good morning. it is sunday, december 20th. thank you for joining us as we take a live look outside at san jose city hall, illuminated on a very cold morning. the last morning of fall. thank you for starting your morning with us. i'm kira klapper. vianey arana joins us with a look at your microclimate forecast. yesterday you predict ed was a beautiful day. >> it was. we're going to get a repeat of that. i wanted to say that a viewer said they always watch us with their cup of coffee, so cheers to them with my cup so we can go over the headlines of the

forecast that we have ahead. 37 degrees in san jose. it is cold but cozy. by 11:00 a.m. temperatures in the 50s. high pressure is sticking around and that will keep us sunny for this afternoon as well as slightly warm wher when temperatures peak. san francisco 50 degrees. i do want to show you the headlines we're looking out for. tomorrow is the first day of winter if you're awake at 2:02 a.m., you'll be able to officially welcome winter solstice and what's ahead. on the bottom it says christmas rain. i have an update on the model for that. i'll have the full forecast. >> we'll see you in 15 minutes, vianey, thanks. we begin with a shooting at a bay area mall during the week shopping rush before christmas. it happened at the great mall in milpitas just after 5:00 last

night this is in the south bay. someone shot a man in or near the old navy store. panicked shoppers went scrambling for safety. police ordered people to shelter in place and went from store to store clearing each scene. we spoke to a group of people who hid in a small storage room of the gnc store. >> it was really hot and we weren't socially distanced. it was suffocating in there. we all thought we were going to pass out. yes, it was pretty scary. >> the victim was taken to the hospital. we are awaiting word on his status. milpitas police tell us they do not have a description. now to a developing story on capitol hill where the stage is set today. for lawmakers to finally approve a new covid-19 relief package.

some long-awaited negotiations went well into the night leading to a last-minute compromise from democrats and republicans. they agredz on federal reserve emergency powers. now only a few small differences remain to be ironed out, so they say. a vote in the senate and the house is expected today under an emergency extension issued by president trump on friday congress has until midnight tonight to pass the nearly $1 trillion relief package which is expected to include stimulus checks and unemployment aid. this is only the second aid for americans since march. as the bay area and the rest of california continues to get hit hard by a wave of coronavirus infections the uk is reporting a new fast spreading variant of coronavirus. "today in the bay's" sergio quintana reports. >> reporter: california is fast becoming the epicenter of coronavirus infections as many hospitals across the state are

at zero percent icu capacity. reports from e.r. doctors are alarming. >> i go from critical patient to critical patient to critical patient, and it's like working with your hands tied behind your back. >> reporter: here in the bay area the icu situation is a little better but still concerning and this winter surge is not just hitting california and the united states. now parts of europe are shutting down through the holidays. >> sacrificing to see our loved ones this christmas so we have a better chance of protecting their lives. >> reporter: the united kingdom shutdown comes as scientists there discover what they say is a new strain of the coronavirus. a microbiologist with the tracking project tells me a new strain is interesting but not a cause for alarm especially as vaccines are starting to be distributed. >> we know the vaccines have proven to be safe and effective. we don't know what that means

with regards to the new mutation but we have no reason to believe it would make it, invalidate the protection it provides. >> reporter: it's important to note it has mutated several times to this point. the concern with the new strain in the uk it spreads up to 70% faster than previous versions of the virus. the best way to stop the mutation and any others is using masks and social distancing. >> just a good reminder for people to slow transmission down because that's how viruses continue to replicate and mutate through transmission. we have a way to stop the impact of this. >> reporter: with the moderna vaccine on the verge of approval, becoming the second to be rushed out to hospitals in a few days and several therapeutics already available, a spokesperson this weekend says doctors and nurses now have effective tools to fight the pandemic but they're overwhelmed by the sheer number of people getting infected. sergio quintana, nbc bay area news. and nearly 6 million doses of that moderna vaccine are slated for distribution starting

today. the first inoculations are expected to go into arms tomorrow. this as all the cdc irons out the latest details regarding recommendations. yesterday a cdc advisory panel voted to recommend the use of moderna's covid vaccine for americans 18 and older. the next step is for robert redfield to sign off on those recommendations. the agency needs to vote on vaccine allocations for the next two phases of the rollout. more people received the pfizer vaccine yesterday at el camino health where they received more than 900 doses of the vaccine. they will be split among the mountain view and los gatos hospitals. infectious disease specialists and other frontline workers will be vaccinated first. >> we are all very excited, worked hard to get to this point. it's light at the end of the tunnel for all of us.

>> el camino health tells us all will be vaccinated by spring 2021. a live look shy of 7:07. this is sfo where despite warnings from health leaders thousands of people are still traveling. tsa saw a record number of passengers throughout its checkpoints. more than 1 million people were screened on friday. the last time numbers were that high was the friday after thanks giving. tsa officials took to twitter to remind people if they must travel wear a mask and follow cdc guidelines. the number of covid cases has been rising. a look at the last four months. back in september the state had more than 4,300 cases. the next month it dipped going down to about 3,400. and november when cases began to surge.

last month the state had well over 11,000 cases. and on friday the number hit nearly 44,000. all of this is overwhelming our local hospitals. here is where the bay area stands in terms of icu bed availability. as a whole the bay area has just 12% of icu beds available. most of the bay area is in the red. that means we have fewer than 15% of icu beds open. san francisco and napa counties are doing better there. they are in the orange. alameda county in the yellow has icu capacity at about 30% open. after a successful run in san jose self-administered covid testing is going to gilroy. testing available at the south county amex. it's free. you don't need an appointment. the site is open monday through wednesday 11:00 a.m. to 5:30 p.m. before christmas eve. a trained staff member watches.

voted, he went public and congratulated president-elect biden and said the phrase president-elect, but he warned he had a meeting with republican senators of which i'm not sure tommy tuberville was in the meeting because he is not yet a senator. he gets sworn in january 3rd. he said objecting to this vote on january 6th would be a bad vote for your colleagues so be careful. the point being all that he would accomplish is force a vote by the full senate to essentially reaffirm. you have a bunch of republicans who would feel they have to make a choice and somehow virtue signal to the trump base and it would look like the republican party is divided about a simple thing like the rule of law and democracy. so it is something that i think mcconnell is going to try to figure out how to keep tommy

tuberville from doing that. he is an extraordinarily inexperienced senator. he was in an interview, did not know what the three branches of government were after the election. he participated in no debates. we know so little other than he was a football coach and had some success at auburn university. >> very popular. chuck, if we could switch gears, you and i have been talking about this for months since the summer at least. it would only be the second package since march. where do things stand this morning? >> looks like they have it. they've come to what was holding things up yesterday where some effort to turn off a federal reserve money spigot of sorts having treasury and the federal

reserve have their own ability to issue some loans to various entities, even government entities if necessary, to fill in the gaps. republicans wanted to shut it off completely. they came to some sort of compromise. i don't want to get into too much of the detail because it is a small part of the deal but here is the big picture. congress didn't cover itself with much glory. a reminder congress only functions about once a year at best. it's usually when a crisis is at the point of no return or christmas or new year's is on the who ahorizon. it's an absurd way to coverage. you have members exhausted from it and four members who run everything. i would hope at some point this is a breaking point for how congress functions because they barely got it done. >> this is the truth as we know it from chuck todd. we won't see you next week so have a merry christmas.

let's talk about -- now i'll be thinking about that all day. where can i work from home. it's very cold as you step out the door. here is your temperature trend into the afternoon. plenty of sunshine. high pressure lingering. 40s and 50s on the forecast. look at san jose, 37 degrees right now. by 12:00 in the mid to upper 50s and today it will be slightly warmer compared to yesterday by a few degrees. mid-60s. san francisco's temperature trend 50 degrees now and by 9:00 a.m. finally start to trend upwards into the 50s, low 60s today in san francisco. here is a look at satellite radar. it paints a picture for what's happening now and what's to come. notice it's pretty clear overall. we are seeing reports in the north bay but you notice what's up ahead in the pacific. we have an approaching system

that could bring the possibility of some changes heading into monday and christmas. first i want to make sure you get your highs for today because we'll be in the mid-60s. in martinez, concord 52. san francisco in the low 60s. and you might be wondering what's the timing? i have good news. one still needs some work. the first good news is the models in terms of how much moisture we'll be getting. the second one is the timing of this. keep in mind as i go through the time line. we have a first initial storm that will pass by in through the creigh sierra area. some light rain and sierra snow. this will not be our big rainmaker that will bring

widespread rain. when i push the time line forward into wednesday and thursday and christmas day, look what pops up in the pacific, that surge of moisture that will come in and this is where we're still trying to work out the timing. right now the models are lining up. it could either move in christmas day as in the first half of the day or christmas night. so that's one thing that as we inch closer to the storm we'll have a better idea what we'll be expecting. another thing that, of course, i want to mention is winter solstice also known as, quote/unquote, the shortest day of the year. and that's when we expect to say, hey, it's winter. more details on the science. kira, i'll send it back to you. >> we look forward to seeing that, vianey.

high surf can be beautiful to watch from a safe distance. rogue waves can be deadly, and that was almost the case for one woman this week. fortunately for her a hero was nearby and accidentally recorded her rescue. "today in the bay's" garvin thomas has it in this morning's bay area proud. >> reporter: if there were ever such a thing as a pandemic-induced purchase, this drone would fit the bill. he bought it back in march when the first wave of stay-at-home orders swept over the bay area. >> we were just finding things

to do with the kids and bought it on a lark. >> reporter: josh grabbed the drone and headed to the coast. he heard the surf was big. >> i've always been fascinated by gigantic waves. >> reporter: when josh got to pacific state beach and launched the drone he wasn't disappointed by the video. >> i was looking at my phone flying out looking at the rocks on the north side and the waves were blasting over the rocks. it was really pretty to look at. >> reporter: it was when josh looked up, though, something else caught his eye. >> i noticed somebody looked like they had gotten owned by a wave, just knocked over, somebody with a dog, and they seemed to be rolling with the wave. oh, that's not good. >> reporter: a woman was in the high surf wave after wave pinning her to the sand. seeing no one else around josh tossed aside the drone controller and raced to help.

>> as i was trying to help her up she couldn't move. she was incapacitated. it became extremely clear this was a life-or-death situation. >> reporter: what happened next his drone running low on battery began to return on its own and caught video of josh struggling to keep the woman out of the waves, her dog by their side. the woman was too heavy for josh to lift himself, so all he could do was hold on, yell for help, and hope a big set wasn't on the wave. >> there was no way she would be okay in that circumstance. the clock was ticking. >> reporter: after what felt like forever two others came and together they were able to drag the woman to safety. >> oh, i think he's a hero. >> reporter: jeff and his team from north county fire were on the scene a few minutes later. >> she probably would have

succumbed to the water. >> reporter: josh was aware he had probably saved someone's life but it wasn't until her daughter came to retrieve the dog that the emotion of it all hit him. he realized he hadn't just saved a person's life but the life of someone's mother. >> it was so intense, that she didn't have to be out there wondering if my mom wasn't on the beach that day, she would still be with us. that's something she would never have to do. >> reporter: one week later josh still marvels at how monumental yet completely random the whole episode was. all he was hoping to do that day was capture some big waves. he ended up capturing something much, much bigger. garvin thomas, nbc bay area news. >> wow. it just gives you chills. that is an incredible story. 7:27. and we do have much more ahead

5:30 p.m. people will have to swab both nasal cavities while a trained staff member watches. results are received in about two days. apple says it is temporarily shutting down all of its california stores. the company says it's making the move out of an abundance of caution as covid cases here skyrock skyrocket. just yesterday apple decided to temporarily close stores in l.a. and then 24 hours later it's already expanded. customers can pick up existing orders for the next few days. usually the goodwill receives donations like clothes or appliances. but the ex-wife of amazon ceo jeff bezos had a different kind of donation. you may remember scott donated more than $4 billion in just the last four months. the money was split among 384 sites, one of them goodwill of silicon valley. they were award add staed a sta

>> california still ranks low in terms of departures but still the fact is we're not used to it. we're not used to people leaving and over the last decade we've averaged 80,000 to 100,000 people a year who have actually left the state. the population has been plaflat because of births and immigrants from other countries. it's happening. >> and why is it happening? is it the new work from home model? if you can work from home why not work somewhere where it's more affordable? >> that may turn out to be the case downstream for some, but for now the legislative analysts went out and conducted a survey to ask these ex-pats, if you will, why they left. three reasons. the biggest, it should not be a surprise, kira, housing. homes in california are 88% above the national average even if you want to rent in the state

it's about 55% above the national average. in the bay area those figures are even exaggerated even more. that's the biggest reason. income and taxes, yeah, they're fine. they rank about the same, ninth for incomes. 11th for taxes. the real problem here is hidden and it has to do with the folks at the bottom rung. the bottom 25%. their incomes are considerably lower than the national average in a state where the cost of living is very, very high. and when you have children involved, these folks say, you know what, we need to leave. those are the big things along with the political culture which people believe is extreme in california. imagine that. one of the three reasons. >> yeah, you're talking to a born and bred californian here. i've heard those reasons before. what about businesses. hp enterprise, oracle, tesla have all announced moves to texas.

>> yeah. if you're moving your business, that's the issue here, if you're a ceo, well, it's not the same because his or her income taxes will still happen if they earn it in california. but businesses that move there such as huleewlett-packard enterprises, they'll build a huge building in usaustin, ther are taxes in california for businesses are almost 9%. the corporate taxes in texas are zero. a goose egg. and then, of course, the whole question about labor. here we have a $15 an hour minimum wage starting in january where if you go to texas it's $7.25. $7.25. so you look at that and if you are a person at that bottom rung, once again, i know my housing is high here but, look, it will be a whole lot lower in texas even though i'm making less money. so you put all that together and those are some of the reasons that businesses have decided to up and leave.

but, again, let's keep this in perspective. while we're shocked about this it's not very high in terms of the national average. >> so what does this mean for california's future? will it have a great impact if it continues on this trend? >> you know, kira, i think there are two things that sometimes we don't think about. one, we're going to see very soon when the census is revealed, it may well be that california will lose at least one, maybe two members of congress, members of the house of representatives. that means we'll have less representation in washington, d.c., and a little less powerful than otherwise as our congressional delegation becomes smaller. the first time in decades. we talked about the families at the bottom rung who are leaving to get a shot at a better life. these tend to be servers, hotel workers, day workers, people like this who we depend on for the rest of us to get by and as
