"today in the bay" friday morning starts right now. that's right, you heard me say it, good friday morning to you. thanks for joining us. i'm laura garcia. >> and we love the sound of it. and i'm marcus washington. mike has a look at the commute, but first let's start with the friday forecast, that fun friday forecast, kari? >> and it looks really great for today. as we are starting out with this live look outside in the tri-valley, wow t looks like there's a lot of people up and out the door this morning and we're starting out with temperatures in the upper 30s. it is a cold start but we have a really nice day ahead as our temperatures continue to warm up, at 11:00 we're in the upper 50s and eventually we'll reach into the upper 60s today. mike, how is it looking, it's supposed to be friday light, right? >> yes, that kind of has been the case every day during the pandemic. we're looking at lighter traffic. as kari showed you, it's smooth

be phased in. >> reporter: senate parliamentarian ruled the wage increase cannot be included. >> the minimum wage doesn't belong in there. >> reporter: setting up a showdown for billions of family, businesses and schools by mid march. tracie potts, nbc news. now to a live look in san jose, where there's good news for small business. the county expects to move into the red tier as early as next week. santa clara county has had some of the strictest covid restrictions in the country. indoor seating has only been allowed for about a month in the past year. if the south bay moves into the red tier as expected, it can seat inside at least 25% capacity. restaurants are encouraged but they say there needs to be more consistently. >> if you open us up again, you can't close us down again. the last closedown, nobody came to go. it was awful.

>> santa clara county says when it does go into the red tier, the restrictions will align with the state and that allows dining, church services, movie theaters to open indoors at 25% capacity. gyms at 10%. however, there's no word yet if the mandatory travel quarantine will be lifted. the county is making changes effective today, low-contact outdoor sports can start up again, that includes tennis, track and field. for choirs, singing at outdoor gatherings without a face covering now going to be allowed as long as you keep that social distancing in place. face coverings outside strongly recommended but not required, as long as you're more than six feet away from someone who is not in your household. 4:35. grab your popcorn and soda. cinemark is opening across the bay area, a total of three, they include locations in san rafael, redwood city and san bruno. the reopening comes after marin and san mateo counties move into the red reopening tier this

week. the theaters can operate at 25% capacity. happening today, another covid vaccine option should be moving closer to being approved. the much talked about johnson & johnson vaccine will be reviewed by the fda's outside advisory panel and if all goes according to plan, emergency authorization could come by the end of the weekend. the 4 million doses being shipped almost immediately. the johnson & johnson difference that pfizer and moderna, it requires just one shot. it can also be kept in normal refrigeration. it appears effective against new variants covid as well. now to a follow-up for you, jumping the vaccine line, this is happening here in the bay area. elected officials say the system is set up to make it easy for those who qualify to get the shot. the trouble s it's also easy for people to game the system. has more from san francisco. >> reporter: bay area counties are terminating vaccination contracts with the provider. good samaritan hospital closed et cetera vaccination clinic and disciplined its c.o.o. after it vaccinated dozens of people who were not yet eligible. >> i heard of a few peo continu exactly do you qualify? >> no one should ever, ever, ever be able to cut in line. >> reporter: while county supervisors are saying people need to wait their turn, vaccination providers are being told to make it easy for people to get one. the san francisco covid command center issued a health advisory to all vaccine proirlz this week. it says in part "use reasonable processes to verify that persons presenting for vaccination meet eligibility criteria, while avoiding overly burdensome documentation requirements that create barriers to vaccination." supervisor matt haney says there

are not strict documentation requirements by design. >> what we don't want to do is create a situation where we create such high barriers that people who really need the vaccine right now have trouble getting it because they can't demonstrate that they qualify. >> reporter: the honor system makes it easier for people to take a hard to get appointment away from someone who qualifies. >> if you aren't at risk, aren't in one of the categories, wait a couple weeks. we are going to get to you. >> reporter: haney says vaccine supply is expected to ramp up in california next week. jean elle, "today in the bay." nbc launched a website called plan your vaccine. the goal is to connect you to what you need to get your shot. head to the site, you select your state, occupation, age, then the site pulls up the closest locations where you can get the vaccine. go to planyourvaccine.com. distress video of an attack

in oakland. you may find it hard to watch. this happened wednesday afternoon outside of a beauty supply store on international boulevard. this woman tried to hang onto her purse as she is dragged by the car, you saw her going by the white car. they were shopping at oakland, when the thief graphed her purse, instinkd kicked in, refused to give it up. the woman tells us she is doing okay but still shaken up by the incident. >> she's lucky she's okay. there's an activist in southern california's asian-american community trying to make it actually easier to report hate crimes. esther liv wrote a 15-page hate crime book and it comes in various languages. the minute she heard president trump refer to it as the china virus she knew it would be true. >> i didn't feel safe in my own country because of the way i

distance, the east shore freeway, smaller fire looks like it's just off the roadway near ashby and gilman. we'll check on the traffic break coming up. happy friday to you. i'm bertha coombs from cnbc. we have wall street pointed towards a flat to lower open this morning. we are seeing interest rates continuing to rise, that pushed the nasdaq to its worst sell-off since october yesterday. the dow slipped from a record high, dropping 560 points on a percentage basis. the s&p down 2.5% and the nasdaq down 3.5%. that sudden increase in rates has really kind of spoofed investors, they're pulling out of big tech stocks like apple and facebook and rotating and shifting into so-called reopening plays, buying stocks from companies that will benefit they think the most from the vaccine rollouts like travel and dining.

today we're getting numbers on consumer spending in a little bit. we have earnings from draft kings and footlocker on tap. beyond meat has struck deals with mcdonald's and yum! brands despite restaurant sales and the pandemic weighing down on quarterly earnings. it will be the preferred patty supplier for the plant burger and new substitutes for chicken, pork and egg and new exclusive menu items at kfc, taco bell and pizza hut thanks to beyond's deal with yum brands. facebook is considering incorporating facial recognition technology into the upcoming smart glasses devices, set to be released at some point this year. the company's head of hardware, andrew bosworth confirmed a buzzfeed report thursday saying facebook is looking at the technology but will only include

facial recognition in smart glasses if people wanted it. he noted ethical concerns the ways it could be used and facebook needs to consider ways to prevent that from happening. marcus and laura, those are the latest headlines. on twitter he talked about positive use, potentially for someone with alzheimer's who has trouble recognizing people could be a good prompt but you know, with all the problems with ai and particularly when it comes to facial recognition and people of color, there are also a lot of scenarios one could imagine work out like "minority report" that wouldn't be so positive. >> not at all. you can find good in everything, so i don't know about that one just yet, bertha. all right. thanks, bertha. >> i'm always surprised when my son doesn't recognize me in the morning. coming up on "today in the bay" a brand new legal ruling in the battle to start up indoor

good friday morning. take a look out, you're like, where is that? that's san francisco, as we get started with the morning. 4:49 and it is friday, the team is all here and we're ready to go. meteorologist kari hall has been keeping us up to date with the beautiful forecasts this week, a little bit cooler some dayrtain the sun out, kari.

>> yes, breezy winds at times, a lot of sunshine and starting out today the same way with our temperatures right now in the low 40s as we head over to walnut creek, and we do have a lot of sun in the forecast, as we go into today. so even with this cool start, it will be a nice and warm afternoon, reaching close to 70 degrees in concord, most of us staying in the mid to upper 60s today. some lower 60s near the coast with san francisco reaching 62, and 56 in half moon bay. if you're going to the beach, have on a nice warm jacket. looking at our weekend forecast if you're going to yosemite national park this weekend we'll see temperatures in some areas reaching into the low 60s, but those morning starts below freezing at times dipping below 30 degrees. and then for monterey, expect a high reaching close to 60 degrees each day, starting today, but a lot more sunshine in the forecast. speaking of sunshine, it's going to stay dry, going into at least

the middle of next week. we do see a couple of storm systems passing very close by, but overall, that high pressure dominates, keeps our weather dry and then toward the end of the forecast, possibly by the end of next week we could be tracking the chance of rain, but we'll see how that pans out. we know that we need a lot of rain at this point, and we are going into the start of march with more dry weather, temperatures reaching into the low 60s. we'll also have gusty winds picking up tomorrow night into sunday morning but overall it's a fairly quiet weather pattern. hopefully it's looking still fairly quiet out there for the morning commute. mike? >> yes, overall fairly quiet. we will take you to berkeley, though, there's activity, let's show you that portion of the east bay, i've circled westbound 80 at gilman, where the crash may be blocking your two left lanes right now until they can move some vehicles.

there may be a quick traffic break and calling out also southbound 13 around redwood road we have that crash, had debris and possibly affecting all lanes forreturned, i think they've cleared at least a few of those lanes heading down toward the 580 merge and the rest of the bay you got green sensors. new details the final report of the helicopter crash that killed kobe bryant his daughter and seven others out. the pilot error was the most significant reason for the crash. earlier the ntsb released its initial investigation and said the pilot's decision to fly into those clouds during bad weather is what led to the crash, the deadly crash. investigators say the helicopter was mechanically sound and its engine and controls were working normally. we have a follow-up on tiger woods this morning. he's waking up in a different hospital. he was transferred to

cedars-sinai medical center in l.a. as he continues to recover from those massive injuries to his right leg. he was originally taken to ucla harbor medical center after tuesday's crash. police say he won't be charged with any wrongdoing. it was just a really bad accident. this is a blow to 25 gyms that want to resume indoor operations in san diego county. a federal judge just said no. the group was suing the state and the county amid the current covid-19 restrictions. similar to other reopening lawsuits the gyms argued they should be deemed essential business. it was unclear whether the group would seek to try to appeal that ruling. it is 4:53. coming up next on "today in the bay," "nbc bay area responds." >> our money-saving team has 5 million reasons to smile today. we'll tell you about melissa, art and how other complaints pushed us past a milestone. i'm consumer investigator chris chmura, "nbc bay area responds,"
