near alum rock of san jose up in the foothills there. it happened at 3:44 in the morning. a viewer tweeting me saying that he felt it in downtown san jose. i jumped on twitter as soon as i felt it this morning and looked up usgs reports noting the magnitude of the quake. and it was interesting. it woke a lot of you up. some in mountain view, santa clara, a lot of people reaching out to me. we always try to do that, i do, at least. try to put some feelers out there of who felt it and so many of you telling me you couldn't go back to sleep right after. the good news here, no reports of damage or injuries. but, quite the way to wake up, scott. >> indeed, it was. now, let's check out what is happening in washington. despite weeks of lies about the presidential election and all the violence yesterday, the very thing that president trump so desperately tried to stop even though it wouldn't have made any difference one way or the other happened late overnight. vice president mike pence affirmed joe biden and kamala

harris will be the next president and vice president of the united states. now, we have been talking about maybe some kind of drama, but what played out has shocked and saddened the nation. >> what a day that it was. we have live team coverage. let's start out with tracie potts. live in washington, d.c. 9:00 a.m. there. the capitol should be open for business. what is happening right there, right now. >> so, we know that the national guard is still patrolling the building. the curfew is over. they have given the all clear and lawmakers are now contemplating how they answer questions about the security breach and who incited the riots. capitol hill is quiet this morning after riots stopped the electoral vote count, sent lawmakers into hiding and left four people dead, including this san diego woman shot by police.

president trump from office including republicans but also including top bay area politicians, as well. >> yeah, now up to 100 members of congress who are calling for president trump's removal from office and we can tell you that vice president mike pence is under tremendous amount of pressure to try to limit what it is that president trump can do in his last two weeks. elected leaders say the violent mob that clashed with capitol police and breached the u.s. capitol were incited by the president himself. while president trump said there will be a peaceful transition of power in two weeks, many leaders say trump has to go now. the california congresswoman says there is no time for impeachment while a bay area mayor who is a former federal prosecutor says prison is the answer. >> we could, however, implore the vice president to invoke the 25th amendment because the president has shown us that he

is incapable of conducting himself in his office right now. and life and liberty is at risk. >> we need to clearly establish the president that this president nor any other president is going to be above the law. >> ricardo said he will recommend the next attorney general to charge president trump with conspiracy which is inciting. for the 25th amendment eight cabinet members would have to agree to it and if trump objects, as we would expect he would, two-thirds of the congress would have to uphold removal. now, the 100 or so members of congress that are right now calling for impeachment or the 25th amendment are democrats. it would take some republicans getting onboard with that effort, as well. scott and laura. >> thanks so much, kris.

6:05 several white house staffers submitting their resignation. the most recent this morning is mick mulvaney who is the former chief of staff and current special envoy to the northern ireland. in an interview with cnbc he said he told mike pompeo he can't do it and can't stay. among others the first lady chief of staff stephanie grissom and sarah matthews and rickie miceta. there may be more coming. among the names being floated robert o'brien, as well as transportation secretary and wife of senate majority leader mitch mcconnell elaine cho. the president's connection with some 88 million social media followers is now cut off. twitter, facebook and youtube all taking action as twitter removed tweets from president trump's account and locked it for 12 hours starting in the late afternoon yesterday. it also warned the account would be permanently suspended if the

president violates civic policy. among the tweets removed, the president's video addressing supporters at the capitol in which he continued to insert the election had been stolen. facebook and youtube also removed the video. a number of pro-trump rallies happened in the bay area. a san francisco a small group of anti-trump demonstrators held a rally outside of city hall. as far as pros in san jose, a group called vietnamese for trump led a rally in little saigon and protests in los gatos, as well. a group of about 15 pro-trump supporters were staging a rally in downtown los gatos. they claim a man driving by shot a small firearm at them and didn't hit anybody but those witnesses say he then parked the car, got out and tackled a woman holding a flag. >> he grabbed her, threw her on the ground and that's when i grabbed the guy and threw him on the ground and grabbed his arm

and pinned him until the cops came up and arrested him. >> well, part of the stamentte from the governor during the midst of the riot reads, quote, peaceful protest is an important mechanism of our democracy but what we are witnessing in our nation's capitol building is reprehensible and an outright assault to our democracy and democratic institutions. most activity at the state capitol was canceled yesterday and a lot of angry protests took place outside. well, reaction also pouring in from leaders around the world. france's president emmanuel macron tweeting a video message of support mostly in french but ended with this. >> we believe in the strength of our democracy. we believe in the strength of american democracy. >> meanwhile, a tweet from uk prime minister boris johnson called yesterday's actions a

disgraceful. he went on to say the united states stands for democracy around the world and it is now vital that there should be a peaceful and orderly transfer of power. canadian prime minister justin trudeau tweeted in part, violence will never succeed in overruling the will of the people. democracy in the u.s. must be upheld and it will be. now, all of this overshadows the history that was made in georgia. two democrats won their u.s. senate seats. reverend raphael warnock t defeated kelly loeffler. jon ossoff first jewish senator. no automatic recount. their win means the senate will be split 50/50 for democrats and republicans, but vice president elect kamala harris gets to cast any tiebreaking votes. that means democrats in power throughout the united states government. the first time they controlled the senate in more than six years.

it is 6:09 right now. everyone is probably looking for a breath of fresh air on this thursday morning. some fog filtering into the bay area this morning, as well, kari. >> yeah, we're seeing that in the south bay right now. it's been foggy in the north bay and the trivalley the past few days but this morning it's rolled to san jose. that's what we're seeing as you get ready to head out for your morning walk. it will gradually clear out but look at the visibility right now. it's hard to see to make your way to work. so, be careful and allow some extra time to get there. but we will have some sunshine today and slightly warmer than normal temperatures reaching up to 60 degrees in san jose and napa, as well as oakland, na reaching 59. rain set to move in early tomorrow morning. that is coming up in a few minutes. mike, what is the update now on the morning commute? >> kari, same thing you started with. the fog in the south bay. you showed from a sky cam and we'll show you from the driver's point of view. we'll show you that perspective.

the bay area. in fact, as we head over towards the trivalley, we are getting a clear view here of the dublin interchange looking at 580. we're going to see clouds to start, but sunshine this afternoon. i'll talk about rain returning in the forecast. that's coming up in a few minutes. and a live look at the san mateo bridge shows you a good amount of traffic. this really builds over the next five, ten minutes and also what has dropped is the visibility of the high rise, low clouds drifting across our view here. kari has talked about fog in other spots and how this is affecting your overall commute coming up. talking about wall street before the break. let's check some of the information coming out of wall street this morning. u.s. futures showing a rise this morning in stocks and we saw a huge record yesterday, as well, and it certainly didn't seem like it matched what we were watching on television. but they are expecting better days ahead on wall street. you can see this, this is a

story about the employment development department, a chronicle report shedding new light according to "the chronicle" the edd has frozen about 1.5 million questionable jobless claims filed during the pandemic. they need further verification. two million false accounts had been disqualified and billions of dollars handed out to people who filed bogus claims. some grocery workers in san francisco may make more money. supe supervisors this week would urge but not require grocery stores to implement a hourly increase. cover hazard pay during the pandemic. the raise would last as long as the city is in the purple, orange or red covid tiers and apply to bigger chains only, not smaller businesses. lawmakers in los angeles passed a similar measure on tuesday. amidst all the chaos on capitol hill, covid in california continues to surge as

icu numbers grow statewide. bay area numbers are improving slightly. icu bed availability is now above 7% but still well below the threshold to end the regional shelter-at-home order. santa clara county health leaders believe the worst of the holiday covid surge may be yet to come. they met yesterday to figure out ways to handle already overloaded hospital icus as ambulances wait for patients in parking lots. things are getting much worse, not better. the regional stay-at-home order will in all likelihood be extended even though it is still set to expire tomorrow. live look at los angeles where the covid crisis is slamming that region. the daily health toll hit another record yesterday. 258 people died sadly on wednesday. health leaders say hospital admissions have leveled off slightly, but they expect another surge with christmas followed byew n year's eve. right now there are only 44 available icu beds in the entire

cou county. for updates on the pandemic, including cases in the vaccine rollout, just head to n nbcbayarea.com. live to downtown san jose. you've seen the fog out there. it is soupy. more rain moving in this week, as well. let's check in with kari and, kari, you know i want my. >> you'll get it later today. don't go out too early. it will be foggy and some clouds will linger once that fog lifts a little bit. for me the best part of home schooling is getting out in the yard and letting the sun hit my face while the kids run around and in brentwood today during home school recess, you'll have a chance to get some sunshine, too. with temperatures in the upper 50s and still need a light jacket and overall a really nice day. that is ahead of our next chance of rain. that is still well off the coast but we're seeing some clouds starting to extend into the bay

area now. as we go hour by hour, it does show some clearing for today but then later tonight, the clouds start to increase and we're stopping it right at 5:00 tomorrow morning because there will be some hit or miss rain moving in. most of this before sunrise and then starting to taper off before noon and the north bay will see, also, some off and on rain while the rest of the bay area looks like it gets a quick shot of it early in the morning. so, rainfall totals very light. this is another weak storm system coming through. where not everyone will get the rain and we'll see anywhere from 0.01 to 0.25 and san francisco and mill valley getting the highest rainfall totals right there along the coastline. so, now, as we take a look at our drought monitor, it's been updated and gets updated every thursday morning. and it is still showing despite the recent rain we've gotten that we're still in an extreme drought for the north bay. notice all the orange covering much of the east bay, peninsula into parts of the north bay

along the coastline. we do have a severe drought still ongoing here. so we're watching that and part of the reason why is the jet stream has been pushed so far to the north that we haven't gotten a lot of these storm systems, especially earlier in the season. well, what's happening farther to the south as we have la nina that's cooler than normal sea surface temperatures near the equator and that can drive some of those storm systems and what we see even in the upper levels of the atmosphere. so la nina is expected to continue and we'll go back to a dry weather pattern into early next week. look how much warmer it will be after that quick chance of rain. we will see some dry weather for the weekend, as well as some upper 60s, which is well above normal. we're going to see those temperatures for the middle of next week. heading over to you, mike. you've been watching the commute. anything new popping up? >> kari, i'm hoping something new is clearing out. the bay bridge will look at this shot from emoryville. the span moves smoothly and

taillights going up towards the island. reports of a disabled vehicle somewhere just after that exit from treasure island waiting for confirmation as the crew gets there or maybe they can clear it. so far no updates and the minor slowing as you look at the map circled that incident and possible disabled vehicle and as you pass through the tunnel heading towards san francisco. that's about the only issue. the bay bridge toll plaza and the approach no problem through the maze or east shore freeway. and smooth flow around the bay except for here north 101 and hillsdale the earlier crash and activity at the hillsdale off ramp and repair some sand barrels and more slowing in the last half hour. this may be better news just stay over to the left as you pass by that and the rest of the bay, just some patchy fog through the south bay where you might not expect it. keep that in mind. back to you. >> we sure will. 6:21 right now. coming up next on "today in the bay" bay area responds. >> millions of families are

the incline to be expected and just after treasure island a disabled vehicle reported. the bridge crew headed out and no confirmation and no clearing reported either. we'll watch that. the rest of the bay watching one class over at hillsdale from north 101 and less slowing than there was before and a little fog in the fremont camera and parts of the south bay camera get touched with those clouds. back to you. >> you really see it out there. thanks so much. 6:32. some new developments overnight in the fall out from trump supporters storming the u.s. capitol. a live look at capitol hill this morning. things are quiet this morning following a very turbulent and violent 24 hours. congress eventually got back to business. overnight, vice president mike pence fulfilled his duty as president of the senate overseeing approval of joe biden as the 46th president of the united states. it ended what was normally nothing more than a symbolic vote.

>> you have the power and we support you 110%. >> far from normal yesterday as four deaths now being tied to the cahaos on capitol hill, including a san diego woman shot by law enforcement during the protests. three others died after suffering medical emergencies. we've got some new video from inside the capitol hill following all of the rioting. protesters really making a mess of congressional offices. they flipped over furniture, as you saw in some of the earlier video. they were breaking windows. pictures on social media show them taking away documents, as well. the police officers who guard the capitol are facing harsh questions and criticism about why they weren't prepared and allowed a mob to take over what is supposed to be one of the most secure buildings in the world. we have more details about the trump supporter that was

shot and killed by law enforcement ashli babbitt from san diego area and outspoken supporter of president trump on social media. in a statement to our nbc affiliate, her brother-in-law said, quote, ashli was loyal and extremely passionate about what she believed in. she loved this country and felt honored to have served in our armed services. he says babbitt was in the air force. the family is asking for privacy. after all that chaos, president trump finally pledging to have an order transition of power via his deputy chief of staff on twitter because most social media companies have temporarily locked president trump from their platforms. that's right. "today in the bay" bob redell joins us outside of facebook headquarters and facebook one of the silicon valley giants really putting its foot down. >> right, laura and scott. facebook has temporarily blocked president trump for 24 hours this was starting yesterday because of a video that he

posted and in his video he addressed his supporters who are on capitol hill and then he continued to push the false claim that the election was stolen. facebook removed that video, instagram which is owned lie facebook has done the same. y youtube has taken similar measures. twitter froze tweets from president trump and then count for 12 hours and understand that 12-hour period has ended. twitter says the president violated its quote civic integrity policy. >> that change in policy and there was a time, at least, when twitter had different rules for public officials for other users. so, it would have allowed for other elected officials to continue to violate this rule. >> that was david green with the electronic frontier foundation out of san francisco. he says locking the president's account does not violate the

president's free speech rights. courts made it clear that twitter is a platform that can curate its site and not be liable for removing posts. reporting live in menlo park, "today in the bay." how they would respond to the attacks on the capitol hill and they brought up back lives matter. san francisco republican chairman john dennis referenced black lives matter demonstration saying violence on either side is unacceptable. he also says he's concerned about president trump's legacy. >> one of the hallmarks of the trump rally and the trump supporter has been that they have been peaceful. i would hate to think that is the final punctuation mark on a trump presidency. >> a tweet from san francisco state committee woman harmeet dhillion reads it is shocking and disgraceful and the mob

disclose how many tested positive for covid due to privacy laws. at least 60 e.r. staff tested positive. turning now to our special race for vaccine coverage. california is changing its covid-19 defense strategy and plans to administer one million vaccine doses in the next ten days. >> so, we have new guidelines as to who gets the shot next. people are in the phase 1b tier 1 group include people 75 years and older along with education, emergency services and food workers. 1b tier 2 people 65 years and older and workers in the transportation and critical manufacturing industries and plus those incarcerated and the homeless. 1c are people 50 years and older along with people 16 to 49 with underlying medical conditions. it's unclear when the phase 1b the secondary phase will start. some bay area counties estimate it will be late january or early february. counties and hospitals are still vaccinating people in 1a those are the health care workers and

>> not surprising given what happened yesterday. we learned from a couple defense sources confirmed this morning that troops unarmed but in riot gear will stick around for 30 days to support capitol police. that will take us past inauguration and this is happening as lawmakers hope to get back to normal. they certainly tried to do that overnight staying up all night to finish that process of counting the votes and confirming the certified election results naming joe biden and kamala harris the next president and vice president of the united states. all of that happened after they spent hours in secure locations while this massive security breach happened at the u.s. capitol. rioters breaking windows and breaking down doors to get in.

>> at this point there are about 100 members of congress who are calling for the president to be removed and vice president mike pence is under a lot of pressure to make that happen, even though there's just two weeks left in president trump's term. now, elected leaders say that the violent mob that clashed with capitol police and breached the u.s. capitol were incited by the president himself. while the president has now said that there will be a peaceful transfer of power in two weeks, many leaders say trump has to go now and california congresswoman says no time for impeachment, which is a proceeding that takes a while while the bay area mayor who is a former federal prosecutor says prison is the answer. >> we could, however, implore the vice president to invoke the 25th amendment because the president has shown us that he is incapable of conducting

himself in his office right now. and life and liberty is at risk. >> we need to clearly that this president or any other president will be above the law. >> ricardo says he'll recommend to the next attorney general to charge president trump with conspiracy which with the goal of overthrowing it. for the 25th amendment to be invoked the vice president and eight cabinet members would have to agree to it and if trump objects which would we think he would, two-thirds of the congress would have to uphold e removal. it would take some members of the republican party to switch sides. not completely switch parties, but definitely to take the side of impeachment or the 25th amendment. now, we will be watching that to see what happens as well. scott and laura. >> thank you, kris.

savannah guthrie will have a special edition of "today" from washington and watched as things unfolded on air yesterday. she'll have much more coming up at 7:00 a.m. might be hard to watch things outside, at least in the bay area this morning because it's a foggy start in some parts, kari. >> yeah, we're seeing that fog in some unusual spots like san jose. you can see it in the background of kris' live shot there. in some spots visibility near zero. take a look at san jose one mile and three quarters of a mile up the peninsula. looking at the south county, you can barely see anything. be really careful out there as you head to work. else where it is mostly clear and that live view in san jose that we can see with the fog that rolled in. later today, a lot nicer in spots like palo alto and make some plans to head out to the park and enjoy time outside and

see sunshine by late morning into the afternoon as our temperatures reach into the upper 50s and you may still need a light jacket but overall nice with our highs near 60 degrees all around the bay area. as we go into the forecast, we're going to see another chance of rain. not all of us will see it. kind of like the rain we saw yesterday. it was very hit or miss. but going into early tomorrow morning, we're seeing some scattered showers, especially for parts of the north bay and along the coastline. but the rest of the bay area seeing some very slight rain chances before sunrise tomorrow, clearing out throughout the day. and then we lead into a nice and dry weekend although we do really need the rain and it looks like the models are only putting down a few tenths to maybe up to a quarter inch of rain by the time all is said and done and then we're looking at warmer weather in the forecast. i've been watching the drought monitor and just updated this morning and for all of california there is at least abnormally dry conditions. but here in the bay area, we do

have an extreme drought for the north bay. all these areas in red. and then for the orange shaded areas, there is a severe drought even with the recent rain we've had. we're still in a drought condition here. and what's been happening is that we have a la nina this winter and driven the storm track and the jet stream and the flow of the upper level winds that carries those storm systems. it moved it well to the north, even though recently we've seen it shift a little bit and bring us some rain. there's still these cool sea surface temperatures causing la nina along the waters and along the pacific near the equator that could continue to give us some dry weather into the rest of winter. and we're going to see here at least a stretch of some dry weather into next week. this weekend temperatures in the upper 50s to low 60s and notice how warm it is going to be next week. it is going to feel like springtime as we reach into up thor upper 60s in the inland

area and go into the 60s in a few more days and the highs in the 50s. and chance of rain tomorrow morning is the last chance of rain we'll get before we go into some warm and spring-like weather early next week. all right, mike, you've been watching the commute. how is it looking right now heading to work? >> well, kari, let's show folks the view you're talking about. the bridge in the bay bridge from emeryville looks clear. i've been watching the reports on the span just around the island there of the disabled vehicle. the map shows you there a little bit of slowing, but i think that vehicle is not a problem. hasn't been and the update hasn't come in for any problems. in san francisco, i've marked a crash howard at fremont. that's close to the on and off ramps and, you know, traffic is so light that we could talk about your smaller roadways getting on to and off of the areas without any issues. rest of the bay area shows a smooth drive, as well. they removed any problems over there and the off ramp appears to be clear now after the earlier morning crash and a look over in palo alto with a live

look. little glow and traffic is not a problem for volume wise and we talked about the fog floating around and the peninsula and the south bay could be potential problem for folks who are not expecting that fog and you're watching us and giving you that update and seen it kick in through cupertino and san jose from time to time. back to you, scott. watching washington and stepping down from the national security council. meanwhile congressman jake laturner tested positive for covid-19. the republican from kansas was tested after voting on the floor yesterday. his office made that announcement on twitter a short time ago saying he is not experiencing any kind of symptoms. he took the test as part of regular capitol protocols. coming up next, a quick look at our top stories in the bay area, including the shaking that woke people up extra early in the south bay. a tough day for most americans yesterday, including the ones who make us laugh. here's "tonight show" jimmy

christmas day outbreak at san jose kaiser hospital. one patient says she tested positive after visiting the emergency room on december 28th. she had tested negative for covid before being admitted to surgery. five days later call ed in to gt a second test and that was positive. can't disclose how many patients were testing positive due to privacy laws. but you know, at least 60 e.r. staff tested positive. a new report shedding some new light on the widespread fraud in california's employment development department. according to "the chronicle" edd frozen about 1.5 million questionable job claims filed during the pandemic. all are in need of further verification. two million false accounts have been disqualified. it is believed billions of dollars may have been handed out to people who file bogus claims. grocery store workers in san francisco may soon be making a lot more money.

supervisors this week approved a plan urging grocery stores to implement a $5 hourly increase to cover hazard pay during the pandemic. it will last as long as the city is in the purple, red or orange covid tiers. it will apply to larger grocery store chains and not smaller businesses. elected leaders in los angeles passed a similar measure on tuesday. we have a huge team of journalists updating everything on our website as far as the pandemic cases go and the vaccine rollout is up to the minute nbcbayarea.com. now, let's get a look at that forecast talking about fog earlier, kari. that can, of course, affect your morning commute. >> yeah, that's a view of what it looks like in the south bay this morning. and we've seen the fog in the north bay the past few mornings, as well as the trivalley. but now those areas are clear and it's moving down to the south bay, as well as the south county. even though we're starting out foggy, it's not going to be that

way all day. in fact, it will clear out and get sunshine and above normal temperates rurching into the upper 50s and low 60s. going to be cool tonight but then we get ready for some rain early tomorrow morning. scattered showers moving through. mostly before sunrise. and then clearing out for the rest of the friday as we go into the weekend. it is going to be nice and sunny and temperatures warming up and look how warm it is going to be next week. we'll also watch for some king tides by the beginning of next week along the coastline. we could see the higher than normal tides starting on monday. so, of course, we'll have more updates on that. mike, what's the update now on the morning commute? >> kari, i have been recently watching the bay bridge because of reports on the span. we still don't have an update for the bridge crew and the bridge isn't that long. we'll take a live look and live look where you see the light traffic volume and in the background curtain of clouds and fog touching parts of the upper east shore freeway and look at the map. you may have fog that has been

reported over there on the span both upper and lower deck on the san francisco side. i circled in san francisco a crash at howard and fremont. not reportedly affecting any of the on and off ramps that we pointed out because traffic volume is so light and light incidents on the report. we could talk about city streets. over at the altamont and trivalley minor slowing in your usual spots. very light traffic continues from over the end of the year. so, that's going on here for the rest of the bay and also no major crashes but as we take a live look out there, we're showing you fremont where there is still some low clouds and fog and in san jose, also some fog, as well, from our camera. i can tell you it's anywhere, but it's san jose. >> that's right. we can tell a little bit there. well, take it easy if you're headed out the door this morning. thank you so much for joining us this morning. >> we will, of course, continue to monitor what is happening in washington. the dhs says they will build a fence around the u.s. capitol.
