>> reporter: investigators will look to see if there is a pattern of police using unreasonable force including against peaceful protesters. if racial discrimination plays a role in traffic stops and if police illegally search private property. >> the investigation will include comprehensive review of the louisville police department's policy and training it will also assess the effectiveness of the officers and systems of accountability. >> investigation comes more than a year after the death of breonna taylor she was shot in her own apartment while police tried to serve a search warrant taylor's death ignited protests in louisville last summer. justice department scrutiny welcomed in louisville. >> the recommendations of the d.o.j. review will help us continue to pursue our efforts to be the best police department in america. >> i think that it's necessary because police reform, quite honestly, is needed in -- near

guidelines may reflect that, but they may also differ based on whether or not you're vaccinated >> the cdc will be coming out with updating their guidelines of what people who are vaccinated can do and even some who are not vaccinated certainly what one can do outdoors vis-a-vis masks is going to be one of those recommendations. it's common sense to know that the risk when you are outdoors, which we have been saying all along, is extremely low. if you were vaccinated it's even lower. >> reporter: now dr. fauci also says that if we continue at the current pace of vaccinations we could be reaching a turning point, not within months but within weeks not broad immunity but he does think the number of new cases, hospitalizations and deaths will drop significantly problem is, 8% of people are not returning for their second shot. the government's trying to

encourage that but due to low demand, some states are asking for less vaccines. some are rejecting those new vaccine shipments as they come but people just aren't showing up for the shots. >> pretty sure the rest of the world would not let those go to waste. tracie, thank you. america's inoculation efforts are facing new trouble as a demand for a covid-19 vaccine is plummeting. nearly 30% of the population is fully vaccinated currently the u.s. is averaging 2.7 million shots a day. that's the lowest level since may 9th. some super sites are shuttering their doors. >> reporter: the johnson & johnson may have been lifted but demand for vaccinations has plummeted at super sites equipped to inoculate thousands, the surge is slowing while in states like ohio, texas and florida some sites are closing the cdc says the average number

homes. >> the supreme court said in 2008 that the second amendment provides an individual right to own a gun. the right to keep and bear arms. the court has never answered the question of what does it mean, and bear. >> reporter: the new case is a challenge to new york state law that allows residents to carry a concealed handgu can demonstrate a special need the state says the law promotes public safety city lawyers for the challengers argue, quote, it makes it virtually impossible for the law abiding citizens to obtain a license. this is the first time in more than a decade that the supreme court has taken on a major gun control case and it will be a big test for a bench that now has a strong conservative majority, including three trump appointees the case coming before the high court at the same time as a fierce debate in the court of public opinion about gun laws made only more urgent after a recent string of mass shootings. >> this is an epidemic, for god's sake, and it has to stop.

another record day on wall street while the dow dipped yesterday, a surge for tech stocks drove the s&p 500 and nasdaq to fresh highs. overall, stocks have been on an historic tear during president biden's first 100 days in office. the s&p 500 is up over 24% from election day the market rose 11.4% under the same period for trump. kennedy had the closest gains with the s&p climbing 18.5% for him. another big gainer is elon musk who tesla reported record earnings but not everybody is happy with musk. plus, did apple just deliver an update long feared by facebook cnbc's steve sedgwick has all the answers to that.
