thanks so much for joining us. i'm laura garcia. >> and i'm marcus washington on this hump day. mike keeping an eye on the roads for us this morning. first we start out with today. kari? >> good morning and it's going to be another really nice day. a little bit on the cool side compared to yesterday but as you're getting ready to head out through the tri-valley it is all clear. temperatures are coming down a few degrees and the winds picking up so we could see some evening gusts topping 50 miles per hour especially near the coast and in the hills and watching a storm system staying just to the east of us, so we'll talk more about all of this in the forecast coming up. mike, any issues for the early morning commute? >> yes, kari, a crash reported out of the altamont pass, as you come into livermore it's at north greenville. that crash was just blocking one lane, a couple minutes ago chp said they blocked all lanes temporarily, that usually means a couple of minutes so we'll track that closely. it should be reopening traffic

flow any minute now but we'll give you an update in a few. there's still that closure of highway 84 going through alvarado niles. you expect that one, not the big backup at the altamont. a couple of crashes in san jose i'm checking as well. back to you. >> thank you very much, mike. 4:31. a story developing overnight the new york attorney general's office opened a criminal investigation into the trump organization. a spokesperson saying "we have informed the trump organization that our investigation into the organization is no longer purely civil in nature." the investigation comes from michael cohen, a source tells nbc news cohen testified to congress in 2019 that trump provided incorrect valuation of assets in official tax documents. so far no comment but the former president has previously called the investigation politically motivated. his taxes are also investigated

by the manhattan district attorney. a violent robbery on a b.a.r.t. train is leading to frustration and outrage. the victim an asian-american woman who police sway was on her work. asian-american community members are desperate for answers. terry mcsweeney has the latest. >> reporter: this is what's causing the shock and outrage, pictures of this asian-american woman her face bruised and swollen, the victim whose name has not been made public was riding b.a.r.t. toward the 16th and mission station when a man approached her. >> what i heard from her directly was that somebody walked past her and said "give your phone" expletive, and proceeded to pummel her face and her head and grabbed her phone and her belongings and the atta robbery as an anti asianletive was not a racial slur. still the attacks with asian

wall street looks to open in the red this morning, stocks falling for a second straight day yesterday despite early enthusiasm over strong earnings from walmart, home depot and macy's. that faded at the end after we got some really big concerns about inflation and weaker than expected housing data. today we're going to be getting the minutes from last month's federal reserve meeting which could offer cues into what members are thinking when it comes to raising rates and inflation. we've also got more retail earnings this morning, great results from target, missed from lowe's. tjx, tjmaxx still waiting for numbers. new survey from the harris poll and "usa today" finds that 40% of us prefer to work from home full time, that compares to 35% who seek a home/office hybrid kind of model and 25% who want to go back to the office

little bit cooler today, but yeah, the winds are going to pick up. it's going to be more than a breeze. it's going to be more of a gust, so let's take a look at these temperatures for this afternoon, reaching into the upper 60s for the south bay, you'll notice it's going to be milder compared to yesterday. seven-day forecast is up at the bottom of the screen, as we'll see our highs today, in spots like antioch, still in the mid-70s but much more cool as we head toward livermore and pleasanton, some upper 60s there. fremont reaching 65 degrees and getting the ocean breeze kicking inland and for the coast, it's going to stay in the upper 50s and low 60s, but we're up to 67 degrees in palo alto. san francisco today is going to be nice and cool, with some sunshine, highs near 60 degrees and our north bay temperatures reaching 72 in napa, and cooler today in ukiah and clearlake, compared to yesterday where it did warm up. later this evening, the winds

will really start to gust and we could see in some spots gusts over 50 miles per hour especially in the hills. near the coast, a wind advisory in effect and here is a look at our hour-by-hour wind speed forecast. it's a windy day and really seeing the peak of those winds at about 7:00 to 8:00, even into later this evening, before it gradually calms down early tomorrow morning, but the reason why we're not calling this a red flag warning is because we've had such cool air coming in, as well as much lower humidity, so some of the humidity levels staying well above what we would issue for red flag warning. so it's good that we don't have that high fire danger but we still have to be really careful. mike, you have some breaking news going on in your department. >> i do, kari, not just one spot but two spots now, the first south bay. the first one out of the altamont pass over there livermore for west 580, we have i'm calling an alert because there's an unusual backup, even

for this early drive, because a crash now moved to the middle of the roadway, the center divide west 580 at north greenville, crash visible to traffic, easily distracted as folks are narrowing down through the area and the closure for highway 84. that one is not an alert. this is in san jose, has just turned into an alert, the chp sent me a note saying they don't know how long it's going to take to clear the right two lanes northbound 101 approaching mckee, a relatively new crash and there may be some water, maybe a busted sprinkler on the roadway. watch that stretch of 101 through san jose. the rest of the we ininess lamoves nicely. back to you. >> thanks, mike. alameda prosecutors declined to file charges in the march accident that killed a school leader, katherine kuo was struck by an suv as she loaded items onto another car.

prosecutors determined there was no criminal intent. a central valley mother outraged her son's homework assignment included a racial slur. melissa cheek says it was included twice in her eighth grader's assignment, from shasta elementary. the assignment also asked students to look up the slur online and visit a museum for jim crow racist memorabilia. the mother says the family were shocked. >> it has been a word that has come up in school, one that we don't use as a family, one that is again offensive. he knew that it wasn't a word that was okay to use. >> school and district officials did pull that assignment saying it doesn't meet their standards. as for the cheek family, the son is now in a different class but the family is calling for the teacher to be held accountable. it's not clear if that happened. new details now, fines are going up for illegally dumping things on san jose streets and

it is asian-american pacific islander month, and a young bay area fashion designer is using her voice in a unique way to stop hate. ashlyn so is 13 years old and her day beau at new york fashion week is old news, it happened four years ago. more recent years the middle schooler in february organized a march and rally in san mateo to raise awareness about hate crimes against the aapi community. she also recently made a pop sugar list of the most influential people under 21. she's organizing a rally for this weekend, and hopes can unite all people of color and talks about it in an all-new interview on nbc lx, 11-15 over the air, channel 185 on xfinity cable or any time on lx.com. check it out. as part of our coverage we recognize bay area artists twee.
