. some rain and sierra snow in the forecast. mike, how is it looking for the morning commute? >> well, kari, things are looking average as far as those speeds go as we take a look at the big map. you don't see anything really outstanding. i want you to know about this but it's still there. southbound 680 coming in to san jose. as you approach the 101 interchange reports of tire debris. there may be a big rig on the shoulder as well. meanwhile we have some slowing coming down towards 680 where the tri-valley and out of the altamont. back to you. >> thank you, kari and mike. a long election night is turning into a confusing and

contested morning. live team coverage to break down all things for you. "today in the bay's" scott mcgrew is standing by with his analysis. >> first let's get right to tracie potts live in wilmington, delaware, with the latest from the trump and biden campaigns. tracie? >> reporter: laura, marcus and scott, what we are watching this morning is the vote count. we do not have an answer as to who has won this election because there are states like nevada and arizona that are leaning towards biden but we haven't called them yet. there are states like wisconsin that are starting to separate. then you have states like pennsylvania where there's just a lot of votes still out there, a lot of ballots left to be counted. we heard both candidates talking about this overnight. let's start with the president who spoke from the white house and claimed falsely that he's already won the election. >> this is a fraud on the

american public. this is an embarrassment to our country. we were getting ready to win this election. frankly, we did win this election. >> reporter: georgia is a big one we're watching very carefully. we're seeing the cars out here. >> we're going to have to be patient until the hard work of tallying votes is finished. and it ain't over until every vote is counted, every ballot is counted. >> reporter: and that's the key here. some of that counting continued overnight. we're expecting to hear from the georgia secretary of state in a couple of hours with an update

there but nevada is saying we may not get their numbers, their update, until tomorrow. so it's not clear when we will have a definitive answer. >> you don't know until the very end. when does the end come? thanks, tracie. >> no kidding. we'll be waiting and watching. scott mcgrew right now talking about the mail-in ballots, one of the keys to deciding the race and officials are still counting them. >> if there's any consolation it's playing out the way we had anticipate anticipated and had warned. on tuesday the early results come from walk-in voters who tend to vote republican, tend to, and they're not done counting the mail-in ballots

which swing towards democrats. we've always known pennsylvania would be a battleground, it like georgia is one of those states that is big urban areas that tend to support democrats and then rural areas which tend to support republicans. both candidates spend a great deal of time there. the trump campaign worried it might not have spent enough. taking a closer look at the results from the keystone state you can see what we're talking about as far as results. it's not hard to find the big cities of pittsburgh and philadelphia, which are blue. the blue county in the middle is home to penn state university. take a look at georgia this morning. even macon went blue along with savannah and atlanta. atlanta voters mailed in ballots. they will be key to the race here. still 1.7 million ballots still outstanding. now this is a state that

restricted the processing of mail-in ballots until election day on of course so many of us voted by mail because of the pandemic. the republican party is in court all over the battleground states to stop counting. there's no reason that should be. it is not uncommon for any race to have lagging in reporting and counting. we don't always get the people elected on election day. the president said he wants to move the election to the supreme court. indeed it was not that long ago we saw an election decided by the supreme court. in this case, though, it's not clear what the argument would be or if the court could accept the case. we may end up there perhaps but it's premature to be thinking about that path. the votes are legal, legitimate ballots which have been sitting in some cases at a registrar's

office for days and possibly even weeks waiting for their turn to be counted. we clearly have an imperfect system but i can't imagine anyone arguing otherwise but what we're seeing it's legal, it's according to the rules so far and, again, this is what we expected. >> thanks so much, scott. take a look at some of the key congressional races. >> most of san mateo county and a portion of san francisco county. jackie speier has about 81% of the vote. her republican challenger 19%. >> congressman eric swalwell once a presidential candidate himself has a sizable lead over republican challenger alison hayden, ahead 73% to 27%. representative swalwell was first elected in 2012.

>> the democrats will keep control of the house and nancy pelosi will remain house speaker. not surprisingly she won her district easily beating her opponent shahid buttar. democrats came into election day heavily favored to retain house control. it was more a matter of how much they could expand that advantage. pelosi says that's up in the air. >> there are plenty more votes to count. >> as of right now it is projected the democrats will have a 227 to 208 advantage in the midterm election democrats gained 40 seats. mitch mcconnell has won his re-election bid. defeating amy mcgrath in the closely watched race.

he will most likely remain republican leader in the senate, it's unclear if republicans will continue to be the majority party. >> we do have some breaking news we're following out of oakland. this is video from overnight showing the violence that got out of hand. someone was shot during an apparent break-in at a cannabis club not far from the coliseum. also from the video you can see damage to several storefronts in an area around east ninth street. police do not confirm the specific details about the case or whether this is tied to protesters. >> as we get a look at the forecast for the day, meteorologist kari hall has been tracking that. it was a nice, pleasant day. how are we looking for today? we're looking at a repeat today and tomorrow. we're starting out with some fog

in san francisco but this will clear out quickly and we'll have a nice, sunny day with temperatures reaching into the upper 60s. parts of the north bay even up to 80 degrees in clear lake. we'll see our temperatures in san jose reaching 76 degrees and 79 in concord as well as livermore. we are going to have a lot of changes in the forecast. mike, how is it looking right now for the morning commute? it's looking great on the maps. it's an important one for contra costa county. not the slowing out of the altamont, that's typical. to 580 we use vasco road and there's a crash blocking the southbound lanes of vasco just here just off marsh creek road. if you look on the map you get down there that's fine. south of the crash and keep that

dublin on our live camera here. the vertebrae bridge shows you how light that traffic is. if people are like our households that were up late watching for those election results. back to you. tuesday was also a night full of important state issues that includes prop 16 to end the ban on affirmative action and california's bid to end cash bails. >> "today in the bay's" cierra johnson has been following the issues and joins us live to break down the outcomes for us. good morning to you. >> reporter: good morning, yes. both hot button issues and both did fail starting with prop 15. we'll jump right into things. a simple majority was needed to reinstate affirmative action and based on the votes that have been counted it does not appear that's going to happen. the ballot issue would have allowed public universities and state or local governments to consider race in admissions and

government. this issue was meant to repeal prop 209 that was passed in '96 which banned affirmative ak at public universities and this issue did not receive enough votes to pass. another, you that failed to gain voter support prop 25, a ballot issue that was abolished the cash bail system in the state of california. the votes were not in favor of judges using a risk assessment tool with an algorithm to predict a person returning to court or rio fere-offending. california would have been the only state to do so, but it has failed here in the state of california. k cierra johnson for "today in the bay." as for another key ballot measure proposition 18 would allow 17-year-olds to vote in primaries and special elections

provided they turn 18 by the general election. losing by about 10%. i want to remind you election results are scrolling across the bottom of your screen as well and will be throughout the newscast. 5:16, time for a look at the forecast. coming off of a nice day, election day yesterday and today, well, it's still going on. hopefully the weather continues in a good way today. we've had some clouds to start, fog near the coast. we're seeing that again this morning. we're still looking at temperatures in the 40s and 50s as you head out the door but we've had a lot going on these past few days. if you're able to, if you have the day off head to the beach and relax. we'll see temperatures in the

60s here in half moon bay. we're starting out at 56 degrees at 8:00. as you make plans for lunch at the beach it's going to be at about 64 degrees and the sun will be coming out so the early fog will be clearing out. 72 degrees in cupertino. for the east bay we're also going to see mostly upper 70s here but danville will reach up to 80 degrees. a high of 74 in redwood city and daly city reaching 60 degrees. san francisco will stay mostly in the 60s this afternoon up to 68 downtown. as we go through the forecast we are getting ready for more clouds and much cooler temperatures starting on friday. looks like we could see spotty showers.

some mist coming in. it looks like in terms of how much we'll see, it will be very light. if you go further north in ukiah there could be up to a quarter inch of rain but most of us will get trace amounts of rain. friday into sunday night. we're looking at our first significant snowstorm here. 17 inches of snow and i foe a lot of the fall colors are really popping right now. so as we take a look at how big our temperatures will drop, we're going to go to napa. we'll see some mid to upper 70s today and then some low 80s tomorrow but then we go from 81 to 61 for highs and it will continue into the 60s for highs going into the weekend. inland valleys will see a big

drop in temperatures. we've had nice, warm weather. you're going to get that this week as our highs will reach into the upper 50s. spotty, light showers, and for san francisco we're going to see temperatures today in the upper 60s but upper 50s starting on friday and more of that going at least into early next week. you're tracking the east bay, mike? i have an alert there. now it's just for folks out of brentwood heading down to 580. it's over my shoulder. let me show you that sign, the southbound side of vasco road. an intersection with marsh creek road heading down to community diablo is where the crash is blocking that intersection. you're still registering 20 minutes and that's typical of the time heading down to the critical connector through the tri-valley and that moves out of the altamont.

now 270 is, of course, the magic number for victory. "today in the bay's" scott mcgrew is keeping a close eye on this race. we'll have another live report in minutes coming up at 5:30. black lives matter plaza in washington, d.c., hundreds of supporters from both candidates were out. at one point one crowd pulled out two large banners saying, and i'm quoting here, remove trump and trump lies all the time. three people were arrested during the mostly peaceful protests. one person was arrested for resisting arrest and disorderly conduct. two others arrested in connection with an assault. other marches across the country including one in north carolina west of raleigh. this march was tied primarily to the controversial incident over the weekend where police arrested and pepper sprayed nearly 2 dozen protesters. police made several arrests in minneapolis, more than a dozen

race still it close to call. millions of ballots remain uncounted and several states are yet to declare a winner. we are tracking what is happening inside the santa clara county registrar's office and where all the ballots are being counted. the results on the big decision including the ride share measure. brake tapping at the toll plaza. maybe folks did stay up waiting for results. do we have any? over to you. millions remain outstanding leaving states yet to declare a winner in the presidential race. right now joe biden leads the electoral college count but that didn't stop trump overnight from falsely claiming victory. 270 is the number to win there. "today in the bay's" cierra johnson from the top proposition for us. >> scott mcgrew, president trump now declaring he is the winner. however, right now he has fewer electoral college votes than joe biden. right. he hasn't got enough. he's looking ahead making these assumptions that he will win states, i think, like pennsylvania, but there's 1.7 million votes to be counted in

pennsylvania alone. they're mostly mail-in votes that tend to lean democratic. nobody has won this race because they're still counting votes. the president last night, though, spoke as if the race was over. he does not have the numbers he needs. nobody does. that put networks in a pickle. some moved their programming away from the white house and the president so as to not repeat false claims. we'll show you some of what the president said. again, what you are about to hear is false. >> i want to thank the american people for their tremendous support. millions and millions of people voted for us tonight. a very sad group of people is trying to disenfranchise that group of people. and we won't stand for it. we will not stand for it. >> now what's going on is the opposite of disenfranchisement.

disenfranchisement is to not count a vote or not let them vote. there are millions of legitimate and legal ballots yet to be counted just as everybody predicted there would be. we vote for a president on election day but he doesn't always get electioned on election day. he says the system stopped when it's working frantically at full speed. >> this is a fraud on the american public. this is an embarrassment to our country. we are getting ready to win this election. frankly, we did win this election. >> he did not nor did joe buy depp. the president said he wanted the race to go to the supreme court but no constitutional or legal reason that it would at this point. we're still in thick of counting legal ballots.

not all employees with benefits, more than 70% of the votes counted it passed. the prop was meant to challenge the state's new gig economy law. "today in the bay's" cierra johnson is live in san francisco with more on this very expensive race. >> reporter: the amount of money is almost unfathomable. a quarter of a billion dollars was spent on the issue. a lot of that money coming mainly from those powerhouses in the gig economy and it proved successful. now the passage of the measure means food and ride share would be defined as independent contractors. prop 22 includes a mandate that app based drivers with minimum compensation, health care, insurance and training. we now know voters sided with the ride share companies and a spokesman for prop 22 explained

why. take a listen. >> the voters in california listened to what drivers were saying who said more than 70% of drivers wanted to remain independent contractors because it gives them the flexibility to choose when they want to work, where and how long they want to work. >> reporter: and that spokesman said in the time of a pandemic entities like doordash and instacart proved to be essential. labor unions did put forth a good amount of money, $20 million in trying to defeat this. they were unsuccessful in defeating this proposition. we're live in san francisco. cierra johnson for "today in the bay." >> cierra, thank you. now a look at some bay area ballot measures, measure rr would authorize a sales tax increase. this is to help keep cal train afloat. >> because the pandemic is in

you just have to wait at this point, that's what he told supporters here in wilmington, they were blowing their horns at a drive-in rally that his team hoped would be a victory speech. instead it was just a let's wait speech. georgia, wisconsin, michigan, and pennsylvania where a lot of the vote this morning has yet to be counted. the word from the biden campaign, patience. >> we're going to have to be patient until the hard work is finished. and it ain't over until every vote is counted. >> reporter: and we're hearing that every vote will be counted in pennsylvania where half of their votes have yet to be counted. we're getting an update from there and from the secretary of state in georgia coming up

probably before lunch time, we're told to count the rest of the votes. >> all you can do is wait if you've voted. just be patient. >> easy to say, hard to do sometimes. jay? >> reporter: you'll get some overtime, you'll continue to see election results and, look, it's been an unprecedented early morning here at the white house. the president coming out into the east room and a political event announcing with supporters clapping and millions of votes still uncounted that he was the winner along with that he suggested that there could be some discrepancies in the way the election was held and

continues some form of legal action. >> this is a fraud on the american public. this is an embarrassment to our country. we were getting ready to win this election. frankly, we did win this election. >> reporter: a couple things we need to point out, the president is not the winner of this contest. there are millions and no evidence presented by the white house or anyone else of any fraud during the process. laura? >> we'll continue to wait and watch. california has decided and it went overwhelmingly blue for joe biden. there were some surprises in the county by county numbers. kris sanchez joins us live with more on that. >> reporter: obviously the ballot boxes are closed.

they are all sealed up but it's not surprising that california went for joe biden. this time joe biden won by 4 million votes and counting. now california voters did turn out in record numbers. 88% of eligible voters were registered to vote. while that did boost democratic votes it boosted republican votes in some counties, too. in santa clara county joe biden won overwhelmingly but donald trump did pick up about 10,000 votes over what he got in the last election, in 2016. in contra costa county joe biden still won but between him and trump combined about 40,000 fewer votes than the 2016 election. it was still quite a restless night for a lot of folks in

california who are focused on the battleground states. i'm looking forward to a nap later on today and maybe some results as well. kris sanchez, "today in the bay." other notable races, state senate district 13 on the peninsula. josh becker has a decisive edge over republican alex glew, 77% to 23%. >> district 15 is jim beil's seat in silicon valley. he turned out with 53% of the vote in santa clara county. dave cortese has 54% of the vote. his opponent also a democrat ann ravel has 46%. measure x has been approved. adding a half cent sales tax generating about $80 until in

you can. >> yes, we only have a couple more days and sunshine. it's going to be misting and drizzli drizzling. let's head to the tri-valley. once we make it into the mid-60s we'll see temperatures warming up unsunshine and up to 73 degrees at lunch time. some mid-70s and santa rosa expect a high of 77 degrees. 73 in observing. san francisco will reach into the upper 70s. a lot of changes. we've been talking about how a couple storm systems moving in will bring about some big-time cooling starting on friday.

enough moisture to produce spotty changes. it will be off and on and we're not going to see a steady rain but it looks to be much more significant system for the sierra. as we look at how much rain we may see out of this between friday saturday and sunday, maybe a tenth of an inch of rain for the south bay and we may see ukiah reaching close to a quarter inch of rain. our first significant snowstorm possibly moving in. it will be really great if we did see that pan out. so we have today and tomorrow with highs in the 70s and a drop in temperatures on friday. we're only looking at highs that will reach into the upper 50s and we'll see more that have with clouds, off and on showers.

we are going to see our morning temperatures, check that out, next week, dropping down into the upper 30s for morning lows. time to dig out the winter coats. how is it looking right now for the morning commute, mike? >> kari, the commute looks great. a lot of folks may have been like us staying up late. as we look out to the roadways, i want to show you fremont. i got concerned because this live shot showed a lot headlights coming southbound. even more taillights for northbound past the truck scales. it looks like everything is okay. that was just the lighting. we'll look to the maps. the south bay, the speed sensors are looking great. all around most of the bay.

5:55. you're watching "today in the bay." with a decision for the president still hanging in the balance, some businesses remain boarded up. last night was quiet. kno nearly every store has windows covered in plywood. sfpd added extra units to patrol in the busiest commercial districts. and the day after the election so far starting with a lot of uncertainty but there are some events going on around the bay area. to both bring people together and ease people's minds. now to see a few events, you can

see them there on your screen. some are called vigils and others rallies. now to some of the key congressional races. california's 14th district which includes most of san mateo county and a portion of san francisco county, jackie speier has about 81% of the vote. a look at district 15 in the east bay. congressman eric swalwell, once a presidential candidate himself, has a sizable lead over republican challenger alison hayden ahead 73% to 27%. representative swalwell was first elected back in 2012. >> democrats will keep control of the house and nancy pelosi will remain house speaker. not surprisingly she won her district easily beating her opponent shahid buttar 79% to 21%.

democrats came in heavily favored to retain house control. it was a matter by how much could they expand that advantage. nancy pelosi says that's still up in the air. >> it's not over until every vote is counted and there are plenty more votes to count. we haven't even started in my state of california and the whole west coast and beyond. >> right now nbc projects democrats will have a 227 to 208 advantage. in the 2018 midterm elections democrats flipped control by gaining 40 seats. mitch mcconnell has won his re-election bid in kentucky. mcconnell defeated nominee amy mcgrath, a former marine fighter pilot, and a closely watched race. while he will most likely remain republican leader in the senate it is unclear at this time if republicans will continue to be the majority party. happening today the u.s.

supreme court will hear a case if a foster agency can consider placing children with same sex couples. the case pits the city of philadelphia against the city's catholic archdiocese which runs this foster care group. both sides will present oral arguments to the full bench including newly seated judge amy coney barrett. it is quickly approaching 6:00 and happening right now still counting millions of billions remain outstanding this hour leaving several states yet to declare a winner in the big presidential race. right now joe biden leads the count but that didn't stop the president overnight from falsely claiming victory. >> we will win this. as far as i'm concerned, we already have won it. >> it's not my place or donald trump's place to declare who has won this election. that's the decision of the american people.
