contra costa county. >> the news at 10:00 starts right now. thank you for joining us for this special election 2020 newscast. >> it's not jut about the vote count. many high profile republicans are joining the president in claiming election fraud without presenting any real evidence. let's start with the numbers. the electoral college vote unchanged. you'll notice in the last 24 hours because the races in five states are still too close to call. and four of those states could go to recounts. joe biden with 253 electoral votes. 214 for president trump. 270 is the magic number. the country is hanging on the results from nevada, arizona, pennsylvania, and georgia. in all four states, both candidates are within 2 percentage points of each other. and two are practically in a dead heat. in georgia, president trump has led, has the lead with less than

2,000 votes. >> it is 11:00 in the evening in maricopa county, arizona, where the count continues at this hour. the county intends to announce new results tomorrow morning. that batch could indicate if president trump is continuing to close the gap with biden there or if biden will win the state. nevada will also release updated numbers tomorrow morning. >> tomorrow morning and tonight we have a lot to get to. let's start with alice barr at the white house. alice, 1:00 in the morning where you are. not a lot of people are getting any kind of sleep. >> that's for sure. as you know, we moved back over to capitol hill. they kicked us out at the white house at 11:00. that does not mean that it's order, 11:00 eastern. you just laid out the state of play for these battleground states that everyone is jut watching so closely. you've got that on one track. the finalizing of the votes. and the election officials insisting they won't be

influenced by anything. they're sticking to the books. and then you have these legal fights being brought by the trump campaign. president trump did come out and speak. he was defiant. continuing to make baseless allegations of fraud on the one hand and then the counter point of joe biden who came out and spoke. he is asking for calm and faith in the system. at a fork in the road to the white house, a study in contrasts between the two candidates. tonight, president trump trailing joe biden to electoral map and claiming with no evidence whatsoever that the election is being rigged. >> if you count the legal votes, i easily win. if you count the illegal votes, they can try to steal the election from us. >> reporter: biden, on the other hand, projecting confidence and urging faith in the system. >> i ask everyone to stay calm. all the people to stay calm.

the process is working. the count is being completed. >> reporter: biden now has multiple paths to a win with tight races in all the unsettled battleground states. that includes the biggest prize, biden's birth place of pennsylvania, where elections officials say the vast majority of votes have been counted by early this evening. >> because it's a close race, it's not quite clear yet who the winner is. >> reporter: biden getting a boost from mail-in ballots, chipping away at the president's early lead from republicans who are more inclined to vote in person. the trump campaign a barrage of legal challenges. the judge quickly dismissed them finding no evidence of law breaking. while on the streets, protesters demanding their voices be heard and votes be counted. >> reporter: tonight, some prominent republicans are saying if the president has any evidence of widespread voter

fraud, that he should make public. if not, that he should let the counting continue. thank you. for the second night in a row hundreds of people are protesting at elections offices in phoenix, new york and philadelphia. ballots are still being counted. we showed you in phoenix. also in philadelphia, no reports of any injuries or arrests. >> we want to bring in our political analyst. the president is keeping the same narrative that he had before the election even took place. that there would be voter fraud, the election would be rigged. the difference is now, the votes are being counted and he's doing it from the white house in the middle of an election. have you ever historically seen anything like this before? >> no, not at all. it goes to certain types of ballots, under certain conditions. they're fought out in the courts and usually they're rejected. in this case, what the president is arguing is simply this.

any votes on election day are fine. anything that comes in through mail is not considered, in his mind, a legal vote. now, there is no basis for this whatsoever. a mailed in vote is just as legal as the voter does on that day. period. there's nobody who will tell you otherwise, except for the president of the united states. >> all right. things have changed in the last couple hours. high profile republicans getting on fox news tonight. the number one cable news country in the country and saying they will join the president and they're asking other republicans to join the president in talking about election fraud. how effective can this be for the president? how damaging kit be for the nation? >> i think this is a lot of 2024 talk. these folks are really trying to stage themselves to be in position to carry the trump mantle four years down the road. it is so unlikely that any of these arguments we've heard today will carry any weight

whatsoever so you might as well throw in. if you're thinking about running in 2024, and they are, and see if you can carry with you all that trump energy. that's what this is about as far as they're concerned. >> with us being at the brink of all the legal arguments about these courts, and how long they take and all this, how do we give book a path of unification for this country no matter who is president? we're deepening this polarization in our country. >> there is no switch you can throw for this. it's not as if, even if biden takes over, that everything is just peaches and cream beginning day one. there is a lot of work to be done. it is not getting done very easily given the false accusations being thrown out left and right. this will take an awful lot of work. not only on vice president biden if he is chosen but also everybody else. the more that people stiff arm

this, the more they reject the effort to come together, the longer it will take to find some way to heal. a long difficult road ahead. >> and last question. you bring up joe biden. he is taking high road. should he get more offensive in terms of putting this to bed and taking, claiming this victory that he is in the lead right now? >> biden has the votes on his side. that simple. the votes in pennsylvania will turn very soon in his favor. all you need is pennsylvania. he doesn't have to make any arguments. he just has to let it play out and he's asking people to be calm. in short, he's acting presidential. >> all right. larry gerston, thank you for being with us on this journey that we've been on the last couple days. not just the presidential vote count but in california, the

count also continues. a lot of statewide props that are too close to call. right now 12.4 million ballots have been processed and canceled. but election officials estimate 4.5 million are outstanding. they have 30 days to complete their extensive tallying, auditing and finally the certification. >> what about those props? where are we? four of the 12 have been decided. let's start with prop 14. it is leading. you see 51%. it would authorize $5 billion in bond money for stem cell research. prop 15, this is a big one. it looks like no as of now. this is property tax increase for businesses. the extra tax money would go to fund education. right now, not happening. also failing, prop 18 which would allow 17-year-olds to vote in the primaries if they're turning 18 by the general election. 18 other states, by the way, have adopted similar laws. it doesn't look line it would

it looks quiet now. >> reporter: it is. the number of protestors dwindling a little bit and i heard some rocks being thrown at the fence. meanwhile the street has been blocked off out here. the home in question is right there with the words, trump flashing on the side of the home. this protest has been going on for hours. at one point, there were about 75 to 100 people out here. now, this is what protestors are angry about. this mannequin from the roof with the sign around the neck that says, sleepy joe, cheater. police came out and convinced the man who lives here to tate down. we saw it in the video. the police took mannequin away. by this evening, protesters starth started gathering here. emotions were running high.

it is all pretty competitive in there. >> with the loss, the 49ers fall 4-5 on the season. they'll try to rebound in ten days against new orleans. anthony flores. nbc bay area. >> cal football is on hold. this saturday's season opener canceled because of covid. the bears were scheduled to play at memorial stadium. however, the cal players tested positive earlier this week. that plus the contact tracing that followed equals too many players in quarantine to put a team on the field. the game that was scheduled against washington will now be declared no contest. it is a troubling trend as we head into the holiday season. the u.s. adding more than 100,000 covid-19 cases today alone. that number eclipsing yesterday's previous single day record by more than 15,000. it is the second day in a row that the u.s. added more than 100,000 new covid cases. in california, the number is lower but still significant. more than 4,500 new daily cases have been reported.

a warning about a roving caravan of armed looters. they've hit a string of east bay businesses in the last 48 hours. oakland police say the thieves are taking advantage of the fact police are focused on responding to any post election demonstrations or civil unrest. >> reporter: thieves came through here like a tornado. a spokesperson for the alameda county sheriff's office says a roving caravan of armed looters stormed their way into this big five sporting goods store in san lorenzo around 9:30 last night. the group made off with items but no firearms. they went on to strike walmart across the street. >> they coordinate and communicate with each other. they're very mobile. >> reporter: authorities believe the caravan is also behind a midnight break-in at the shoe

store near san pablo avenue. richmond police say the thieves ran out with 100 pairs of sneakers which can cost anywhere from $200 to $600 a pair. police manage to make one arrest after chasing one person into san francisco. it was book election night when it first turned violent in oakland. one man was shot and killed by police after the group broke into a cannabis grow operation in east oakland. >> hundreds of people in an organized fashion. >> reporter: the owner didn't want to go on camera for fear of stoking race tensions but told us they destroyed cash registers. if you're wondering why the caravan of criminals is striking now, oakland police say this is

as mr. biden's lead continues to grow. biden now has 50.5% of the vote. the president has 47.7% of the popular vote. right now, b has received more than 73 million votes. that's more votes than any other presidential candidate in u.s. history. the trump campaign has already filed or threatened to file nearly a dozen lawsuits against states to try to stop the counting of ballots after election day. along with some other grievances. the map shows the five states in the president's legal cross hairs. four were announced in pennsylvania alone. also in georgia, michigan, and two in nevada. the trump campaign taking legal action over a variety of issues, threatening to sue for invalid ballots over nonspecific irregularities. and another threat in nevada claims that gop observers aren't getting enough access to watch the ballots being counted. in wisconsin, the president said he would sue to get a recount.

here. does a legal standing when it comes to the legal and illegal votes? >> no. of course not. i think he's talking about mail-in ballots but they're obviously legal votes and have been for a very, very long time in the history of this country including in oregon. they've been voting by mail only for a year. so i don't think there's anything there at all. >> professor, another issue. pre election polling. let's take a listen. >> these really phony polls. i have to call them phony polls. were designed to keep our voters at home and keep the illusion of momentum for mr. biden. and diminish republicans' ability to raise funds. they were what is called suppression polls. everyone knows that now. >> let's be clear. . of the polls were simply wrong but rigged is a different thing. from a legal point, does he have a leg to stand on in. >> no. first of all, yes, the polls

were really wrong. once again forecasts years later. we need to ask questions about why? i'm confident no one did that on purpose. but second, it is not obvious that the polls have any impact one way or the other on turnout. thishighest turnout in american history. >> you mentioned something interesting. you had maybe they don't have a legal standpoint. perhaps it's just to bring more pressure to the legal system. lindsey graham, senator, also ted cruz saying all republicans should now back up the president with these claims. would that help the president in terms of the legal impact? >> i don't know i don't have see a court overturning a vote count. i just don't think that will happen this year. i think they're unique. florida was really tied in 2020. there was no way anyone could figure it out. i think however the republican party may be considering a strategy of bringing into question vote counts in close states and therefore the

legislature sflepg and appointing second electors. that seems to be what's going on. that might happen if the election turns on a razor thin margin. but i don't see the litigation itself making a lot of sense. >> and last question for you. do the electoral college, are they bound? do they have to vote by what the people say in terms of the count in the states? >> so that's really interesting. the supreme court just decide ad case about that. some states require the electors to stick to what the voters said and the supreme court said yes. they do have to stick to it. not all states do that. so you could have an electorate that would jump shipment but it is really rare. >> we are living in rare times. people pen, arizona -- pennsylvania, arizona, nevada corks this happen? >> i don't think so. i think the electors are pretty

loyal. >> all right. we appreciate your time and your insights this evening. >> thank you for having me. >> the professor just mentioned, it was record setting voter turnout this election cycle. and one of the groups most responsible, latinos. it is the political diversity that continues to confound the pollsters. damian trujillo takes a better look. >> you saw the long lines on tuesday at this polling place in san jose's mexican heritage plaza. voters came out in droves. >> every vote should count. everyone who can get out the vote, who has the privilege to vote, should utilize that. >> they were critical across the country this year from california to texas on florida. but latinos proved ones again they do not vote as a single block. >> there are several blocks within the large latino voting bloc. analysts say latinos helped biden out in arizona and latinos

voters we talked to say they spent hours researching each proposition. one woman said she and her friends got together to discuss the propositions one by one. they all had one thing in common. that they take voting seriously. >> it was a lot. it was a lot this election. but i was okay with it. i had no problem. it wasn't a quick vote. you had to educate yourself with what's going on in the city. >> to hear more from our voters, check in with jonathan bloom. he has a full report. head to our website. >> how about this? the holiday season could come with an extra hurdle this year. a mandatory quarantine for california travelers. a closer look at the impact of having people quarantined after a holiday trip. >> california is that specially bay area are making a lot of progress in keeping covid-19

cases low and health officers want to keep it that way. >> 27 cases per 100,000 cases per day. nationally, in the bay area we're about four. >> reporter: the doctor matt willis and other bay area health officers are now focused on how to best avoid a holiday coronavirus surge. >> the safest way to protect yourself over the holidays is to not travel. to stay home. can. >> reporter: the bay area health officers are also discussing whether or not to issue an advisory for the holiday that's would include a seven or 14-day quarantine for anyone traveling into the bay area from out of state. so they don't bring the virus with them and then spread it. some travelers flying into san jose's airport support the idea and think people should already be doing it. >> i got here early so that i could quarantine. >> reporter: others say it's too much. >> i wouldn't travel because

nobody can afford to spent 14 days before they go before they actually do anything. >> i think if people are getting tested and they're good to go, they should be able to fly and not have to wait 14 days. not only are you traveling for a holiday, a week, but would you have to add two weeks on both ends. that's not very fair. >> reporter: the holiday travel quarantine is only up for discussion right now. even if it is used, health officers say it would most likely be a recommendation and not a mandate. >> remember, if do you travel, do everything you're doing here so that you're not bringing that virus back to the bay area. >> reporter: in san jose, nbc bay area news. >> the tsa says there have been a total of 19 confirmed covid cases amid screening agents across the three bay area airports. san jose has had the most with ten confirmed cases. sfo, eight, oakland international case, only one case. the most recent reported infection was at sfo on

sees 27 domain names they say were used by iran to spread disinformation as america prepared to vote in the presidential election. >> definitely an escalation of this kind of activity. >> reporter: shades of 2016 now with even faster technology and better reach. in some cases, posing as legislate news sites. the cyber security professionals say between the government and social media companies, most efforts to hurt our electoral process were beaten back. >> we are better prepared. i think the agencies, the companies are doing a better job. >> reporter: twitter flagging multiple tweets, spreading disinformation including some from our president. facebook, shutting down a group called stop the steal. aimed at delegitimizing the election process. >> we're not talking about recounts. we're talking about the legally tasked votes being counted. and the effort to stop that.

>> reporter: votes that were counted but a warning that fraud didn't end with the election. >> whatever side you're coming from, there are people out there trying to manipulate you. >> reporter: nbc bay area news. >> there's trouble in san jose. a former city worker is accused of sexual assault and taking bribes. william jerry was a code enforcement inspector. san jose police say several business owners, especially massage parlors have come forward saying jerry sexually assaulted them and extorted their businesses while he was on duty between 2018 and last year. jerry moved to texas and that's where detectives took him into custody. he's being held at the santa clara jail. his bail, more than half a million dollars. >> usually they're considered pets. this season, thousands of wamss were released in neighborhoods. they said releasing the wams there's help prevent the spread
