helping to keep our economy going. >> vice president-elect kamala harris says the incoming biden administration has an immigration plan for the first 100 days in office. that plan coming up next for you. the third hour of "today in the bay" continues right now. and a good wednesday morning to you this hump day. why not make it a wonderful wednesday. i'm marcus washington. >> and i'm laura garcia. >> wow. >> we'll check in with mike who has a look at the roadways for us. meteorologist kari hall, are there any changes today? yeah, it feels cold this morning. it will be slightly cooler today and we've also seen some big waves along the coastline. that will continue along our beaches. but we are also looking at some cooler and breezy weather for the rest of the week. and this weekend we are looking forward to some rain finally coming into the bay area. today we'll see the highs reaching into the mid to upper 60s and a mix of sun and clouds

every now and then. we'll see the sun really peeking through. we'll talk about the changes ahead in the forecast coming up. mike, how is it looking right now for the commute? >> well, wonderful this wednesday at the bay bridge toll plaza. no backup, no metering lights. we passed the 6:00 marker and still very little traffic. that's great. the map shows you a little slowing on the incline and also getting off and towards san francisco's fremont street exit area. so do watch that build. we'll track it. a smooth drive. a crash shows up in sunol. 680 south. we send it over to laura. >> a shooting near a gas station but they haven't released his name or a suspect description.

several police cars there as it's roped off as the investigation continues. this is san jose's 43rd homicide of the year and 2019 there were 34 total. a critical day tomorrow for the pfizer vaccine, when the fda will approve or deny its use here in the u.s. if pfizer gets the green light bay area teams say first vaccines will happen next week. the fda says data concludes the vaccine is 50% effective after the first dose and 95% after the second. doses will have to be stored in special freezers at minus 94 degrees fahrenheit. the chief medical officer is hoping there's a high demand and that people want to get it and they want them to know it is safe. we also know the importance of being able to convey the

safety of the vaccine and making sure that people do get vaccinated. >> meanwhile, up to 24,000 help care workers in san mateo are among those to receive the first vaccine. president-elect joe biden is also talking about vaccines. he's promising to vaccinate 100 million americans in his first 100 days in office. masking, vaccination, opening schools. these are the three key goals for my first 100 days. we'll still have much to do in the year ahead and, sadly, much difficulty as well. >> "today in the bay's" tracie potts joins us live from washington, d.c., with that plus the key member of the cabinet expected to be announced today. good morning, tracie? >> reporter: exactly, laura. good morning. breaking barriers, again, this person comes highly recommended

this morning by general colin powell who was a mentor. he will need a special waiver from congress because defense secretary is a civilian position and this individual has only been out of the military for four years. today president-elect biden will announce the first black nominee for defense secretary, retired general lloyd austin. nbc confirms two others pending, tom vilsack returning as agriculture secretary and congresswoman marcia fudge to head housing and urban development. biden just named his health team backing a promise to vaccinate 100 million americans in his first 100 days. >> the work ahead will not be easy. but we know what needs to be done. >> they've authorized tens of millions of vaccine doses will be available this month and we'll get it distributed very quickly. >> reporter: but the white house coronavirus task force warns it

will be late spring before we see a significant drop in cases and deaths. on capitol hill still no agreement on cope individual financial relief. the white house pitched deep cuts to unemployment. democrats rejected that. senator bernie sanders wants to add $300 billion for stimulus checks and senate leader mitch mcconnell suggests dropping everything lawmakers disagree on to pass a smaller bill before christmas. >> we'll be confronted with another request after the first of the year. >> senator mcconnell has put the job of firefighters, ambulance workers, sanitation officers, police officers in jeopardy. >> reporter: today lawmakers are expected to prevent a government shutdown for one more week. now lawmakers did get something done. the house passed defense spending. money for our military in such large numbers that they can override a threatened presidential veto.

>> tracie, speaking of the first 100 days, vice president-elect kamala harris has been outlining the incoming plan on immigration, which is certainly such a big issue for california. tell us about that. >> reporter: yeah, absolutely. she is speaking out about that and in a recorded appearance she said that they want to get this legislation to the hill within the first 100 days and that she and president-elect biden are looking for a more humane immigration policy. here is what she said. >> in our first 100 days we will send an immigration bill to congress, reinstate daca, repeal harmful and discriminatory policies like the muslim ban. and during our administration we will repeal indiscriminate enforcement policies that tear families apart and make us less safe. >> reporter: she mentioned reinstating daca, the program that allows young people who

were brought here as young people before they were 18 to stay legally in the united states. the trump administration tried to get rid of it. the courts have now spoken, and that program, for now, is back. homeland security announcing that they are accepting new applications and renewals of 300,000 eligible even though the administration may appeal that ruling. for now it's open. >> big changes already. tracie potts live from washington, thank you. 6:07 for you this morning. with cases spiking and strict shelter at home orders in effect most bay area school districts are forging ahead on target dates to return to the classroom. oakland schools want to bring the first wave of children back in late january but not everyone happy about this. concerned oakland teachers plan to protest ahead of tonight's school board meeting. san francisco schools eyeing the late january start. and new details on a new

decision from uc berkeley. some are feeling the school is sending mixed signals when it comes to the pandemic. according to "the chronicle" the university plans to close its on residence campus hall on december 18th. but under california's stay-at-home order, residents are told to contact student housing on an emergency basis if they need to stay in place over the holidays. the coast guard hsays a man scaled a railing to get close to beach boulevard and poe knmona avenue. a woman and her dog were swept away. she was rescued along with her dog. both are expected to be okay. not far from there, this video we got at mavericks and half moon bay.

volunteers and rescue boats were also on hand keeping a close eye on all of those surfers out there. the dangers of the water we've been talking about never turn your back on the wave. i can't imagine getting in like this. huge. >> we have to keep in mind those are experienced surfers. you don't want to be out there especially if you're just walking along the water. we have some pictures? let's get a look at what's going on. i'm hearing -- what pictures do we have? i'm listening to the producers. oh, okay. let's go to our forecast for today. we are going to see high waves for today, the surf advisory. look at how cold the water is.

imagine being swept up. you do have to be careful about that and we'll have the high waves for today. how it's a spectacle to see them crashing up that high. reaching into the low 60s this afternoon but we're going to keep off over the next few days. we'll talk more about some rain coming up. how is it looking for the commute? kari, there are some changes, overall very light commute. some issues found on the report as we look at the south bay map, the bottom of your screen. an alert from 85 north, one lane is blocked. there's slowing. the other hazard sign is for the activity on center road.

and a live look at the bay bridge toll plaza shows you coming off the 880 overcrossing you have a line as well. things may slow down. we may see the metering lights soon because there is a crash reported on the fremont off ramp right on the san francisco side of that westbound upper deck. we'll track these changes and more coming up. well, good morning to you and a very happy wednesday to you as well. a lot of ipos this week, an advertising company starts trading today. also c3ai trading under ai, artificial intelligence, on the new york stock exchange this is the same guy behind siebel systems. his new company is worth about $4 billion. doordash will make its debut this morning trading under the symbol dash after a very successful ipo last night pricing shares above $100. far more than even the company was asking for.

doordash at a valuation above $30 billion. a few months ago private investors thought doordash was worth about half of that. now doordash debuts today. airbnb tomorrow. so it's a big week for ipos. they're kind of opposites when you think about it, doordash and airbnb. doordash thrives in the pandemic because so many of us don't want to risk going out. airbnb suffers because so many of us don't want to risk going out. when the pandemic end that relationship sort of flips. airbnbs will be more popular. will people still pay a lot for delivery when it's perfectly safe to get the food themselves? tesla once again going to sell more stock, something that normally drives investors crazy because it dilutes the value. shares have been going up so fast they don't think you'll hear much objection. elon musk says he's moving out of california to texas. he says about california if a team has been winning too long they do tend to get a little i

complacent, a little entitled. california has been winning for too long. now it should be noted while musk is taking this principled stand he's also moving to a state that has no income tax and no capital-gains tax and he's the second richest person in the world. wall street very much keeping its eye on the talks over a coronavirus relief bill. all of a sudden there's a player three in the game, steve mew xhin a mnuchin have made a suggestion to reduce the amount of extra money people would get in their unemployment checks to $300 a week and a one-time $600 check. neither side seems to like that idea very much, marcus and laura. so we'll continue to watch these negotiations that are really stumbling lately. >> scott, before you go, let's talk about vaccines. california has ordered a lot, enough to vaccinate its people over and over again. >> yeah, bloomberg was reporting

that. canada has the most vaccines of anybody anywhere and that's followed by the uk and australia which is amazing. they have a map that shows the rich countries and the poor countries and the green is good and the yellow is not as good. this is the number of vaccines ordered. japan has ordered more tan we have, but this is really a good map of showing in a pandemic not everyone has equal access to medicine. it is something that has been true for hundreds of years and is true today. again, the u.s. not very high up on that list. japan has ordered more vaccines than we have so far. >> you feel bad for those developing nations, too. thank you very much, scott. 6:18. american airlines will offer at-home covid tests for passengers on domestic flights partnering with let's get checked. the tests will cost an extra $129.

temperatures reaching into the upper 60s and also some mid-60s for much of the east bay. we'll see some breezy winds today as well as a few more clouds in the mix. it won't be as windy as we've seen recently. the coastline still very mild here reaching into the upper 60s for the north bay. as we go into the forecast, a lot more changes here, some good changes. we've been waiting on some rain. it looks like we start to see it moving in on saturday and mostly starting out with some light showers kind of off and on. we may see another round of rain coming in on sunday. and this one looks to be slightly heavier as we go into early monday, that starts to taper off. we are looking at a couple rounds of rain even though with all of that rain coming through this is not a significant system and only looks to bring us anywhere from about a tenth to a quarter of an inch of rain. we may see higher amounts further to the north. looks like ukiah could get close to an inch of rain. that would be really nice to see

because it's been so dry, every little bit helps. as we get closer to the holidays we may be seeing a change in the pattern that could allow for more rain to come in but expected to be a cool and showery weekend for parts of the bay area. let's head over to you, mike. how is it looking as you sit on your shelf there? kari, looking over here and perusing the bay, a crash on the right side of your screen. that's sunol south 680 around the highway 84 merge. it's a distraction because i see a little slowing over there. the rest of the bay shows a nice pretty green drive. over to the bay bridge is easy. the bay bridge itself, there's slowing and there's an issue on the fremont exit that will possibly cause this volume and the slowing to result in metering lights. the live look shows us the backup off the overcrossing. the middle lanes has been relief off the middle lanes so we are not sure because of the lighter december traffic and the lockdown traffic we may not see metering lights. we'll track it closely.

a shark attack in maui is putting a well-known surfing competition on hold this morning. the maui pro will not be happening anytime soon. it comes after a recreational surfer was critically injured near the bay. we don't yet know what kind of shark it was but look at this. the photo showing the surfboard with the bite mark 17 inches wide. the victim is now recovering. on a much lighter note, take a look at this. a big fish tale not to mention the body to go along with it. this is a photo taken of a nine-pound goldfish just taken in south carolina. the fish was found by a crew studying fish stock. after this photo was taken they threw the fishback into the lake. >> that is crazy how big it got. >> imagine someone bringing that home, one of the kids, mom, can we keep in? >> i don't have a tank big enough, no. put it in the bathtub.

"today in the bay" continues right now. good wednesday morning to you. thanks for joining us. i'm laura garcia. >> and i'm marcus washington. let's start with the forecast for you this morning. meteorologist kari hall tracking those temperatures and shaping up to be a nice day for us. yeah, we're calling this wonderful wednesday. we have a wonderful sunrise about to start. as we take a live look outside in san jose, just a few clouds there in the distance. as we are going to see more sunshine today we're still watching the big breakers along the coastline. we'll have cooler and breezy weather in the forecast going into the weekend, well, it will finally rain. and we're talking about that approaching system coming in. but let's get a look at today's highs as we reach into the mid to upper 60s. a little bit cooler compared to yesterday. we'll talk more about this coming up. how is it looking for the commute?

not wonderful but not bad. let's look at the bay bridge toll plaza. we do, unfortunately, have metering lights on now. traffic lighter. only ten minutes ago the lights were turned on and only the middle lanes where we see the backup approaching and over the 880 overcrossing. as we look at the map another set of good news, the crash has cleared from the exit so they may speed up metering lights and that will contribute to things moving smoothly in and out of oakland. the rest of the bay moves nicely. the east bay coming up. almost two weeks after thanksgiving health leaders say predicted surge in covid cases is here and the numbers are rising. the availability for those in critical icu beds they're getting lower. cierra johnson is live in san mateo county to break down where the region stands right now. cierra? >> reporter: yes, good morning. well, before thanksgiving health officials made those predictions that in the two to three weeks after thanksgiving we would see

a surge in cases and based on the data and number of available icu beds we believe we are there right now but health officials are also worried that we don't have the full scope because we don't have all of the data. let's break down exactly where we're seeing the lowest rate of beds. so right now the biggest concern those icu beds, santa clara county 16% of their icu beds are available. here in san mateo county as well as marin and sonoma counties, they're all in the red meaning they're at less than 15% availability as well. right now dr. anthony fauci says that full fallout from the thanksgiving holiday has not yet been felt and there's still more concern about another surge coming. some people mingling and traveling over christmas. locally emergency physicians are seeing an increase in the number of people coming in to get tested with concerns not knowing when the surge could end. >> our hope is that with the

vigilance people exhibit and with the vaccine around the corner that these are things that will, again, hope to mitigate and kind of contain the surge. >> reporter: and as dr. shin with stanford mentioned strong strides are being made with the vaccine which is important but it is crucial for folks not to let their guard down during the holidays or in the recent surge that we're in. right now it is important to note that as counties fall below that 15% bed availability threshold they will be forced to enact some of those tougher restrictions that we've seen in five bay area counties. regardless of where their decision is now to stay open if they hit that less than 15% threshold they will be forbes eo shut down. we'll let you know if that happens in the surrounding areas. cierra johnson for "today in the bay." >> thanks, cierra. the national restaurant association is confirming

110,000 restaurants have now closed across the u.s. since the pandemic began. closer to home one san francisco restaurant owner says he wants his money back from the state. under california's new stay-at-home order the blue light is back to takeout only and minimal staffing. the bills for state and local licenses, however, keep mounting. the restaurant owner says as long as he can't fully operate those payments should be returned or forgiven not deferred. >> please forgive these permits and licensees during this time. >> we're going to file a lawsuit on behalf of all the restaurants in california, against the state and against various counties, who have kept their money in order to get the money back. >> in the meantime in los angeles a legal challenge to the county's outdoor dining ban has a judge demanding the county prove it contributes to the spread of covid. new details for you, several

bay area counties now have a new plan to limit panic buying during the shelter in place. so the solution, allow more people in grocery stores. "the chronicle" reports that alameda, contra costa and marin counties, those stores now allow up to 35% capacity instead of 20%. california grocers association says it would cause long lines and panic buying. san francisco is at 20% and santa clara has a 25% cap. governor newsom is looking at the low end of next year's projected tax windfall. analysts earlier this year pegged it at $26 billion. the "l.a. times" reports newsom now believes it will be about half of that, $15 billion. "the times" reports councilmembers are starting the tough task of painful budget cuts. right now the plan includes a lot of furloughs and draining city reserves trying to hold off more drastic plans including job cuts to the police department.

new this morning a big change when it comes to a ban on smoking inside of san francisco apartment units. in an unusual move supervisors rejected the proposal during its second vote yesterday. there are legal questions. under the proposal tobacco smoking in buildings with more than three would have been outlawed in public areas but inside apartments. the measure will be sent back to a committee. a live look outside for you at sfo. sfo was the first in the u.s. to require masks at all times at its terminals and rapid testing. accreditation including charles m. schultz airport in sonoma county, san diego and long beach airports.

right now at 6:40, huge, dangerous waves continue along the coastline today and we'll still have this high surf advisory continue until 3:00 today as we could see some of those breakers reaching up to 25 feet again today. we'll be tracking this as well as some incoming storm systems bringing us some rain. that's coming up in a few minutes. trump supporters appeal to the supreme court to stop joe biden from becoming president. the supreme court said no. >> and, scott mcgrew, an unusual ruling. >> it really is. it was basically a no. republicans in pennsylvania asking the high court to step in and reverse the state's certification that biden won.

the supreme court in a very short message said the application for relief had been denied. this was one of two losers for trump's lawyers yesterday. the pennsylvania supreme court also ruled against them. there is a case brought by texas and ken paxton that he wants the supreme court to hear saying that because states like pennsylvania and georgia changed their election rules last minute because of the pandemic that wasn't fair to texas. the governor of texas changed the election rules because of the pandemic. a group of lawyers including the former head of the american bar association has published an open letter calling for these three lawyers to be disbarred. rudy giuliani, sidney powell made allegations of fraud in front of tv cameras but not before a judge when under oath.

on tuesday we discussed the fact that lloyd austin will need a special waiver from congress to serve as defense secretary because the law, as it stands right now, doesn't allow somebody who served in uniform to run the defense department. some big-name democrats voted against the idea at the time. elizabeth warren says she will vote no on austin as well. the house easily passed the defense bill. the senate is expected to do the same. the bill has the support of both democrats and republicans but president trump says he'll veto it because he wants that bill which sets funding levels for the army, the air force, the marines and the navy to include a change of rules for internet sites like twitter and facebook. a rule change, by the way, joe biden supports but lawmakers said no to that idea. we'll be following what's happening in wash today.

again, austin being present ed today. i'll be tweeting about it. to our race for vaccine coverage. i'm in our covid crisis center to continue this weeklong special series. teenagers are now part of the vaccine trial for pfizer and moderna. there are a number of immunization kids need to get. a covid shot won't be one of them for a while. kris, what are your kids saying about this report? any reaction? >> reporter: they got a flu shot but they don't have to worry about getting a covid shot. nobody can at this point because according to the cdc they are just about last in line to get a covid vaccine. we did ask whether they think in

the interest of getting the community back to normal kids should be higher up on the priority list. >> i would think that's a smart way to go. >> if you want to attend school get the vaccine or online learning if you don't. >> school seems like a superspreader environment for all the kids as well as the staff. they will take it home to their families. >> reporter: dr. maldonado said there's no evidence schools are superspreader events mainly because kids are better about following rules, about hand washing and masking up and keeping their distance than grown-ups are. kids can return to school safely without a vaccine if the plan is to keep them in stable pods and socially distanced but only if everyone in the community does their part to stop spreading the virus.

>> right now it's pretty high. >> reporter: so here is where we stand right now moderna and pfizer are testing the vaccine in teenagers, it will include young children in the trials. some could get vaccines starting next fall. if it slows the spread, it's possible children could go back to school before they are eligible for a vaccine. i expect to hear more about how santa clara county will distribute its vaccine. marcus and laura? >> we're going to follow that and, kris, this is on the minds of many parents this morning, what does the testing show about kids and covid-19?

>> reporter: there's new data out as of jed about 1.5 million cases of covid in children nationwide. here in california kids from zero to 17 make up about 11% of cases, which sounds high, but they all recovered. they account for none of the deaths. they get sick, they get less sick, but they are contagious and keep masks on and stay away from their little buddies. >> thanks, kris. great job. 6:47. the nhl and san jose sharks appear to be getting closer to a return to the ice. a framework is in place for a 56-game season that may start january 13th. now if and when that deal gets done the sharks may have to do some serious shuffling here. abbreviated training camps may get started after christmas and at that point santa clara county stay-at-home order will still be in effect.

here is something good to share with you this morning. a new york family sharing sounds of inspiration and hope from inside their living room during the pandemic. ♪ the hockman clan called themselves the quarantine quartet. the family says they came up with the idea to perform on social media when all their concerts were canceled. the clan is based in new york. they're receiving so many attention on instagram, connecting with fellow musicians, even some here in the bay area. >> we're lucky enough to connect with two families that happen to be from the san francisco bay area. the curtis family and the del monte family.

for a run, head over to the east bay as we will see our temperatures starting out in the upper 30s. if you're late to start you're going to see the temperatures much milder as we go into late morning. as we see a few clouds mixing in. first starting in the north bay, the highs will reach up to 66 degrees in cupertino. up to 70 in gilroy. our east bay highs will be in the mid to upper 60s and we're going to see the mild weather. you'll notice it will be slightly cooler compared to yesterday so not as warm as we'll see more clouds in the mix today, some breezy winds, up to 66 for a high in palo alto and 61 in the marina district in san francisco. north bay highs will reach into the upper 60s. we'll see a high of 68 in napa. going through the forecast big changes coming our way. i'm so looking forward to getting some rain in here. we'll see the rain chances starting on saturday as we could see some scattered showers moving in especially by saturday morning into early in the

afternoon. then it looks like it takes a break. another wave of rain coming in. neither one of these systems is going to be a huge storm system coming in but it's nice to see at least that high pressure moving out of the way. very light snow in the sierra. here at home we're looking at the possibility of getting anywhere from a tenth to a quarter of an inch of rain. it could be much higher heading further to the north. ukiah reaching nearly an inch of rain and possibly up to half an inch of rain in santa rosa. as we track those changes we're also going to have some cooler air. we're going from the 70s we had to start out to the 60s today and then the upper 50s in the weekend forecast. always saying, hey, if we're going to be safe at home we might as well be watching some rainfall and that's exactly what we're watching for this weekend. let's head over to you, mike. how is it looking now for the commute? kari, in the south bay, although something popped up if

fremont as well. the south bay highway 87 off 85 a lot of slowing that just popped up over the last five minutes. there was a crash that happened on the transition ramp. one of two lanes was blocked but they may be running some sort of activity to clear vehicles so there's slowing there. chp issued an alert for the one transition ramp. i'm circling center road right around coyote. do watch the one stretch of center road and that will be for the police investigation we continue to monitor. as we look at the rest of the map. the crash south 880 around stevenson may be blocking a couple of lanes. a quick update before the end of the show. a live look at the bay bridge does show you the metering lights are on. they have been on since 620. a half hour, there's the net effect, just the middle lanes and 880 overcrossing. back to you. >> happening now for you cope individu covid-19 restrictions could last

live pictures from san jose. san jose police confirm a man was shot and killed on center road near monterey west of 101. it happened about 10 is near a gas station. police have not yet released the victim's name or a suspect description.

police are still at the scene investigating. this is san jose's 43rd homicide of the year. in 2019 there were 34 in total. it's 6:56. nearly two weeks after thanksgiving the predicted surge in covid cases is here. >> cierra johnson is live in san mateo county looking at the rise in cases as availability falls for those critical icu beds. cierra? >> reporter: yes, good morning. months before the thanksgiving holiday health officials warned us it's this time period, two to three weeks after thanksgiving we could see the surge in cases and based on the data, the numbers and the percentage of availability in icu beds we're seeing that we have hit that point. so just to break down exactly who is seeing what. santa clara county 16% of their icu beds are available and here in san mateo county as well as marin county and sonoma county, they're all in red meaning they're at less than 15%

availability. right now dr. anthony fauci says the full fallout from thanksgiving holiday has not yet been felt because the data is not in and he's also worried about another surge after christmas from people mingling and traveling over that holiday. so locally emergency room physicians seeing an increase in testing which could mean more cases or more people planning to travel. we'll keep you updated on the crucial icu availability of beds. live in san mateo county, cierra johnson for "today in the bay." with cases spiking and strict shelter at home orders in effect most bay area school districts are still forging ahead on target dates to return to the classroom. oakland schools want to bring the first wave back in january. not everyone is happy about it. concerned oakland teachers plan to protest ahead of tonight's school board meeting. new details on the decision from uc berkeley leaving some feeling the school is sending out mixed signals. the university plans to close

its on campus residence halls. this is for winter break on december 18th. under california's stay-at-home order residents are asked to not travel. students are told to contact student housing on an emergency basis if they need a place to stay over the holidays. well, before we turn to meteorologist kari hall, check out these pictures of large waves this is from carmel point in monterey county. take a look at the size of these. big wave surfers say these are some of the best conditions out there but, boy, do you have to be experienced especially at mavericks in the past few years as well. the waves are said to be between 25 and 40 feet. yeah, we are going to have some really dangerous conditions there, but the drop in warm weather. we'll see it cool off and watching some rain this weekend. how is the commute rolling, mike? kari, everything is fine.
