washington is just moments away. back home, the pandemic continues to impact our communities, at times turning americans against each other. up next, the fight to reopen small businesses in one bay area city, as health officials battle the surge in covid cases, as hospitals are full up. we'll dive into it as the third hour of "today in the bay" starts right now. good tuesday morning to you. i'm scott mcgrew. >> and i'm laura garcia. happy birthday to our mike inouye. we'll get to that morning commute in just a little bit. let's check in with kari right now. she has a look at our forecast for us. >> yeah. we're starting out with a look at storm ranger showing where some light rain is falling for parts of the bay area. just the north bay right now. some spotty sprinkles moving through. it doesn't look to measure up to much, but at least we're seeing some wet weather somewhere. it's dry in the tri-valley as you get ready to head out the

door, no need for the windshield wipers here as we go into today. still a lot of lingering clouds, and temperatures will be warming up into the upper 50s once this system passes, we're back to some sunshine. mike, what's going on right now for the commute? kari, we're looking at a smooth drive right now. i want to show this map, full screen. at the bottom i circled 101 northbound. yesterday we saw a little blip, a little more traffic than we've seen for a while. there, we have more slowing at th 6:00 hour. we'll see how long it lasts. no major concerns. just a little build here. north 680 into sunol, looks like crews there are picking up a little more than you might expect. back to you. >> thanks so much, mike. democrats in congress are expected to issue an ultimatum today to vice president trump -- to vice president pence, i should say, to remove president

trump from office. "today in the bay's" tracie potts is live in washington with what is expected today. tracie? >> hi, laura. good morning. today, that request to use the 25th amendment and following a likely impeachment vote as lawmakers here, democrats mostly, try to remove president trump from office early. >> donald j. trump, incapable of executing -- >> reporter: after one republican blocked it. >> i object. >> objection is heard. >> reporter: the house of representatives plans a roll call vote today asking vice president pence and the cabinet to remove president trump for inciting violence against the government. if he says no, which is expected, the next step is impeachment as early as tomorrow. it will make president trump the first president to be impeached twice. >> we have to stand up to this man who incited a violent riot

at our nation's capitol. >> i do not see how that unifies the country. >> reporter: getting 17 republican senators to convict the president is an uphill battle. >> they know the votes aren't there. i think this is so ill advised. >> reporter: some republican say keeping it simple, just about the riots, not the election, might work. president trump met for the first time with pence since the capitol attack. he declared a federal emergency in d.c., allowing law enforcement to beef up inauguration security. there's already talk on social media of armed protests. >> mass disturbance is something we plan for. we have contingencies in place. >> reporter: acting homeland security secretary chad wolf resigned and the fbi is warning law enforcement across the country to expect protests at every state capitol. and that could start as early as saturday, according to those fbi reports. meantime, two capitol police officers have been suspended.

10 or 15 others are under investigation, we're told, for their actions during that riot last week. back to you. >> what a scene that was as well. tracie potts live from washington. thanks so much. speaking of the riots as well, remember the man who put his feet up, he broke into nancy pe pelosi's office, putting his feet up on the desk during the siege in capitol hill? he's appearing in federal court today. richard bannerett faces several charges, entering restricted grounds, violent entry and theft of personal property. he was arrested in arkansas and ultimately will be extradited to washington, d.c. we are continuing to watch washington closely. when we're not on the air, great place to get the latest information is on our website. nbcbayarea.com. right at the top, we've got a section called capitol riot updates. it's on our trending bar. it's an easy way to find our stories and updates in one

place. 6:04. the other crisis we're facing, of course, the pandemic. many small businesses have been shut down for weeks or cutting back service. leaders in one north bay community now demanding the state allow outdoor dining to resume. this is happening in mill valley in marin county. that's where cierra johnson is. tell me more about the pushback. >> reporter: yeah, good morning. as you can imagine, these business owners have businesses like this one sitting empty. this time period has been really difficult, really since the last round of restrictions has been implemented. city leaders reaching out to governor newsom, asking them to issue an exemption to allow outdoor dining for these businesses so they can recoup some of the money they've lost since they've been closed. that letter asking for that green light to reinstate outdoor dining was sent to governor newsom last week. explaining cases in the county

have gone up since outdoor dining has been shut down and the act of eating outside in a ventilated space is safer than shopping. dining between more than one household is still very high risk. so just how much is marin feeling the pinch financially of this pandemic? data collected by researchers with harvard's opportunity insight tracker says the number of small businesses in the county decreased by about 37% from january to december 30th of 2020. another sign that business in this county is struggling, looking at the amount of revenue within the county. those same researchers say in that same time period, january to december 30th of 2020, revenue in marin county dropped by 35%. so that letter that was issued to governor newsom, we haven't heard about communication between the governor's office and city leaders here. the moment we do, of course, we'll let you know. folks here are really itching to

get back out, serve their community as well as get some of their employees back to work. we're live in mill valley. cierra johnson, "today in the bay." >> we all feel for them. cierra, thank you. we told you icu bed availability was at 3% in the bay area yesterday. look at the numbers this morning. less than 1%. this is why the regional stay-at-home order impacting so many businesses, as cierra was talking about, has been extended. the positive test rate is also a big factor. we hit our all-time low in mid-october. this morning we're at 13.7%. ideally, we want to be below 7%. >> they're doing what they can to quickly vaccinate people as well. happening today, in fact, seniors and their caregivers at san francisco's towers retirement community will get their vaccines starting today. it's part of the city's push to vaccinate older residents. also today, santa clara

supervisors are considering an emergency order to force health care systems to provide a timeline for administering the vaccine county wide. they also want accessible and comprehensive updates on how many vaccines are being administered, to whom and when. long beach is now way ahead in vaccinating its residents. southern california city also moving into the next phase ofity rollout. ahead at 6:30, "today in the bay's" bob redell is looking at how the city got so far ahead and how the bay area will try to make up for lost time. 6:08. covid cases overwhelming the icu and hospital staff. last summer the facility peaked with fewer than 50 covid patients. yesterday it had 63, with 11 in intensive care. >> the numbers have never been higher. we've never had more patients in

the hospital, fighting covid than we have right now. >> sf general is not turning away any local covid patients currently but they have stopped accepting overflow from other hospitals. switching gears from our pandemic coverage, new this morning, research says wildfire smoke makes up half of all the small particle air pollution in the western u.s. and climate change is playing a big role. remember the big orange glow across much of the bay area during the fires in september? researchers say warming temperatures are helping to fuel some of the most destructive wildfires in u.s. history. it's leading to major smoke events which may be tied to more health problems and even premature deaths. >> kari, there are clear skies out there. i remember in september i got sort of blue because you can't be inside because of pandemic. you can't go outside because it

was like mars. so much better now. >> yes, it is. but, you know, part of the reason why we're going to really have a big impact from that climate change study is, one, our typical weather setup where we have sinking air aloft and below that you have cold air that keeps that smoke from really mixing out. it acts as a cap to push that smoke closer to the surface. then we have our topography, those mountains and valleys, and the smoke gets trapped in between some of those valleys, in between the mountains and the valleys. so, with that sinking air above that, it just pushes it down. so that's something, of course, we watch during the summertime, even in the wintertime when we have these spare the air alert days. as we take a live look out there right now, we're starting out not with smoke but some clouds. we'll see clouds linger today as a storm system passes to the north in san jose. it will still warm up nicely, reaching into the low 60s. i'll be watching what it will

analog devices in milpitas cut 255. and california grand casino in pacheco laid off 181 positions. chipotle is holding its first coast-to-coast hiring. just one week after becoming the world's richest person, elon musk is the richest no longer. shares of tesla fell nearly 8% yesterday, decreasing his net worth by $13.5 billion. with the current net worth of $176 billion, he is once again second to amazon's jeff bezos. both guys doing okay, i think, though. president-elect joe biden plans his head to the white house. plans are under way as well for

indoguration. follow me here. his dog is having a massive zoom party, major. it's on inauguration day hosted by the delaware humane association where major was adopted. he will become the first dog adopted from a rescue shelter to live at the white house. check this out. sir darius brown will be part of that celebration. the 14-year-old boy was selected because of the work he does with animal adoptions. his signature look is that bow tie. he wears them and makes them for dogs looking for their forever home. he is also making them for both biden dogs on inauguration day. it was featured on "nightly news with lester holt" kids edition. you might have seen it. trending this morning, if

bay as we get a look at it on storm ranger. once again, rain in the north bay but not affecting the rest of the bay area. as i open up the view to show you this system coming in, a lot of the storm is falling apart as it moves in. unfortunately, we're not going to get a decent amount of rainfall out of this. it's just going to move through fairly quickly but may bring in spotty sprinkles throughout the day and early tomorrow. there's still that chance that the north bay could still be in with some wet weather. it's part of a bigger storm system that, for the most part, will stay to the north. as we look at how much rain we may measure, few hundredths of an inch. up around ft. bragg, .75". they're also in an extreme drought so every little bit helps. for us, we'll see clouds and, as you get out for a walk today, looking at a mostly cloudy start in gilroy. it's going to be in the upper

40s at 10:00. notice how warm it gets for this afternoon, with the sun just peeking out, that will not keep the temperatures down. next several days in livermore, cool start to the week. clouds today. look how much it warms going into the weekend. upper 60s, and more spring-like than the middle of winter. part of that is because it's going to be very dry and we'll see much more sunshine through the forecast with some upper 60s by early next week, which is martin luther king day. a lot of kids will be off of school. you may be off of work as well. let's head over to mike. how is it looking for your birthday commute? >> kari, it's a gift for me. i have a very short commute from down the hall to over here. drive through american canyon, we have much more of a problem. take you out to the maps. you see at the bay bridge area and across contra costa county, much of the bay area fine. now highway 12 is basically

$300 per week up to 11 weeks. pua, pandemic unemployment assistance, which people like gig workers, contractors and small businesses can collect. here is how that extra $300 a week will get to you and what you need to do. first the treasury sent the money to the states and then they take over. in california, the employment development department will dispense the money. edd says it will automatically recal calculate and notify claimants through its website, mail or text message. when you get that message you'll likely have to certify. certifying is the process of answering basic questions every two weeks that tell edd you're still unemployed and eligible to continue receiving benefit payments. that process is under way for people collecting regular unemployment. if your benefits ran out or you received pua, edd says it might take longer to get that extra $300 per week. first it has to put revised

so much to get to, so many things to tell you about. let's get you out the door with a check with kari and mike. good morning. >> good morning. and we're turning on the windshield wipers in parts of the north bay. we're tracking it with storm ranger. that's the red you're seeing there. san bruno mountain to give us the best view of the north bay. light rain is moving through, part of the bigger system, heavier rain staying well north to the bay area. we're not expecting a lot out of this, except more clouds moving in today. it's a pretty good commute for you. we'll still see cloudy skies throughout the morning, but warming up nicely for the afternoon. we'll talk about a bigger warming trend in our forecast as well as the king tides along the coastline. that's coming up in a few minutes. mike, how is it looking for everyone looking to head to work across the bay area? kari, the tri-valley looks great for the commute. and a smooth drive. green senseers dominating the

map. i have to call out a couple of spots. the top of the map, up to the north bay. american canyon, highway 12 is essentially closed. they're clearing debris and big rigs just shy of the merge with 29. you see more traffic coming off i-80, heading toward i-29 on that road anyway. that continues. that's been going on all morning. just in the last few minutes, the arrow shows you the bay bridge slowing toward the tunnel around the treasure island area. i believe we have a disabled vehicle. we're waiting for the bridge crew to give us more information. back to you, scott. >> efforts ramping up statewide to vaccinate more californians. in some cases large cities already moving into the next phase of the rollout. "today in the bay's" bob redell is in san ramon. trying to sfwribt more shots, because they are behind. >> reporter: correct. this is something that governor gavin newsom announced yesterday, scott, that the local health department has more flexibility now to decide when

to move on to the next tier of vaccinations. the governor's goal, to vaccinate an additional 1 million californians by this friday. tier one recipient, health care workers, especially on the front lines, taking care of covid-19 patients and that also includes lon long-term care residents. once those people receive their shots, next in line, people 75 years of age and older. workers in education, food and agriculture. california is ranked 43rd out of the 50 states for shots administered. 2.4 million vaccines delivered to california only one-third are now in people's arms. to help speed up this rollout, the 49ers are offering up levi stadium as a mass vaccination center for sant camera clara county, saying they have the technology to store the shots, along with ample space. in oakland, the coliseum

authority is in talks to open a drive-through vaccination center in its parking lot. and down south, disneyland will also join in, expecting to vaccinate thousands of californians each day. currently, there is no statewide registry to sign up for shots. top health officials say when it's your time, you'll be contacted by your health care provider or the county. now, ucsf infectious disease specialist dr. monica gandhi says we should get rid of the tiered vaccine rollout to make it more simple and speed up the process of mass vaccination. >> they did this in 1940s for smallp smallpox. this is what we have to do now. we're in a medical emergency and we have the shots. >> reporter: dr. gandhi says while health care providers can easily contact their employees to get shots, talking about doctors and nurses and the like, the next phase will be much more complicated. their estimate that you need to

vaccinate 50,000 people a day to quickly get to that herd immunity that we're striving for. reporting live here in san ramon, bob redell, "today in the bay." >> it's a race against the clock, bob. california yesterday added another 40,000 infections, which now exceeds 2.7 million since the start of the pandemic, with 264 additional deaths, the state has now lost nearly 30,000 people. to put that into perspective, california death tolls now match the entire population of los gatos. now to los angeles this morning, where the next few days will really be critical for that city and what they're undergoing, in just trying to fight this covid. l.a. times reports the last few days, icu cases have actually hit a plateau. that provides a sliver of hope, but there are still fears facing new year's eve gatherings that may bring another surge. l.a. county, meantime, expanding

its vaccine eligibility to all health care workers, not just those working in hospitals and in nursing homes. san diego zoo documenting the first known case of apparent human to gorilla contact. the zoo says multiple gorillas have tested positive for covid-19. it's believed they caught the virus from an asymptomatic staff member. it's not clear if the gore ilsas in the video released by the zoo are among those infected. zoo keepers knew something was wrong when two developed a cough last week. zoos throughout california are closed as the shelter at home continues. but oakland zoo, following strict protocol. masks, hand washing, no staff with clinical signs. as we know, covid can be transmitted by someone with no clinical signs. >> that happened at the bronx zoo last spring when a tiger and

several lions tested positive and may have gotten it from a staff member. 6:37. happening today, bus test express on its way to berkeley. this is a mobile testing bus that will be able to test 500 people a day for covid. it's also equipped to provide vaccinations and other health and wellness services. bus test express buses are already operating in southern and central california. meantime, sonoma county's health department is ending a partnership with a coronavirus testing company that last week drew an fda warning over the risk of a false negative. the county will allow curative to continue conducting tests on its own, but it won't use the test. sonoma county says it will resume its own pop-up testing on friday. >> grim new details on san francisco's imploding commercial real estate market. the pandemic is to blame for the city's weakest year in 30 years. the chronicle says new leasing simply fell off the cliff in 2020, down 71% from the previous

year. that is the lowest level on record dating back to the 1990s. commercial rent dropped about 10%. housing rent dropped nearly 25%. happening today, san francisco supervisors are holding a second reading on the waiving of city fees for struggling businesses. they approved the measure last week. supervisors are also expected to extend a rule that tells companies if they're going to fill positions they cut during the pandemic, they have to offer the job to people that they actually laid off first. help may be coming for some people that are trying to just make it in the bay in marin. today, supervisors will consider extending the county's eviction moratorium. if approved it would remain in place until june 30th. landlords are currently forbidden from evicting tenants who can't pay their rent due to covid-19 but it expires at the end of the month. >> new details this morning and

a step perhaps toward a unified bay area commuter rail system. according to the examiner, caltrain director steve hemminger floated that idea last week during a board meeting. bay area transit leaders are pushing for more coordination between the 27 transit agencies during the pandemic. supporters say a closer partnership would approve efficiency and reliability. critics in the past have called that idea too costly, too cumbersome. kaiser hospital in san jose is back in the spotlight this morning. up next, the covid violations the hospital is accused of before the most recent outbreak, where dozens of workers were infected. it's not the only kaiser hospital in the bay area facing similar accusations. tuesday's trade something under way. let's take you out to the big board this morning. let's not. let's just go to commercial. what do you say? i'll see you back on the other side.

step two is impeachment. we could see that vote. the resolution for the vice president roll call vote happening today. impeachment vote could happen as early as tomorrow. article articles have already been written up and introduced, but do they have the votes to convict him in the senate, and how quickly could that happen? 17 republicans would have to sign on, and right now they don't have broad support among republicans to bar this president from ever running again. >> we have to stand up to this man who incited a violent riot at our nation's capitol. >> i do not see how that unifies the country. >> they know the votes aren't ther there. >> reporter: so we'll see what happens in the senate, if impeachment goes through this week. meantime, security, a lot of it happening on capitol hill. this will not be the type of inauguration next week that we've seen before with thousands

of people crowded in front of the capitol. the capitol grounds are off limits to the public, scaleable or nonscaleable fencing is already going up. the president's emergency declaration starting tomorrow means some of those precautions, metal detectors and other things will be in place. and that's because the fbi has warned that armed protesters are not only headed back to washington, but to state capitals in all 50 states. meantime, the man who broke into speaker pelosi's office, put his feet on her desk during that siege will appear in federal court today. richard barnett faces several charges, entering federal grounds, theft of property. he is being extradited back to washington to face those charges. tens of thousands of tips have come in, and 90 people, so far, have been arrested. >> tracie potts in washington,

thank you. new england patriots head coach bill belichick has declined president trump's offer to receive the presidential medal of freedom. he was supposed to receive that award later this week. in a statement he says, quote, remaining true to the people, team and country i love outweighs the benefits of any individual award. kaiser hospital in san jose was failing covid protocols long before dozens of its emergency staff were exposed to the virus on christmas, according to cal osha. according to the agency, it's not just the san jose hospital either. >> "today in the bay's" kris sanchez joins us live from san jose with a look at the penalties that hospital is facing. kris? >> reporter: kaiser san jose has already been hit with some violations and some fines but the investigation by cal osha is still not over. they are still looking into that incident here at the emergency

room at the hospital. one woman died. she was a registration clerk in the emergency room. she was among at least 60 people who tested positive after a christmas day exposure. the hospital blames a staffer in an air-powered christmas tree costume for unknowingly spreading that virus to other employees. but employees tell us that the hospital is using that employee as a scapegoat. cal osha found kaiser permanente did not report infections in a timely manner. an $85,000 fine for the happenings at the hospital in san jose. santa clara county also fined the hospital $43,000 for failing to report positive cases amongst staff and the health care giant also facing fines of $56,000 by cal osha for not reporting positive cases at kaiser antioch. we reached out to kaiser for comment this morning. we have not heard back. it is early.

bay. we're tracking it on storm ranger. this is all part of a bigger storm system that's keeping some of that rain well to the north of us. we're just seeing a little bit of it moving into parts of the north bay. but the much more heavier rain or measurable rain is moving through far northern california. it's still churning up some big waves today. so we're dealing with those big breakers and also some dangerous waves today along the coastline. some of those waves may reach over 25 feet. and we have those long period swells. that means that the water can draw you well out to sea before that next wave comes in. that could bring you back close to shore. and we have rip currents possible as well. those sneaker waves have caught a lot of people off guard. and the water temperature is only about 52 degrees. we are also going to have this high surf advisory going into effect today, along with those king tides and the dangerous wave conditions will continue through tomorrow afternoon. so, as the storm system moves

through, we're not getting a lot of rain out of this. we will see some clouds, a few spotty sprinkles early. and then the rest of the day, we're starting to clear out while there still will be some wet weather just to the north of the bay area. so, the model is just showing a few hundredths of an inch of rain. clear lake, ukiah may reach .7" of rain. check out ft. bragg, they could see .75". the bulk of this storm system staying away. as we go through the forecast we're heading into much more dry weather and it's going to warm up. over the next several days you're already seeing that at the bottom of the screen. we'll get sunshine and temperatures trending up to near 70 degrees. we're still in the upper 50s and low 60s for today. we can see that trend going up for livermore as well as a lot of our valley spots around the bay area. it's going to feel like spring this weekend. so, if you're like me, you're making plans to get outside. let's head over to you, mike,
