a car while on duty. straight ahead, a live report from the scene of his condition and the very latest on the suspect now in custody. the third hour of "today in the bay" continues right now. it's friday morning and good morning to you. thanks for making us a part of your morning. i'm marcus washington. >> and i'm laura garcia. let's get straight to the breaking news on this friday morning, an officer in the hospital right now after getting hit by a car. pete suratos what do we know what happened here, pete? >> reporter: the injury to the officer is nonlife-threatening. the scene has cleared but it's about a mile up on suncrest avenue where this incident took place. we want to show our viewers some of the video from that scene. the officer was struck roughly

around 12:30 a.m. by a car outside of his marked police unit. the suspect is in custody. we're getting different reports on what may have happened and hoping to confirm details with san jose police soon. it is an ongoing investigation and we'll continue to monitor things. reporting live, pete suratos for "today in the bay." >> thank you, so much, pete. 6:01. the man accused of stabbing two elderly asian women at a san francisco bus stop is expected in court today. patrick thompson is scheduled to be arraigned on multiple felony charges. investigators released a security video of the suspect and have graphic evidence of the attack. the city district attorney says the stabbing left one woman with

a punctured lung and the suspect stabbed the other victim with so much force the blade of his knife broke. the grandson of one victim is vowing to speak justice. >> throw the book at him. i don't want him getting out on mental issues. i want him locked up forever and never to be on the streets again. >> authorities say thompson has a long history with the criminal justice and mental health systems. police say so far there's no evidence the incident was a hate crime. new findings show hate crimes against asian-americans and pacific islanders are up sharply. the group stop aapi hate released updated numbers and it counted more than 6,600 incidents nationally, from march of last year to march of this year. verbal harassments, the most common at 65%. next is shunning or deliberate avoidance at 18%. 12% of those complaints involve physical assault. maybe you felt the shaking last night from the 4.7 quake some people in the bay area say

they felled it, it was centered near truckee. struck about 9:30 at night, didn't cause damage but some people received an alert fearing it would be even stronger. >> earthquake, drop cover, hold on. shaking expected. >> the shake alert warned of an estimated 6.0 quake. afterwards social media pretty much lit up about that, as the actual earthquake. a live look in san francisco this morning where a big weekend is on tap because for the first time in a long time, businesses can operate in the least restrictive yellow tier. cierra johnson is live in san francisco. you've been following the story for days now. what should people expect? >> reporter: we've been following this for about a week. we're officially there, entered the yellow tier yesterday and approaching the week and it will be a big deal for the bars and restaurants. not only those type of

businesses expanding as well, there are museums reopening for the first time since that pandemic, one of them being legion of honor in san francisco. them later today, they'll be doing so with a very big installation. now, this installation is done by a kenyan-american artist, and she interprets the gruesome 2018 death of neil wilson using bronze sculptures, placed in the middle of the museum's courtyard. 18-year-old wilson, if you recall, her and two of her sisters were traveling to a memorial service for a relative when she was stabbed to death at macarthur b.a.r.t. station, again in 2018. the 29-year-old suspect in that stabbing was found to be insane at the time of the stabbing so the bronze sculpture arrangement will be placed in the center of this museum. folks can anticipate expansion

of capacity within some of the bars in san francisco. bars are allowed to open indoors at 25% capacity, also increased for gyms, wineries, restaurants and tasting rooms. those are all at 50% capacity indoors. our crews are out last night during the first night of business within the new tier. many business owners said this move was a welcomed one and counting down the days until the june 15 date, the date governor newsom set for a total reopening. >> it's nice to come inside and have a drink. it's a small step but feels like a big weight. >> we know each other so it really becomes a focus of the community. >> reporter: and as we've been saying all week and really last week, entering this yellow tier could really be a domino effect for a lot of those businesses,

parking garages, parking lots, some hotels may see an increase in business. a big weekend ahead for bars and restaurants and some of our art establishments here in the city, many of them opening with big statement-making installations in san francisco. we're live, cierra johnson for "today in the bay." >> all right, thank you, cierra. this is a question a lot of people have been talking about. can you be fired from your job if you refuse to get that covid vaccine? that question may soon be answered in the federal courts. almost every state including here in california considering legislation about mandatory vaccines. now the new census survey finds nearly 10% of businesses in the san francisco, oakland, berkeley area they're all requiring employees to show proof of vaccination before coming back to work. we spoke with one employment law expert about the courts and what they will consider and if someone refuses to get a shot. >> i would think that the courts would look at three issues, you know, do you have a religious

reason, a health reason, and to the employer, you have no less onerous way of accommodating this employee who does not want to receive the vaccination. >> some larger companies like facebook are only encouraging people to get the shot instead of requiring vaccines. neighborhood activists plan to demand more be done to clean up hunter's point shipyard. new home construction recently began on an epa superfund site. the battle over contamination is going on for years but the goal is to build thousands of new homes. activists plan to hold a news conference later this morning. a major return for the san francisco symphony. ♪♪ lars night was the symphony's first show with a live audience since the pandemic started. it was filled with health care

solano county and areas just off to the east. highs today we start out with most 60s for san francisco, upper 70s for antioch and fairfield. mike, what's going on now for the commute? >> an unusual pattern of slowing in san jose. look at the map, our usual spot at 680 starting to get jammed up not that bad. there is a crash or disabled vehicle something in the middle of northbound 101 around mckee and that is jamming up traffic. folks see the backup and take 280 northbound to get past that, causing a rip there will. we'll watch for progress from chp once they arrive. no other problems for the sensors around the bay except for west 24, that crash again off the roadway on the right shoulder around st. stephens or shy of that causing some slowing into and through orinda. back to you. how does this sound?

you like an out of this world bottle of wine? a bottle of petrvs spent 14 months maturing in space, one of 12 bottles sent to the international space station in 2019 to be aged in an experiment to see how plants adapt to space conditions. christy's private sales are auctioning off the bottle which could go for $1 million. proceeds will go towards future agricultural research missions in space. what could be better than being paid to sleep? one website is offering jobs to five people to go to sleep. part of a study conducted by sleepeachnight.com. they have to nap undisturbed and write reviews once they awaken. things like motivation, productivity, and memory all taken into account here. each participant will receive $1,500 for the 30-day study and this is what we call a "dream" job.

these spots that we're seeing right now will be much warmer tomorrow, reaching 78 today in concord, martinez reaching 73, at a high of 70 in fremont. let's head to the coast if you're going to the beach this weekend, it's still going to be cool. a high of 58 degrees in half moon bay and 68 in redwood city. san francisco 62 in the mission district and 56 in the marina and for the north bay a high of 77 degrees in clearlake and sonoma in the mid 70s. into the weekend we watch out for gusty winds picking up as well as hotter temperatures. we've been seeing the storm systems passing well to the north of us, and now high pressure is moving in once again. so you're going to see those temperatures going up as a result of that, as we continue on with some dry weather, and we do have the concern of this high fire danger, fire weather watch is going up for solano as well as much of the central valley into the weekend.

so here is a look at our seven-day forecast for the inland spots like antioch, mid-70s for today, but then upper 80s tomorrow and you can see how warm it's going to be through the rest of the forecast, so this is like the last day we could leave the air conditioning off. we do keep the natural air conditioning in san francisco, low 60s today, and upper 60s but some gusty winds through mother's day weekend. mike, how is it looking right now heading out to work? didn't look as busy in dublin. >> yes, it's not as busy, especially not dublin. no problems 580 or the dublin interchange today. we look at the map we had san jose slowing, a lot of focused slowing because of a car in the middle of north 101 at mckee that cleared to the shoulder. disabled vehicle on the shoulder, minor distraction and things are smoothing out there. the rest of the bay light. tri-valley as we said very different than yesterday, good, good, good. 24 still slow approaching st. stephens drive, the crash is over on the shoulder but maybe a spectacle because there's a lot.

"today in the bay" continues right now. good morning to you. thanks for joining us. i'm laura garcia. >> and i'm marcus washington. details on the shooting in a bit. first the breaking news we've been following out of the south bay, an investigation now under way after a car struck and injured a san jose police officer. this happened about 12:30 this morning on suncrest avenue in prairie lane, near alum rock park in east san jose foothills. the scene there now clear and officers wrapping up that initial investigation about 30 minutes ago. there is a suspect in custody but we're still working to learn exactly what kind of injuries the officer suffered and what led up to that crash. and more breaking news, big announcement this morning, when it comes to pfizer's covid vaccine, the drugmaker seeking full of fda approval for anyone

16 and older. they are requesting the agency consider the anally indication within six months. all three vaccines have emergency authorization only, pfizer right now is also askr. the moderna vaccine is highly effective in younger teens. researchers studied 3,200 subjects and found the vaccine was 96% effective and with few if any side effects. the vaccine is currently authorized for adults 18 and older. family members plan to talk about what comes next now the officers won't be charged. grabbed headlines when it all happened. >> they confirmed to nbc bay area that the contra costa district attorney is not going to be filing charges against any walnut creek police officer in his death. miles hall was killed by walnut creek police in his neighborhood, back in 2019, so actually we've been talking about it for almost three years now. according to 911 calls he was suffering a mental health crisis when his family called police for help saying that he was behaving erratically and holding a metal pole. he was rushing officers when they arrived. one officer fired bean bags and then officers fired real shots when he continued to run past them. it added fuel to anti police protest and in september of 020, the city of walnut creek agreed to a $4 million settlement with

hall's family, money that the family sayspu for change in how deal with people who are having mental health crises. in a same the city did not admit fault but said the settlements were to avoid protracted litigation. today we learn more why the district attorney's office is choosing not to file charges against the officers involved. the hall family will be there and they say they will speak to us at that point. kris sanchez, "today in the bay." >> i'm sure they'll be emotional no doubt. thanks, kris. the chp is investigating the third freeway shooting on highway 4 in the last hit days. two people were shot, no word on their conditions or the status of the investigation.

windsor's town council is talking major new action trying to take major new action to ost the town's embattled mayor. sexual assault allegations dominic foppoli continues to te deny. the d.a. forwarded the request to the attorney general due to a potential conflict of interest. a live look in san francisco this morning where the slow rebound for the convention business continues to hit the city where it hurts most, talking about the bottom line here. "sf gate" reports in 2019 the travel and convention business brought in $11 billion. last year was mostly wiped out, and this year there are at most ten conventions planning to come to the city. this after the largest remaining one scheduled by the american college of rheumatology just canceled for november. it would have brought in some

$30 million. new details san francisco leaders reportedly ready to extend hazard pay for grocery store workers. the city's $5 a hike is expected to end on may 19th and supervisors are expected to extend it through the middle of june. new this week, a week from tomorrow you had have more options to get around in san francisco so muni's underground metro service returns may 15th, the nduia t third kay ingelside and f lines are resuming operation, a full month ahead of the state's planned reopening but ridership is starting to bounce back. according to "the chronicle" last week muni recorded more than 200,000 riders. the numbers are half of what they were before the pandemic took hold last year. muni plans to restore service to 85% pre-pandemic levels by january. here we go for the weekend,

6:35 right now. a beautiful sunrise, as we're looking out on walnut creek. it's a golden friday right here in the bay area, and of course it is friday, headed into the weekend. meteorologist kari hall has a look at temperatures and what we can expect. i know a lot of people may want to have outdoor activity and wear the short sleeves, the shorts because it's going to be a warm one. >> yes, we are going to see temperatures heating up in fact if you're traveling tomorrow, whether you're going to see mom or taking mom out for a treat this mother's day weekend, we are going to see our temperatures very warm, especially as you head down to l.a., 75 and 90 in paso robles and santa rosa up to 89 degrees, lake tahoe reaching 77. headed to i have gas i have veg, pretty hot. nice weather if you want to check out the walkway weekends

happening in chinatown for saturday and sunday. we're going to see temperatures in san francisco reaching up to 71 degrees during the middle of the day, but that will be a nice little treat or if you're headed to yosemite, in the mid-50s for a high today, 60 tomorrow, and then 54 degrees or 56 degrees on sunday, as we keep that sunshine. we'll be warming up in santa cruz, so we're starting out the weekend at 71 degrees, up to 81 tomorrow, and then back to the 70s on sunday, as we get a little bit more of an ocean breeze. going to l.a., a high of 68 degrees for today, 75 tomorrow, and then we'll see the temperatures in the upper 60s. so no matter where you're headed, if you're going to sonoa lot of changes, upper 70s day, for some outdoor time, reaching 84 degrees. now we'll talk about what's going on today, as you get ready to head to work.

that's coming up in a few minutes. mike, how is it looking for the commute? >> kari, unfortunately even though it's friday, lighter volume of traffic we have an alert. breaking news for the north bay, if you're just joining us, a crash we've been following for southbound 101 heading in through novato around birken birkenstock, toward highway 37 the crash blocks a couple of lanes, jamming folks south pet luna toward san rafael. the rest of the bay shows a nice smooth drive. extra slowing for highway 4 into orinda. the crash on shoulder just shy of st. stephens drive. slowing concord through 4. the separation for the three different routes here, very different timing starting to build up and yesterday was a very tough drive all the way from antioch into concord through pittsburg and bay point. south bay by comparison slowing for the distraction the vehicle on the shoulder at mckee no major problems for the routes.

infrastructure bill is standing in front of infrastructure, so president biden stopped at a water and sewage plant in louisiana yesterday. critics say his plan includes too much spending, including things for not traditionally thought of as infrastructure. president biden insisting after years of talk it's time to get something actually done. >> truth is, across the country, we have failed. we have failed to properly invest in infrastructure for half a century. last four years, how many times said this is going to be infrastructure week. i got so tired of hearing "infrastructure week" nothing happened, nothing has happened. >> biden doesn't usually make references to trump, but the term "infrastructure week" is a reference to an inside joke in washington. president trumpastructure, and w

minutes later changing the headlines for the day. in fact the former administration is back in the headlines this morning, the federal elections commission says it is dropping its investigation into payments trump's former lawyer made to an adult film actress, stormy daniels. the payment which trump's then lawyer michael cohen called hush money came after daniels said she had an affair with trump. because the payment came weeks before the election, the fec had been exploring whether that was a campaign expenditure. trump's current lawyer, mayor rudy giuliani blurted it out in an interview with george stephanopolous and trump's previous lawyer michael cohen testified before congress about that very same issue. back to the present. president biden is going to speak later this morning about the terrible news we just got from the labor department, 266,000 jobs created in april,

businesses that have been shut down for quite some time. >> reporter: yes, good morning, marcus and laura. we've been talking about this for a number of days, yesterday was the first official day san francisco was in the yellow tier and with the weekend upon us, it can be a big boost for some businesses and restaurants but it's not just that sector that's having a boost. some of our art establishments here in san francisco reopening for the first time like legion of honor museum opening today to the public for the first time with an installation that speaks to something that happened right here in the bay area. this installation is the work of a kenyan-american artist, and she interprets the gruesome 2018 death of neil wilson using bronze sculptures, placed in the middle of the museum's courtyard. 18-year-old wilson, if you recall, her and two of her sisters were traveling to a memorial service for a relative when she was stabbed to death at macarthur b.a.r.t. station, the 29-year-old suspect in that stabbing was found to be insane

at the time of the stabbing so her death, what played out around it being memorialized here within this museum. i peeked through the fence and it is breathtaking, huge bronze sculptures, but it's not just the museum opening talking about all week, it's bars and restaurants that are really seeing a boost, because bars are able to increase capacity 25% indoor capacity, as well as not having to serve food, which is also a big deal as they've had to serve food with alcoholic beverages. capacity also increased for the indoor gyms, wineries, restaurants and tasting rooms, they're all able to open at 50% capacity indoors, and our crews were out cruising around thursday night during the first night of business in this new tier. many business owners we talked with said the move is a welcome one counting down the days until june 15th, the date governor newsom set for a total reopening. >> it's nice to just come inside and have a drink. it's a big day for us.

weekend, some sunshine, and as laura said, let mom sleep in. that's probably a note to your triplets, right? we're packing up those lunches in the backpacks this morning, getting ready to take those kids out to school, drop off time coming up very quickly. let's head to sunnyvale and see how our weather will be shaping up, light jacket weather as you're getting ready to head out and temperature at about 50 degrees. pickup time is going to be so nice and comfortable, 62 degrees as that sunshine continues. now let's head to the south bay, take a look at all of our temperatures as we reach into the low to mid-70s today, gilroy reaching 76 degrees and then we'll see some upper 70s for the east bay. danville up to 74, and along the coast, we're keeping those upper 50s at half moon bay but much warmer in palo alto as we reach up to 70 degrees. san francisco in the low 60s, downtown, and our north bay highs will be in the mid-70s. we better take it in and enjoy the nice mild weather, in fact this is where we should be, but

we do have a heat up on the way. so as we get that cool breeze this evening, of course we'll be celebrating willie mays this evening out at the oracle park and during the giants game we'll see a temperature starting out at about 63 degrees, but it's going to be definitely heavier jacket weather once those winds pick up and we'll be in the upper 50s. it's going to be a gusty weekend as high pressure moves in. we'll start to see our temperatures rising as well. you're probably seeing that at the bottom of the screen. the high pressure is not going anywhere and we keep the dry conditions, so that's the reason why we're back into that fire weather watch for solano county, much of the central valley, even the north and east bay hills, we'll have to be careful this weekend, not to allow any sparks to spread rapidly because we could see some more of those grass fires. temperatures will reach into the 60s in san francisco, a lot of sunshine. our inland valleys this is where we are going to see changes. so some mid-70s today, upper 80s tomorrow, and then we stay in

the upper 80s, but mother's day we're going to bring it down just a few degrees to make it more comfortable for visiting some of the vineyards and heading over to you, mike, how is it looking right now for the morning commute? >> slow drive in the north bay so breaking news for folks up there, heading southbound 101 from petaluma down toward novato. look at the map, we have a crash in lanes, no major injuries reported but this is quite a backup, unexpectedly so, heading down toward highway 37 and novato. south of there you're fine. build san rafael out of richmond, typical for that portion of the east bay and 4 is slow toward the crash. over on the shoulder st. stephens is sticking around, slow out of walnut creek, slow through concord for westbound 24, a pretty standard area, same thing for 101, which we have hey that earlier crash at mckee, but now we just have a little slower drive for that portion of silicon valley. 101 farther north through palo
