thanks for joining us. i'm laura garcia. >> i'm marcus washington. mike keeping an eye on that commute. first, let's start out with meteorologist kari hall. looks like nice blue skies behind you. does that mean nice blue skies today? >> yeah, we will see some sunshine today and, in fact, this is the last day we'll see these blue skies up until the weekend when we see a lot of cool temperatures and more clouds moving in. they're going to see a cold front arriving tomorrow and it's going to bring in some gusty winds and light showers to the bay area and then as we go into the weekend the off and on rain and chilly temperatures as we'll see our temperatures today reach into the 70s. get out there and enjoy it. we'll talk more about this and what's ahead coming up in a few minutes. mike, any issues for early morning commuters? >> we'll have changes ahead, of course. the build and the volume and the traffic. we'll look at the green sensors and i'm checking out some details from chp near the dublin

interchange in the middle of your screen there. no problems on the sensors and no slowing south of 580 and double check on what those details are coming up. drive towards the bay bridge and contra costa county at speeds. back to you guys. >> thanks very much. the presidential race still too close to call. joe biden has a narrow lead and president trump with 214. 270 is the magic number here. biden can outright win the election if he holds on to his win in arizona and nevada. >> the other battleground states we're tracking are georgia, north carolina and pennsylvania. these are five battleground states. election crews are still counting those ballots. want to give you a live look that's in philadelphia where a lot of counting is going on for the next few days and the latest we turn to nbc bay area tracie potts in delaware where joe biden's team is on standby. >> reporter: protecting the

vote. >> where are the votes? where are the votes? >> reporter: near phoenix, dozens of trump supporters gather at the elections building. some trying to get inside. security had to escort workers away. a similar scene in detroit where self-proclaimed election challengers tried to storm the room where votes are being counted. >> no candidate, no campaign, no political party is going to stop us from counting every vote in michigan. >> reporter: joe biden is projected to win michigan. president trump is suing there and in georgia and pennsylvania to stop the count or let his observers in. he tweets the damage has already been done. >> not a single republican has been able to look at any one of these mail ballots. they could be from mars as far as we're concerned. >> reporter: pennsylvania officials say it could be days before they're done. >> every vote is going to count. i'm going to fight like hell. >> reporter: biden is within

today take questions during a virtual final forum. two internal candidates who are both opd deputy chiefs and husband and wife. jason lando is a pittsburgh, pennsylvania pennsylvania. tonight's forum will start at 6:30. new details this morning, san francisco leaders may be ready to trade police budget cuts for less control on police reform. reporting supervisors today debate a proposal that would save the city millions in the short term during the budget crisis but the same deal would provide 6% raises once the economy improves. also limit negotiating power and police commission reform policy. critics are asking the board to reject that plan. right now sonoma county is the only county in the bay area still in the state's most restrictive tier. talking about the purple tier you see right there. the state, once again, failing to allow to begin more

reopenings this week. sonoma county in the reopening tier since august. comes as the top health officials warn a new rise of covid-19 cases. dr. mark gahly says hospitalizations and icu cases are up by double digits statewide. >> you know, marcus, in contra costa county they're set to tighten their restrictions again. currently in the orange tier or moderate level, but now there are four cases per 100,000 people daily. so contra costa county leaders are deciding to get out in front of that problems. >> things such as bars are no longer going to be able to serve alcohol unless it's with a meal which takes you back to the red standard. restaurants will need to go back to the 25% capacity rather than the 50%. >> right now the county is allowing indoor dining at 50%

capacity but the new restrictions will go into effect on friday. well, here we go this morning for you, 4:36 and a look at that forecast for you as you get started for today. meteorologist kari hall tracking that and the last day we can enjoy some nice weather out there. >> yes. so you want to make sure you're making extra plans for later today. just getting out the door this morning for the commute, we're starting out in the east bay checking out the trivalley. we're going to see those morning lows dipping down to about 50 degrees and it's all clear now. we'll see the mostly sunny skies continuing into the afternoon. take a look at the warming trend through late morning. if you're going to be heading out for lunch, you'll see the temperatures already in the 70s. we'll talk about a cool down for the weekend coming up. mike, how's that commute rolling around the bay area? >> well, kari, we'll go right over to the dublin interchange. over my shoulder. hey, look at this little thing over off to the left.

minutes. heading to the beach. that does sound refreshing. we have to turn back to this undecided presidential race. >> cnbc bertha coombs watching it all for us this morning. good morning, bertha. >> hey, good morning, marcus and laura. we have wall street set to open higher this morning following on yesterday's post-election rally. we saw the dow rising nearly 370 points although it did close off the highs of the day. nasdaq was their stand out. up 430 points or nearly 4%. in fact, the s&p 500 and the nasdaq saw their best post-election rally on record. investors focused on the possibility right now that this presidential race may result in a split government. tech stocks led the way on the belief that if we have a biden victory and a split congress, that would make biden's hope of raising taxes and post stricter

regulations on tech companies. health care also a standout there. you have a mixed congress. meantime markets overseas in europe and asia also higher today as we continue to await more election results. marcus and laura, back to you. >> okay. we're breaking up with your microphone, but i want to ask you really quick if we can. if the presidential race lingers on, what might we expect from investors? >> that is inissue. the expectation is that this will get settled in the next few days but if we get a situation like we saw back in 2000. it took 36 days for that to be resolved ultimately through the courts. that is going to weigh on the markets. and we still don't really know whether the senate will actually

here we go. a live look at the golden gate bridge. is it wednesday? is it thursday? >> it's friday eve. >> don't forget that. get one thing straight here. it's been a long week. >> it has been a long week but the team is all here. we're keeping it going. 4:47 for you this morning. and something to make you smile, a look at that forecast for today. meteorologist kari hall has been telling us about that. i am excited and hopefully get out and enjoy it while i can. >> yes, you should definitely get out today. take in some sunshine and some warm weather this is the last day of it. let's go through our hour-by-hour forecast. as we're starting out this morning, mostly in the upper 40s and low 50s. as we take it through noon, we're going to see those temperatures at about 77 degrees in livermore. 74 degrees in oakland and 71 in san francisco. going into the evening, if

you're planning to head out for a walk and, once again, taking that sunshine and getting in an outdoor workout we'll see temperatures up to 80 degrees in napa and 75 in fremont and in san francisco we'll drop it back to the upper 60s. and then for the evening, we're, once again, prepared for that sunset shortly after 5:00. and at that time, we'll be in the upper 60s in oakland, as well as fremont. but mostly 70s else where. as we go into tonight, it will cool off and we're getting ready for a cold front to move in. now, the popular vote on twitter was that you want some cooler weather. here we go with that and some rain moving through. some spotty showers off and on between friday a little bit of a break on saturday and then another round of some light showers on sunday. but overall doesn't look like it will add up to a whole lot here. let's go through the forecast and our outlook on how much rain we may measure and it's only showing a few 0.01 and possibly a tenth of an inch in the east

bay, as well as the south bay. there may be a few spots getting about a quarter inch of rain which will be pretty good and now we have the winter storm warnings going up for the sierra. want to show you how much we could possibly see here throughout the weekend into early next week. if you have trips planned there to the sierra, make sure you have the snow tires to prepare for the winter weather along with a lot of extra layers. i want to show you how much our temperatures dip here. we're looking at walnut creek in the low 80s today and compare that to the low 60s we'll have tomorrow and that's the kind of weather we'll see throughout the weekend and into early next week. so, once again, this is that last warm day before we head to winter for a little while. we'll talk more about that coming up. mike, how is it looking right now for the commute? >> looking better now, kari. the earlier issue over in the trivalley. here the dublin interchange that has cleared. some debris reported by one driver in the area. the map shows no slowing on 680.

the arrows show you where your typical commute build will happen and it is already starting to build a tad bit over there. the bigger look shows you no problems or slowing to the south bay or peninsula. a great drive in through san francisco northbound through 280 and maybe an issue near 280 actually washington street the update came in. so, no problems there on the freeway, but just to note there and the top of the screen, the golden gate bridge. we took a look at it earlier but i wanted to show you, again. chp did advise overnight patchy, dense fog across the span and right now a clear view and a clear drive. you can see that, too, marcus. back to you. >> thanks so much, mike. developing for you right now in southern california word of a sad end. the family of a 48-year-old l.a. county firefighter reported him missing and possibly kidnapped in mexico. now mexican authorities say that the body of frank agular had

been found. he had a condo down in mexico and that's where his burned remains were found two weeks ago. >> tragic. california attorney general bosara is leading a new lawsuit to limit the daca program. maryland, minnesota and maine have joined in that lawsuit. it accuses the trump administration of taking continued steps to diminish protections for children of undocumented immigrants. even after the recent supreme court ruling preserved the program. the suit cites a more recent order to fully restore daca and accept new applications which the white house is set to be ignoring. l.a. county seeing spiking numbers. it added more than 1,800 new cases to its total just yesterday. in the meantime, no mask, no shirt, no shoes, no service. call it the new covid-style for businesses in los angeles.

they're now allowed to refuse service to anyone not wearing a mask. council members signed off on that ordinance yesterday citing small business owners and their employees who are risking their own lives just to stay afloat. they said wearing a mask is one easy way to lower the risk. well, just when you think the season couldn't get any crazier for the 49ers, it does. the niners are dealing with covid crisis hours from playing in primetime tonight. so, look, the team shut down its headquarters in santa clara yesterday after wide receiver kendrick borne tested positive. three other players placed on covid lists. at the moment tonight's game against the packers at levi stadium is still on. meanwhile a cal football player tested positive for covid-19. cal is planned to play its first game of the season this saturday. it's bond, james bond. talk about a big role to fill.

meteorologist kari hall on what we can expect from the weather today. >> it is going to be a really nice day. make plans to get outside because this is the last one where we see temperatures in the 70s and also nice, calm, quiet weather. by tomorrow a cold front arrives and it will bring in high winds and some light rain. we could see that rain off and on throughout the weekend as we could see a big drop in temperatures, as well. only highs in the 50s. but today it is going to be in the 70s, a few low 80s, too, as we reach up to 78 in martinez. we'll see a high of 75 in palo alto. we'll talk more about the drop in temperatures coming up. mike, how is it looking right now for the commute? >> well, kari, you just mentioned palo alto. one in palo alto where i saw clouds across the camera. the rooftop of 101 right there just now. when we look at the map, no real impact to the speeds and on
