you. thank you for joining us. i'm laura garcia. >> i'm cierra johnson. marcus washington will join us coming up and we begin this hour with impeachment trial of former president trump. >> the trial begins in washington we have a live look at its u.s. capitol will lawmaker also hear perhaps several days of arguments surrounding trump's role in last month's riot. "today in the bay's" tracie potts is live in washington with a preview of the trial and arguments from both sides. tracie? >> law rein cierra, good morning. good morning, everyone. we've never seen a public official in this country tried twice but gets under way. this is what you can expect throughout the day. the first basic question lawmaker also debate and answer in a vote this afternoon is whether this trial is constitutional. should it be happening at all? up to four hours of debate before a vote on that. if it passes with a simple majority, tomorrow we'll see opening statements, presentations from both sides, up to 16 hours each.

that will go for a few days. what we don't know is whether or not there will be any witnesses in this trial. remember the last time last time in the impeachment trial, there were no witnesses. this time that decision could be made during the trial. we don't know yet. trump lawyers have said that the former president will not testify on these charges that he incited a riot at the u.s. capitol last month. trump's team calls the trial political theater. they argue his fiery speech is protected by the first amendment. democrats claim he aimed the mob like a loaded cannon down pennsylvania avenue. >> i got to listen to this crap so i hope by sunday or monday, the trial will be over. >> we have to put an end to donald trump's big lie once and for all. >> so how will they make their case? both sides expected to use the president's own words, the former president's own words

from that speech to support their arguments. democrats also introducing social media posts, and videos. the trump team expected to call out democrats for what they say was similar incendiary speech. bottom line? democrats have to convince 17 republicans to go along with them and convict the president. >> hmm, some heated days ahead no doubt. tracie, before we go, switching gears for a little bit. president biden is proposing raising the federal minimum wage to $15 an hour. a new study is pointing out it could lead to some job losses. talk about that. >> right, laura. this is the non-partisan congressional budget office, they took a look at what happens if employers have to pay $15 an hour. workers earn more but some of those employers might not be able to support as many jobs. they found 1.4 million people could lose their jobs if their employers can't afford that

amount of pay but nearly 1 million would be pulled out of rty and we could see inflation kick in, so sort of a mixed bag on just what the impact of that $15 an hour minimum wage might be. >> right, exactly. it could squeeze the employers kind of tight and workers have to do more. in the bay area, most of the counties here are up to that $15, i think oakland is the only one not. tracie, thanks for the latest. always so much happening in washington. stay with nbc news all day long as the trial gets under way. the "today" show will have special live coverage starting at 7:00 a.m. and nbc will bring you the trial live starting around 10:00 a.m. santa clara county giving in to the recent supreme court rulings indoor worship services are getting the green light to resume. "today in the bay's" bob redell joins us live this morning. bob, the county's only made this announcement late last night. >> reporter: correct, laura.

you recall the u.s. supreme court ruled this past friday that churches could reopen in california at 25% capacity. santa clara county was the only county in the state to hold out on allowing indoor services, over covid safety concerns. so what changed? last night a federal judge with the u.s. district for the northern district of california issued a temporary order that indoor worship services could resume in the county, but at 20% capacity. the county will still require face coverings and social distancing inside churches. singing and chanting will not be allowed. the county health officer still strongly discourages any indoor gatherings citing significant risk to the community, as part of a statement they put out last night and also put this out from the county attorney and i'm quoting here "we are disappointed by the temporary order of the federal district court. covid-19 continues to pose a serious risk in our community, and unfortunately, no court decision can decree otherwise.

the county has consistently had a legal framework for its health orders that respects well-stabbed constitutional precedent." cavalry camel in san jose openly defied the county's order against indoor gatherings and wracked up hundreds of thousands of dollars in fines. the pastor said god's word is "a bigger law" and argued the county's order banning indoor gatherings is unconstitutional, and a violation of relinlg yums religious freedom. the u.s. supreme court agreed with the ruling. to be clear santa clara county never banned indoor worship services per se, never said you can't go to church. what they have said and continue to say until last night was indoor gatherings in general, which include churches. reporting live, bob redell, "today in the bay." >> thanks, bob. confirmed covid cases in the bay area are moving closer to

400,000. more than 2,000 additional cases were reported yesterday since the start of the pandemic. nearly 4,600 people have died. after a one-week delay, "the press democrat "reports sonoma county has begun vaccinating teachers. county leaders put the plan on hold due to a limited supply of doses. teachers and day care workers are expected to receive vaccines by the end of this week. there's no specific timetable for public schools toll start reopening. our website nbcbayarea.com has lots of pandemic related resources right now on our trending bar linked to vaccine dashboards to find out when and where you can get vaccinated if you are eligible. a follow-up on the recent surge of violent attacks in chinatown. asian-american groups will demand action. it follows the announcement from oakland, an arrest tied to three attacks. authorities believe a man

identified as yaya muslim is seen in surveillance video shoving a 91-year-old man to the ground. chief armstrong says muslim did the same thing to two other people just minutes later. >> i'm sending a message to those that commit crimes in this city that we will pursue you and we will arrest you. >> police are investigating more than 20 assaults and robberies in chinatown over the past few weeks and beefing up patrols and the da created a special response unit. pg&e's plan to boost wildfire safety is under the microscope. last friday, california's major utilities submitted their plans to reduce risk as is now required by state law. pg&e's plan calls for $3 billion in spending this year alone. it includes more fire resistant power poles and moving some power lines underground. it also includes reducing power shutoffs. the state's public utilities commission will approve each

utility's plan before the summer. have you heard of the term home hardening? it's a process of retrofitting to better protect older homes from wildfires. regulators aproved a new plan to create incentives for homeowners in high-risk areas. the insurance commissioner says his office will work to establish home hardening standards he hopes will make insurance more affordable. let's take a peek outside right now in san jose and san francisco before the sun's arrival. it's a little chilly and cloudy start this morning over parts of the bay area. let's check in with meteorologist kari hall. she's tracking that forecast for us along with storm ranger. >> yes, good morning, and weowe showing us that we are seeing some light rain moving through, especially parts of the east bay and north bay, but as we get ready to head out the door maybe to turn on the windshield wipers as we track rain moving through, parts of northern napa and

sonoma counties, moving toward parts of contra costa county as well. for san jose expect possibly some sprinkles here as well but the rest of the day we're looking at a lot of clouds, gradually warming temperatures as we head up close to 60 degrees for today. we'll talk about more significant rain in a few minutes. mike, what's going on with the commute? >> kari, the effect of the rain not pronounced but we have the impact from the police investigation still for the south bay, that's our breaking news in san jose, as we look at the freeways, they're fine. access to and from highway 101, listen up, this is a problem if you use santa clara, the continuation of alum rock on the other side of highway 101 between 26th and the freeway, it's closed for a homicide investigation. we have a crew heading out there. mckee is your access, julian i guess on that side of the freeway is your access. the rest of the freeways move smoothly, no delay, not even at the toll plaza. back to you. >> thanks so much, mike.

right now at 5:12, let's get a look at the north bay commute, where some of those spotty, light showers will linger up until about 8:00 and temperatures will be in the mid-40s. but then going into today, just getting a lot of sunshine once again. we'll see more rain in the forecast, come up in a few minutes. that's on the weather front. on the roadway front in the north bay, let's look at san rafael, 101 heading south away from us from this shot. remember the harbor bay bridge project continues with some closures, the off-ramp to central san rafael tonight until about 6:00. should be picking up over the next half hour. no major impact except for alter

that exit as you come up toward the north bay. back to you. good morning. very happy tuesday to you as well. all the recent attention is paying off for san francisco's reddit. the company got millions of dollars in new funding from venture capital, putting the overall value of reddit north of $6 billion. the social network made a lot of news after its users ran up gamestop stock and then that clever five-second super bowl ad as well. reddit has actually been around for a long time, founded by two friends. this is alexis ohanian, once famous for cofounding reddit, now more famous as the tennis star venus williams' husband. reddit's been around since 2005. if you haven't tried it, you really should try out reddit. it's kind of like a bulletin board with sections divided into what they call sub reddits. slow cooking in crock pots, they're talking about that. calico cats, talking about that,

whatever your favorite tv show or movie is, they're talking about it online. parents should monitor their children on it because did i mention they talk about everything on reddit. check of the markets, new records hit again, old navy is going to move its headquarters into its parent company the gap further downsizing in san francisco. the car company tesla bout about $1.5 billion worth of bitcoin. people heard tesla was buying it so tesla's investment paid off because the price of bitcoin went up because tesla was buying it. if that sounds a little bit circular, it is. oprah winfrey became wealthier after she brought weight watchers. weight watchers stock skyrocketed at the time. that paid off for oprah winfrey. some peep see bitcoin as an investment, others the currency of the future. this is where i lose some

followers on twitter. it can't be both. tesla indicates it will eventually accept bitcoin as payment for illustrates cars. bitcoin is worth far more in dollars today than yesterday. a tesla model s costs right-hand $69,000 u.s. it did yesterday. it did last week, it did last month and it does today. that's u.s. dollars. but the value of bitcoin moves around so much, four different people who bought the exact same car at four different times just in the last couple of weeks would pay four different prices, because bitcoin changes value so often. the fella in the suit converted his dollars to bitcoin today bought his tell lafor sticker price. lady to the right bought it on monday but bitcoin was worth less so when we convert it to dollars she paid about $6,000 more. woman on hercaon february 1st, poor fella on the right bought his after new year's. when we convert what he paid in bitcoin to its value today, he paid more than $100,000 for the

this morning and a lot less for you. let's talk about it. pizza hut offering you a deal today $10 taste maker, a large pizza with any three toppings and papa john's, a large one-topping epic stuffed crust pizza for $12 and tom know's has a contest to win a free pizza for a year. and hey, if you eat all that pizza, are you remembering to brush your teeth? it's probably a question you're like what? if so, you are not alone. apparently a lot of americans are forgetting to do so and blaming the pandemic. a new study finds that 21% of people are no longer brushing their teeth in the morning and 23% are not flossing on a regular basis so cierra and laura, okay, does this include you? i'm going to say it did include me when i was battling coronavirus. there were a few days i said i haven't brushed my teeth but i brush them every day more than twice a day now. >> really? >> yes, i was so tired. >> that is the first thing do when i get up.

>> you don't want all that trapped up in the mask. uh-uh. >> mind you, i was sick at the time. >> and here's an important thing, too, after you're sick, you should throw away that toothbrush and get a new one. there is your tip for the day. >> thank you. >> you're welcome. there's mama bear again, sorry, she comes out every once in a while. let's check in with kari with a look at the forecast for us today. >> i think it's a little different for us, because we're like getting up and putting on makeup and doing hair and all of that stuff, so forgetting to brush the teeth is i think for people who are still working in their pajamas, right? let's see what's going on. maybe you're working in your pajamas this morning and we're getting a little bit of light rain coming in, a bit of a shower from mother nature as we track it with storm ranger and a closer look shows that most of it is coming through in parts of the north bay, but also

spreading across parts of contra costa county this morning, and some of the heavier rain now moving over some of the upper elevations. most of us aren't seeing that. as we go into today if you're planning on heading out to the park, it's still going to be a good day. we're still looking at some cloudy skies and some peeks of sunshine, but gradually warming temperatures going into the afternoon. so we have this first wave, this weak disturbance coming in but a better shot of rain on thursday. we'll have some more showers in the forecast from saturday afternoon into sunday. you see what's happening here, we have several storm systems that will be coming through, but all of them will be fairly weak so as we go through the forecast, we are going to see some rain chances ramping up, especially on thursday, where we could have about a half to three-quarters of an inch of rain. it moves out on friday afrnoon. turday a new round ofain comes in and there could be some rain also to start out early next week. more of the same in san francisco temperatures remaining in the upper 50s.

i want to turn our attention to our climate in crisis. here say follow-up to the story we were reporting on yesterday with 165 people still missing this morning and more than two dozen people are dead. that's after a glacier collapse in northern india on sunday. the missing and dead were working on a tunnel project in the himalayas, a portion of the glacier snapped off and sent mud and debris down the mountain trapping workers. scientists say this looks very much like a climate change event as the glaciers are melting twice as fast than previous decades and the warming two to three degrees around the world is showing glaciers are health melting our arctic sea ice. thay so that's why they thought it was safe to do this project at the time. we've had two-degree on average rise in temperatures around the

world, that's what's causing everything to melt very quickly. so you can get the complete story, see what else is happening. we have a full page of climate change related stories on nbcbayarea.com/climateincrisis. we'll continue to follow that. mike, what's the update for the morning commute? >> well, kari, unfortunately, i have to start with some really bad news in the south bay. traffic impact is not so bad. there's a work-around but a tragic scene. we're out there at santa clara street, east santa clara street just off of highway 101, it's closed right now for what san jose police report is a homicide investigation. traffic has to go around. now this is a local impact of course but a big impact for folks getting to or from a highway 101. let's take you to the maps, we're talking about the closure where you're looking with a live camera between 26th and 101 itself. you can use mckee to the north. actually it's called julian up there. santa clara street and alum rock continue across highway 101.

this fact is maddening to many families. unemployment income is taxable. >> at the federal level. in california, california

doesn't tax unemployment benefits on your state returns, that's good news but on your federal return, they're taxable >> here's how to return unemployment income on your federal tax forms. first you should receive this, a 1099g form by mail. it looks a lot like a w2 but it's from the state. the boxes below will show you how much you collected, and how much the state took out in taxes, if any. you might be able to access your 1099g online. once you have real numbers, you have to feed them into your return. if you have tax software, it should walk you through the process. if you do your taxes by hand on paper, there's more work than just the standard 1044. you'll need to attach schedule one and write your unemployment income on line seven. if the state deducted federal tax for you, that amount goes on the main 1040 form line 25b. you could end up owing a little bit when you more often though it just reduces your refund a little bit.

showers lingering for another hour or two and gradually starting to move out but this is a quick round of rain that will be moving through the bay area, and then some clearing before we get some more widespread rain in the forecast. we'll be tracking the next shot of rain in a few minutes. mike, what's going on right now for the commute? >> -- homicide investigation and our crews are on scene there at the closure of the east santa clara street and 26th, headed toward highway 101. the crews there have closed, san jose police continue the investigation there. you cannot access the freeway off of santa clara street. you have to use julian a bit to the north. the map shows you just north of there julian and mckee are your access to and from highway 101, a major surface street for san jose but the freeways overall are moving smoothly. back to you. >> thanks so much, mic. a new first in washington.

the senate is set to begin a second impeachment trial against former president donald trump. the first -- trial is if it's constitutional. in 32 hours of arguments lawyers plan to use his own words for and against him. the white house press secretary says president biden will not be watching a whole lot of it. >> i know that everyone here will soon be marching over to the capitol building to peacefully -- >> we fight like hell and if you don't fight like hell, you're not going to have a country anymore. >> look, he got an offer to come and testify. he decided not to. we'll let the senate work that out. >> meanwhile a new uc berkeley poll finds a majority of california voters support efforts to try the president. 63% favor a senate conviction. 32% oppose it. well you might say it's game on at levi's stadium but in this

case the game is far more important, that's where later today thousands will receive their first dose of the covid vaccine. "today in the bay's" kris sanchez is live there this morning and kris, when do those first shots begin? >> reporter: it kicks off in three hours and by the end of the day, about 5,000 people should have their first step toward covid protection. we have to look inside levi's stadium, hundreds of santa clara county health and hospital worker also deliver doses. they have the moderna and pfizer vaccines here. up to 5,000 today but eventually at full capacity. 15,000 people who live or work in santa clara county will get their vaccines here so long as they are 65 years or older, and are in that 1a vaccine tier. you have to sign up at secfreevax.org, a link is on my social pages. all those include second shots just a few weeks from now. >> we have to make sure we have the right patient with the right name and that they get the right

day so they can come back in the right amount of time. >> if everything goes smoothly, that process will probably take around 30 minutes to an hour. >> reporter: other mass vaccination sites are up and running, too. san francisco's vaccinating people at moscone center, alameda county moving on to the 1b tier which includes agriculture and food workers and teachers and the oakland coliseum site is wrapping up with the help of fema and federal troops. we added up the vaccines distributed in our nine bay area counties, now at more than 1 million shots, but a anxious to get yours you have to qualify under the state and county guidelines and in almost all cases, you have to have an appointment and this is where it's been a struggle. i went on there myself the other day, secvax.org. through that system. if you're having a hard time, it's kind of a, and we have folks who maybe aren't used to doing a lot of stuff online so if you know

somebody who is elderly or struggling, maybe ask if you can offer a little bit of help but do make that appointment because if you qualify, you definitely want to get the shot. in santa clara, kris sanchez, "today in the bay." >> thank you. sonoma county is opening three new vaccination centers for people over 70. you can see the locations here, opening today. the fitness center at the pet luna campus of santa rosa junior college, tomorrow huerta gym in windsor opens and next tuesday sonoma valley veterans memorial hall will become a vaccination site. state health leaders are supposed to updaid date covid tiers across california while california governor gavin newsom isn't expected to announce any bay area counties moving out of the purple tier today. new data shows hopeful signs on the horizon. "today in the bay's" pete suratos joins us live in san francisco with a closer look at where things stand in the bay area. good morning. >> reporter: good morning to

you, cierra. the positivity rates are looking pretty good for some bay area counties but as those case rates per county that continue to be the biggest hurdle as far as moving into that red tier. we put together some numbers for some of the counties you can see there. now it needs to be under seven cases per 100,000 people in order to move to the red tier. you can see as far as the numbers go, san francisco is the closest, but as i mentioned, the positivity rates do look good in all the counties you see there. they are all below 6%, which does meet the threshold for the red tier, but again, you need both in order for the county to move into the red tier. elementary schools can reopen if cases are under 25 per 100,000 people which is the case in contra costa county. >> we've worked with our staff and community and we are scheduled to begin our reopening with our preschool second graders this wednesday, and then our third to sixth graders the

following wednesday. >> reporter: now as far as what will be different with the red tier, the major changes will be for movie theaters, gyms and restaurants, which already have outdoor services as we speak. they'll specifically be opening for indoor services, those will be at a limited capacity of course but at least a number of them are trending in the right direction. reporting live, pete suratos for "today in the bay." >> thank you, pete. 5:38 right now. contra costa county's district attorney is defending herself after getting married in her backyard with family and friends in attendance during the pandemic. baya in a becton indicated the wedding took place last attende. she also to her wedding. happening today, san jose leaders plan to resume their debate over hazard pay for grocery store workers. the rule would provide an extra $5 an hour for workers at large chains as long as the pandemic continues. councilmembers last week tabled

the vote. oakland leaders meantime passed a similar plan. grocery stores since then have filed for an injunction. today in the marin county board of supervisor also consider freezing some rents in marin city and west marin as people try to make it and live right here in the bay. the county's community development agency says there's been a 40% increase in unemployment for lower wage earners due to the pandemic. the rent freeze would last until the end of the year. single family homes, condos and apartments built after 1995 would be exempt. san francisco supervisor matt haney will hold a virtual hearing today on the cleanup of toxins at treasure island. the issue is certainly long and complicated. the contamination goes back to the world war ii era where the military was there. efforts havn today's hearing starts at 1:30 in the afternoon. still ahead on "today in the

because donald trump asked them to be there, and they'll rely on the senators themselves to recall what happened. the senators are both the jury and the eyewitnesses to the crime. now there's lots of video evidence shot by the invaders themselves. this fella, the one in horns who sat at the speaker's dais is apologizing. jason chansley said i should not have been there, period. i'm sorry for having aroused fear in the hearts of others, that was wrong, president. he criticized former president trump writing "i am deeply disappointed in president trump. he was not honorable. he let a lot of peaceful people down." the georgia secretary of state says he'll launch a state investigation into trump's phone call to state officials asking them to find more votes that could lead to charges but generally presidents are protected from actions they can claim were acts of governing. it would be a tough case to prosecute. history being made in many

following that capitol siege. government leaders say the tap for national guard troop deployment lend up cost more than half a billion dollars. re than 20,000 troops from all 50 states and u.s. territories, remained there for protection through the presidential inauguration. one-third will remain on futury through mid march. the ntsb is expected to wrap up its investigation into the helicopter crash that killed nine people, including kobe bryant. board members are expected to announce a probable cause. the crash happened in thick fog in southern california a little more than a year ago. the chopper struck a steep hillside. investigators have previously indicated there was no sign of mechanical failure, calling the crash accidental. some sad news this morning. mary wilson, founding member of the supremes, has died. she was 76 years old. wilson's long time publicist jay schwartz reported she died suddenly. the cause has not yet been revealed.

moving through spots like fairfield, moving over towards santa rosa and extending towards napa as well as parts of marin county. so with the light rain falling this morning, we won't see it all day and in fact, even though it does stay cloudy, we won't see much in the way of rain. our next storm system coming in looks a little bit stronger and will bring in some more widespread rain, moves in for thursday afternoon, and then starts to clear out by friday morning. then right behind that will be another storm system coming in, this one also looks pretty weak and will bring in some quick moving rain between saturday afternoon and sunday morning, then right behind that is another one to give us some rain to start out early next week, although it looks like a lot of that rain does stay to the north. so with this first system coming in on thursday, we could see anywhere from a half to three-quarters of an inch of rain so that's a pretty good soaker before we start the weekend and the next system arriving. for the sierra, we have several waves of snow coming in, so by the time all is said and done

the time fire fighters got there on sunday. investigators say the owner lives on board. no word yet on how the fire started. trending this morning, koala chaos. the animal is back in the wild after causing a five-car pile-up in australia. it ran into a busy highway, causing drivers to slam on their brakes. good samaritans helped get the koala into a car until rescuers arrived. he got so comfortable he chilled behind the wheel. little rascal. talk about the ultimate story of lost and found. a 91-year-old san diego man lost his wallet in antarctica while he was back in the navy in 1967. it was found in 2014 on ross island. his navy i.t. card and a reference card on what to do during an atomic or biological chemical attack was still inside, but it still took several years and a lot of legwork by people on social media to finally track him down.
