first those cold temperatures. meteorologist kari hall is looking at that. how long are those temperatures going to stick around? it's going to be a while. we have more mornings like this going into the rest of the week. and we're even seeing some freezing temperatures in parts of the north bay but we will stay clear up until about thursday. we'll start to see our next storm system coming in bringing some rain late and we will see off and on showers throughout the first part of the weekend. here is where we are right now if you're about to head out the door. we are seeing some of those freezing temperatures especially in the interior valleys. we'll have more on this in a few minutes. mike, how is it looking right now for the drive? kari, the speed sensors look fine for the freeways but we have a very serious incident to the south bay as we look at your maps. your main commute nothing unusual but in san jose we just got word from san jose's police department they have closed the intersection of brokaw because of a deadly crash there. avoid that for the morning.

a connector between 880 and 101. you'll have to take local roadways. meanwhile, a look at the bay bridge toll plaza. that is looking clear for the morning commute and no major problems. a smooth drive for the other freeways outside of that. we'll talk about the delays for the north bay coming up. back over to you. this morning a rocky start for the biden transition team. a look at the white house as the president-elect focuses on covid-19 and health care. the trump administration is refusing to take the turnover heat. attorney general william barr sent a memo to federal prosecutors around the country about investigating allegations of voting irregularities. the transition that's not really transitioning right now because of some delays from the trump administration. roadblocks -- a trump appointee in charge of helping with the transition, has not provided office space, security hernss and classified information agreed to in advance. biden officials say they have not ruled out legal action to make that happen. and attorney general william barr is telling federal prosecutors it's okay to investigate if they find substantial allegations of election fraud. >> president trump is 100% within his rights to look into allegations of irregularities and weigh his legal options. >> lawsuits must have basis and facts and evidence, and, make no mistake, there has been no evidence of any significant or widespread voter fraud. >> reporter: reaction from capitol hill as the president makes more baseless and disputed

allegations and fires secretary of defense mark esper. >> no problem. i consider firing everybody. >> reporter: president-elect biden is focusing forward speaking today on the affordable care act as the supreme court hears the case to overturn it. on monday he named a covid advisory group and urged americans to protect themselves from the escalating virus. >> i implore you, wear a mask. do it for yourself. do it for your neighbor. a mask is not a political statement. but it is a good way to start pulling the country together. >> reporter: the biden team says he'll reverse several trump policies on day one. so those policies include rejoining the paris climate agreement, the world health organization, reinstating immigration for mostly muslim countries. remember the trump administration shut a lot of that down. and he also wants to ensure and

day one that daca is in place, that policy that allows immigrants brought here as children to stay in the u.s. legally. all of those orders being prepared for the first day that biden is in office. >> a lot of those orders no surprise that he's making those particular moves. we'll be watching. thanks, tracie. it is 5:04. developing this morning a shake-up at one peninsula school district. the result of inflammatory tweets. las lomitas jon venverloh is stepping down. his wife tweeted and was widely criticized. people in menlo park have wide reaction. >> so many things are going on in the school district. they need to be super focused. >> he's not really responsible for what she said, but usually

birds of a feather flock together. >> venverloh's wife issued an apology blaming a medical condition for her lack of judgment. expressed reprehensible views that he does not agree with but wants to avoid being a distraction for the district. the u.s. hit another new record high for daily cases with 133,000 just yesterday. california has also seen a new surge. this graph we want to show you showing the daily new cases across the state since the start of the pandemic. you can see on july 24th california hit a peak with an average of 9,500. take a look at october and now into november. it's going back up averaging about 5,000 new cases per day. marcus, new hope from pfizer saying its coronavirus vaccine may be ready for the end of the

year. with a we followed developments yesterday. pfizer announced the vaccine candidate was more than 930% successful. one leading bay area expert says other vaccines are also moving forward. >> i think the others will be coming online in the late spring with enough being manufactured that we can really have -- get lots of people immunized with lots and lots of doses. >> many researchers are trying to temper the enthusiasm a bit saying final hurdles still have to be cleared. also making headlines the fda has issued an emergency use authorization to eli lilly for an antibody treatment that can be used to treat those over 12 with mild to moderate symptoms but atries tok becoming sick enough to require hospitalization. school leaders in san francisco and palo alto are

developing new time lines to return to in-class learning. "today in the bay's" cierra johnson is live in san francisco to break down the challenges both districts are facing and what a return to campus may look like for these students. cierra? >> reporter: yes, good morning. both of the districts are tasks with completing a very complex plan that would ensure both the safety of their students and of their teachers and this morning we're learning what those district plans could look like specifically san francisco unified. those plans need to be completed no later than december 8th. according to "the examiner" the district has until the 8th to release a plan that includes a start date for all elementary students. the plan so far includes a specific start date of january 25th. for some students with disabilities as well as students in first grade or younger. they have until january to create a plan for middle and high school students. the district has a lot to keep in mind as you can imagine in creating this plan including how

to incorporate social distancing and have proper ventilation. "the examiner" revealed a reopening could cost as much as $84 million for the district. sf unified is expected to release details of their progress of that plan at the next board meeting which is a week from today. and while the city's district works to create a plan, school leaders in palo alto have revealed their plan and if approved by the board the proposed hybrid model is expected to begin as early as january 7th. under the new plan the second half of the school year will look completely different than anything we have seen in years passed. they will have to enter due to specific times. there won't be lockers and students will be expected to use assigned seats and in terms of school lunches that will be grab and go style. again, nothing is completely finalized right now. both districts have to have their plans approved by the board so come january it's a possibility that thousands of students here in the bay area could be entering yet another

new normal as the nation works to get hold of covid-19. we're live in san francisco, cierra johnson for "today in the bay." >> cierra, thank you. a live look at the golden gate bridge with commuter bridge traffic down about 30% during the pandemic drivers may soon have to make up the revenue loss. people who drive from marin to san francisco may soon be faced with an emergency toll hike. this may go up as much as $2 with a final decision expected next month. federal emergency funds are running out and the bridge district says if the toll hike does not happen, there may be massive cuts. >> oakland councilmembers want to boost affordable housing options for people trying to make it in the bay. today they'll debate a resolution asking the state to allow affordable housing entities the first chance to buy foreclosed homes sold at auction. san francisco supervisors today hold a final vote on new eviction protections as well. the measure would temporarily restrict landlords from evicting tenants for not paying rent due

to the pandemic. 5:09 for you that morning. taking a look at that forecast outside for you. meteorologist kari hall has been tracking those temperatures for us and, again, another cold one but, you know what, kari, it is fall heading into winter so -- but this is colder than it normally is around this time? yeah, we are setting some records especially for our morning temperatures and then for the afternoons we are cooler than normal and we went from having record high temperatures to now record low temperatures all within a week, so we are looking at our morning temperatures in concord. right now at 33 degrees and the record is 36. so continuing to watch those numbers drop and watching the north bay where there are freeze warnings in effect for all of these areas shaded in purple including the valleys where we'll be dipping down into the mid-20s and we'll start out our morning well below freezing in a lot of these areas. we'll have to get used to it because we have more mornings like this and we'll talk about

that in a few minutes. how is it looking for the commute? kari, the freeways overall are looking all right. there's one in the north bay i want to warn you about. in the south bay as we take a look at the map, the hazard sign is on brokaw, a major roadway between 880 and 101. there's a closure there because of a deadly crash. i have a bigger view because over near mckey and capitol there's police activity. i'm tracking that as well. it sounds like an investigation. i'll let you know about that coming up. the rest of the bay on the freeways we are okay. there's one-way traffic control, important in the north bay. this is highway 37 just east of 121. so, laura, folks will have to use traffic control in that area. only one way, your car will be stopped periodically as you go back and forth. back to you. >> well, good thing they have you to tell them all about it. thank you, mike. 5:11 right now. still searching, still ahead the

netflix might suffer if we're not staying at home and, two, tech stocks like apple are so blue chip, so big and steady, they seem good places to park your money. now vice president pence was quick to praise that public/private effort cooperation warp speed for the vaccine success. pfizer executives reminded analysts and reporters pfizer's vaccine was not part of operation warp speed. on a happier note there are a lot of gadgets in the news. apple will have yet another announcement today. these used to be rare. they used to be in person. we expect apple will announce new laptops that use apple made chips instead of chips from int intel. if you're asking yourself, who cares? it's a reasonable question. as apple moves more and more things in house and uses common chips in its iphones and laptops, you should be able to expect to have some of the same experiences on all of the different devices it makes. you don't have to think how do i

we're looking at a cool morning but then at about 2:00 partly cloudy and 62 degrees. so nod bad. we'll see some of those temperatures mostly in the supper 50s and low 60s today. we're going to bring it up a degree or two above yesterday's high. and then for tomorrow still nice and dry but then on thursday we'll be watching our next storm system that will be moving in late on thursday with some spotty north bay rain. most of us will be waking up to at least a light shower on friday morning as we head to work. temperatures are also going to stay cool. we'll watch that for our upper elevations that may get light snow. we are mostly looking at rain with our saturday rainfall coverage mostly during the morning and clearing out for the afternoon. it does look dry by then. rainfall totals at this point looks like it will be closer to an inch further to the north but

most of us a quarter to half an inch of rain. models are backing off on how much we're going to see. we are going to potentially have at least a good soaker for some spots but our temperatures are, of course, the main story here with our highs only in the low 60s over the next several days. mike, you were watching something happening in the south bay. what's the update on that? >> we have a couple of incidents, a little more information, kari. thank you for starting with that. in the south bay we'll look at your freeways are fine but we'll zoom in to two incidents. one from "early today," the closure of brokaw, a deadly crash and they're likely to keep that intersection closed for many hours there. you can use trumbull. there's a police investigation. sounds like there was some sort of shooting. we're tracking that at the news desk. the rest of the freeways are fine with no backups because it's early for that one. back to you.

be at stake with high court hearings. supreme court justices and the new even more conservative majority will consider a republican led legal challenge. "today in the bay's" kris sanchez is live in san jose with a look at what this may mean for cover california policyholders. kris? >> reporter: hi there, marcus. for folks who have their health care coverage through cover california, the affordable care act, obamacare, whatever you want to call it, this is a troubling time. i we are still in the middle of a pandemic. first know that the supreme court with that newly sworn in conservative justice amy coney barrett is not expected to rule on the obamacare challenge until next year and any decision that they make would likely not impact your 2021 health care coverage because it would already be locked in at that point. set that aside for just a moment. next, if you're thinking we've been here before, you are right. this is the third challenge to end up before the supreme court

which upheld the law in 2012. 1.5 million californians under covered california. the 18 states challenging the aca are red states, say that the individual mandate is unconstitutional, a requirement everyone buy health care insurance. california and 19 other states asking the court to uphold the law say individuals can choose not to buy the insurance and that is not unconstitutional. cover california enrollment is open now through january 31st. speaking at a kickoff event health leaders spoke about the impact of aca in our state. >> while california has reduced the rate of the uninsured more than any state in the nation, we still have an estimated 1.2 million californians uninsured today.

>> reporter: president trump said from the outset of the administration without any replacement for it. this morning president-elect joe biden will make comments about the aca and the challenge going before the supreme court. by the way, his state, delaware, is one of those states joining california in trying to get the justices to uphold the law. in san jose, kris sanchez, "today in the bay." lawyers working to reunite families separated by the short-lived white house border policy are unable to locate the parents of 666 children. that's according to a new email obtained by nbc news. the new number is more than 100 higher than the 545 reported last month. the attorney leading the effort to reunite families explains that's because it includes children who did not have contact phone numbers. the new surge in covid cases in some bay area counties concerned about new rollbacks

could have a big impact on struggling businesses. "today in the bay's" bob redell joins us live in san ramon this morning. bob, contra costa county is one county seeing an increase in the infection. >> reporter: correct, laura. and later today the state will announce which counties can move forward in their reopening plans, which counties might have to move back. contra costa county is worried that sacramento might force it back into the red tier of reopenings. take a look at your tv screen. as you can see on this map contra costa and several other bay area counties are right now in the orange tier of reopening because they were able to reduce their covid-19 infections to a moderate rate of spread. but ever since coco entered the orange tier on october 7th and loosened restrictions in places like restaurants and other gathering places, the number of cases has increased. last week the health officer here cut back on the number of people allowed in restaurants, movie theaters and churches in an attempt to republreduce that.

santa clara county cases jumped to more than 350. hospitalizations are also up. dr. sara cody warns that santa clara county is trending back into the red, possibly purple tier which could then lead to more restrictions. the co-owner of the table restaurant in willow glen is urging the county to let her continue indoor dining arguing that restaurants like hers are not the problem. >> we're following all the proper procedures and the spike in cases are due to people gathering for halloween and private gatherings, so why don't you pope lease that instead of small businesses? that's just my opinion. >> we are trending ourselves right into the red and potentially the purple tier of the state's framework which, as you know, means a lot more restrictions. >> reporter: some doctors do believe that halloween parties and other private gatherings are

driving the recent surge in cases. the state will announce which must change their tier status. bob redell, "today in the bay." all right, thanks for the latest there, bob. san francisco supervisors vote on ex tenning two measures, one to protect workers from retaliation if they have to quarantine for becoming infected or exposed to covid. the other caps the fees delivery apps can charge. new details 12 former ghostship warehouse residents may reach a settlement today with the city of oakland over the deadly 2016 fire. the city attorney is asking councilmembers to approve a proposed settlement tied to the suit brought by former tenants. they're seeking each of them $7b,000 tied to emotional distress and loss of personal property.

the city previously settled with the families of 32 of the 36 people who died in that fire and one person who was severely injured. happening today san jose taking another step towards transparency with a new policy on releasing police video footage. it follows highly charged incidents during protests this summer following the death of george floyd. san jose police was asked to release the latest video footage but the department withheld the video. the new policy will clarify what the department must release. happening today vta leaders take the first step in the decision that in all likelihood will lead to deep service cuts. the agency is facing a huge budget deficit in large part due to the pandemic. the proposed cuts could amount to 30% of operations and a lot of commuter lines could feel the impact. the first in a series of votes takes place tonight with the final vote scheduled for next month.

prepare for his presidency and indeed yesterday he announced new steps in the fight against coronavirus including new members of his coronavirus task force. more about that in a minute. coronavirus has killed more than 7,000 americans since election day. emily murphy may become a household name. the trump appointee who releases funds for the president-elect to use in his transition. literally the desk space and the pencils and the security clearances, all the things you need to build a government from the roots up. kamala harris was there as well. i don't have video of richard pilger but he's the guy at the department of justice who is in charge of investigating election crimes. bill barr, who you see here, the attorney general, said yesterday federal prosecutors should look into allegations of election crimes and so pilger, who is in charge of election crime investigations quit.

there is lot of talk but very little proof by the people making the allegations. president trump said the actual allegations would be released, quote, soon. even fox news had a hard time with the white house's allegations. >> every vote to be recounted and every illegal vote -- >> i think we have to be very clear she's charging, the other side is welcoming fraud and illegal voting unless she has details i can't continue showing you this. i want to make sure maybe they do have something to back that up but that's an explosive charge to make. the other side is effectively rigging and cheating. >> now a reminder president trump essentially always says things are rigged. he said the 2016 election was rigged and he won the election in 2016. take a look at his tweets to ted cruz. the language may sound familiar. fraudulent win.

today or not we're going to have lows that are starting out in the 20s in parts of the north bay, the reason we have these freeze warnings for all of these areas highlighted in purple and we're also seeing the frost advisories near the coast. this will continue until 9:00 this morning and we're seeing a calmer wind and slightly lower temperatures. we'll have more mornings like this over the next few days. taking a look at where we are right now, a lot of us in the 30s and low 40s. so make sure you're wearing some extra layers. we've even seen some freezing temperatures in some of our inland valleys. but then as we go into today we're back into the upper 50s and low 60s. that's going to basically be a repeat of yesterday with the winds continuing to calm down. but we will have some changes on the way heading into late thursday. a storm system will start to move in from the north. looks pretty weak and will bring in light showers late on thursday night and parts of the north bay here we are going into friday morning with a

possibility of a wet morning commute, off and on showers fry d friday and early saturday. things should dry out saturday afternoon and sunday. most of the rain falls early on saturday morning and then we're looking much better for the rest of the weekend. it looks like the possibility of rainfall will bring us the potential of a quarter up to half an inch of rain. really nice to see a decent amount of rain in the forecast as well as sierra snow and we're looking at some cool temperatures continuing into the forecast heading into the end of the weekend. mike, how is it looking right now for the morning commute? we have a couple bigger incidents for the south bay as we look at your typical slowing for north 101 at 5:40 as we look at the map. it clears just before 6:00 and that's what we're seeing.

san francisco may take a big step towards addressing climate change through a change in its building code. today supervisors will consider banning natural gas and all new construction. if that ordinance passes they would have to have all electric power beginning january 1st. this would not aemploy to pply g buildings. last year the largest city required all electric power and new construction. certain taxis will be getting priority at sfo. an appeals court ruling favors taxi drivers who ten years ago started paying $250,000. then uber and lyft showed up. now the drivers will have preference over other taxi drivers. new this morning, take a look at this video from new delhi, india. not smoke covering the city. it's just air pollution. during the covid lockdown the
