microclimate. sunshine and a really nice afternoon. we'll talk more about the changes coming up. mike, what are you seeing changing on the roadways? >> things kr just changed over the last few minutes. we're seeing the middle lanes backing up and slowing. in the middle lanes true to form there and on the sensors no problems getting over there. one crash on the maps. laura, we have more results maybe? >> that's right. you want to go swimming? we are diving right into it. scott mcgrew making sense of all that is happening in the presidential race. >> let's begin with tracie potts live in delaware. no official winner just yet but that's not stopping the president from making some false statements.

>> reporter: no, one of them being he has won the election. he's not. he's named specific states that are still up in the air. we have not called them because either there's a lot of vote outstanding or the vote is very close. president trump calling into question this election where, again, some states have not yet named a winner. >> now we want to bring in scott mcgrew. >> good morning to you. >> tracie? >> reporter: we want to tell you what president trump said last night about that when he called the election a fraud. listen. >> this is a major fraud on our nation. we want the law to be used in the proper manner, so we'll be going to the u.s. supreme court. we want all voting to stop.

we don't want them to find any ballots at 4:00 in the morning and add them to the list, okay? >> reporter: so that was president trump talking about challenging this continued ballot counting in a handful of states but critical states am joe biden was out here talking to his supporters last night, urging patience saying this process has to play out. he said he feels confident and he was a little bit wishful talking about his trip back to scranton, pennsylvania, his childhood home and what his grandfather used to tell him. >> folks, you heard me say it before, every time i walked out of my grandpa's house, joey, keep the faith. and my grand mom, joey, spread it. keep the faith, guys. we're going to win this. thank you, thank you, thank you.

>> reporter: but how soon could we get those results? we don't know. there are states resuming counting this morning, pennsylvania, we expect an update from their secretary of state, georgia as well, and while there's a lot of cheering and honking going on in the parking lot last night we are still awaiting definitive results. >> we want to bring in scott mcgrew right now. it will take some time. >> we just don't know how much. if there's any consolation this is playing out the way we had been warning people. these early leads in states like pennsylvania but just as we were talking about tuesday, walk-in voters who tend to be republican, they're not done counting ballots in pennsylvania.

so the mail-in ballots there, those tend to swing towards democrats. it makes it impossible to predict. we always knew pennsylvania would be a battleground. it, like georgia, is one that has big urban areas that support democrats and vast rural areas which tend to be republican. both candidates spent a great deal of time there. taking a closer look at the results for the keystone state you can see what we're talking about. not hard to find the big cities of pittsburgh and philadelphia which are blue. that blue county in the middle is home to penn state university. same with georgia, even the small city of macon and is your rounding county went blue along with savannah and atlanta. georgia too close to call. atlanta voters' mailed in ballots will be the key here. there are so many ballots. in pennsylvania there's still 1.7 million still outstanding.

this is a state that restricted the process of mail-in ballots -- processing of them, i should say -- until election day. so many of us voted by mail because of the pandemic. now the republican party is in courts all over the battleground states looking to stop the counting though there are no clear reasons why that should be. it is not uncommon to have some lag in reporting. we vote on election day but we don't always get the vote on election day. that's okay. it was not that long ago we saw an election decided by the supreme court. in this case it's not at all what the argument would mean or the court would accept it as a case. it is extremely -- when they're not even done counting the

legitimate votes. those votes we are talking about are legal and legitimate. some of them have been sitting in a registrar's office for days or weeks waiting for their turn to be counted. we do have an imperfect system. so far what we're seeing so far is very legal and, frankly, we've been talking about this for days. this is what we thought might happen. >> scott, quickly on arizona fox news reporting that biden had won but nbc news and others have not. >> right. in the past nbc had worked closely with the associated press. we decided to stick to our own experts who are not ready to call for biden or georgia for trump or half a dozen other states as well. let's take a look at arizona. biden is ahead by about 100,000 votes in arizona, and this

sounds remedial but, remember, who wins the state gets all 11 electoral votes there. but not all of the votes have been counted in arizona in a patchy county. that's that long county, only 62% of votes are in. they are just extremely cautious here. i want to remind folks at home when a network or news agency calls a state for a candidate it doesn't mean he actually won it. it means the math would indicate there's no way he's going to lose it. only a state's secretary of state can certify the results, marcus and laura. >> we're going to check back with you in just a little bit throughout the hour with more updates.

california voters turned out in record numbers heading into overnight hours, 11 million votes have been counted so far. now that's about half of the overall total cast statewide representing 88% of california's eligible voters. to some of the most closely watched measures, a measure pushed by ride share companies to allow drivers to remain contractors. more than 70% counted, it passed. it's to challenge the gig economy law. live to "today in the bay." tracking results for other key measures for us. >> reporter: good morning. that ballot issue you just mentioned was one of the most expensive in state history. a quarter of a billion.

it seems the voters as we know so far have voted in favor of it. now the passage means app-based drivers, food and ride share, would be defined as independent contractors. prop 22 includes a mandate that app-based drivers are provided benefits like minimum compensation, vehicle insurance and training. now opponents say the ballot issue creates a special, those opponents say prop 22 eliminates basic work place benefits and replaces them with new lower earning guarantees and lower health care payments. based on the results so far, a spokesman for prop 22 explains why. take a listen. all right. he essentially said there were multiple times 70% want to remain independent and gives

them the flexibility to do what they want. we had a chance to speak with someone on the no side. everyone put up a good effort and so did the labor union. labor unions put up $20 million but it was up against $235 million in this fight. we're live in san francisco. cierra johnson for "today in the bay." >> all right. lots to get through. thank you, cierra. current market value losing but only by a few percentage points, about 70% reported. the tax revenue raise would go to public schools and community colleges. as for another key ballot measure proposition 18 would allow 17-year-olds to vote in primary and special elections provided they turn 18 until the november election. election results are also

business. bob redell is live in oakland with a look at what we can expect. bob? >> reporter: good morning to you, marcus. talking about propositions 15 and 21. they're both heading for defeat and one has officially been defeated. with 71% of the votes reported so far prop 15 is losing 52% voting no. prop 15 would have loosened some of proposition's 13 on property tax increases that went no effect in 1978. they would have been taxed on current value rather than the current price. that looks like it's heading for defeat. 50% of voters said no to prop 21 versus 40% who said yes. that has been defeated even though it's expected to stand, i should say, with 71% tabulated so far. prop 21 would have allowed rent

control on residential properties that are over 15 years old. this proposal came in after years of rising housing costs that have pushed many young adults to move back in with their families. bob redell, "today in the bay." 6:17 for you this morning. a look at the traffic this morning. the commute is not looking too bad. mike will get a look at that in a bit. first a look at the forecast. meteorologist kari hall has been tracking that. another nice day. something to be excited about today. >> absolutely. with temperatures like this reaching up to 79 degrees in morgan hill as well as concord. 78 the high in napa.

now we are going to see some changes ahead because of an approaching storm system that will come in on friday. it's going to cause our temperatures to drop significantly, bring in some spotty showers and clouds and some breezy winds. we are going to see this potentially bringing in some unsettled weather for the week. another one right behind that will give us some milder weather for next week. a little bit further to the north. as we look at how much rain we may see out of this, the models putting down up to a quarter inch around ukiah. a few trace amounts and up to a tenth of an inch around the santa cruz mountains. a big significant system for the sierra where it will bring in the potential of at least a foot of snow in upper elevations. it will be really great to see after seeing how dry throughout the fall season.

once again this weekend those big changes and time to dig out the winter coats and maybe even an umbrella as we see the mist and drizzle along the coastline. upper 60s today. we'll drop it back to the upper 50s over the next several days. mike, how is it looking now for the morning commute? >> continued backup at the bay bridge toll plaza. the most significant change over the last few minutes. metering lights turned on just after 6:00. all lanes have now filled in over the last 15 minutes. slowing, no slowing in the freeway. slowing getting on the decline to san francisco. they may slow metering lights down a tad bit. contra costa county southbound

6:23. welcome back to "today in the bay." we have live pictures of ballot counting happening in philadelphia right now. a lot left to be counted in the city of brotherly love. >> from team trump to team biden and everyday americans, everyone watching the count in philadelphia. here is randy gyllenhaal. >> reporter: there are plenty still to be counted, the bulk of them those mail-in ballots.

why the delay? the pandemic. many deciding to vote by mail in historic numbers. you combine that with a state law that does not allow counting until 8:00 p.m. last night, and so what we have is a nonstop operation happening here at the pennsylvania convention center. 24/7 counting since the polls closed. as we've been reporting for weeks we may need patience in pennsylvania. this is not unexpected. it could take another day or even more. that counting continues. the numbers we have right now, there are about 350,000 mail and absentee ballots that were cast by voters. so far only 40% of those have been counted, less than half. and we know the majority of mail-in ballots are coming from registered democrats. across the commonwealth of pennsylvania more than a million votes have not been counted. here in philadelphia officials say they still have to get a lot of the in-person votes counted as well. bottom line it is a combination of massive turnout and the

historic number of ballots that will require plenty of patience. the results in pennsylvania still unclear. we should get more of an update this morning. in center city, philadelphia, randy gyllenhaal, "today in the bay." >> we are waiting and watching. the good news here we didn't see a lot of overnight violence so that's very good news. up next on "today in the bay" our decision 2020 coverage will continue with just minutes to go before the markets open this morning. we'll see how they are reacting. the futures have been up so far. our own scott mcgrew is keeping his eye on the stocks this morning and will show us how investors on wall street are reacting to all the political uncertainty.

good wednesday morning to you. thank you for joining us. i'm laura garcia. >> and i'm marcus washington. scott mcgrew is here as well. i know the markets are about to open. i know investors at the presidential race lingers on. >> it does linger. the stock market does not like uncertainty. you could make a logical argument the stock market doesn't care what party is in charge. it just wants center and it prefers that there be one party in charge because that manages -- that increases the chances of things like a

stimulus. you see the countdown to the opening bell on wall street. we expect more money to move into tech stocks like apple and google have been considered safe havens, the we we considered gold. so we do expect the nasdaq to take quite a hop this morning. the fed is also meeting as well. we have president trump last night saying he thought he had won. here you see the electoral map with the states still outstanding. not only does he not have the 270 needed to win he has fewer electoral college votes than biden. now the president may very well win re-election but that will take days to figure out. we are wait for the stock market to open. we expect the dow to stay steady as investors sit back and wait and put their money in safer places. >> all right, good deal.

morning. let's look at the roadways. the maps show we have some slowing, also shows the backup because the metering lights are on. green overall. southbound 680 and a crash over there as you head south where i think it's slow on the 242. three vehicles there. the bay bridge toll plaza has the metering lights on. no problems out of the maze. we knew about this one. we predicted it. back to you. >> back to our election coverage. voters have passed proposition 22 which means ride share and app delivery drivers will still be considered independent contractors. >> "today in the bay's" cierra johnson to break down what this means for the drivers and riders.

talk to us. what does this mean? >> reporter: well, it means that the gig industry really put a lot of money ahead of this prop to get it out there. the passage means app-based drivers, those who deliver food and do the ride sharing, would be defined as independent contractors. prop 22 includes a mandate that app-based drivers are provided with benefits like minimum compensation, health care subsidies, vehicle insurance and training. opponents say assembly boat 5 that was passed last year. prop 22 eliminates benefits and replaces with new lower earning guarantees. based on the votes so far a spokesperson explains why. take a listen.

increase to keep cal train afloat. and with 100% of the votes now in it appears to have narrowly passed in all three counties. measure x will add a half cent sales tax generating about $80 million in annual revenues. all it needed was a simple majority to pass and got nearly 60% of the vote. >> california's 14th district and a portion of san francisco county. jackie speier has about 82% of the vote. her challenger has about 18%. >> a look at district 15 in the east bay. eric swalwell, once a presidential candidate himself, has a sizable lead over republican challenger alison hayden ahead 73% to 27%.

our current temperatures. in the south bay we're at 51 degrees. we're at 44 degrees in the tri-valley. we'll see temperatures elsewhere mostly starting out with low 40s in the north bay. areas of fog in san francisco. heading out the door with temperatures also in the 40s and 50s. a comfortable day. some low 70s by the bay. a look at a drop in temperatures coming up. >> got to use that car heater, kari. the circle at the bottom a little more slowing. some folks getting closer together for north 101. light traffic right now. a slowdown in contra costa county southbound 680 continues. there were three cars involved

>> reporter: yeah, marcus, laura, and it's really been an unpress decedented morning here the white house from the president's event inside the east room that for all practical purposes sure look like a political event inside the white house, and during that event the president with millions of votes left to count basically declaring himself the winner. >> this is a major fraud on our nation. we want the law to be used in a proper manner. so we'll be going to the u.s. supreme court. we want all voting to stop. we don't want them to find any ballots at 4:00 in the morning and add them to the list. >> reporter: we are told that the president has been talking to legal teams and is looking into several of the states that

are still a tossup at this point, those states that are still counting early ballots. laura, marcus? >> still a long way to go. tracie, let's talk about biden. what is he doing today? >> reporter: waiting, just like everyone else. we just got an update the campaign manager will be giving us an update we believe at the top of the hour so we should get more details in the next 15 minutes or so. they have said they have lawyers on stand by to fight any attempts to stop counting the ballots. early this morning he urged supporters to have patience. >> folks, you've heard me say it before. every time i walk out of my grandpa's house he would yell, joey, keep the faith. and my grandmom, no, joey, spread it. keep the faith, guys. we're going to win this. thank you, thank you, thank you.

>> reporter: so they are full of confidence after having pulled ahead late this morning in michigan but that one has not been call yet. another has wisconsin or pennsylvania and that trio of states is what they're watching very closely. >> well, we know that biden, like the rest of us, all waiting today. they've had a harrowing run through all of these different states. anything else he's doing other than possibly resting? >> reporter: yeah, you would think after having been here early this morning. nothing on the schedule we've been told but we'll wait for the update to get a better sense. >> jay, you've been following the trump campaign, what is he planning to do today, if you know? >> reporter: the same thing here, marcus. there's a lot going on behind closed doors but as far as his

public agenda nothing announced at this point. i would think we would hear from the president but, again, no clear indication just yet. >> thank you both this morning. 6:44. another look at the electoral count for you. 224-213. >> americans were presented with two different visions for our country and we're still not sure what they pick. >> first scott mcgrew, as tracie was just telling us, they even differ on how they're interpr interpreting this election result. >> while the voting is definitely over, the counting is not. they'll be counselling again in nevada, arizona and others. we're talking about legitimate,

legal ballots submitted or postmarked on or before election day. this just takes a lot of time. nevada saying we will not hear from them again until at least thursday. so you have that. president trump put networks in a pickle for sure as he falsely declared victory. so they would not repeat those claims. not only did he falsely declare victory, he's short of the 270 electoral college votes he needs. in fact, he's behind joe biden. he's also wanting the supreme court to decide the election. there is no constitution al mechanism for that to happen. again, if we stopped counselling now, which is what the president is asking for, that would disenfranchise millions of americans who voted legally, voted on time, in some cases

weeks ago. the supreme court is unlikely to take a case now. there is a constitutional mechanism for the house to decide the election. we're getting a little ahead of ourselves. this would be if they end in a tie. an even number of electoral college votes that means there could theoretically be a tie. some of the key states, starting with pennsylvania, which, again, has not been called for either camp. pittsburgh and philadelphia voted democratic while the more rural areas stuck to the gop. in the middle is home to penn state university. the same with georgia. even the small city of macon, surrounding county, they went blue along with savannah and atlanta. now atlanta voters mailed in ballots are still being counselled and will be key. biden is ahead by about 100,000 votes but not all have been

counted there. that long, thin county on the right-hand side, the eastern side, only 62% of the votes are in. they do favor biden by quite a margin but nbc has chosen to be conscious here. when a network or a news agency calls a state for a candidate, mathematically it means there's no way he could lose it. second, we expected this. it's okay we doan know who the next president is. there are 328 million of us living in the united states. a record number voted and this is just take to take time and it will be okay. >> thank you, scott. several battleground states are

up in the air. california went blue for joe biden. >> there were some surprises in county by county numbers. "today in the bay's" kris sanchez joining us live with a look at that this morning. kris? >> this morning would be so much easier if other states operate the way california did. california registrars have been counting votes for 29 days before the election so a lot of the counting was done and released on election night. as far as the results themselves not a big surprise joe biden got the majority of the votes here in california. california has gone overwhelmingly democratic. joe biden got 4 million more votes than president donald trump. california voters did turn out in record numbers. and while that boosted

democratic votes it boost ed republican votes. joe biden won overwhelmingly but donald trump did pick up over 10,000 votes from 2016. in contra costa county, joe biden still won but both together, he and trump combined, got about 40,000 votes less than in the 2016 election. but it was still a restless night for california voters focused on the national election. we know those votes will continue here in santa clara county. they will process some of the provisional ballots starting at 8:00 this morning. kris sanchez, "today in the bay." >> thanks, kris. 6:49 for you. a live look. look at this beautiful shot of san francisco, the golden gate bridge. just makes you want to go outside and just stand and look.

off into the sunset -- the sunrise, i should say. some of us have been up -- >> yes. >> meteorologist kari hall, you've been talking about some beach going if you can. yes, we have a couple days left of mile weather and sunshine. today high temperatures along the coast mostly in the mid-60s. you do still need a jacket. inland temperatures will reach into the upper 70s and a few low 80s. we'll see more clouds, the approach of a storm system will bring in spotty showers near the coastline and more clouds but we are going to see it off and on throughout the weekend high temperatures in the 50s. at times light rain moving in. a few hundredths of an inch of rain, maybe up to a tenth for

the santa cruz mountains over to san jose. we could see possibly close to a quarter inch of rain. we've been so dry. we're going to go straight from fall to winter over the next few days. bundle up and be prepared to pull out the winter coats next week. we'll talk more about that coming up. mike, how is it looking for the commute? >> well, kari, the bay bridge toll plaza metering lights showing some slowing. no problems on the approach or the span. after earlier crashes, typical in that area of contra costa county, i circled a crash. also through fremont, those are distractions on the shoulder. arrows show typical slowing patterns. no real problems. a little bit of build for san jose. back to you. >> thank you, mike. happening now for you violence in oakland overnight.

the ballot issue would have allowed public universities and states to consider race in admissions and government. prop 20 9 banned affirmative action. a ballot issue that would abolish cash bail system. the votes were not in favor of judges using a risk assessment tool with an algorithm to predict a person's likelihood of returning to court or re-offending. the abolishment would have really been groundbreaking for the criminal justice reform. california would have been the only state to abolish cash bail within the entire country. live in san francisco, cierra johnson for "today in the bay." >> reporter: and i'm bob redell live in oakland.

here are the latest numbers from the secretary of state's office with 71% of the votes reported so far, prop 15 is losing with 50% saying no. prop 15 would have loosened some of prop 13's limits on property tax increases. it would have allowed most possible taxed on current market value rather than the original purchase price. with 60% saying no, our election desk has called that proposition defeated though it's 71% of the vote tabulated so far. we believe the decision is firm. prop 21 would have allowed local governments to establish rent control on properties over 15 years of age. it comes after years of rising costs that forced young adults to move back in with their families. bob redell, "today in the bay."
