"today in the bay" continues right now. >> good tuesday morning to you. thanks for joining us. i'm laura garcia. >> and i'm marcus washington. let's get you out the door this morning. meteorologist kari hall has a look at what we can expect from that forecast today. kari? >> hey, before you head out, you want to make sure that you have a nice warm jacket but also prepare for some high winds today. we're starting out clear and also calm in walnut creek, 45 degrees, and the slow climb in temperatures today. it's going to be a nice one. as our temperatures reach up to 68 in oakland, we'll also see a high of 68 degrees in palo alto and upper 60s in parts of the north bay, but the wind is going to cause some issues. we could see some mountain gusts reaching over 50 miles per hour.

so we'll talk more about that and some warmer air in the forecast, coming up in a few minutes. >> thank you, kari. right now, in colorado, police sorting through witness statements to determine why someone would open fire at a supermarket, killing ten people. this happened yesterday afternoon in boulder, about 25 miles northwest of denver, and sent shoppers running for their lives. one man now in custody. they call him a suspect and say that he was injured during the police response. officers could be seen taking a shirtless man away in handcuffs with bloodstreaming down his legs. but they are not confirming if this is the suspect. among the ten killed, 51-year-old police officer eric talley. he was the first to arrive on the scene and had been with the department since 2010. he was also a father of seven children. boulder's district attorney is calling for more action than just thoughts and prayers. >> my heart goes out to eric

talley's family, his loved ones, and his colleagues. he was by all accounts one of the outstanding officers at the boulder police department and his life was cut far too short. >> so far, other victims have not been identified, and it's still not clear if that suspect had a prior history with the supermarket or any of those victims. support is pouring in from california governor gavin newsom, along with other state lawmakers and police departments, tweeting their reactions to that shooting. many tweeting tributes to officer talley. breaking news in india this morning, more than 100 people are injured after a packed spectator stand collapsed. look at it there during a sporting event in southern india. in the video, it was a collapse of a temporary gallery that was set up. we know at least 20 people were taken to the hospital. so far, there are no deaths reported. the crowd was watching a championship match for a popular

team sport there called kabati. by this time tomorrow, close to half of the bay area may be reopen again for things like this, indoor dining and everything else that comes with the orange tier. now seemingly finally within reach for three additional counties, santa clara, san francisco, and marin. "today in the bay's" kris sanchez joins us live this morning in san jose and kris, certainly a lot of anticipation for both the patrons and i would imagine the business owners as well. >> reporter: we've been talking to people about moving into the orange tier since yesterday and the answer we hear most often about when we say what are you looking forward to is people say they feel like they are feeling like they're getting closer to normal. in santa clara county, people are looking forward to gather with friends at cafes like this one, also at restaurants, and at bars. we know that the owners are looking forward to that as well. same story in san francisco, where bar owners are eager to get back to serving up drinks

inside without having to scramble and imp vials the food menu in order to meet state rules. musicians also getting ready to be able to play more freely again. >> enjoying being around company and being around vibes and everything else, yes. >> i'm ready. i mean, i feel like we've been like a hermit crab in our shell exploring and getting back out. >> it's more than we reopened at one time since the beginning of this. that is why this is great news. >> reporter: aside from restaurants and bars, orange tier restrictions would also increase capacity for some family friendly operations like museums and zoos and churches might be able to invite more people inside for easter sunday services. to remain in the orange tier, counties have to maintain that caseload of fewer than four cases per 100,000 people and also positivity rate that is 5% lower than 5%.

in san jose, kris sanchez, "today in the bay." >> all right, good news for those counties. thanks so much. another milestone for california as well in the fight against covid, governor newsom tweeting overnight the state administered 15 million vaccines. he said that's 5 million more than any other state. it's also about 35% of the state's population. and with a fourth vaccine likely soon on the way, health experts that worry that you're going to start shopping for your injection. apparently some people are already doing that and passing up the first vaccine available. some people tell us that they want the pfizer vaccine or the johnson & johnson one-dose option because they don't want to have to get another booster shot down the road. ucsf infectious disease expert warns us one key part in beating the pandemic is getting the first shot you can. >> your immunity helps your friend's immunity and neighbors immunity because we get to reducing cases and reducing transmission in the community faster and we're going to get to

morning. how are we looking out there? >> it's going to be a really nice day but a little windy. maybe not the best hair day. we'll see gusts in the valleys at about 125 to 20 miles per hour but some of our mountain gusts may reach up to 50 miles per hour today. we'll see more sunshine nice and warm with warmer temperatures in the forecast. let's talk about the wind speeds going hour by hour, we're going to head to the early afternoon with the wind speeds at about 29 miles per hour, in spots like san francisco and livermore and some of our once again hills and mountains will see the higher winds but in the valleys, even there in san jose we could see 25 to 35030--mile-per-hour wind gusts for today. make sure the garbage cans are secured outside and any lawn furniture. mike, how is it looking for the morning commute? >> kari, just taking a scan and we have something going on for the south bay, so let's take folks down there on our maps.

a disturbing report but i don't think there's a huge alarm going on here. southbound 85, where the arrows are from 17 to caudal a traffic rolling. someone reported a car driving slowly on the shoulder the wrong way, northbound on the southbound side. southbound side see the slowing from the traffic break, compressing town toward caudal and no other reports. that is the better news. we'll track that but is should be just fine even if you're there right now. a new crash shows up over there in san leandro, 880, not sure what's going on. and a live look at the golden gate bridge, i saw a big puff of what looked like smoke but i think it was just exhaust from one vehicle traveling by because nothing's happened in the last couple of minutes, just the crews. watch for the cone zone. laura, over to you. >> thank you very much, mike. kids under pressure, at 5:25 on "today in the bay," more and more schoolchildren are admitting to cheating. the reason so many are willing to gain the system.

as we take a look at your day planning to head out to the park, we're going to see our temperatures mostly starting out in morgan hill in the upper 40s and then we'll see it warming up. it's going to be a beautiful day for any outdoor activities, but watch out for those high winds. we'll talk about a warmup in our forecast, and even look ahead to the weekend as well as our climate in crisis, all of that coming up in a few minutes. it looks like all the assigned unit force chp have been called off from the traffic break south 880 toward caudal. this is not very interesting. much more interesting shot is scott. >> well, thank you, mike. good morning. very happy day to you as well. what is it, tuesday. airlines are pressuring the cdc to say it's safe to fly after you've been vaccinated. scientists have previously said once you're two weeks past your second vaccination you can safely meet with other people

580, coming out of the altamont with a typical slower drive, the first to build on a typical day anyway but calm out there right now. kari, how is it weather wise? >> it looks pretty good out there. we're starting out clear and some mild temperatures, but it's going to warm up today once again even a little bit warmer than it was yesterday. let's head to the south bay looking at our high temperatures for this afternoon reaching 67 in san jose, as well as east san jose and cupertino reaching 66 degrees. as we head toward the east bay, expect it to reach into the upper 60s once again with martinez reaching 67 degrees. oakland reaching 68, and 66 today in livermore. near the coastline, it's going to be very gusty and half moon bay will reach 64 degrees but going to be an offshore wind and we could see some of those gusts reaching over 30 miles per hour there. we've seen high wind gusts in san francisco as well, reaching up to 67 in the mission district and our north bay highs reaching into the upper 60s as well with

sunshine and it's going to be very pleasant. high pressure moving in, but we still have the storm systems passing to the east of us, and that's what's creating the high winds and it will be slightly cooler on thursday, as that storm system passes just to the east of us, but then as high pressure moves in for the weekend, it's going to give us more sunshine and also some warmer temperatures and it may still be quite windy. we have continue to monitor our rainfall deficits. in oakland over ten inches. in santa rosa we need over 18 inches of rain to catch up to normal. that's not happening in this forecast. it's going to be very dry as our temperatures go from the 60s to the upper 70s this weekend, first full weekend of spring and we're talking about weather that feels more like the end of spring as well as san francisco seeing those temperatures reaching into the upper 60s towards the end of the forecast. now let's turn to our climate in

crisis, we've been keeping an eye on our rainfall deficits and also seeing what's happening with our drought. the last 20 years, we've had droughts in 16 of those 20 years. what we're seeing is drought is becoming more frequently happening, as well as what we experienced in 2014 through 2017. how could we forget with all of the water restrictions and the problems that we had with the drought. well, it looks like as well we could see more of those very bad and worsening wildfire seasons as a result, and we can basically chalk 2021 up as another drought year. we're seeing abnormally dry conditions at 99% of california right now, and we do still have the extreme drought that's happening in parts of the north bay. unfortunately that's one of the things that comes along with climate change and we've been

5:24. jury selection could wrap up in the trial of derek chauvin, the former minneapolis police officer facing murder charges in the death of george floyd. 14 jurors have been selected but the judge wants to find one more alternative, just in case. opening statements are scheduled for monday. along with support, donations pouring in for families who loved ones in the spa shootings. ken jeong is donating to help

the families. calls are growing for more to be done to combat anti-asian hate crimes. new details in shasta county where the district attorney is reviewing a report on the cause of last year's zogg fire. cal fire says it started when a tree fell into a pg&e power line. the fire killed four people, burned 56,000 acres. investigators have seized pg&e equipment related to that fire. also shasta and tahama counties sued pg&e alleging negligence. pg&e has not issued a response. a live look in miami this morning, where leaders are ready to extend the state of emergency to control spring break crowds. an announcement may come today that would allow a curfew to remain in place through mid-april. miami beach police say more than 1,000 people have been arrested since of start of spring break and the cdc is warning of another possible surge if more action is not taken. new numbers this morning

>> all right. well we have some more great weather in the forecast for us. we're starting out with a live look outside in san jose, it's 48 degrees. of course, we have our cool morning start but it is mostly clear and a lot of sunshine for today as our temperatures warm up, headed up to 67 degrees. that's what we'll see in san jose. 68 in oakland as well as palo alto and san francisco reaching a high of 64 degrees but it will be windy. we'll talk about the high winds in the forecast and also more of a warmup coming up a little bit later. >> all right, kari, thank you. for a second time since last week, authorities are investigating a deadly rampage. first georgia, now colorado. investigators this morning they're still at the scene of the boulder supermarket, ten people died there. among them, a police officer who is a father of seven. a suspect now in custody. nbc's erin mclaughlin has the latest on what investigators are saying and what authorities still have yet to confirm.

>> reporter: good morning. authorities say that this is a complex investigation and at this point, we certainly have more questions than answers. authorities say they have a suspect in custody, though they've yet to release his name, also refusing to confirm whether or not he is in fact the individual that we saw being led from the grocery store in handcuffs, leg bloodied. authorities say there are ten victims in total. we know that among the victims is 51-year-old police officer eric talley, father of seven, youngest being 7 years old. his father spoke to us late last night, saying that he was actually trying to get out of the police force to avoid this kind of violence, just one of many stoies we'll be hearing over the next few days. authorities have yet to release the names of the other nine called killed. we expect an update from the police later today. back to you. >> thanks so much, erin. come up, the "today" show

"today in the bay's" bob redell is live in dublin this morning. bob, what can we expect later in the courtroom this morning? >> reporter: good morning to you, marcus, here at the east county hall of justice in dublin at 9:00, teanto bailey a 26-year-old man from oakland will be appearing before an alameda county superior judge for an attorney and plea hearing. bailey is accused of assaulting, robbing and murdering pak ho, a 75-year-old asian man. ho was on his regular morning walk near lake merritt in oakland when bailey allegedly punched ho. ho hit his head on the pavement and later died from his injuries. people are trying to determine

if at tack was a crime of opportunity or fueled by a hatred of asian people. across the bay in san francisco, steven jenkins a 39-year-old homeless man accuse of in last week's attack of an elderly asian man and woman in sf will appear before a judge. jenkins allegedly assaulted an 38-year-old man and as a security guard pulled jenkins away he allegedly assaulted a 75-year-old woman. that woman fought back, sent jenkins to the hospital. police say both assaults were unprovoked and they're trying to figure out if they were racially motivated. shae xen shea is in better spirit, eye no longer swelled shut. a go fund me page he writes "she said we must not submit to racism and must fight to the death if necessary." reporting live here in dublin, bob redell, "today in the bay." in san jose, volunteers are

walking the streets of japantown, citizen patrol members wear red vests and carrying whistles. similar programs are already in place in san francisco and oakland, this as sonoma county supervisors and other community leaders held a virtual hearing to discuss the recent attacks. the superintendent of santa rosa public schools diane kittamura says she's heartbroken. >> in all of that work, 38 years of my career, and here we are today, and i can't even protect my own mother. >> kitamura made the call to enact policy changes. you can help in the efforts to stop the hate. nbc bay area, telemundo 48 and our parent company comcast have partnered with the bay area-based asian-pacific fund to provide grants to organizations working to stop attacks against the asian-american community. since february, more than

$750,000 has been donated. a live look in san francisco and san jose, and there's big news coming from these two. three more counties are expected to move into the orange tier fending on state assessments later today. san francisco, marin and santa clara county are expected to join san mateo county, which has been in the orange tier since last week. and here are some of the changes for those businesses in those counties, indoor dining can increase to 50% capacity, bars could reopen outdoors, bowling alleys could reopen for the first time. contra costa has just allowed more access to covid-19 vaccine, and now if you are 50 and older and live in the county or work there, you can schedule an appointment. that decision comes after solano county lowered its vaccination age to 50 last week. the county is having difficulty keeping up with demand. allocation of new doses have dropped by 60%. health leaders in contra costa county say that does not mean the same scenario will play out

you more information if you're eligible now. it's 5:38. a live look out at the golden gate bridge, looking nice and smooth traffic wise but what about those temperatures? meteorologist kari hall has been keeping track of that weather and kari, i can't keep talking about how great yesterday was. i was doing an interview for "race in america" show and we did the interview outside. it was just beautiful. >> it was so nice. hopefully today you'll have a chance to relax a little bit more and maybe go out for a hike. in the north bay, our temperatures will start out in the morning mostly in the 40s, but then as we go through the day, all of that sunshine will make it feel nice as we reach into the upper 60s, but it's also going to be quite windy, and the winds will start to pick up. as we look at san jose at lunch time it's 23-mile-per-hour winds and some of the gusts. san francisco may have some 30-mile-per-hour gusts so we'll continue to go through this time line and take a look at the wind speed forecasts coming up. mike, what's going on right now for the morning commute?

monroe which confiscated more than four tons of cocaine and nearly six tons of marijuana since january in international waters. the drugs have a street value of more than $300 million. overwhelmed immigration agents have reached a deal with san diego county to help house unaccompanied children at the border. sources tell nbc news some 5,000 children are being held at the border patrol facilities many beyond the 72-hour legal limit. san diego county allowing border patrol to use the san diego convention center for housing the minors seeking asylum. they expect to use the facility for at least the next 90 days. president biden is pushing to fix america's infrastructures and republicans are up in arms over a lapse. laugh. >> questioning a moment from the vice president if she'd visit the border, they're questioning her laugh. >> do you plan to visit the border?

>> not today. but i have before and i'm sure i will again. >> president biden meanwhile expected to propose something president trump proposed a $3 trillion investment in america's infrastructure. bridges, highways and communication and of course green energy, the biden white house says our plan to reduce carbon emissions and dependency on foreign energy is inseparable from our economic future. treasury secretary janet yellen and fed chair powell will speak with congress about that today. a number of republicans who voted to impeach donald trump along with many democrats are pushing nancy pelosi to drop any plans to review the results of a congressional race in iowa. republican marionette miller meeks beat democrat rita hart by six votes. the state certified that vote, some are pushing congress to review it but republicans and democrats who said trump was wrong to question a state vote

say congress should remain consistent and accept iowa's count. sidney powell made wild accusations against dominion voting machines. strees' asking a court to dismiss a lawsuit brought against her by dominion saying no reasonable person would have actually believed what she was saying at this press conference. dominion in its lawsuit says she made "wild accusations and outlandish claims" in her case to dismiss. she said exactly, i should not be sued because people should understand what she was saying wasn't true. >> thank you. california counties are getting closer to verifying the 1.5 million signatures needed to trigger a recall election for governor gavin newsom. some 2 million signatures were submitted. if enough signatures are verified there would be a recall election likely in november. here is how it will work. there would be two questions for voters. the first should governor newsom be recalled, the second one, who should succeed him? the candidate with the most votes on that second question wins, no majority required. new problems for the employment development department's problem-plagued website. all weekend and into yesterday, people had a hard time locking onto the site to access their jobless benefits. for part of the time, the site was shut down. department leaders are awaiting details from their i.t. branch, but it's just the latest in a string of embarrassments. one state lawmaker says it's time for more accountability. >> everybody has a right to know

all to slow down and kind of take notice of some of the things that we might have missed if we were just driving by in our cars, in that we found a lot of messages to the community. >> i've been called a couple of times to just share some color and send out some good vibes. >> reporter: san jose muralist lyla gemellos worked steadily, hired by clients to use art to lift the community's spirits. right now, she's painting the nostalgic valley of the hearts to light but also painted playful murals like the llama corn reminding people to keep their heads up and the stallion reminding people to stay strong. >> the bright side is that a mural is socially distanced already. this is an activity that you can take part in without any cost, without anybody else. >> reporter: and we needed every bright spot we could find over the last year. 40% of adults reported mental or behavioral conditions like anxiety and depression and 27% more children ended up in

these days and trending this morning, a different kind of zoom fatigue. there's now a new movement to take the video out of video conferencing. people working from home are growing tired of always being on camera during those zoom calls. so they're urging people to turn off their cameras. experts say always being on is causing social anxiety. we're always on here. >> always on and ready to go. >> but how that works for tv. see how that works for tv? not so good, huh? >> not good at all. a good look at the forecast though, that's something to make us smile this morning. >> absolutely. we have sunshine that's going to make it feel good out there, especially if you're taking the zoom calls outside to the back patio. we're starting out cool with our dump tiers in walnut creek in the mid-40s. it will be slow to warm up throughout the morning but the rest of the day is looking great, just a heads up, though. there will be high winds so that may knock your camera stand over

especially if you're outside throughout the middle of the afternoon as our winds pick up. this shows the winds in miles per hour and look at san francisco, at 6:30, wind speeds coming in at 32 miles per hour, so very windy and the winds will continue through tonight. some of our mountains may see those gusts over 50 miles per hour, but this at the same time is our temperatures reaching into the upper 60s. so it will be a very nice and sunny day. as we go through the forecast, there will be these storm systems passing to the east of us and that's what's causing the high winds because we also have high pressure building just to our west, and it's keeping it clear as well as dry, going into the weekend, that high pressure inches in a little bit closer, and that's going to ramp up those temperatures especially from saturday into sunday. so look at our seven-day forecast for the inland areas, we're in the upper 60s through thursday and then we start to see the 70s in the forecast for the weekend. it will be dry, but for the most part, doesn't seem like anyone's

complaining. looking forward to a weekend of getting outside without the restrictions we've seen over the past year. mike, getting out the door this morning, how is it looking right now for the commute? >> it's also looking breezy there, kari. dumbarton bridge, bay bridge, having those notes from the chp as well as the san mateo bridge, so just use caution. the bay bridge toll plaza doesn't see a problem here, that's great. westbound with the headlights moving to a little slowing on the incline and you see that on the map. we also marked outside of our view a disabled vehicle coming off of 580 toward the toll plaza off the berkeley curve. someone fixing a flat tire out of lanes. watch out for them. the rest of the bay shows a smooth drive, the circle on the bottom of the screen, obviously marcus, our typical slowing north 101 through san jose. first sign. >> thanks, mike. happening now, air travel lifting off. tsa reports it's been 12 straight days of more than 1 million passengers taking to the skies. sunday was the most with more
