i'm laura garcia. >> and i'm marcus washington. we want to start out with breaking news this morning, we have liftoff on the red planet and history as the ingenuity mars helicopter taking off for the first time today. take a look at this picture right here. this is so cool. this is history right here. and that video we want to show you there inside the area where they were so excited as this was all happening but anyway, this was the first power flight on another planet. it triggered a lot of cheers in the mission command centers. we have video of that earlier i wanted to show you how excited they are that we're at this point right now. the ingenuity touched down on mars earlier this month after disconnecting from the perseverance rover. so cool. in a few hours, closing arguments are set tor trial. we've got a live look in minneapolis where police are bracing for possible protests once a verdict is reached. other cities across the nation bracing for possible all-fought

from that verdict. right now in minneapolis, windows are boarded up, national guard members are posted on nearly every block. starting wednesday, minneapolis public schools are actually pausing in-person learning. of course a verdict will have to be unanimous, even if one of the 12 jurors is a holdout the result is a hung jury and a mistrial. one bay area poised to be the first in our region to move into the yellow restrictions as soon as tomorrow, it could come as some businesses hope to return to normal. "today in the bay's" pete suratos is live in corte madera with details this morning. pete? >> reporter: yes, good morning to you, marcus. ma be the first bay area county to moves becaus they're meeting two requirements. they are under two cases per 100,000 people and the positivity rate in the county is just below 2%. let's talk about what we can

expect to see if the county moves into the yellow tier. we'll see bars open indoors at 25%. gyms can also up its capacity to 50%, and outdoor live events can also increase to up to 67%. but for restaurants, they would have to remain at 50% capacity, which could be an issue if the state eventually makes changes to capacity limits. now san francisco and san mateo counties are also getting closer to the yellow tier, but the earliest they can move into that tier would be may 4th. reporting live, pete suratos for "today in the bay." the biden administration starting a major publicity push today to tell everyone over 16 they can now receive a covid shot. "today in the bay's" tracie potts joins us live with more and update on the future of johnson & johnson's one-shot vaccine as well. tracie? >> we could know in days whether or not they're going to start using that vaccine again. dr. anthony fauci says he

doesn't think that the cdc advisers will drag this out. meantime, expect to hear talking about vaccines and y covid, but you'll see him before that, as his administration fans out across the air waves, across social media to encourage people to get the shots. tv, twitter, facebook, snapchat, see president bidden, vice president harris, dr. anthony fauci and others from the air waves blanketing social media as the covid vaccine becomes able to everyone over age 16. half of all adults have now at least one shot despite a pause in the johnson & johnson vaccine. dr. fauci says expect a decision on that by friday. >> my estimate is that we will continue to use it in some form. i doubt very seriously if they just cancel it. >> reporter: but fear has led to some people canceling appointments. >> my family had an appointment today, they all canceled.

>> reporter: the cdc map shows more vaccinations happening on the coasts. new england and california, and less in the south, we're now seeing nearly 70,000 new cases a day in the u.s., one in ten of them in michigan. >> our success at keeping covid spread down for such a long period of time has left us with vast reservoirs of people who don't have antibodies and that was a good thing until the variants came on stage. >> reporter: current vaccines do work against the variants. tracie potts, nbc news. developing this morning, police are hoping a $40,000 reward can lead to an arrest in east oakland fire that killed a father and his toddler on saturday. six other people inside the homemade it out alive. firefighters say the father died trying to save his daughter. police believe it may be connected to a series of other fires and shootings starting with a deadly shooting at a liquor store on april 10th. now it's not clear why they

believe these incidents are linked. the manhunt continues this morning in and around texas, for a former deputy authorities say killed three people in austin yesterday. they believe that suspect, 41-year-old steven broderick, knew his victims and is now being called a case of domestic violence. he's also considered armed and dangerous. new details gun opponents are pointing out even red flag laws are falling short in preventing deadly shooting rampages. it follows last week's mass shooting in indianapolis, where eight people died at a fedex facility. that gunman purchased his weapons even after his mother warned police he may be suicidal. at one point last year he was placed on a mental health hold and had a shotgun removed from his home but he later legally purchased two guns found at the scene. mourners including many from the city's sikh community gathered yesterday for a vigil. four of the eight victims who

in the afternoon, but then make it into the upper 70s. a few spots will reach into the low 80s. we'll see a high of 83 degrees in concord and even more cooling tomorrow. so we'll talk more about that coming up. mike, how is it looking right now for the commute? >> well, some good news, kari, we have a reopening of the roadway and we'll take you out to the big map and show you overall green sensors and as we zoom toward the tri-valley area, highway 84 was closed, that reopened and the arrow shows you where highway 84 typically shows slowing and that's what we see right now. again just over to the other side of 680 the windy part of 84 reopened. a crash out of the altamont pass not affecting the volume but it is on the shoulder there, we still have one lane of the off-ramp closed from northbound 680, not a p alameda county look great toward and across the bay bridge. back to you. >> thanks so much, mike. 5:09. we have a new warning this

the bay bridge beautiful clear view. you can see the san francisco side of the span i guess in the middle of that dark spot is treasure island. lights move steadily and taillights are going west. we'll give you more, coming up. good morning, very happy monday to you as well. the federal governmen investigating a tesla crash in . the fire after the crash burned for four hours. firefighters tell the local newspaper they poured 30,000 gallons of water on the car. the crash may have happened while the tesla was in self-driving mode. it appears nobody was even sitting in the driver's seat at the time. wall street starts the week at yet more records. the dow and s&p 500 at all-time highs. a lot of companies will open their books to investor this is week as well. alaska airlines tells the "san francisco business times" it's expanding routes in and out of santa rosa to bring more

people from southern california into wine country, including new service between santa rosa and orange county. alaska lets you check a case of wine as baggage for free. we expect facebook will announce several new products today including something that might compete with clubhouse. clubhouse is an audio only meeting system, not unlike a conference call or a zoom call without video. it was q rage for quite some time. apple also holding a virtual event tomorrow, where we may see new ipads and possibly something called ear tags. if you're familiar with tile, it's the same thing, a small bit of plastic you attach to your car keys or other things you often misplace and then it works like find my phone. you can set off a noise to better handle it. i have to find my phone 100 times a day. i leave it everywhere around the house. >> yes. yes. >> it's car keys, glasses, wallets. >> remember they had the clapper? you could clap to find your

keys, do you remember? >> i do. same idea. >> you can call my phone? can someone call my phone? >> i'll find it. i'll get right to it. thanks, scott. i'll call you. peloton pushing back after a federal safety agency urged parents to stop using one of the company's treadmills. the consumer products safety commission asking americans with children to stop using peloton tread plus. the fear here is that small children and pets may become trapped in the back roller. the agency adds there are 39 reports of children being injured by the machine. in response, the company is calling the warning misleading and inaccurate. peloton says the product is safe when used properly. gas prices still heading up, aaa says averages in santa clara county and alameda counties are about $4 a gallon. in san francisco, it's even higher, averaging $4.12 a

maybe. oh my gosh. >> i have a lot more than that, but -- all right, let's get a look at the forecast for you today. how is it looking, kari? >> pretty good, but i think i'd get one of those temporary tattoos, just to say okay, here it is and would they even know the difference? okay, so let's check out our live view as you're maybe planning lunch for today. start off with breakfast and morning view of the low clouds over san francisco and a lot more kids are heading back to school today. let's check out our forecast mo mountain view dropping off the kids, we'll see temperatures there in the upper 40s. jacket weather, mask, all of that stuff and then as you pick them up, we'll see our temperatures in the mid-60s. it's going to be a lot more comfortable, so they may have the jackets off so make sure you write the name on the tag. as we get a look at our temperatures for today, as we head toward noon, we'll see some of our inland areas already in

the mid-70s and it's going to warm up, just not as hot as yesterday in some of those valleys. we will still have some mid to upper 80s in parts of the east bay, but then look at san jose, we're in the mid-70s and fremont also stayingp today and that continues through tomorrow as well. tonight we're heading back into the 50s, more dry weather in the forecast, but we do see some changes on down the line. let's talk about what's headed our way for the weekend. we're dry all week. by the time the weekend gets here we see a low approaching and we've seen a lot of these this season. by the time they get here, they dry up, but this time it looks like it could tap into some tropical moisture from a typhoon well to the west of us and that could bring in much more moisture and maybe a better chance of rain. so we're watching that for sunday. overall we have a very nice and mild week ahead as that continues. like to hear mild ah

when we get started on mondre l. but i did have a concern coming toward us that's eastbound 92, the san mateo bridge toward the hayward side where our camera is, how some flashing lights and looked like a traffic break starting but then cleared up. it's been okay. the map shows no disturbance to the traffic sensors, that hasn't lasted long enough so good stuff. the rest of the bay clear, easy drive. a crash on 205 at the merge with 5 a80 but not a problem with the altamont pass. contra costa county popular routes and 580, the reason why we're in the green, everybody's still okay as far as the spacing. back to you. 5:20. next on "today in the bay," "nbc bay area responds." >> their treadmill is dead, but the owner is still sweating over a refund. i'm consumer investigator chris chmura. it up for an extra 250 bucks, cheney noticed the belt wasn't perfectly aligned. you can see the gap right there. fast forward a few months. cheney says this happened right here. you can see the belt had shifted and folded over, turning this treadmill into a $1600 dust collector. cheney wanted a refund. that didn't happen until our team contacted proform and best buy, that is a $1656 win for shenny. neither company would send us an explanation. things get tricky sometimes when you've got a store and a setup crew and a manufacturer all involved in the same dispute. shenny described a fair amount of finger pointing between the two companies but was not deterred at all and documented every instance with photos. fighting for yourself can be a marathon, but a good time line like shenny's with photos, that starts from the moment you notice something is off, might just carry you to the finish

reopening across the bay area. >> "today in the bay's" bob redell joins us live in kensington in west contra costa county this morning. the return of the classroom is voluntary not only for students but for staff as well? >> reporter: correct. good morning to you, laura and marcus. west contra costa unified is opening kensington elementary behind me and all of its other elementary, middle and high school campuses today for in-person instruction, the first time since this pandemic began. it will welcome back video on your tv screen, the superintendent outlines the safety measures that will be in place for students. classroom sizes will be limited to 15 students, masks worn at all times, staff and students will be required to get a covid test on site. we don't know what percentage of students chose to return to in-person instruction versus remain in distance learning but the district says 51% of teachers and 83% of other staff have chosen to return back to campus. just south of here, oakland

unified will resume in-person instruction today for pk through 6 and priority students in grades 7 through 12. 83% of oakland teachers plan to return to the classroom and last night, the oakland teachers union reached an agreement with the district for teachers and students to return for full in-person instruction coming this fall. and very south of here, far south of here in san jose, the east side union high school district is back on campus today, with a maximum of a thousand students on campus at any given time. we don't know how many students plan on returning. students will be tested regularly, required to wear masks and maintain a six foot social distance. reporting live in kensington, bob redell, "today in the bay." if you had a hard time booking the vaccine appointment, i have some good news for you this morning. thousands of new spots are now available. "today in the bay's" kris sanchez is live at levi's stadium mass vaccination site this morning with the good news.

kris? >> reporter: good morning. isn't that nice to be able to report this morning that there are vaccine appointments available? we know there are some here at levi's stadium where i am this morning and several of the other santa clara county mass vaccination sites. as of this morning, as you likely know, eligibility is open to anyone over the age of 16 who lives or works in santa clara county, includes anyone who already had covid and recovered. the cdc recommends that you get a shot because it's not clear how long those natural antibodies are going to last. if you are in santa clara county or you work in santa clara county, you can book a shot through sccfreevax.org. there are plenty available for next weekend and the days leading up to next weekend. there are a large number of vaccine appointments available through stanford health but in emeryville, you could still book an appointment at the oakland coliseum site. best way to do the state website

tomorrow, wednesday and thursday. the state is on track for most californians to be vaccinated by the middle of the summer, which is good because people are slowly starting to gather and travel and other parts of the country are seeing more new infections. >> we're also seeing that a growing trend of young, healthy, unvaccinated people, because they're not vaccinated yet, people are among some of the sickest. >> reporter: something that i found here in santa clara county through the sccfreevax.gov site is the form will require to you enter slashes in for your birth dates and dashes in for your phone number, but the keyboard doesn't necessarily let you do that on an iphone, so if you are having trouble booking an appointment through your phone, you might try to go onto your laptop and try to do it that way, that way worked out better for me and now i have an appointment booked for wednesday. i'm very excited about that. in santa .

to get under way. the jury may start slibrations as soon as this afternoon. the former minneapolis police officer is facing manslaughter and murder charges in the death of george floyd. "today in the bay's" jay gray is live outside of the courtroom with a closer look at what we can expect today. jay? >> hey there, marcus, laura, good morning to you. for the defense it's one last chance to convince this jury it wasn't derek chauvin's knee across his neck but drug use or his heart that led to george floyd's death. for prosecutors no question they'll get back to that video that's really been at the core of their case here, the final moments of george floyd's life, and they say that video's indisputable evidence that the former minneapolis police officer is guilty of murder. for 14 days the jury heard from police officers, doctors, experts and those that were there.u need a moment, take a minute. >> reporter: from george floyd's family but not -- >> i will invoke my fifth

amendment privilege today. >> reporter: -- derek chauvin. they've seen charts, maps, graphs, animation and video and today all of that evidence and testimony comes down to the last word from prosecutors. >> the case has gone in as well as i could imagine for the state. >> reporter: and the defense. >> all he has to do is convince one juror, right, to have one juror doubt the prosecution's case, and we have a hung jury. from judge peter cahill. >> it's up to the jury how long you deliberate, how long you need to come to a unanimous decision on any count. >> reporter: the jury will be sequestered in a city that is in essence sequestered as well. businesses locked down, boarded up, security stepped up, so many here, including those closest to the case. >> i'm very anxious and wondering what's going to happen, what's going to be the outcome. >> reporter: on edge for what comes next.

look, security's at an jowel time high for this trial, more than 3,000 national guard troops on the ground, marcus, laura, joined by 1500 police officers and federal agents here. >> well, jay, we know security is high, but tensions are so high as well. can you talk a little bit about the death of daunte wright killed by a police officer, just, what, about ten miles from the courthouse? >> reporter: no, you're absolutely right. that's certainly playing into what's happening here. you can't walk through downtown minneapolis without seeing national guard soldiers, humvees on pretty much every corner. it was already tense as you might imagine. it's really been ratcheted up here and playing a role inside the case but inside the courtroom a judge will determine when he releases the verdict and how he releases people from the courtroom, based on the atmosphere outside so a lot of people watching this very closely, and very nervous to be real frank, in this area.

>> that area and really across the country right now. jay, thank you. >> reporter: yes. more details bay area authorities are trying to figure out who targeted a defense witness in the derek chauvin trial and a warning, we're about to show you a graphic image of the bizarre vandal attack. police are trying to figure out who threw blood and a pig's head on the front porch of this santa rosa home. it was previously owned by a retired santa rosa police officer, barry brodd, who no longer lives there. he testified in minneapolis as an expert witness. coming up on the "today" show, they'll of course have much more on the trial. craig melvin will be live from minneapolis, starting at 7:00 a.m., right after "today in the bay," and later this morning, nbc news will bring you the closing arguments live in a special report. 5:39 this morning. and we're taking a live look out

at san jose, downtown looking nice and beautiful this morning, as we get started with this work week. meteorologist kari hall has a look at those temperatures. what can we expect today, kari? hopefully something similar to this weekend. >> hey. yes, it's going to be very nice, just like this weekend but a little bit cooler. we could see from the live shot from san jose sun rising earlier, days are getting longer. let's get you ready for the morning commute in the east bay, with a look at our forecast in martinez. we're starting out with low 50s here. we're going to see a lot of sunshine for today, and look at the warming trend, by noon we're at 71 degrees, and it's going to also be a little bit cooler heading into the rest of the week, so we'll talk about that in a few minutes. mike, any problems for the commute? >> you know, it's a little weird as far as the flow of traffic in the tri-valley. that's really the only place we're having slowing. everything else, including the bay bridge is just fine. over here 84 shows a little slowing than expected as more traffic but it's conjested in

here is a look at high temperatures around the bay area, reaching up to 83 in santa rosa. that's still pretty warm, and we are looking at some low to mid 80s in parts of the east bay, but then when you head down to san jose, much more of that ocean breeze there and 76 degrees and staying fairly mild near the coastline, and in san francisco. we are still dry this week. we were hoping to get some rain for tomorrow, wednesday, but that's not going to pan out, but there does look to be something more promising by the end of the weekend. we'll be watching that as it could tap into some moisture and possibly boost the sunday into early next week. so we'll of course have more updates on that. temperatures for antioch and santa rosa will reach into the low 80s today. mid-70s for tomorrow, as well as wednesday. we do get a little bit warmer on thursday, but then check out friday and this weekend, it's going to be much cooler, if you

miss the beach this past weekend, probably this weekend will not be the weekend to go, so of course we'll be looking ahead to see if we do have some warmer weather in the forecast. mike, how is it looking heading to work this morning? >> most people will have an okay time but some will have a problem for the tri-valley. let's show you the big map and i've circled the bottom of the screen what we've come to expect, my zooming class, you know about the slowing north 101 through san jose. this is the typical slowing direction but much worse than typical, westbound 580, approaching north livermore avenue and indeed as the pattern showed, chp updated as they arrived on scene it is westbound with a crash and the vehicle in the middle lane of westbound 850 and that adds to the time. here is more complication for folks out of contra costa county, brentwood, byron, discovery bay. take vasco road that joins with the backup. drive time joining in with the folks delayed out of the
