"today in the bay's" bob redell is live this morning. a key deadline for the parents passed yesterday. talk about what's next? >> reporter: fremont unified has

no plans to restart in-person learning now. the deadline the parents gave them yesterday clearly happened and no plans to resume in-person learning between now and the end of the school year, june 9th. it will continue with the distance learning. the school board approved a full returning to in-person learning in the fall for its 35,000 students, not enough for a group of moms and dads fremont parents for reopening. some seen here in a rally last week. the "east bay times" reports those threatened to sue the district if they didn't return by last wednesday which didn't happen. the parents acknowledge there's only a month and a half left in the school year but according to "the times" they organize not having the children in the classroom has caused children heartache. the superintendent announced last month the schools will not reopen this school year because the district and teachers union could not agree on how to do it

safely. "the times" reports the parents demanded a plan for full reopening in the fall which as i mentioned the board approved at its meeting last week. just north of us in newark, the superintendent of newark unified will hold a virtual town hall to discuss its plans for reopening that virtual town hall tonight between 7:00 and 8:00. reporting live in fremont, bob redell, "today in the bay." >> thank you, bob. starting today in santa clara county you won't need an appointment at vaccination sites. you can drop in. anyone who lives or works in the county is eligible. appointments are still required at levi stadium in the east ridge mall site, same day appointments are usually available. drop-in sites include santa clara county fairgrounds, mountain view community center and gilroy high school. big changes are coming if you're looking for a vaccine in the north bay. marin county is closing its two mass vaccination sites in san rafael at the end of may, but it

means that the last day for the first doses will be may 1st. those sites are at marin health and wellness campus on kerner boulevard. the second dose at each location through may 29th. marin county plans to focus on mobile and pop-up clinics. to get the full list of santa clara drop-in sites or any other information in setting up the vaccine appointment, head over to our website, and click on "how to get a vaccine appointment" in the trending barp at the top. a controversial sentencing happens in the case of a murder that once rocked the city of santa cruz. many of you probably remember young maddy middleton, a young girl whose body was found stuffed in a dumpster at an apartment complex. her neighbor, adrian gonzalez, killed her in 2015. he was never actually tried but could have received two life sentences if he was tried as an adult. as prosecutored hoped. since then state laws changed because gonzalez was 15 at the

time. his case recently went to juvenile court. that is where he pleaded guilty earlier this month. it's possible he may be set free at the age of 25, although his sentence can be extended indefinitely every two years. a new shakeup in san francisco tied to the corruption scandal engulfing city hall. long time city attorney dennis herrera expected to step down to become the next head of the city's public utilities commission. he's been city attorney since 2001. yesterday mayor london breed nominated him to be general manager. herrera's office has been investigating corruption allegations since the public works head mohammad nuru and the former head of the puc resigned in november, accused of accepting bribes from a contractor as part of nuru's investigation. a follow-up in windsor, where organizers have launched a new effort to recall the town's

embattled mayor. six women accused dominic foppoli of sexual assault. he denies the claims but stepped back as an active role on the tunnel to council. organizers have four months to gather signatures from 20% of registered voters, in windsor, that's about 3,300 signatures. election leaders have to verify the signatures before approving a recall election. more data showing some home prices are still just out of range for the first-time home buyers. despite the pandemic, santa clara and san mateo counties have seen spikes year over year. numbers out earlier this year from sotheby's shows median prices jumped from $1.35 million to $1.46 million in santa clara county. median prices in san mateo county went from $1.57 million to $1.76 million. total sales across the bay area are 30% higher.

interchange. there's no delays vasco road, looks great and clear and dry. it will be dry for a while around here talking about. us continue to l virtually and home school recess forecast, taking in fresh air makes a huge difference. let's get a look at our fremont forecast at 9:00, 53 degrees, a chilly start to the day and going into the afternoon feeling comfortable reaching into the upper 60s and we'll start to get temperatures at 2:00 to 3:00 this afternoon. all of our microclimates looking at warmer air. 75 in napa, 76 in71 degrees. there are storms in the pacific moving closer to more than california but for us a lot of it stays well to the north of us.

it will turn windy as we go into the weekend with temperatures reaching into the upper 70s, a significant warmup here after starting out the week in the 60s in a couple of days we'll be in the 80s and see san francisco forecasting in the 60s over the next several days. if you have solar panels we'll talk about ways you can generate more energy. in the past few days it has been cloudy but we'll make up for that over the next couple of days with a look at how much energy you can generate if you do have solar panels between today, tomorrow as well as thursday. you'll be able to make double the amount putting into consideration that you're using an average amount of electricity at your home. we are saving more than 3,000 metric on its of carbon dioxide across the state each day because we're using solar panels. we've been looking for ways to

far. kris? >> reporter: hi there, laura. santa clara county sheriff's department was trying to stop a driver when the driver instead took off and caused that crash with another car. this happened on mitty way, just off lawrence expressway near highway 280, right near the campus of mitty high school. the sheriff's office confirms they were trying to stop that driver, who failed to yield and hit that other vehicle and according to a witness, the crash was so forceful that vehicle was hit and went airborn. >> it's probably going fast to get off the pavement. it's like flipping over the air and slamming into the wall, like a movie. >> reporter: we can't confirm who the victims are, whether they were in the vehicle being stopped or the other vehicle hit. we don't know why the deputies were trying to initiate the stop. san jose police department is

handling the crash investigation and not giving much information at this point however we can also say that lawrence expressway continues to be closed behind us, between 280 and glen tree way. if you're coming to the archbishop campus this morning, you will have to route here, some other direction, because you won't be able to get through that way. we don't know how long the investigation will continue here at the scene. in san jose, kris sanchez, "today in the bay." it was a trial that captivated the nation, 2004 scott pederson convicted for killing his wife laci peterson and their unborn son. 17 years after the verdict peterson makes another appearance in court. "today in the bay's" cierra johnson is outside of san quentin to explain what will happen next and what the judge will consider. >> reporter: good morning. for nearly two decades scott peterson has spent his life behind bars and today he'll make

a court appearance over zoom given the fact we're in a pandemic for two specific conference hearings. let's break down exactly what the hearings are. at 10:00 peterson will appear on a criminal matter for the 2004 conviction. last year a high court ruled a second look at the case was needed after the original trial judge excluded jurors from the juror pool after they exposed they were against the death penalty. they struck down the penalty case which brings us to today's retrial of that penalty phase of the trial. the second portion of today's appearance relates to a new trial here over juror misconduct. peterson and his team filed a separate challenge, claiming juror seven who served during the trial lied during pre-trial questioning asked if she was a victim of a crime. she did not disclose a

restraping order after being harassed by a boyfriend's ex-girlfriend. the hearings which is where we are today. it's been nearly two decades since that original trial played out. next week, laci peterson would have been 47 years old, her unborn son at the time his name would have been connor he would have been 20 years old around this time. an emotional case for a lot of folks involved, a high-profile case then in aa matter of hours he'll appear over zoom. we'll bring you updates as they become available. we're live in front of san quentin state prison cierra johnson for "today a lot of pe concerned about the case. it's 5:35. both sides gearing up to sway undecided voters in the battle to recall governor gavin newsom. >> who's behind the partisan recall of governor gavin newsom? anti vaccine qanon extremists.

>> the newsom team quickly posted this political ad shortly after the news broke yesterday confirming enough signatures to hold that special recall election. state republican leader harmeet dillon says it will not work. >> across the political spectrum, repudiation of his failed leadership. it's great news for california, suffering under one-party rule headed by gavin newsom for too long. >> newsom has widespread support among democrats answer an election will likely happen this fall. among the notable candidates running against governor newsom, southern california businessman john cox who ran against newsom in 2018, former san diego mayor kevin faulkner and olympian own former reality tv scar caitlin jenner. to new covid cases in california still seeing the

lowest numbers anywhere in the region. the state is averaging 33 infections per 100,000. according to the "l.a. times" over the last week california is averaging 1,900 new cases per day, a 34% drop from two weeks ago. the white house plans to update guidance later today on wearing masks outdoors, that's what sources tell nbc news. a growing number of experts argue the risk of spreading outdoors extremely low for people who are fully vaccinated. we can expect new guidance from the cdc, many in san francisco agree it's time. >> soon, very soon, clarifying the situation visa spree vis-a-vis masks and unvaccinated. >> if they're vaccinated outside i would feel fine. >> some worry unvaccinated people will drop the masks and

many experts say the timing of such an announcement is really critical, because once it's lifted, turning back would be difficult. we take you to a more in-depth on the mask mandates around the country. look at the map and if you look through the map the united states as you can see, california and 22 other states require those masks to be worn indoors and outdoors, as you can see with the color blue here. so six states have mask mandates indoors, we're talking about arizona, florida and three other states, only require certain employees to wear those masks. now in texas, right here, that along with 14 other states don't have any mask madates right now. happening today, mandatory water conservation is on the table in the east bay. east bay mud could ask its 1.4 milln omers to cut back water use by 10%. the board of directors will decide during its meeting today. east bay mud customers live in alameda and contra costa

counties including the cities of oakland, berkeley, danville and san ramon. marin county approved water cutbacks a week ago. the south bay water customers are asked to conserve voluntarily for now. growing outrage, north it is 5:39 on your tuesday morning, let's get a little breath of fresh air, as we take a live look outside, the sunrise slowly approaching over san francisco this morning, really nice skyline shot there. kari has a look at our forecast for today and maybe a peek of the rest of the week. >> yes, we're going to start out with chilly temperature this is morning. let's look at what you'll feel, upper 30s in ukiah and napa, 36 degrees in morgan hill. the rest of the bay area right now mostly in the 40s, and then as we get a look at our clear view of the south bay, our highs will reach into the mid-70s this

afternoon, in concord. you're going to feel some warmer air, burlingame reaching 65 and san jose looking at a high of 71 degrees. we'll talk about even warmer temperatures in our forecast coming up. mike, how is it looking right now for the commute? >> kari, we have breaking news for the south bay, but it's not the slowing we see on the map. the arrow pointing northbound 101 typical on schedule at 5:40 on the dot there. we're looking at lawrence expressway. it's still closed from 280 down to just shy of bollinger, consider that open, takes to you the south side of archbishop mitty high school. the reason we mention that, the closure of lawrence may affect folks headed toward the campus. if it happens overnight, the departments will need some daylight to take some photographs. that may be the case over the next hour or so. we'll track that. the rest of the b drive including the bay bridge toll plaza starting a little build. back to you. >> that could be a busy spot.

thanks, mike. for the first time ever, california is losing a congressional seat due to population shifts. it's not alone. new york, pennsylvania, ohio and michigan are also losing a seat. california's loss of representation will be somewhere in the los angeles area, but we won't know where for several months, as the state committee redraws district lines. six other states including arizona, texas and florida are among those gaining one or two seats as we see people leave california. >> that marker in politics seen by some as a signal of how tough it is to make it in the bay and california, for that matter. texas one state seeing a big population boom thanks to the golden state, an estimated 700,000 california residents moved there between 2010 and 2020. now census data indicates texas population growth was more than

developing right now, in north carolina, family members of a man shot by deputies are scheduled to release the results of an independent occupancy. >> andrew brown, jr., was shot while a search warrant was served. kerry sanders has more on the video family members just got to see for themselves. >> andrew brown's family here in elizabeth city, north carolina, say they have denied the opportunity to see the full body cam video of what happened to 42-year-old brown, when police moved in last wednesday. they were, however, given what they call a snippet of video, only 20 seconds and therein lies where they say is a big problem. what is the sheriff's department hiding by not giving them all the video. when they did look at the 20-second video which they watched repeatedly over and over, they concluded it was what they call an execution.

warmer than we've seen in the past few days, reaching 74 degrees in livermore, and 75 as we head over toward the east bay. there are a couple of storm systems out there in the pacific, but unfortunately we're missing out on all of that action, because high pressure is blocking it all, steering those storms to the north so we're not going to see any changes at least in our rain chances throughout the next week, possibly even beyond that and we look at our reservoir levels that are continuing to drop. right now, as we look at our four largest reservoirs across the state we're at about 69% of capacity, based on the historical average, but we compare that to a year ago, where we were over capacity for a lot of our large reservoirs across the state. you can see just how much has dropped over the course of one year, just one dry season, and we are really starting to see some critically low levels. going into the forecast, once again, no rain, the wind picks up this weekend, so expect it to be breezy but comfortable.

mike, you've been tracking breaking news all morning. what's the update? >> kari, that's still going on in the south bay. let's start with that, because it does involve a closure of an expressway. lawrence expressway is closed south of 280 on the border between cupertino and san jose officially in san jose as folks know, including archbishop, mitty high school at mitty way where the police investigation continues. actually police and sheriff working together for traffic control and investigation and that has a closure. you notice the orange stretch there, folks are getting toward lawrence and realizing they can't get to 280, trying to get to a different way of bollinger road, take you over to wolf, on-ramp for saratoga toward 280. f that's where you're going. northbound 101 for slowing in the south bay, right on schedule there as well as the rest of your commute for the major freeways. quick look at the bay bridge toll plaza, shows you we are starting to see the brakes tapping in the middle lanes approaching the toll plaza and a little slow up the incline, marcus. that's not a surprise. back to you. >> thanks, mike. happening now, if you don't
