coast of louisiana a vessel cap sizes "early today" starts right now. good morning, i'm phillip mena. >> i've frances rivera. two dozen arrests were made overnight. police tensions seemed lower there is still a curfew in effect with national guard troops on the streets. kim potter who shot daunte wright was arrested and posted bond her first court appearance is today. nbc's jay gray has more. >> reporter: the calls for justice continue in brooklyn center three days after daunte wright was shot and killed during this traffic stop, kim potter, the officer who pulled the trigger wears an orange jump suit instead of a badge charged with second degree manslaughter police have said it was a mistake, that she thought she

only about ten miles away from there another former officer is on trial over the death of george floyd. the defense team for derek chauvin is expected to finish presenting its case this week and only call on one expert witness on wednesday gabe gutierrez is there in minneapolis. gabe, good morning. >> reporter: phillip, good morning. here at the courthouse the defense is building its argument that george floyd died due to drug use and underlying health conditions not due to a lack of oxygen they called one of their key witnesses on wednesday, a former medical examiner in maryland so far george floyd's heart has been at the heart of derek chauvin's defense. >> how did the heart and drugs contribute to the cause of death? >> they were significant they contributed to mr. floyd having a sudden cardiac arrest. >> reporter: dr. david fowler said floyd died with sudden

cardiac arrest and illicit drugs, not lack of oxygen. >> in your opinion did this impact the structures of mr. floyd's neck >> no, it did not. >> reporter: fowler said he would have classified floyd's manner of death as undetermined due to multiple factors, including this >> there is exposure to a vehicle exhaust, so potentially carbon monoxide poisoning. >> reporter: fowler recently retired after 17 years as the chief medical examiner of maryland cross examination, the prosecution came out swinging. >> i think you should do your homework before you arrive at your opinion, fair enough? >> yes >> you haven't seen any data or test results that showed mr. floyd had a single injury from carbon monoxide, is that true? >> that is correct. >> reporter: also fowler acknowledged floyd needed immediate medical care to reverse the cardiac arrest. >> are you critical of the fact

six crew members have been rescued and one person found dead while 12 others are still missing. the coast guard says it's possible some of the missing could be trapped within air pockets within the ship. this morning "the wall street journal" reports the biden administration today will impose sanctions on russian individuals and entities as well as expel ten russian diplomats in an effort to disrupt the 2020 election earlier this week president biden and russian president vladimir putin had what's been characterized as a tense phone call amid russia's buildup along the border with ukraine. democrats want to give the supreme court a deeper bench a group of democrats are introducing legislation to expand the high court from 9 to 13 justices. tracie potts joins us with more. tracie, this bill faces a tough fight ahead. >> reporter: frances, this could be interesting the u.s. supreme court was established back in 1789, and

while the size of the court fluctuated early on, it's been the same, nine justices, for the last 150 years this legislation could intensify the fight. it's going to be interesting it taps into the fury felt by some democrats after republicans blocked president obama's choice for a vacancy back in 2016 but then amy coney barrett was confirmed as a justice just days before the 2020 election so this bill to change the size of the court is led by massachusetts senator ed markee and jerry nadler it's co-sponsored by congressman hank johnson and mondaire jones t. will face push back from both sides. president biden said he is not a fan of packing the court although next week he introduced a new commission of liberals and conservatives to study the
