it's a terrific tuesday this morning. mike has a look at that commute. we want to start out with the terrific temperatures. i don't know if that's a good word for it but this is a terrific day for you. >> yeah, absolutely. we are transitioning over toward winter so we kind of expect it but this has been a little bit colder than normal. in fact, near some record lows and we're going to see more of this chilly weather the next several days. by thursday your next round of rain coming in and that will be terrific, even some more rain moving in as we head into friday as well as saturday. we have cool temperatures but we're going to warm up and reach upper 50s to low 60s. we'll talk more about this, the sunshine and the changes as the rain moves in coming up in a few minutes. mike, are you seeing any changes for the morning commute? kari, we are but not for the favorable. we have the bay bridge toll plaza, the metering lights on

for about 15 minutes now and we see the backup packing in on the toll plaza and the approach and the span itself. it is slowing because of the volume so they may slow the metering lights down a bit. we look at the map, the rest of the bay shows a smooth expected commute except for here northbound 680 coming through fremont. we have that construction crew clearing a little bit late so they're slowing north in to sunol and the south bay incidents coming up. back to you, laura. >> thanks so much, mike. we begin with a transition of power in washington. overnight attorney general bill barr making headlines after saying improper voting allegations should be examined. the trump administration not making it easy for team biden to get started. >> "today in the bay's" tracie potts is following the post election drama. i know the president firing the defense secretary with possibly more firings to come.

>> reporter: exactly. some people being moved around within the administration as well on climate change notably but now this pushback on biden winning the election and making a transition into the white house isn't just coming from the campaign. it's coming from the government. roadblocks, a trump appointee in charge of helping with the presidential transition has not provided office space, security clearances and classified information agreed to in advance. biden officials say they have not ruled out legal action to make that happen and attorney general william barr is telling federal prosecutors it's okay to investigate if they find substantial allegations of election fraud. >> president trump is 100% within his rights to look into allegations of if irregularities and weigh his legal options. >> lawsuits must have basis and

facts in evidence and make no mistake there has been no evidence of any significant widespread voter fraud. >> reporter: reaction from capitol hill as the president makes more baseless and disputed allegations and fired secretary of defense mark esper. >> no problem. i consider firing everybody. >> reporter: president-elect biden is focusing forward speaking today on the affordable care act as the supreme court hears the case to overturn it. on monday he named a covid advisory group and urged americans to protect themselves from the escalating virus. >> i implore you, wear a mask. do it for yourself. do it for your neighbor. a mask is not a political statement but it is a good way to start pulling the country together. >> reporter: the biden team says he'll reverse several trump policies on day one.

those policies include rejoining the paris climate accord and the world health organization. they want to get immigration moving again for mostly muslim countries and put daca in place permanently for people who are brought to this country, immigrants brought to this country as children to allow them to stay legally. back to you. other top headlines spiking covid cases, 133,000 new cases reported alone across the country. california also seeing a new surge in cases following -- followed by a rise in hospitalizations and amidst the backdrop bay area school leaders are developing new time lines to return to in-class learning. cierra johnson with what a return to campus may look like for those students.

>> reporter: a very complicated ordeal of just creating a plan that would be safe for both students and those teachers. and we're learning that san francisco unified school district has to create that plan and present it in less than a month. according to "the examiner" they have until december 8th to release the plan that includes a start date for all elementary students, a start date of january 25th for some students with disablgts. the district then has until january to complete a plan for middle and high school students. the district has a lot to keep in mind when making that plan including social distancing. a reopening to cost as much as $84 million. sf unified will release progress at their next board meeting.

school leaders have revealed their plans and if approved by the board the proposed hybrid model is expected to begin january 7th. under this new plan the second half of the school year will look completely different than any of the past years. students will all enter campus at specific times using specific entries. there won't be lockers for students. students will be expected to use assigned seats and school lunches, believe it or not, grab and go style. things will look very different in palo alto. both are not approved until approved by the school board. the first day of school in san rafael so a big day there. a lot of anticipation. they haven't been in school for months now. things are looking a lot different whether you're learning from home or going in this morning.

cierra johnson for "today in the bay." >> and what a year because of it. thanks so much. the fda issued an emergency use authorization to drug maker eli lilly for an antibody treatment. it can be used to treat those with mild to moderate symptoms but could be sick enough to require hospitalization. making headlines, strong reaction to pfizer saying sits coronavirus vaccine may be ready before the end of the year. we followed the developments on "today in the bay." pfizer and bioentec said it was more than 90% successful. they say final hurdles will still have to be cleared. 6:07. councilmembers want to boost affordable housing options for people trying to make it in the bay. today they'll debate a resolution asking the state to allow affordable housing

entities the first chance to buy foreclosed homes sold at auction. san francisco supervisors today hold a final vote on new eviction protections. the measure would temp rarely restrict landlords from evicting tenants for not paying rent due to the pandemic. a live look at the golden gate bridge for you this morning. drivers may soon have to make up the revenue loss. poem who drive from marin to san francisco may soon be faced with an emergency toll hike that may go up as much as $2. federal emergency funds are running out. the district says if the toll hike does not happen there may be massive cuts. okay. so grab a cup of extra hot cup of joe there. extra blanket, if you will, because it is going to be a cold week across california. check this out. the road there remains open but chp had to escort drivers

through 2 inches of snow and up in the north bay a big chill with freeze warnings this morning. we're talking about this. we're heading into winter so maybe a winter wonder land of sorts here in california. i don't know. kari? >> it looks good to see that snow around the grapevine. we had the creek fire burning and that brought in moisture for those fires and hopefully we'll get a lot more containment and get those fires put out there. we've seen our morning temperatures starting out in the 30s so right now we are matching our record low temperature at 36 degrees and these are some pretty long-standing records. we are going to see our mornings start in the 30s. if you're going to let the kids out in the backyard in between home schooling sessions in palo alto a chilly morning so make sure they have a jacket on not

well, good morning. a very happy tuesday to you as well. we did see a lot more movement on wall street after that wild ride on monday. a lot of tech stocks on the nasdaq so that's why you saw such a bifurcation yesterday, big moves on the market after pfizer said its new vaccine was more than 930% effective. stay at home stocks like netflix might suffer if we're not at home and, two, tech stocks like apple are so big and steady they're seen as safe places to park money until you find a more lucrative place to put your money. vice president pence was quick to praise the public/private effort with pfizer. pfizer executives spent most of the day yesterday talking to analysts and reporters reminding them there was no agreement with

the government and they weren't part of the operation warp speed. a lot of gadgets in the news today. apple is going to announce something. we're not entirely sure what. here we see the iphone. talk about using common chips in its iphone and laptops. you expect to have some of the same experiences there. that's why this is important. it's why this is important, apple wants to get to the point where you have the same experience whether you're using an iphone or a laptop. you will know how to do things on one based on how you did it on the other. both microsoft and sony start selling new video game consoles this week. xbox today, playstation later this week. they're very large devices. you may have to clean out a lot of things on your tv stand shelves. i doubt many people have a slingbox but you can clear that out. dish network says it's discontinuing the hardware.

flying for the holidays? united is boosting its schedule hoping for a big bump in travel. 1,400 flights are being added, a 9% increase from current levels. other airlines are doing the same but the number of flights are still well below pre-pandemic levels. starting today pizza hut is selling plant-based beyond meat pizzas. the first pizza company to do so. meantime this week is really a good week to buy pizza and save, offering large pizzas for $10 and little caeser's not to be left behind is offering free throw delivery through sunday. the real winner is when two pizza companies go to war the customers are the big winners here. if you love pizza, hey, this might be the time to go out and get some or order it. and, you know, with christmas around the corner you could ask for more stretchy pants to go with that pizza. >> see, it's getting closer,

chilly morning start going to feel like it did yesterday with sunshine. temperatures reaching into the low 60s. spots like gilroy reaching 63 degrees and we'll see more low 60s for parts of the east bay. oakland today reaching up to about 62 degrees and some low 60s elsewhere across the inland parts of the east bay. as we head along the coastline, mostly some upper 50s here in daly city, 58 degrees. and 60 in palo alto. san francisco will reach mostly into the upper 50s today and our north bay highs will reach into the 60s for today with a light wind and sunshine but we are getting ready for some changes ahead in the forecast. we've been watching the potential for this rain that's been in the computer models consistently and starts to bring in rain late on thursday and we may wake up to some showers on friday. some off and on rain most likely continuing to move throughout the day. then we start to see at that rain tapering off on saturday. if you're making outdoor plans on saturday into sunday it's

coronavirus regains the upper hand. a live report next on which counties may soon be forced to take action to stop the surge and what it means for you. "today in the bay" continues right now. and a good tuesday morning to you am thanks so much for making us a part of your morning. i'm marcus washington. and i'm laura garcia. we'll check in with mike. it's been a busy one out there on the roads this morning. first let's check in with kari because it's another cold one this morning. yeah, we're having to bundle up once again as we are seeing the sun rise. we're going to feel more chilly air as well as clear skies throughout today. we are getting ready for some changes as that new storm system comes in late on thursday. we'll have some off and on rain between friday and early saturday. as we are looking at what to expect for today once again those chilly temperatures this morning creating some freeze warnings for parts of the north bay where we may dip down into the 20s. we'll talk more about this and what's ahead coming up.

mike, how is it looking for the commute? the big map looks it fine but a trouble spot for folks. the speed sensors, slow sensors at the toll plaza and that is what we find. northbound 680 still looks slow. even though the crew has not cleared from the caltrans grid the speed sensors are changing. slow from mission. the freeways themselves are clear. back to you. thanks so much, mike. to new developments in the pandemic the recent surge in covid cases has some bay area counties concerned about new rollbacks that may have a big impact on already struggling businesses. >> "today in the bay's" bob redell, contra costa county is one seeing an increase in those infections. >> reporter: correct, marcus and

laura. later today the state will announce which counties can move forward in their reopening plans and which might have to move backward. contra costa county is worried sacramento might force them back into the red tier of reopenings. take a look at your tv screen. as you can see on the map contra costa and several other bay area counties are in the orange tier because they reduce their covid-19 infections to a moderate rate of spread. ever since coco entered the orange tier and loosened restrictions and restaurants and other gathering places, the number of cases has increased. last week the health officer here cut back on the number of people allowed inside places like restaurants, movie theaters and churches in an attempt to reduce that spread. in santa clara county south of here which is also orange cases jumped to more than 350 on sunday. hospitalizations are also up. dr. sara cody, the county health officers warns that santa clara is trending back into the red

possibly purple tier which would lead to more restrictions. the co-owner of the table restaurant in willow glen is urging the county to let her continue indoor dining arguing restaurants like hers are not the problem. >> we're following all the proper procedures and spikes in cases are due to people gathering for halloween and private gatherings, so why don't you police that instead of policing small businesses. that's just my opinion. >> we are trending ourselves into the red and purple tier which means a lot more restrictions. >> reporter: some doctors do believe halloween parties and other private gatherings are driving the recent surge in cases. the state will announce at noon today which counties, if any, must change their tier status. reporting live, bob redell, "today in the bay." >> all right, bob, thank you. here is a closer look at new bay area covid cases. contra costa county reported

around 150. alameda county saw the most with more than 300. santa clara county had 250. new details for you, 12 former ghostship warehouse residents may reach a settlement over the deadly fire from 2016. the city attorney asking councilmembers to approve a proposed settlement tied to the suit brought by former tenants. they're each seeking $400,000 for emotional distress and loss of personal property. they settled with the families of 32 of 36 families who died in the fire and one person who was severely injured. pg&e credits newly installed devices for doing the job intended in lowering the scope of recent power shutoffs. during the past year crews have installed hundreds of sectionalizers in high-risk areas. it can stop the flow of electricity breaking power deliveries to smaller sections which better isolates high danger areas. a spokesperson tells "the

mercury news" about half as many customers experienced shutoffs with fewer lines to inspect when power was restored. happening today leaders in the north bay will provide an update on recovery efforts from the glass fire that burned more than 67,000 acres and destroyed over 1,500 structures. devastating harvest season for several wineries. napa county will give a new report on the fire and how pg&e is working with the community to restore infrastructure. disney is cutting back on more jobs at its southern california theme parks. disneyland and california adventure have been closed ever since the pandemic started and there's no word on when they may reopen. in september disney announced 28,000 layoffs. disney is not saying how many employees will be furloughed this time around. 49ers wide receiver kendrick bourne back on the covid list. he did not play against the packers because he tested positive. the next day the niners removed him after two straight negative tests. the team won't confirm this time

heading to city streets. 6:39. a shake-up at one peninsula school district the result of inflammatory sweet s jon venverloh is stepping down immediately. over the weekend his wife posted racially charged comments about vice president-elect kamala harris. the tweets have since been removed but were shared and widely criticized. there is mixed reaction. >> there are so many things going on in the school district right now. they really just need to be super focused. >> he's not really responsible for what she said but usually birds of a feather flock together. >> venverloh's wife issued an apology blaming a medical condition she says affected her

judgment. in his letter of resignation venverloh says the post expressed reprehensible views he does not agree with but he wants to avoid being a distraction for the district. the golden state may be well represented in president-elect biden's office. former east bay -- ebay ceo meg whitman is reportedly being considered for commerce secretary and l.a. congresswoman karen bass could run the department of housing and urban development. also l.a. mayor eric garcetti is among those being considered to lead the transportation department. joe biden's team is having a tough time getting ready. >> scott mcgrew, the trump administration not ready to acknowledge that loss just yet. right. it's standing in the way of the transition. biden can still prepare his people for the presidency and, indeed, yesterday he announced

new steps in the fight against coronavirus including new members of his coronavirus task force. more about that in a minute. coronavirus has killed 7,471 americans since election day. emily murphy may become a household name, the trump appointee who releases federal funds to the new president elect to use in his transition, literally the desk space and the pencils and the security badges and all of the things you need to build a government from the roots up. here she is at a senate hearing some time ago. kamala harris was there as well. i don't have video of richard pilger but he's the guy at the department of justice in charge of investigating election crimes. bill barr, the attorney general, you see here, said yesterday federal prosecutors could look into allegations of election crimes. pilger, in charge of election crime investigations, quit his job. there's a lot of talk about election crime but very little

proof provided by the people making those allegations. president trump yesterday said the actual allegations with be, quote, released soon, on twitter. even fox news is having a hard time with the white house's allegations. take a look. >> every legal vote should be counted and we want every illegal vote -- >> whoa, whoa, i think we have to be very clear she's charging the other side as welcoming fraud and welcoming illegal voting. unless she has more details to back that up, i can't in good countenance continue showing you this. i want to make sure. that's an explosive charge to make. the other side is effectively rigging and cheating. >> now as a reminder president trump essentially always says things are rigged. he said the 2016 election was rigged, and he won the 2016 election. take a look at these tweets after trump lost the republican caucus in iowa to ted cruz. fraudulent win.

there @scottmcgrew. 6:44 right now. the future of the affordable care act may be at stake. supreme court justices and the new even more conservative majority will consider a republican-led legal challenge. "today in the bay's" kris sanchez with a look at what this may mean for cover california policyholders. kris? >> reporter: yeah, a lot of folks might be worried about their health care especially if open enrollment is under way right now. what does it mean if this case is going before the supreme court again and we are in the middle of a pandemic. you should know that the supreme court with that newly sworn in conservative constituent amy coney barrett is not expected to rule on the obamacare challenge until next year. and any decision would not impact your 2021 health care coverage because it would already be locked in because of open enrollment. set that aside for just a minute. next, you might be thinking we've been here before and you are right this is the third

challenge to end up before the supreme court which upheld the law in 2012. now 20 million americans are covered through the affordable care act which includes 1.5 million californians who are covered under the california one. now the 18 states challenging the aca say the individual mandate is unconstitutional. that is the requirement that everybody buy health insurance. california and the 19 other states asking the court to uphold the law say individuals, in fact, can choose not to buy the insurance. cover california enrollment is open now and will continue through january 31st. speaking at a kickoff event for covered california state health leaders spoke about the impact of the aca in our state. california has reduced the rate of the uninsured more than any state in the nation. we still have an estimated $1.2 million californians uninsured today. >> reporter: president trump set

dip in the water, just walk outside. some of us are starting out below freezing. in concord and livermore. we're at 33 in napa. most of us are feeling some 30s to start on this tuesday morning. then take a look at our high temperatures. a little bit better as we reach into the upper 50s and low 60s and getting ready for more changes as we go to the end of the week. it'll be great to see this late thursday night. scattered showers friday morning and then friday off and on rain that looks at this point pretty light. then another round of some slightly heavier rain as we head into sunday -- or saturday morning but then it moves out by saturday afternoon. we're looking at the time frame there 2:00 a.m. and clearing out as we head to the evening and then on sunday it looks nice and

dry. in terms of how much rain we're going to see it looks like a lot of models are backing off on how much we're going to see getting close to an inch of rain around ukiah. not a really heavy soaking but it does look good for the sierra and the possibility of anywhere from 5 to 12 inches of snow here throughout the week. here we're looking at still some cool weather in the forecast. it will feel very much like winter and our morning will continue into the 30s. early saturday and clearing out on sunday with highs in the low 60s. mike, how is it looking right now with those chilly temperatures and drivers heading to work? >> looking like i have to get a couple layers. looking out on the roadway, the slowing north 101.

on the freeway that's normal. the police activity still blocking the westbound lane heading up to capital avenue. an overnight shooting in the area. meanwhile the closure from brokaw. a deadly crash happened overnight and they've been investigating that for hours. trumbull between 880 and 101. the freeways are smooth through the south bay. some slowing south 880 looks like a crash. an earlier crash cleared but there may be more complications and that construction crew is clearing. the only other slowdown between those and we expect that there. back over to you. >> thank you, mike. san jose's happy hollow is back open for business. members can start touring the zoo today. reservations are needed. the general public can start making reservations on friday. you can expect to see fewer visitors on your trip and health safety protocols in place. happy hollow has been closed

welcome back. it's 6:54. a quick look at our top stories. >> bob redell is following the spike in covid cases and what this could mean for you. bob? >> reporter: good morning to you, marcus and laura. california will announce which counties can move forward in their reopening plans for covid and which might have to move back. in san ramon, contra costa county, concerned that sacramento might push it back into the red tier reopening. this is a map of the bay area counties. you can see most of us are in the orange tier of reopening because the infection rate reduced to a moderate rate of spread. since coco entered on october 27th and loosened restrictions and restaurants and other places the number of cases has

increased. in santa clara county which is also orange cases jumped to more than 350 on sunday, hospitalizations are also up. dr. sara cody is the county health officer, warned that santa clara is trending back into the red possibly purple tier which could lead to more restrictions. reporting live here in san ramon, bob redell. bob, thank you. the u.s. hit a new record high for daily cases of the virus. yesterday alone there were 133,000 new cases of covid-19. and amidst the backdrop bay area school leaders are developing new time lines to return to in-class learning. cierra johnson with more on that. >> reporter: good morning. school districts have the task of creating a plan that would get students in class safely. less than a month to present that plan that includes a start date for all elementary students

that so far includes the specific start date of january 25th for some students with disabilities as well as students in first grade or younger. the district has until january to make the plan for high school and middle school students. palo alto revealing their plan if approved by the school board the proposed hybrid model expected to begin january 7th. under this new plan students will enter the campus at specific times. they'll have assign seats and lunches will be grab and go style. a lot going on. san rafael pre-k through 2nd grade, a lot of changes and a lot of adapting for both parents, students and teachers. back to you all. boosting affordable housing options. they're going to ask the state to allow the first chance to buy foreclosed homes sold at auction
