also a spare the air alert day. no wood burning. some rain in the forecast by christmas. it's coming up in a few minutes. mike, that fog getting thick in the north and east bays. it is, kari, we're showing that on our maps as we take it to full screen. the amber, the orange highlighting there just like yesterday, that's where the overlay shows where the fog will be thicker and tougher to see. not as widespread. similar areas. the bay bridge moves smoothly and golden gate bridge. all easy conjunctions across the bay and no problem. the south bay, traditional spot should stick around for five or ten minutes. kris, back to you. breaking news where the chp is investigating a shooting that happened on the freeway overnight. it happened late last night at the cesar chavez off ramp 101.

all lanes of traffic were closed for several hours and the scene is clear but the answers are not. the chp has not been able to tell us at this point why the shooting happened or anything about the victims. one car did plow through the off ramp barrier. cierra johnson is asking for answer this is morning. when she gets them we will get them to you. we'll talk with her pe bottom of the hour. a live look at capitol hill where talks went down to the wire. the senate passed the $900 billion aid package just before midnight following the approval in the house. president trump should sign the bill some time this week. "today in the bay's" chris pollone is looking at the details, which, as we know, everything seems to happen. he's showing us what it means for our families here at home.

chris? >> reporter: yes, kris and marcus, what it means for families and for businesses that have been struggling during the pandemic is some relief from the federal government and we could start to see dollars flowing by next week. congress passing a new coronavirus relief package just before midnight, $900 billion with aid for struggling families and businesses. >> it doesn't go all the way but it takes us down the path, a first step. >> a big bipartisan majority recognize the incredible good it will do. $600 for people making less than $75,000 a year and $1,200 for married couples earning up to $150,000 with $600 more for each dependent living in the same household. forgivable loans for businesses and jobless $300 more weekly in unemployment. >> if you're out of work $600 isn't going to do much but $300

a week is huge. >> reporter: the vote coming on the same day president-elect joe biden publicly got his first dose of the covid-19 vaccine. the administration looking to vaccinations. the bill includes billions for transportation, schools -- >> there's some money in there for vaccine distribution. there needs to be more. >> reporter: the vote heads off a shutdown of the federal government which is funded through next fall. and because of a congressional rule this particular bill couldn't go straight to the white house for the president's signature. it should be there by the end of the week. the treasury department says some people could see their stimulus payments arriving by direct deposit as early as next week. live in washington, chris pollone, "today in the bay." >> so much help for so many families. thank you, chris. we do have more details, though, in the massive bill. the new relev has serious

implications for folks struggling in california. for one it means when this is all said and done some californians may end up receiving up to 70 weeks of pandemic-related relief. and jobless benefits. also $14 billion allocated for transit agencies including here in the bay area. b.a.r.t. expects to receive $377 million. again, the most in the bay area. restaurants and stores are sitting empty from this latest regional stay-at-home order which more business owners are wondering how long can we survive? "today in the bay's" jackie live with possibly good news from san pedro square. there is an effort to keep the recounts and businesses afloat. >> reporter: that's for sure, marcus. this morning businesses are continuing to ask for something they've been asking for months. the data that proves the

transition -- the transition, rather, of the virus is happening at their establishments. restaurants are not allowed outdoor dining, takeout only. a lot of them say they cannot survive on that alone. retailers while still open can only operate at 20% maximum capacity. supervisor matt haney is expected to introduce a resolution at a special hearing asking for clarity on how outdoor dining is impacting the spread. >> we're calling for an emergency plan to step in, to provide additional grants and loans. the federal government came out, said they're going to deploy additional ppp loans for businesses. i want to make sure we're ready to get those in the hands of businesses and to support them in applying. >> reporter: san diego county restaurants are now really in limbo tied to the battle that started when two strip clubs sued over closure orders. some businesses are defying an injunction that came down late

friday blocking the lower court decision that seemingly allowed restaurants to resume on site dining. the governor's office requested a stay. enforcement san diego has not yet resumed. the bay area stay-at-home order is to expire january 7th but may be extended. jackie ward, "today in the bay." >> thank you, jackie. with san francisco's return to the classroom plan now seeming to fall apart, supervisors will talk about how to speed up the process. the school board put the brakes on the first return in january and no return date for in-person learning. distance learning will continue at home. mayor breed is blasting not only the school board but the union saying they need to make more effort to get children back into the classroom. today nearly 40,000 doses of moderna's vaccine will arrive in santa clara county and the

forecast coming up. mike, how is it looking for the commute? >> you mentioned air quality. judging by the meter readings, the fog reading is not like it was yesterday in many spots. the south bay is showing a clear view with a little bit of slowing. that's where it was the last time we took a look. zooming out the maps, no problem. highway 84 back at speed. the altamont pass had slowing and maybe fog. a nice easy drive down the east shore freeway. a little slowing north and there are crews in the area doing paving. oakland shows you a good volume of traffic. there's no backup. back to you. up next, only three days away from christmas and if you

can't see so well like kari is talking about. a very happy tuesday to you as well. you know how facebook and google were facing allegations from states and the federal government. facebook and google got back together in 2018 to team up to fight those accusations if they were to come. "the journal" quoting sheryl sandberg as saying the agreement was, quote, a big deal strategically. the journal reporters got access to unredacted versions of the lawsuit to team up. the lawsuit brought by ten states alleges google made a deal with facebook not to compete with online advertising efforts. that could be illegal under antitrust statutes. the second part, agreeing to team up if accused of antitrust is not illegal but may show they

were very much aware their activities might lead to an antitrust allegation. waymo under alphabet umbrella is expanding taking up more space in mountain view. more than 170,000 square feet of office space to be used when people come back to the office eventually. you'll hear more about england and the uk over the next week or so not only dealing with the new strain that chris was talking about and draconian lockdowns in london, it's been cut off from the rest of the world because other countries are afraid of the spread. the deadline to make a deal on brexit comes in less than ten days. they have no trade deal when they drop out at the end of next month. stocks did better than i would have predicted on monday. there was worry about that new strain of coronavirus in england. we just got the latest gdp numbers showing better than 30%

gain in the economy over the summer. these are really good numbers that are almost useless to us because of the ups and downs of the virus. what we're seeing, you remember that time we were opening up and everybody had the stimulus check from the spring. that's what we're seeing but that's not true now. much smaller stimulus check, hasn't been issued yet. in a much more dire place with the virus. there are numbers that are good but i can't say useful. >> without the big picture you just can't. thank you, scott. a crackdown in los angeles. people have been going to underground parties and now they were busted. the sheriff says the parties are classified as superspreader events. deputies arrested 67 people at one party in downtown l.a. and at another in compton. san jose state's football team may be facing a big off the

field penalty ahead of its biggest game in years. the spartans will try to finish undefeated on new year's eve when they face boise state in the arizona bowl. now they are facing possible fines, even more severe punishment from santa clara county for not following local health orders after spending time between road games in the south bay. county rules call for a ten-day quarantine when traveling more than 150 miles out of the county. the university spokesperson tells us the team's travel plans did follow county health orders. we'll follow that back and forth. the clock is ticking with two days before christmas. customers can use its countless same -- contactless, i should say, pick up and delivery options. walmart wants to tackle one of online shopping's biggest drawbacks, that return.

walmart is launching a program for scheduling a pickup of a return and you can schedule it from walmart's webpage or app. cookies and spam. i don't know if these good. the sandwich is not for everyone, me included. it was made with two slices of spam and is topped with crushed oreos and mayo on top of that. it is only being sold right now in china. on mondays. about 400,000 of them. i don't know. kris -- >> listen -- >> tell me what you did. >> i want to settle the debate. mike and you were like yes way.

forecast as you get out the door on this terrific tuesday. meteorologist kari hall, will it be a terrific day for us? >> yes. for me, the spam stays at the store, okay. let's get a look at what you'll see as you get ready to head out and it's still foggy. walnut creek, 43 degrees. warmer than yesterday as our temperatures will hold steady there. it looks like we should get some clearing for this afternoon. parts of the north bay we've seen the fog moving in and out. temperatures in the upper 50s. getting ready for some rain, this is what we need and it comes in right after christmas. santa comes in, gets back to the north pole and then the rain moves in. the weather is clear on

christmas eve. as we go into friday night, that rain will be moving north to south and then we'll see a break between early saturday and sunday. a new round sunday night. with some of the computer models showing the potential of rain it shows a good amount between the two storms this weekend. over an inch for the north bay and about half an inch for the south bay up to three-quarters of an inch and at the same time two rounds of heavy snow so the first round comes in, brings some very slick roads and some heavy snow and then the second round sunday into monday and in total we could see up to two feet of snow. that's great to see. we're dry the next few days. we start to see that wet weather coming in. how is it looking now as the fog rolls through the east bay and the north bay? kari, the fog is there.

>> reporter: millions of people are still working from home, but many businesses are planning to call workers back to the office when it's safe to do so. mandated temperature checks and required health protocols have gotten regulators' green lights. with the vaccine rolling out we wondered whether your boss can require you and your co-workers to get the vaccine before coming back to the office, or on the flip sewed whether an anti-vac boss can prohibit it. we posed those questions at the state and federal level. the answers are less straight

forward than we prefer. let's start with uncle sam. here is what the equal employment opportunity commission said. the commission continues to closely monitor the development of a covid-19 vaccine and is actively evaluating how a potential vaccine would interact with employers' obligation under the americans with disability act and title 7 of the civil rights act of 1964 and the other laws the commission enforces. basically stay tuned. but the eeoc dropped a hint. it shared this q&a about the flu vaccine. question, may an employer public or private compel or of its employees to take the influenza vaccine? answer, no. one caveat. that guidance appears to only apply to businesses with 15 or more employees. as for a boss who might prohibit you from getting a covid-19 vaccine, we didn't get a response. at the state level we asked the california department of fair employment and housing the same question. the department said we do not have public vaccine guidance at this time.

christmas surge. >> reporter: marcus and kris, good morning. as you know cases of covid continue to explode nationally and many believe that california is now the he center of the crisis. here in los angeles county the numbers are through the roof. we are seeing some of the highest numbers ever reported since the pandemic in terms of new cases, hospitalizations and icu admissions, they're not getting better. as we approach the christmas holiday travel season officials fear the numbers are only going to get worse. many hospitals can't take more patients here in california and a growing concern where you are at in the bay area fl coming up on the "today" show the very latest including a look inside the crisis at local hospitals. i hope you can join us. thank you, miguel. we want to take a live look at sfo where there's still no official change in the strategy for testing passengers arriving from the uc. we know that new york is instituting changes.

"the examiner" reports a talk with the chancellor. white dot expect most students to be back on campus next august. the man investigators say abducteded and killed a hayward girl more than 32 years ago heads to court. david misch was just arrested in this cold case investigation and faces murder and kidnapping charges. he faces charges of killing two women in fremont in 1986.

titled facts about dominion, smartmatic you should know. some quick samples. no evidence has been offered that dominion or smartmatic used reprogrammed software that manipulated votes. never one, neither dominion nor smartmatic has any relationships with george sor so s. smartmatic is a u.s. company and not owned by the venezuelan government, hugo chavez or any foreign official or entity. all of these allegations were made by the president's so-called elite strike force, legal experts, and then repeated by many pundits on fox news and newsmax. sydney powell, rudy giuliani, jenna ellis never offered any proof of the allegations. bill barr meanwhile, is rebuffing the president's calls to appoint a special counsel to investigate joe biden's son hunter. here is the attorney general. >> i thought a special county stage was the right tool and was

appropriate, i would name one, but i haven't and i'm not going to. congress has passed a spending package that will keep the government open. more than 5,000 pages. lawmakers have complained, quite rightly, they didn't have the time to read it. a lot to go over whether you'll get a check and what it means for your family. our chris pollone earlier was talking about that. we'll talk more about it on the midday news at 11:00 as well. people are talking about it online as well, complaining, really, about some of elements in there wondering why the coronavirus bill has money for, say, foreign aid or even a line about how the dalai lama should be the leader of tibet. that's because the bill is an omnibus bill. it is everything. it's a coronavirus relief, the government spending plan, all assorted other things all crammed into one big bill. for instance page 4,073 deals with murder hornets. mention of the dalai lama on

and i love when you post your pictures and tag me in them. check out the picture i took of us wearing our masks out there. it was great to see something different and look up at the sky. you'll be able to see it tonight if fog doesn't block your view. you can get out there and see if you can see the great conjunction with saturn and jupiter. dealing with the fog now and it's been really thick through the central valley with the tule fog and visibility in those spots down to zero. it's been moving into parts of the delta as well as the north bay and napa. quarter mile visibility so be careful on your way to work. after this clears, we'll see some more clearing in parts of the east bay. temperatures in the 50s and a few spots reaching into the low 60s and getting ready for rain. now it doesn't get here until christmas. santa can get here, deliver the presents, get back to the north

pole and then on christmas day into christmas night we'll see some of those showers starting to move through. we're having movies and game night. it will be perfect to see the rain passing by off and on throughout the weekend. there is the possibility that we could get a decent amount of rain here between the two systems moving in between friday and again on sunday. we may see over an inch of rain in parts of the north bay and about three-quarters of an inch of rain in the east bay. less for the south bay. i'll be tracking that. mike, what are you tracking for the morning commute? >> kari, it sounds like a great time. i'm tracking what you're doing at your house this weekend. on the roadways not a lot going on. it's a great drive. i do have one area i'm worried about. less worried now. green all over. the fog registering out of the altamont pass but in the tri-valley, west 580 where that arrow is, a crash and reports of someone darting across the freeway.

welcome back. we want to give you a quick look at our top stories for this tuesday morning. >> we start with cierra johnson tracking breaking developments in the deadly late-night freeway shooting in san francisco. what have you learned? >> reporter: yes, good morning. we can confirm that incident is being considered a fatality by chp. near cesar chavez off ramp is where the whole thing began to play out. crews around 1 is 1:00 p.m. and saw investigators combing the scene. two cars ma were damaged near the shoulder of the off ramp. investigators worked to piece together exactly what happened. that off ramp was closed for a matter of hours, reopening after 2:00.
