rioters. we have team coverage from d.c. to the bay area. >> today in the bay kris sanchez is tracking the new growing calls for president trump to be removed or impeached, but, first, tracie potts live in washington, d.c., with the latest overnight developments. tracie. >> and the latest from overnight, laura and scott. the work got done despite these historic and unprecedented riots that breached security into the u.s. capitol. joe biden and kamala harris early this morning named the next president and vice president of the united states. here's how it happened. >> the votes for president of the united states are as follows. joseph r. biden jr. of the state of delaware has received 306 votes. donald j. trump from the state of florida has received 232 votes.

>> reporter: and this happened after the breach and lawmakers came back and worked through the night, all night long dealing with some objections. although some republicans came back and said they could not in good conscious continue to object to this process. they didn't finish up until about 12:34 a.m., california time. it was a long day. also overnight, president trump finally pledged that there will be an orderly transition of power on january 20th. this in a statement after the results here were declared from his deputy chief of staff on twitter because the president's twitter account is suspended so he couldn't tweet and all that political drama playing out after these brazen riots happened on capitol hill. >> he's got a gun. he's got a gun!

>> so, after night fall protesters remained outside the capitol. they were no longer forcing their way into the buildings as we saw in the earlier images. standing around with flags and signs and officers in riot gear were shoulder to shoulder to keep those protesters back. reporters on the scene say that the officers gradually moved forward and that's what prompted them to give up. but it was a very unusual day to say the least here on capitol hill. as democracy faced a test as they were trying to move forward and name the next president of the united states. these riots like we have not seen in 200 years at the capitol in this country interrupted that process. >> here on the west coast, we just had to watch it play out on tv.

obviously, you're there for us every morning as you have been for years in d.c. how did it play out for you? i know you do the morning shift for us, but were you in close contact with anyone who was near that mob scene yesterday? >> yeah, so, i wasn't down here while it was happening. i was in contact. i can tell you my cousin was down here. she works very nearby. people were scared. people were looking out of their office windows seeing this happening and wondering should i stay? in her case, her building was closed. can i safely get to my car and can i get out of here? lawmakers we heard from said they were whisked away to these secure locations. i heard one saying she called her husband and told her husband where their will was located in case he needed it. people feared for their lives while this was happening. >> you could hear from a lot of those leaders the fear in their voice, as well. we're glad everything looks much

calmer with a nice sunrise behind you. tracie potts from washington, thank you. the calls to remove president trump from office are growing in size even though two weeks left in his term. "today in the bay" chrkris sanc with the latest. >> mike pence is under tremendous pressure to do what he can to limit what president trump can do in his last two weeks in office. even if that means removing him from the oval office. now, elected leaders who represent us here in california say that the violent mob that clashed with capitol police and then breached the u.s. capitol were incited by the president himself. while president trump has now said that there will be a peaceful transition of power in two weeks, many leaders say trump has to go now. the california congresswoman says that there's no time for impeachment which takes a while and a bay area mayor, a former federal prosecutor says prison.

>> we could, however, implore the vice president to invoke the 25th amendment because the president has shown us that he is incapable of conducting himself in his office right now. and life and liberty is at risk. >> we need to clearly that this president nor any other president is going to be above the law. >> ricardo says he will recommend the next attorney general to charge president trump with conspiracy which is insighting revolt or violence against a lawful authority. for the 25th amendment to be invoked eight cabinet members would have to agree to it and two-thirds of the congress would have to vote to uphold it. scott and laura. >> kris, you mentioned cabinet

members. there would be fewer of them to decide this 25th amendment issue. >> we saw some resignations from the white house staff, but we know there are several people who are considering resigning in protest or perhaps to save themselves. they include national security adviser and assistant national security adviser and also the deputy chief of staff. so, certainly a lot of high-profile people looking to perhaps exit. we did see during that electoral college debate yesterday. a lot of folks said they were and they did not. we don't know what will happen as we move forward. >> kris, we have been checking on that and i can add mick mulvaney the former chief of staff for president trump said i can't do this, i can't stay here. he, too, has resigned. >> wow, okay. thank you. well, on that note, we're talking about white house

staffers submitting their resignation in reaction to the protests on capitol hill. among them the first lady's chief of staff. stephanie grissom as well as social secretary rickie. among the names being floated national security adviser robert o'brien, as well as transportation secretary and wife of senate majority leader mitch mcconnell. 88 million followers on social media is now cut off. facebook, twitter all taking action and locking the account for 1 hours starting in the late afternoon yesterday. it also warned the account would be permanently suspended if the president violates his policy. the president's video suggesting supporters at the capitol in which he inserts that the election had been stolen. 5:08. a number of pro-trump rallies

happened here in the bay area. one small one in los gatos briefly turned violent. 15 pro-trump supporters gathered downtown and they claim a man shot at them using a small firearm and missing people in the crowd. he parked a car and then tackled a woman wearing a flag. witnesses pinned the pan down until police could arrest him. vietnamese for trump led a rally and police had to intervene. in san francisco a small group of anti-trump demonstrators rallied outside city hall. part of the statement from governor newsom during the midst of the riots reads, quote, peaceful protest is an important mechanism of our democracy but what we are witnesses in our nation's capitol building is reprehensible and an outright assault to our democracy and democratic institutions, unquote. most activity at the state capitol was canceled as loud and angry protests took place

outside. reaction also pouring in from leaders around the world. france an incredible democracy and manual macron tweeting a message of support mostly in french but ended with this. >> we believe in the strength of our democracy. we believe. we believe in the strength of american democracy. >> a tweet from uk prime minister boris johnson called yesterday's actions disgraceful. he went on to say the united states stands for democracy around the world and it's vital there should be a peaceful and orderly transfer of power. canadian prime minister justin trudeau tweeting in part, violence will never succeed in overruling the will of the people. democracy in the u.s. must be upheld and it will be. well, all of this overshadowing the history that was made in georgia when two democrats winning u.s. senate seens raphael warnock defeating

kelly loeffler and jon ossoff. those candidates won by large enough margins that no automatic recount will be triggered. senate seats will be split 50/50 for democrats and republicans. vice president elect kamala harris will cast any tiebreaking votes. it also cements democratic control of the senate for the first time in six years. 5:11 right now. let's take a live look outside overlooking san jose. you know, it's a foggy start to our thursday morning, but rain is moving in this week, as well. meteorologist kari hall tracking our forecast for us. when and where, kari? >> yeah, we're seeing some of that fog and some unusual spots like san jose and palo alto while it's mostly clear in san francisco, as well as clear in the north bay this morning where we've seen fog all week. but we will see at times some sunshine today before that rain moves in tomorrow morning. more on that in a few minutes. mike, what is going on right now with the commute?

there and also the low clouds making a glowing sensation. traffic moves smoothly in many parts of the bay and seeing some fog, though. we'll watch for that and right now we're checking. >> good morning, i'm leslie picker at cnbc. wall street is set to open higher this morning extending yesterday's gains as investors largely shrug off the violence on capitol hill. the dow closing at a record high with traders showing little appetite for so-called safe haven investments such as gold, treasury bonds and the dollar. analysts say that's because yesterday's events did nothing to change the political and economic outlook in the coming months. now, the driving force behind the market gains appear to be optimism over the prospect of another large round of stimulus now that the democrats will control the senate. investors are also more positive about the rollout of vaccines, which would allow a wider reopening of the economy. corporate america is

speaking out condemning yesterday's violence. steve schwarzman saying he is shocked and horrified while also noting the outcome of the election is very clear. jpmorgan ceo jamie diamine saying this is not who we are as a country. diamine did not call out the president by name but urged elected leaders to call for an end to the violence. apple ceo tim cook saying the isis a sad and shameful chapter in our nation's history and urged the transition to be completed. scott and laura back over to you. >> leslie, thank you. turning now to our forecast. let's take a live look in san jose and walnut creek. you see some fog greeting many parts of the bay area this morning. kari has a look at our day's outlook and maybe a little. what is to come, as well. >> we're starting out with some fog in the south bay right now as well as some clouds as we

take a look at the east bay. but as we take a look at the wide view, you can see all of the clouds moving in but there will be a break in between before a new storm system comes in going into early tomorrow morning. so, where it's going to be mainly dry today, but look at the fog down to a half mile visibility in san jose, as well as san carlos. but then you head over towards the east bay and it is a little bit lighter, at least you can make it to work without any major problems and in parts of the north bay where it's been foggy all week, we are seeing clear visibility there. taking a look at the trivalley. i want to show you what to expect this morning with some temperatures in the mid 40s and then look at 11:00 we're at to degrees and notice the icon, it is a little bit more sunny there will, once again, be sunshine later today. but then as we go through the forecast, taking it hour by hour and stopping it at 4:00 tomorrow morning and right at about this time. if you're an early riser, you're heading to work and expected to

be wet in parts of the bay area and scattered showers moving through and some hit or miss rain in parts of the north bay and this is not going to be a very strong storm moving in. and it moves out i quickly. by noon we're seeing it clear out and by 5:30 the sky is all clear and the rainfall totals will mostly be very light. most of us getting about a tenth of an inch or rain of less. but there could be up to a quarter inch of rain in redwood city as well as san francisco and mill valley, as well, where we'd normally see more of that rain. the drought monitor will be updated today. i'm watching it closely because we have had some rain recently but i'm wondering how much has that helped us out with the drought especially seeing we do have extreme drought conditions for parts of the north bay and severe drought conditions else where. the storm track has been well to the north of us, but it may possibly stay that way over the next couple of weeks. so, that means we will go back into a dry weather pattern. i'll be following that. mike, what are you watching this

morning for the commute? >> some of that moisture you're talking about, kari. the fog in the air and that's unusual as we take a live look in palo alto and unusual slowing northbound with these taillig s taillights. unusual for this time. it's not even 5:20. in a couple seconds it will be. heading up towards san mateo and we'll look at the map where we see the fog in palo alto and this crash in san mateo and traffic break going on for north 101 as they had to clear some vehicles from the roadway. little slowing still, but clear by the time you get to 92 and easy up into or out of san francisco and maybe some fog drifting around the peninsula side, as well. looking over towards the trivalley where there is a little bit of a build. no problem there's and showing slower sensors and easy drive through the maze. back to you. >> mike, thanks. coming up next on "today in the bay" nbc bay area respds.on millions of families are unawarehey could have the federal taxes figured and filed

visibility for the south bay and parts of the peninsula. else where it is fairly clear. we'll talk about when that rain arrives and that's coming up in the forecast. mike, how is it looking for the drive around the bay area? >> most of the drive, the only thing we're worried about is the fog and we'll talk about where it is touching the roads and i want to talk about this traffic on 101 on the peninsula north 101 at hillsdale and earlier crash cleared from the off ramp. i was just told chp may close that for repair work and sand barrels that were damaged there. if you have hillsdale because it's closed and either direction off the freeway gets you to the surface streets. rest of the bay moves smoother and issues for the south bay and san francisco coming up, scott. back to you. mike, several developments overnight from the fallout from storming the u.s. capitol. live look at the capitol. things are quiet this morning, but, wow, what a turbulent and violent 24 hours we were watching on television.

congress did eventually get back to business. overnight, vice president mike pence fulfilled his duty as the president of the senate overseeing the approval of joe biden as the 46th president of the united states. the affirmation, really. it happened in what was normally a very symbolic vote. >> we have the power and we support you. >> so, four people have died. all in the chaos of capitol hill, including a san diego woman. she was shot by law enforcement during the protests. three others died after suffering medical emergencies. new video from inside capitol hill following the rioting. you can see protesters just trashed the place making a mess of congressional offices, flipping over furniture. some of you saw earlier in that video, breaking windows. pictures on social mead i

ashowed people taking away documents. the police officers who guard the capitol are facing harsh questions and criticisms about why they were not prepared and allowed a mob to take over what is supposed to be one of the most secure buildings in the world. >> it was really shocking to see and we have more details about the trump supporter shot and killed by law enforcement. ashley babbitt was from the san diego area outspoken supporter of president trump on social media. in our statement to our nbc affiliate her brother-in-law said ashley was loyal, as well as extremely passionate about what she believed in. she loved this country and felt honored to have served in our armed forces. he says babbitt was in the air force. the family is asking for privacy. our "today in the bay" team is live with complete coverage. we have kris sanchez and bob redell watching overnight developments for us. and also new overnight,

president trump finally pledging to have an orderly transition of power via his deputy chief of staff on twitter. the president's twitter account is now suspended. so, let's check in with bob redell right now and silicon valley social media companies took some action against president trump. >> good morning to you, laura. facebook which is headquartered behind me here in menlo park has blocked president trump for 24 hours starting yesterday. this after the president posted a video and in its video he dra addressed his supporters and continued to push the false claim that and they have taken similar measures. twitter froze three tweets from president trump's feed yesterday and locked his account for 12 hours. twitter says the president violated its, quote, civic integrity policy. >> it's significant because that is a change in policies and there was a time, at least, that twitter had different rules for

public officials for other users. so, it would have allowed for the president and other elected officials to continue to violate this rule. >> that was david green with the electronic frontier foundation. he also says locking the president's account does not violate his free speech rights. twitster is a platform and can' beriab rliable. >> bob, it will be interesting to see if the social media companies permanently ban the president from their platforms. what do you think? >> that's a certain possibility, laura. twitter has threatened to lock the president's account for good if he doesn't remove the tweets from yesterday. in the company's words and according here, future violations will result in permanent suspension. twitter has been vital to president trump as it provides

from a direct line of communications with 88 plus million followers on twitter. >> yeah and 12 hours locked out will be interesting to see what he does and maybe what his first new tweet will be. we'll follow that. tha thanks, bob. here in the bay area we're watching as the violent mob stormed the capitol. we're watching on television and just disbelief. watching the capitol police seemingly let it all happen. immediately people started contrasting that and the response to other recent protests, including black lives matter. kris sanchez live in san jose with that part of the story. good morning. >> i know as you were watching it, it didn'tu wonder how this is happening. it's not like walmart on black friday and then also to wonder if perhaps the reason it was happening so easily it seems was because most of the rioters.

they were calling them rioters or mob and they did push them back but in some of the area it does seem that some capitol police just allow them right in. the president failing to call in the national guard leaving vice president mike pence to make that call. and whether this was an instance of white privilege or a lack of preparation is now the question. >> i think the evidence backs that up. when you work as a different way to lead to respond to different types of threats, i think that is inescapable conclusion. >> they plan for people to be angry and flags. i don't think they planned on scaling walls and breaking through barricades and trying to get inside. >> the one criticism, of course, was how the capitol police that were there responded. one other criticism was why weren't there more capitol police knowing that president trump was calling supporters to

washington yesterday. knowing that he was holding a rally and was firing him up and knowing that the electoral college vote was happening. the fact that only one person was shot by police seems to be quite surprising for a lot of folks. certainly our condolences to that mily. however, a lot of folks saying if this had been a black lives matter protest, the protest of any other kind, then certainly more weapons would have been drawn. scott and laura. >> kris, i saw a picture on twitter of them protecting the lincoln memorial during a black lives matter protest in which there were hundreds of police officers ready to go. kris sanchez, thank you so much. well, this tweet during the riot triggering a lot of backlash for central valley state senator and trump supporter shannon grove. the bakersfield politician is also the senate gop leader after falsely claiming antifa radicals were behind the riot she soon deleted her tweet. in a follow-up tweet soon after

she seemed to clarify suggesting it was incomplete and meaning this is how antifa behaves. bay area republican leaders responded to the attack on the capitol by bringing up black lives matter. san francisco republican party chairman john dennis referenced last year's black lives matter demonstration saying violence on either side is unacceptable. he also said he's concerned about president trump's legacy. >> one of the hallmarks of the trump rally and the trump supporter has been peacefully. i would hate to think that is just the final punctuation mark on a trump presidency. >> one tweet from san francisco gop state committee woman harmeet dhillon the mob violence the left has hababitually engag in these past years is desp despicable. we are a nation of laws not anarchy. be sure to stay with us for ongoing coverage for what is

treated in the e.r. on christmas day and cannot disclose how many tested positive for c orcovid do privacy laws. 60 e.r. staff tested positive. let's look at our cameras in san jose. you can see how foggy it is there. more rain is moving in this week. meteorologist kari hall tracking our forecast. good morning, kari. >> good morning. and we are starting out with a lot of fog in the south bay. visibility down to a half of a mile, but there will be some clearing this afternoon for a little while and our temperat e temperatures may get up to about 60 degrees and 62 degrees in morgan hill and our north bay highs will reach into the upper 50s. but as we go hour by hour we are going to see some of the showers moving in early tomorrow morning and we're going to wrap up the week with some early morning wet weather. so i'll talk more about that coming up. mike, what is going on right now for the morning commute? >> little alert, kari, for folks leaving san francisco heading to the bay bridge. look, i marked it on the bottom of the bridge here as you're

good thursday morning, it is 5:45. let's head over to brentwood for a look at what to expect this morning. a lot of clouds and temperatures in the mid 40s and good time to get out in the backyard for home school recess will be this afternoon when we reach into the mid 50s with sunshine. i'm talking about rain in the forecast. i'll have a look at that coming up in a few minutes. we're also talking about some fog in places you might not expect. we talk about the south bay and portions of the peninsula like palo alto and live look out there shows you fremont. we don't necessarily have fog, but low clouds hovering around and we know how it drifts up and down and right and left.

we'll see how things are moving. so far the traffic is moving well. >> thanks so much, mike and kari. 5:46. breaking news the latest jobless numbers are out. 780,000 americans applied for first-time benefits. that's fewer than analysts expected. about 5 million still receiving jobless benefits. almost 70 million americans or about 40% of the workforce have filed for unemployment at some point during the pandemic. governor newsom meanwhile says new help could be on the way for low-income californians. he wants to provide $600,000 of golden state stimulus money directly to about 4 million californians. it's part of his proposed budget. this is not a for sure thing but that is on top of the $600 in federal stimulus money many will have or already receive. the governor is also extending the state's moratorium eviction and ensuring the $2.5 billion in federal rental assistance money goes to those with the greatest

need. leaders in the bay area's two largest school districts are among those voicing new criticism against governor gavin newsom school reopening plan. he announced the plan last week for california's youngest students to return to classrooms next month. san francisco and oakland including l.a. and sacramento who sent a letter this week to the governor saying the covid reopening plan falls short for urban districts with low-income studen students. they also call it too vague in what constitutes a safe school environment. the governor's office has not yet responded. 5:48. a live look at the capitol this morning. it is calm this morning outside after yesterday's chaos. it's quiet in the morning in the inside, as well, after congress went late into the night. approve or affirm the election results. protests in southern california got heated yesterday. tv news helicopters catching scuffles in beverly hills and downtown los angeles. police officers seen leading

some people away in both cases declared it an unlawful assembly and that managed to break up the crowd. well, despite the uncertainty in the nation's capitol, the nba chose to proceed with a scheduled game that they have last night. most teams taking a knee before their games including the warriors at chase center. their opponents, the clippers, also took a knee. the milwaukee bucks and detroit pistons did the same before their game as well as the boston celtics and miami heat. the players say they want change. some changes in our forecast. a live look outside in san jose and fremont. kind of a gloomy start, sort of a gloomy start in general when you think about it. let's check in with kari, there is sunshine ahead. >> yes. so, we're starting out foggy, but won't be like this all day long. in fact, as we go into the afternoon, it is going to be a really nice one. but look how cold it is in parts of the north bay, just a few degrees above freezing in ukiah and check out clear lake 39 and

most of us in the upper 40s to start out. you need a jacket this morning and most likely throughout the day if you want to head out to the park in palo alto and expect it is to start foggy and 60 degrees with an afternoon high which is warmer than normal and that is what we will see around the bay area and overall temperatures around 60 degrees. we'll see sunshine, once again, today. we will also have rain coming in early tomorrow and i'm stopping the timeline right at 4:30 tomorrow morning. so, the isis as a lot of us early risers will be heading to work and look at where we could see some of the rain moving through the south bay parts of the east bay and also some scattered showers for the north bay. now, this is going to be a quick-moving rain by noon a lot of it is out of here and by the evening commute, all clear. so, during that quick round of rain, we're only looking at some light rainfall totals reaching up to a tenth and maybe a quarter inch of rain along the coastline, as well as parts of the north bay.

but as we check out the drought, i've been watching this because the new update comes out from the drought monitor this morning and it still shows that despite the rain that we've gotten recently, we're still in an extreme drought for parts of the north bay. notice all the orange which includes much of the bay area. we're in a severe drought and pretty much the whole state is under a drought condition or at least abnormally dry. so, really critical situation here. what we're seeing is the jet stream well to the north of us. now, it has dipped a little bit farther to the south recently, but it was such a dry start to the fall and early winter that now it's going to be a really hard to catch up, especially when we look at what's happening with our overall weather patterns. la nina has developed and cooler than normal sea surfaces near the pacific and that causes the jet stream to ride farther to the north, which means that we could miss out on a lot of rain. so, we're only seeing a couple weak systems coming in but then

next week, we're going into some dry weather and temperatures will be warming up. i'll be watching that. mike, what do you have going on right now for the commute? >> well, kari, we have this issue and two crashes on the peninsula right now. we also have some fog through palo alto drifting around. let's look at your maps here. we are looking what i circled right there. i'll move my maps and adjust them. let me see. now we'll zoom in. two crashes showing in that area. one at the peninsula. one at the top of the screen is not the major issue. the one at hillsdale is. now this crash cleared and the off ramp was reported clear and now they may have to close if there is activity there you see all the slowing and sand bails that were hit and i believe the off ramp is still closed. if it is when you get there, you pass that and exit 92 on either side of the freeway and you can get to surface streets and loop back around and jump back to 92 heading back to the san mateo bridge. the east bay moves nicely and

little slowing out of the altamont and for 84 a pretty typical light pattern right now. you zoom over here and we're talking about vasco road and the altamont pass and do watch out. vasco road a crash to the north and reported at gate 16. you know gate 16 right after gate 15. up there outside of brentwood and byron. no major problems. the rest of the bay shows a smooth move of traffic and i circled the disabled vehicle in san francisco and getting off the central freeway 101 heading through the city jumping out of the eastbound sky way. there is a disabled vehicle that may be there for half an hour and will cause a disturbance but as we look at the bay bridge toll plaza and getting on to the span from san francisco you can act at fourth and harrison without any problems and past that issue, that disabled vehicle no problem and no problems here, obviously, scott. no delay at the bay bridge on the oakland side. back to you. >> thank you, mike. updates on our race for the

vaccine. california changing its covid-19 defense strategy. plans to administer 1 million vaccine doses in the next ten days. now, we have new guidelines as to who gets the shot next. people in the phase 1b tier 2 group 75 and older and along with education and emergency services and phase 1b tier 2 are people 65 years and older and workers in the transportation and critical manufacturing industries and those incarcerated and the homeless. phase 1c are people 50 years and older along with 16 to 49 with underlying medical conditions. now, it's unclear when phase 1b of the vaccine rollout will start. some bay area counties estimate that late january early february. counties and hospitals still vaccinating people in the phase 1a where the top health care workers and residents of long-term care facilities. well, happening now, a congressman's office says he's tested positive for covid-19.
