i'm cierra johnson. >> and i'm laura garcia. a trial against a former president in the very room rioters stormed into. >> "today in the bay's" tracie potts joins us live and tracie, lay it out for us. what is today going to look like. >> well, today starts this afternoon here on the east coast, with 100 senators sitting in judgment of whether or not president trump is guilty of inciting that riot. here is a look at what the trial is going to look like, starting this afternoon, up to four hours of debate on the basic question of whether they should be holding a trial ait's constitut. that vote expected today. if it passes with a simple majority, we move on to opening statements and presentations tomorrow. each side gets 16 hours. we're hearing the democrats prosecuting the case may take

theirs, the defense may come short of that. the big question is, will all of this go past the weekend, if they decide to call witnesses? that we don't know yet. that decision may not come until the middle of the trial. trump's lawyers are arguing that this is political theater, that his fiery speech is protected. meantime, democrats say that he incited the mob on january 6th. >> i got to listen to this crap so i hope by sunday or monday, the trial will be over. >> we have to put an end to donald trump's big lie once and for all. >> look for social media posts and videos from the democrats case. they have to convince 17 republicans that the former president is guilty. back to you. president biden is saying he's going to be very busy today, not able to watch what is going on, but he is proposing raising the federal minimum wage

to $15 an hour, but a new study is pointing out that could actually lead to a loss in jobs. explain that. >> could be. en cot congressional budget office, nonpartisan office of the government, what would be the impact of employers having to pay $15 an hour. they found nearly 1 million people would be pulled out of poverty, 1.4 million could lose their jobs presumably from small to moderate sized employers who feel they cannot pay that wage. so there's a bit of a mixed bag there. they also raised concerns about inflation. >> concerns across the board for both sides. tracie, thanks so much. stay with nbc news all day long as this imteachment trial gets under way. the "today" show will have special live coverage starting at 7:00 a.m. and nbc will bring you the trial live starting around 10:00 a.m.

santa clara county giving in to the recent supreme court rulings indoor worship services are getting the green light to resume. "today in the bay's" bob redell joins us live this morning. bob, the county's only made this announcement late last night. >> reporter: was santa clara, correct. you recall the u.s. supreme court ruled this past friday that churches could reopen in california for indoor services at 25% capacity. santa clara county was the only county in the state to hold out on allowing indoor services, over covid safety concerns. so what changed? last night a federal judge with the u.s. district court of the northern district of california issued a temporary order that indoor worship services could resume in santa clara county but at 20% capacity. the county will still require face coverings and social distancing inside churches. singing and chanting will not be allowed. the county health officer still strongly discourages any indoor gatherings citing significant

risk to the community. the county council released this statement, "we are disappointed by the temporary order of the federal district court. covid-19 continues to pose a serious risk in our community, and unfortunately, no court decision can decree otherwise. the county has consistently had a legal framework for its health orders that respects well-established constitutional precedent." cavalry in san jose openly defied the county's order against indoor gatherings and wracked up hundreds of thousands of dollars in fines. the pastor said god's word is "a bigger law" and argued the county's order banning indoor gatherings is unconstitutional, and a violation of their religious freedom. never banned indoor worship d services per se, just indoor gatherings in general, which includes worship services.

reporting live, bob redell, "today in the bay." >> thank you. confirmed covid cases in the bay area are moving closer to 400,000. more than 2,000 additional cases were reported yesterday since the start of the pandemic. nearly 4,600 people have died. here is a live look at levi's stadium where this morning it will open a mass vaccination site. our kris sanchez will have more on a live report at 5:30, including how many people have been vaccinated in the bay area. after a one-week delay, "the press democrat" reports sonoma county has begun vaccinating teachers. county leaders put the plan on hold last week due to a limited supply of doses. about 1,000 teachers and day care workers are expected to receive vaccines by the end of this week. there's no specific timetable for public schools to start reopening. our website nbcbayarea.com has lots of pandemic related resources right now on our trending bar linked to vaccine dashboards to find out when and where you can get vaccinated if

you are eligible. contra costa county's district attorney is defending herself after getting married in her backyard with family and friends in attendance during the pandemic. diana becton reveals on facebook that the wedding took place last summer. a spokesperson said 25 to 30 people attended. she also said no covid cases were tracked back to her wedding. becton says "i ensured all my guests had their temperature taken before entering the backyard, everyone wore masks and were socially distanced." 6:07. a follow-up on the recent surge of violent attacks in chinatown. asian-american groups will demand action. it follows the announcement from oakland, an arrest tied to three attacks. authorities believe a man identified as yaya muslim is seen in surveillance video shoving a 91-year-old man to the ground. chief armstrong says muslim did the same thing to two other

people just minutes later. >> we're sending a message to those that commit crimes in this city that we will pursue you and we will arrest you. >> police are investigating more than 20 assaults and robberies in chinatown over the past few weeks and beefing up patrols and the d.a. created a new special response unit. have you heard of the term home hardening? it's a process of retrofitting that can better protect older homes from wildfires. insurance commissioner ricardo laura says his office will work to establish statewide standards he hopes will make insurance more affordable. and it's 6:08. let's take our first check of the forecast this hour with meteorologist kari hall. i know you're tracking some rain in your forecast. >> yes, we are starting out this

morning with some rain over parts of the north bay. most of it spotty and light, but it is good to see with some of the wet weather we have this morning. we're tracking it on storm ranger, as we get a closer look, we can see the rain that's moving through marin county, toward central sonoma county and starting to clear napa county as it moves into solano county and parts of the east bay. as we go into today, we're going to start out with a lot of clouds. walnut creek showing a chance of light showers through about 9:00 and then gradually warming temperatures, but we are not going to see much sun. we'll talk about more widespread rain in the forecast. mike, how is it looking for the morning commute? >> kari, we still have a couple of spots for breaking news. first to our crew who is out in san jose, the continued closure of east santa clara street that's just on the approach to 101 or just leaving 101. we're going to advise to you use mckee or julian on that side of highway 101 to access the

freeway. you might not be able to use the alum rock or santa clara exits because of the police activity. they continue their investigation for a homicide, we're told, just west of the freeway. again, julian or mckee you might know either roadway, they continue with the same roadway, different names on either side of highway 101. the rest of the freeways move smoothly but just here breaking news we are told west macarthur exit from east 580 closed for another two hours possibly for a crash there but the bigger issue may be the impact on the bay bridge from a disabled vehicle just past treasure island. the backup is forming now at the toll plaza. it looks like they've turned those metering lights on to slow the traffic headed toward the disabled vehicle on the san francisco side, on the decline. back to you. >> all right, keeping you busy. thanks, mike. 6:10, coming up next. one of the few airlines still blocking the middle seats in the plane to keep you covid safe. plus we've got scott mcgrew.

widespread rain in the forecast and one spot where climate change caused a devastating tragedy. we'll talk about that, coming up in a few minutes. back to the bay bridge, backup caused by a disabled vehicle. crews are trying to clear that quickly but the backup building quickly as of 6:14 and the toll plaza heading back toward the 880 overcrossing. good morning. happy tuesday to you as well. all the recent attention is paying off for san francisco's reddit. the company got millions of dollars in new funding from venture capital, putting the overall value of reddit north of $6 billion. the social network made a lot of news after its users ran up gamestop stock and then that clever five-second super bowl ad as well. reddit has actually be for a long time, founded by two friends.

this is alexis ohanian, once famous for cofounding reddit, now more famous as the tennis star venus williams' husband. reddit's been around since 2005. if you haven't tried it, you really should try out reddit. it's kind of like a bulletin board with sections divided into what they call sub reddits. slow cooking in crock pots, they're talking about that. calico cats, talking about that, whatever your favorite tv show or movie is, they're talking about it online. parents should monitor their children on it because did i mention they talk about everything on reddit. check of the markets, new records hit again, old navy is going to move its headquarters into its parent company the gap further downsizing in san francisco. the car company tesla bout about $1.5 billion worth of bitcoin. people heard tesla was buying it

you're talking about the weather and the climate. >> yes, because we are seeing some light rain moving in, and we'll talk about the climate in just a second. we are showing some downpours in parts of the north bay as you get ready to head out. a closer look at the rain knob extending to parts of the east bay. it's hit or miss and most of it fairly light but many wanting to put on your hood as you head out for work this morning. this will quickly clear out. we're going to see sunshine tomorrow and more widespread rain is in the forecast especially for tomorrow afternoon, going into early friday. so with this next round of rain arriving in the bay area, and looks to bring us a pretty decent amount of rain, and then once again for friday afternoon, it starts to clear out, but rainfall totals may reach anywhere from a half to three-quarters of an inch of rain and that's with this first

wave. a couple more storm systems right behind that and so we're going to be tracking some off and on rain starting on thursday, but continuing over the next several days. temperature wise, we'll reach into the upper 50s and low 60s. no changes there with san francisco seeing also some slightly cooler temperatures along the coastline as well. upper 50s for today, with the chance of some spotty sprinkles but then some more rain heading into thursday afternoon as well as saturday. now we do turn our attention to our climate in crisis. we're following up on the story of 165 people still missing this morning and more than two dozen people are dead and that was after a glacier collapsed in northern india on sunday. the missing and dead were working on a tunnel project in the himalayas when a portion of a glacier snapped off and sent mud and debris down the

trapping the workers. scientists say this looks very much like a climate change event as the glaciers are melting twice as fast than previous decades and rising temperatures around the world are causing the glaciers as well as sea ice to melt. usually in february, they're not seeing those glaciers melting, but we've had on average about two degrees rise in global temperatures and that's what's causing that melting to happen. this collapse shows climate change is not a distant possibility. it's happening right now and there is something that you can do to help change that. check out our page of story, nbcbayarea.com/climateincrisis. we've got several stories on there of what's going on and what you can do to fight it. that's something we'll be watching hopefully you'll check that out. if you collected unemployment benefits, the way you file your taxes is going to change and you're going to have to report that income. i'm consumer investigator chris chmura. we'll show you how to, next.

federal tax forms. first you should receive this, a 1099g form by mail. it looks a lot like a w2 but it's from the state. the boxes below will show you how much you collected, and how much the state took out in taxes, if any. you might be able to access your 1099g online. once you have real numbers, you have to feed them into your return. if you have tax software, it should walk you through the process. if you do your taxes by hand on paper, there's more work than just the standard 1044. you'll need to attach schedule one and write your unemployment income on line seven. if the state deducted federal tax for you, that amount goes on the main 1040 form line 25b. >> you could end up owing a little bit when you file your return, more often though it just reduces your refund a little bit. 6:27 right now. what's next to reopen as covid cases klein and when? up next, a live report on how bay area counties are doing when it comes to keeping cases down

60s as the rain moves out. we'll talk about some more widespread more measurable rain in the forecast coming up in a few minutes. mike, you've been tracking some breaking news for the morning commute. >> i have, kari. this is in the south bay, talking about a closure for major street east claire just off highway 101, our crew is out there and so is san jose police, where we heard about their homicide investigation, investigating a body found in the stretch of roadway between 26th and highway 101, you see the closure there, and so you're going to have to reroute. we're getting you tohe t map, you use julian to the north to access highway 101 and also mckee, that's a continuing of julian, keep that in mind. the rest of the south bay freeway a smooth flow of traffic. the bay bridge toll plaza a back bigup. the disabled vehicle on the span but you can't clear the backup coming off of the maze. back to you. >> thanks so much, mike. 6:32.

a new first in washington. the senate is set to begin its al against former president trump. the first step, deciding whether trump is accused of inciting the january 6th capitol riot. in 32 hours of arguments, lawyers plan to use his own words for and against him some of which we'll play again for you right now. president biden meantime believes the truth will come out, even if former president trump isn't going anywhere near the trial. >> we fight like hell and if you don't fight like hell, you're not going to have a country anymore. >> look, he got an offer to come and testify. he decided not to. we'll let the senate work that out. >> meanwhile a new uc berkeley poll finds a majority of california voters support efforts to try the president. 63% favor a senate conviction. 32% oppose it. well you might say it's game on at levi's stadium but in this case the game is far more

important, that's where later today thousands will receive their first dose of the covid vaccine. "today in the bay's" kris sanchez is live there this morning and kris, when do those first shots begin? >> reporter: well the kickoff event is happening in just about two hours, cierra. we know that all of the appointments here are spoken for. we've got a look inside the stadium where hundreds of santa clara county health and hospital worker also deliv er vaccines. they have the moderna and pfizer shots. today up to 5,000 people will get their vaccines but eventually at full capacity, 15,000 people who live or work in santa clara county will get their vaccines here so long as they are 65 years or older, or are in that 1a vaccine tier. you have to sign up at secfreevax.org, all those doses include second shots just a f the right patient with the right name and that they get the right day so they can come back in the right amount of time.

california governor gavin newsom isn't expected to announce any bay area counties moving out of the purple tier today. new data shows hopeful signs on the horizon. "today in the bay's" pete suratos joins us live in san francisco with a closer look at where things stand in the bay area. good morning, pete. >> reporter: good morning to you, laura. the good news is the positivity rates are looking good around the bay area but those case rates that are probably the biggest hurdle for the counties in order to move into the red tier. we put together some numbers for the case rates per 100,000 people for counties in the bay area. you look at the chart, it needs to be under seven in order to move into the red tier. looks like san francisco is the closest by far. as i mentioned, the positivity rates in the counties are all below 6% which does meet the threshold for the red tier but you need both of them. elementary schools can reopen if cases are under 25 per 100,000 people which is the case in contra costa county. >> we've worked with our staff and community and we are scheduled to begin our reopening with our preschool second

graders this wednesday, and then our third to sixth graders the following wednesday. >> reporter: now as far as what will be different with the red tier, movie theaters, gyms and restaurants see major changes, specifically opening for indoor services. but at least a number of them are trending in the right direction. reporting live, pete suratos for "today in the bay." >> thank you, pete. the ntsb is expected to wrap up its investigation into the helicopter crash that killed nine people, including kobe bryant. here is a live look at the meeting that got under way a few minutes ago. board members are expected to announce a probable cause. the crash happened in thick fog in southern california a little more than a year ago. the chopper struck a steep hillside in that situation. investigators have previously indicated there was no sign of mechanical failure, calling the crash accidental.

some sad news this morning. mary wilson, founding member of the supremes, has died. she was 76 years old. wilson's publicist said she died suddenly. the cause has not yet been revealed. she began her career in detroit in 1959, and soon started the supremes. motown's most successful group of the 1960s, 12 number one singles including "where did our love go," "stop in the name of love" and of course this favorite tune. ♪ baby love, my baby love, i need you oh, i need you ♪ >> lots of classics. diana ross wrote on twitter "i have so many wonderful memories of our time together. the supremes will live on in our hearts." nice to see that classic music live on as well. marcus joins us now, listening to the supremes makes you want to move.

protected from actions they can claim were acts of governing. it would be a tough case to prosecute. history being made in many ways. never before has the president of the united states been in office while a former president of the united states was on impeachment trial. white house said the president will be far too busy to watch tv today. through all of this, have no doubt, we are keeping an eye on the current administration. though the democrats did not include their $15 minimum wage in their relief bill, any hopes of that may have been dashed after the nonpartisan congressional budget office, and the $15 would lift people out of poverty, but cost more than 1 million jobs. now what's curious about that is a seminole uc berkeley study said the opposite, found higher wages reduced employee churn, people changed jobs less. one of the things we look at when we return our focus to the biden white house after the nbc begins its coverage today at 10:00 and this will last throughout the week. taxpayers are still paying dearly for security one month following that capitol siege.

government leaders say the tap for national guard troop deployment will end up cost more than half a billion dollars. more than 20,000 troops from all 50 states and four u.s. iot. they remained there for protection through the presidential inauguration. one-third will remain on duty through mid march. some of your favorite or maybe not so favorite rules will be back again for the coming baseball season. sources say the league and players agreed to bring back a few of the health and safety protocols in place last year clearing the way for spring training to start on time. for one, double header games will now go into seven innings, and extra inning games will start each inning with a runner on second base. pitchers and catchers report to camp next week. disneyland is getting ready to hold its first major event since the pandemic. the park announcing it plans to hold upcoming outdoor dining event as part of the 20th anniversary of its california adventure park.

the sun very much today? >> it's going to be very much like yesterday, except this morning we're starting out with some light showers moving through. we're able to track it with storm ranger, our mobile doppler radar, showing that rain moving through parts of the north bay anne springing into san francisco as well as parts of the east bay. so with this moving through this morning, you may need to turn on the windshield wipers for a little while. it's not going to last all day. if you're planning to head out to the park in concord, the rain chances continue through about 8:00 and then we'll just see the clouds lingering as temperatures warm up and make it into the low 60s for tonight. we're feeling some seasonable weather going into the forecast. we have several more storm systems headed our way. the next one arrives on thursday, mostly during the afternoon, continuing into the evening and then once that clears out on friday, we'll have another one right behind that on saturday. it looks like it could bring some additional rainfall, and then a third storm system coming

in by monday looks like it could hold a lot of that rain farther to the north. but we'll be watching that as we could add up on some additional rainfall totals and some much needed rain. we're looking at anywhere from about a half to three-quarters of an inch, and that's just with that first round of rain. we will see more showers saturday afternoon and into early sunday morning for the sierra, over next week the possibility of about another foot, possibly two feet of snow going into the next week. so as we go through this forecast, expect temperatures to hold steady, off and on rain throughout at least next several days in the forecast. mike, you've been tracking some breaking news all morning. what is the update now? >> we'll look first with our camera, our crews are over there in san jose, look at the east santa clara, which is still closed at 26th, heading over toward highway 101 or from highway 21, an ongoing investigation, we're told is a homicide investigation. a body was found earlier this

>> reporter: correct, laura. you recall the u.s. supreme court ruled this past friday that churches could reopen in california at 25% capacity. santa clara county was the only county in the state to hold out on allowing indoor services, over covid safety concerns. so what changed? last night a federal judge with the u.s. district for the northern district of california issued a temporary order that indoor worship services could resume in the county, but at 20% capacity. the county will still require face coverings and social distancing. singing and chanting will not be allowed. the county health officer still strongly discourages any indoor gatherings citing significant risk to the community, as part of a statement they put out last night and also put this out from the county attorney and i'm quoting here "we are disappointed by the temporary order of the federal district court. covid-19 continues to pose a serious risk in our community, and unfortunately, no court decision can decree otherwise. the county has consistently had a legal framework for its health
