"today in the bay" continues right now. good tuesday morning to you. thanks so much for joining us. i'm laura garcia. >> i'm scott mcgrew. marcus washington has the morning off. it looks like kari and i are rocking the yellow this morning. it's going to be a beautiful day out there, kari. good morning. >> yes, good morning. and it's tuesday. we're seeing some rain moving across parts of california. but a lot of that rain will just weaken before it gets here. even though we are seeing a lot of green here moving through ukiah, it's some very light showers for the north bay. but the storm is also pushing up some big waves. you combine that with the king tides due to the gravitational

pull of the moon, it's bringing the water farther inland and we're going to have a lot of issues here with the possibility of some coastal flooding and some big breakers today. i'll talk more about all of that coming up in the forecast, like what's going on right now for the morning commute? >> bright yellow, i have gray. i'm eeyore. easy one right now. green shows a smooth flow of traffic. look out here toward the north bay. circled up at the top. a little debris up there. do watch out there. no major issues. just a little slowing that showshow ed up when that report came in. live look at the golden gate bridge. no problems right now. kari talks about the system but it's not affecting the view right here. back to you. >> thanks so much, mike. the fallout from the siege on capitol hill now impacting

the health of lawmakers who had to hide from the angry mob. overnight, a second lawmaker confirmed she is infected with covid, which she blames on gop lawmakers who refused to wear masks during the capitol lockdown. meantime, congress is expected to issue an ultimatum to vice president pence today. remove president trump or they will. "today in the bay" tracie potts is live, tracking all these developments. there are so many. an impeachment vote could possibly happen as soon as tomorrow, according to the speaker. >> right, because they're not expecting that vice president pence will follow-up on this resolution today to try to remove the president under the 25th amendment. so they are moving forward with that next step of trying to get the president out of office early. >> donald j. trump incapable of executing -- >> reporter: after one republican blocked it. >> i object. >> objection is heard. >> reporter: the house of representatives plans a roll call vote today asking vice

president pence and the cabinet to remove president trump for inciting violence against the government. if pence says no, which sources say he will, the next step is impeachment. as early as tomorrow. it would make president trump the first president to be impeached twice. >> we have to stand up to this man who incited a violent riot at our nation's capital. >> i do not see how that unifies the country. >> reporter: getting 17 republican senators to convict the president is an uphill battle. >> they know the votes are there. you would think they would do that. this is so ill advised. >> reporter: some republicans say keeping it simple, just about the riots, not the election, might work. president trump met for the first time with pence since the capitol attack. he declared a federal emergency in d.c., allowing law enforcement to beef up inauguration security. there's already talk on social media of armed protests. >> disturbance is something we plan for.

we have contingencies in place. >> reporter: acting homeland security secretary chad wolf resigned and law enforcement is being warned across the country to expect protests at every state capitol. couple of capitol police officers suspended, 10 or 15 others under investigation, based on their actions in that riot last week. laura, scott? >> and what a scene it was, tracie. how is the investigation going, trying to track so many people down? >> reporter: well, it's exhaustive. you saw there were thousands of people out there. tens of thousands of tips have come in to identify those people. 90 arrests so far. >> tracie potts, thank you. the man who broke into nancy pelosi's office and put his feet on her desk during the siege on

some restaurant owners in marin say enough is enough. they're imploring governor newsom to reopen outdoor dining. cierra johnson joins us now. it's been a financial hit for so many people, so many restaurants. good morning. >> reporter: good morning, yes. it's been financially difficult for a lot of those business owners as well as those employees working at some of those restaurants behind me. you can see throughout the bay area they're sitting empty. that latest round of restrictions eliminates indoor and outdoor dining. some of the city leaders here in marin county reaching tout governor newsom, asking him to allow them to reinstate that outdoor dining. that letter asking for that green light to go forward with outdoor dining was sent to the governor last week. city leaders wrote the letter, explaining cases in the county have gone up since outdoor dining was shut down and the act of eating outside in a ventilated space is safer than

shopping. public health experts explained that dining between more than one household is still a very high risk activity. so, just how much is marin feeling the pinch financially of this pandemic? data collected by research with harvard university inside tracker says the number of small businesses in the county has decreased 37%, january till the end of the year, december 30th, 2020. another sign that businesses in the county are struggling, by looking at the amount of revenue. same researchers say revenue in the county dropped by 45% within that same timeframe. hearing those numbers you can understand why some of those business owners are so upset and really kind of nervous about the state of their business. now so far we've not heard whether or not governor newsom has addressed that letter, whether he has reached out to the city leaders here in marin.

when we do hear any communication between the governor's office and county leaders, we'll be sure to let you know. we're live in mill valley, cierra johnson, "today in the bay." >> i've got more numbers for you. the regional stay-at-home order will not be lifted any time soon because icu bed is at .7%. that's the lowest level yet. the governor says availability needs to be bigger than 15% to end the shutdown that's impacting so many businesses. we have a live look in san francisco this morning, where later today mayor london breed will update the city's battle against covid and where it stands in terms of cases and icu bed space. overwhelming both the icu and hospital staff. last summer the facility peaked with fewer than 50 covid patients. yesterday it had 63 with 11 in intensive care. bay leaders are expected to

extend the emergency due to the pandemic. it allowed for quicker response to pandemic-related action. 5:09. in a few hours hundreds of seniors and caretakers at san francisco towers retirement community will get the vaccine. this is the latest step in the city's major push to keep older residents healthy. also today, santa clara supervisors are considering an emergency order to force health care systems to provide a timeline for administering the vaccine. they also want accessible and comprehensive updates on how many vaccines are being administered, to whom and when. new this morning, new research says wildfire smoke now makes up half of all the small particle air pollution in the western u.s. and climate change playing a bigger role. remember this orange glow across much of the bay area during the fires in september? it was so eerie looking.

warmer temperatures are helping to fuel some of the most destructive wildfires we've seen in u.s. history. it's leading to major smoke events which may be tied to more health problems and premature deaths. and that is always such a big concern here in the bay area. as we reach fire season. we've seen horrible firestorms we've reported on, kari. >> absolutely. and part of the reason why that smoke doesn't mix up is our typical weather pattern basically puts a cap on all of that smoke, so you have high pressure that makes the air safe with some very light winds and also some cool temperatures near the surface. and it doesn't allow for that smoke to mix out. it just -- the cold air just sinks and also the topography of the bay area traps that smoke in between the mountains and in the valleys. we don't get a lot of high winds in those low-lying areas. of course, that's part of the

reason why we have that smoke that just lingers for days on end. at least the air quality is is good now. we'll talk about what to expect with our temperatures in the forecast coming up. mike, what's going on now with the commute? >> i don't know what's going on in my head. i talked about the north bay. not a lot of incidents. we're talking about american canyon. the crash i circled at the top. highway 12 at kelly road just before 29 and 12 come together. this crash was given a local alert because it's a big intersection for that portion of american canyon. we now have one lane open in each direction. that just happened in the last few minutes. it was completely closed up there. again that does affect the area approaching that highway 12 at 29 interchange. that interchange itself -- not interchange. the intersection is open. the rest of the bay, you're basically at speed. back to you. >> thanks so much, mike. legendary head coach bill belichick calls an audible on

tides that we have, which is from the gravitational pull of the moon that makes the water come farther inland. then you have these big breakers on top of that. a lot of people have been taking pictures near the coastline, saying the sea looks really angry. you don't want to be anywhere close to that. let's head inland and talk about just getting out and getting some fresh air today. going to the park, it's going to start out in the mid 40s in gilroy, at 9:00. notice the trend goes up, but not a lot of clearing. there will be peaks of sunshine, but at least those temperatures won't be so bad, into the low 60s for today. upper 50s and low 60s, which is about normal, maybe slightly above normal. that storm system is approaching but not a lot on our hour by hour outlook. lot of clouds as that rolls on through but rainfall totals stay well to the north of us.

and pandemic unemployment assistance, people like gig workers, contractors and small business owners can collect. here is how that extra $300 per week will get to you and what you need to do. the treasury sent the money to the states and then they take over. in california, the employment development department will dispense the money. there are two basic steps. first the edd says it will automatically recal calculate and notify claimants on their website, mail or text message. then you have to certify. certifying is answering basic questions every two weeks that tell edd you're still unemployed and eligible to receiving payments. that process is under way for people collecting regular unemployment. if your benefits ran out or you received pua, it might take longer to get that extra $300 per week. first, it has to put revised computer programming in place. if you've just been laid off or never applied, it's important to get the ball rolling asap.

you can do that online at edd.ca.gov. the new york state bar association moving to oust rudy giuliani. the group launching an investigation after the capitol riots, citing the speech he delivered during the rally ahead of that siege. meantime, orange county has decided not to fire a professor who spoke at the same rally. law professor john eastman stood next to giuliani for much of that speech. in response, more than 150 school staff members have signed a letter to the l.a. times calling for that professor's firing. new england patriots head coach bill belichick has declined president trump's offer to receive the presidential medal of freedom. he was supposed to receive that award later this week. in a statement he says, quote, remaining true, the people, team and country it outweighs the benefits of any individual award.

there's also construction south of the robin williams tunnel. starting to clear up now. right around spencer. two smaller events but overall, look at all that green. back to you, laura. >> thanks so much. 5:32 right now. new fallout on capitol hill following last week's siege. a live look at washington, d.c. this morning, where house members have taken the first steps to impeach president trump for a second time. but the president will not be in washington today. he's actually going to be in texas. he's attempting to highlight his work that he has done on the border wall. meantime, the acting capitol police chief says several officers have been suspended for their actions during the riot. and to curb the threat of more violence, the city declared an emergency declaration until january 24th. that is extending, of course, past joe biden's inauguration. we're also learning two members

of congress have tested positive for covid after being locked down during the riot at the capitol. that includes congresswoman pernilla jaepal, who claimed some gop lawmakers mocked the use of masks during the lockdown they were in all together. 5:34. in a race for a vaccine. efforts are ramping up statewide to vaccinate more people, to protect them from coronavirus. "today in the bay's" bob redell is live. those counties have more freedom now to distribute those shots. >> reporter: correct. good morning to you, scott. yesterday governor gavin newsom gave local health departments more flexibility to decide when to move on to the next tier of vaccinations. the governor's call is to inoculate an additional 1 million californians by this friday.

we're in tier one, health care workers and those taking care of and treating covid-19 patients and also residents of long-term care facilities. once they receive their shots, next in line includes people who are 75 years of age and older, workers in education, emergency services, food and agriculture. california has been slow in its rollout of vaccines. ranked 43rd out of 50 nationwide. only 1.5% of the population in the state have been inoculated so far. of the 2.4 million vaccines delivered to california, only one-third are now in people's arms. to help speed up the rollout, 49ers are offering up levi stadium as a vaccination center for the county of santa clara, saying there's technology to store the shots along with ample space. in oakland, the coliseum authority is in talks to open a drive-through vaccination center in its parking lot. disneyland down south will also join in, expecting to vaccinate

thousands of californians each day. currently, there is no statewide registry to sign up. health officials say when it's your time you'll be contacted by your health care provider or the county. ucsf infectious disease specialist dr. monica gandhi says we should get rid of the tier rollout to speed up the process of mass vaccination. >> they did this in 1940s for smallpox. this is what we have to do now. we are in a medical emergency and we have the shots. >> reporter: dr. gandhi says while health care providers can easily contact their employees to get shot, this next phase will be much more complicated. there are estimates that are out there that we need to vaccinate 50,000 people a day to quickly get to herd immunity. reporting live here in san ramon, bob redell, "today in the

bay." >> i have grim numbers for you. 2.7 million since the start of the pandemic cases, 264 additional deaths. the state has now lost nearly 30,000 people. to put that in perspective, the california death toll now matches the entire population of los gatos. happening today, bus test express is on its way to berkeley, the first of its kind mobile testing bus will actually start up. they're going to hopefully test about 500 people a day. it's also equipped to provide vaccinations and offer health and wellness services. bus test express buses are already operating in southern and central california. meantime, sonoma county health department is ending a partnership with a coronavirus testing company that last week drew an fda warning over the risk of false negatives. the county will allow curative to conduct testing on its own. sonoma county says it will

resume its own pop-up testing today. superintendent tony thurmond will host a virtual event. later tonight he will join state senator bill dodd's school virtual town hall. both events come as california is urging health care providers to speed up those vaccinations. child care workers, educators are on tap to get these shots in the next phase of the distribution, but that phase so far is on hold. some grim new details in san francisco's imploding real estate market. the pandemic is said to be to blame for the city's weakest year in at least three decades. the chronicle is reporting new leasing simply fell off the cliff in 2020. it was down 71% from the previous year. that is the lowest level on record, dating to the 1990s.

commercial rent rates dropped, housing rent dropped nearly 25%. also happening today, san francisco supervisors are holding a second reading on the waiving of city fees for struggling businesses. they approved that measure last week. supervisors also expected to extend an emergency ordinance requiring the rehiring of workers laid off during the pandemic if they're actually hired for the same position, rehired. help may be coming for those trying to make it in the bay in marin. today, supervisors there are going to consider extending the county's eviction moratorium. if approved it would remain in place until january 30th. tenants who can't pay their rent due to covid-19, that expires at the end of the month. happening again today, those king tides we've been talking

about, they're so dangerous. we've been telling people don't turn your back on the ocean. it actually seems very angry out there. that danger has really grown, kari, for anyone heading to the coast as well. >> yeah. we have king tides as well as a high surf advisory. the two have separate because the king tides, that's the water being pulled farther inland due to the gravitational pull of the moon but we have storms driving in some of those high winds, creating some big breakers. some of those breakers may reach over 25 feet. we have rip currents and long period swells that draw you farther out into the water. and the sneaker waves that come up higher on the beach. the water temperature is only 52 degrees, and that high surf advisory will go into effect today at 10:00. we will see these big waves continue through at least tomorrow. so we'll be watching that as well as the storm that's bringing the north bay some light rain. i'll have more on that in a few minutes. how is it looking right now,

good tuesday morning. as we check out the north bay, we're getting rain in sonoma county. some light showers moving through. it won't amount to much, but at least it's something. we'll talk about what else is in the forecast. that's coming up in a few minutes. developing this morning, the alameda county district attorney has decided not to file new criminal charges against a second bart officer involved in the death of oscar grant. dennis pirrone was seen holding down oscar grant when johanis mehserle fired the shot that killed grant. the d.a. reopened the case in october. she now concludes that pirrone's actions should be condemned but he will not be charged with any criminal offense. oscar grant's family wanted a murder charge filed. kaiser hospital in san jose

was failing covid protocols long before dozens of emergency room staff were exposed to the virus on christmas. this is according to cal osha. according to the agency, it is not just the san jose hospital. "today in the bay's" kris sanchez joins us live this morning with a look at some of the penalties that we're hearing kaiser is facing. kris? >> reporter: well, hi there, laura. cal osha fines the hospital here in san jose not because of what happened over christmas day, but because of violations that happened, as you said, before that episode and we know that cal osha is still investigating what happened with that exposure on christmas day after the death of an emergency room registration clerk died of covid. among at least 60 employees exposed christmas day. the hospital says a staffer in an air-powered christmas tree costume unknowingly spread the virus to other employees.

other employees accuse the hospital of scapegoating that worker. kaiser permanante did not report infections in a timely manner. the agency hit kaiser permanente with $85,000 fine. and this hospital was also fined $43,000. but cal osha fined $56,000 for not reporting positive cases at kaiser antioch. we've not heard back from them directly. in a statement sent to the mercury news the hospital giant says the fines related to the response early in the pandemic was while the protocol was still evolving. quite a few kaiser employees have told us off the record, did not want to be on camera. they told us they did not feel protected in their workplace. kris sanchez, "today in the bay."

>> which makes you have concerns for the patients then as well, violations that impacted them. >> reporter: yeah. so, we know that related to that christmas exposure, 60 employees were infected, but they tested 70 patients. kaiser won't tell us how many are positive, they say, because of patient confidentiality. however, one patient did come forward to speak to us and told us she tested positive five days after she showed up for surgery, though she tested positive when she first arrived on christmas day. >> very concerning. okay, kris. thanks for the details. >> patient showing up negative. hockey season gets under way tomorrow afternoon. san jose sharks don't know when they'll be able to play at the sap center. right now they're scheduled to play their first eight games on the road. they're working out in arizona. according to mercury news, happening later today, the team will get an update from santa

me mendicino counties. also along the coastline, some spotty sprinkles. this is part of a larger system that's bringing some much-needed rain farther to the north. as we go through our hour- hour-by-hour outlook, it shows some clearing in the afternoon. rain stays to the north. we head back to some dry and clear weather in the forecast over the next few days. take a look at this model. it does show we could see some light amounts of rain measured farther to the north. it's going to be a lot more as you head toward northern california. check out ft. bragg. up to .75%, and a few hundredths of an inch elsewhere. with all this dry weather, we check in on the sierra. this is our summertime water storage, and it helps to fill those reservoirs. we've only measured half of the normal amount of snow across the whole sierra. it is doing a little bit better for the northern sierra where

waters. several of the boats capsized in big waves on sunday. a handful of nearby surfers pulled several children out of the water. >> right to the rescue right away and grabbed kids, who were in most needs, and then a few other of us, myself and a couple people came in right on the next wave and grabbed other kids, pulled them away from the rocks and moved the boats out to sea. >> thanks in part to the surfer's quick action, no one was seriously hurt. the yacht club says it's looking into what happened to avoid something similar in the future. >> uc students will be returning to campus next fall. university officials making that announcement yesterday. they said they wanted to make that decision early so students can plan ahead. each school is now responsible for laying out a start date and specific safety protocols. schools still trying to plan for online classes only in the upcoming spring semester.
