i'm marcus washington. >> and i'm laura garcia. santa clara county in the yellow tier with a twist. the county will require all employers to determine the vaccination status of employees and contractors. >> "today in the bay's" kris sanchez joins us live from downtown san jose with one of the top questions about the new policy. kris? >> reporter: probably the same question you might have, which is it legal for my boss to ask me what my vaccine status is. that is a requirement that santa clara county is making of all employers and agencies within the county. let's take a look at that policy, in case you missed it, happened around the noontime hour just yesterday. employers have to determine the vaccine status of all employees that includes contractors showing up at work sites. this has to happen within the next 14 days. employees can decline but they'll have to follow the same rules as unvaccinated people,

with the masking requirements, the quarantine requirements, social distancing requirements, and such. the county is providing a form for businesses and agencies, though they can choose to use their own tracking system. a former law school dean tells us that health privacy laws do allow for this. >> that would not prevent, in my opinion, prevent an employer from asking their employees, are you vaccinated, even do you have proof of vaccination. we want to see that. >> reporter: the county's other yellow tier changes were pretty straightforward, aligning with san francisco and san mateo, who went first, allowing gyms to reopen indoors at 50% capacity, same for restaurants. bars can also reopen at 25% capacity indoors, live outdoor venues can host events at 67% capacity. all of these changes go into effect starting today. >> kris, i do want to ask you before you leave, the

vaccination verification, this applies to all businesses across the board, not just state or federal companies? >> reporter: right. this is all initially i thought it was government county agencies going to be requiring this of their employees but it is really for all employers and in fact, i was a little bit surprised that we didn't get one in our email box by the end of the day yesterday, although businesses do have 14 days to comply and it is at this point seems to be legal although some people say that they don't think so. >> all right. thanks, kris. across the bay area, san francisco and san mateo are also in the yellow tier. the east bay and much of the north bay are in orange, but solano county still in that red tier. we asked a supervisor there why the county is under tight restrictions. >> i attribute it to the fact that people have covid, they're tired of covid. they're tired of staying home. they're tired of being told what

you can and cannot do. people want to get back to life the way it was prior to march 18th of last year. >> right now, solano county has an adjusted case rate of nearly 7 per 100,000. it needs to be under 5.9 to move into the orange tier. the positivity rate is at 2.5%, which meets the orange tier threshold. should businesses be allowed to require proof of vaccination forms for their customers? majority of california voters say yes. that's according to awe any uc berkeley survey, finds two out of three people believe places like concert venues, sports stadiums and casinos should be allowed to check verification cards and a majority also say businesses should be allowed to require negative covid tests to allow customers inside. >> if you're not vaccinated yet, you'll have the opportunity to do so, in the east bay today, pleasanton teaming up with satisfy way to give out pfizer doses at the pleasanton senior

"today in the bay's" bob redell is covering this part of this story, covering it all morning yesterday for "today in the bay." he's live for us and bob, talk to us about do police have any leads at this point? >> reporter: marcus, if they do, they aren't saying. we know that oakland police, chp that they are looking for at least two suspects who shot at a party bus early of young women celebrating a friend's 21st birthday. two teenagers were killed, several more people injured including one person who is still in the hospital in critical condition. oakland police and chp believe that this was not a random crime, that the shooters

targeted the bus. it started around 12:20 yesterday morning, the bus returning to oakland from san francisco. the suspects who were in another vehicle shot at the bus as it drove off eastbound 580 on to seminary avenue and again near foothill boulevard and 68th avenue. at least two shooters fired about 70 bullets into that bus. the bus eventually made it to east oakland it's police ethmont substation. one of the women killed was a 19-year-old mother from oakland whose child turns 3 on saturday, the other zee woe hughes of modesto, she was just 16 years old. >> she just deserved a lot more than 16 years, and i want everyone to know that it's a nightmare what's happening and that i love her so much, and i wish that i could just hug her one more time. >> reporter: that was zoe's

cousin. oakland police and crimestoppers are offering a $40,000 reward for information leading to an arrest of the suspects. chp and crimestoppers have their own respective tip lines, too, that people can call into with information. reporting live, bob redell, "today in the bay." >> thanks so much, bob. 5:07 right now. developing right now, the search is on this morning for the driver involved in a deadly hit-and-run crash in san francisco. one person died at the scene, another victim in extremely critical condition. it happened at about 7:00 last night on polk and hayes near the civic center plaza. police say after the two vehicles collided, one of the drivers ran from the scene. san francisco mayor london breed apparently on the verge of providing much-needed relief for some of those struggling most to make it in the bay. "the examiner" reports she's allocating money in the city's new budge tote further subsidize rents for one group of 2,800 tenants in permanent supportive

police can set up a perimeter, they'll decide how to safely remove it. a follow-up for you now, sonoma county leaders are delaying a rules to give agricultural commissioner more leeway to issue permits and remove a cap on large-scale pot growing. growers say sonoma county has been dragging its feet when it comes to loosening restrictions. opponents worry about pot farms using too much water, attracting criminals and lowering property values. new impact this morning from the extreme drought conditions. more north bay residents are being asked to conserve water. last night, santa rosa councilmembers adopted a 20% voluntary reduction in water use, the move comes after a recent drought declaration for mendocino and sonoma counties. half way through our work week here and it's been rather pleasant, a little breezy yesterday afternoon, how are we looking for today, kari?

>> it's going to be another really nice day. we were just talking about the drought conditions that we were seeing and as we look across the state, once again a lot of bright red showing some extreme drought as we get a closer look, that includes pretty much all of the bay area at this point, and so we are going to continue to watch out for that, as well as the high winds, and we'll be picking up later this evening. this is a wind advisory not a red flag warning, mainly because the humidity levels won't drop low enough for this to be a red flag warning but we'll watch out for the fire danger due to those gusty winds and dry vegetation. so we'll talk more about that coming up in a few minutes. mike, what's going on right now the commute? >> kari, chp still calls this an alert. i'm pulling back on it a little bit for the south bay, but let's look at the map for northbound 101, unusually slow as you're approaching oakland road, up toward 880, there's a crash but more importantly reports ofwo l part of that connector, you

now a security company called the liptick, dark side received $90 million in ransom over the last eight months from 47 different corporate victims. taking you out to the markets this morning, target says the sales hit all-time records, futures there showing a rough day ahead as investors continue to worry about inflation. prices are up on all kinds of commodities. we talked yesterday about how the number of new homes built fell last month because builders said it was hard to get their hands on lumber, price of lumber, would up something like 400%. there is an old saying the solution to high prices is high prices, it brings in more supply and the price of lumber is in fact falling. they trade lumber futures on the chicago mercantile exchange. the price of lumber falling so fast, it fell faster than the exchange allows, past the limits, and that should

meteorologist kari hall has a look at that. should be a good one at least for the morning jog? >> yes, absolutely. i was hoping we would see what they look like now. that was so long ago. let's get a look at what you're going to see as you get ready to head out the door this morning for the morning run. we're about 30 minutes away from sunrise as you enjoy a cup of coffee and get ready for the activities, it's going to be a cool start. we have some low 50s for parts of the east bay this morning, but it will be clear and a nice warmup today, but it does happen slowly over the next few hours. you do have some time to get outside before those temperatures start to feel a little bit warm, but it won't be that warm today especially compared to yesterday as we reach into the low 70s for some of our warmest spots in the inland areas. check out the seven-day forecast. it's already up at the bottom of the screen. it is going to be windy today, especially this evening, take a look at this wind speed forecast. san francisco 53-mile-per-hour winds at about 7:00 to 8:00 and for our inland areas, san jose

really seeing the winds gusting at 25 to 30 miles per hour. so make sure everything around the house is secure and ready for these high winds but we're also watching out for the fire danger, not because the humidity will be low, because we're seeing relative humidity numbers during the middle of the day at 50%. we have dry vegetation, it's been so long since we've had some rain and going to see a storm system that will bring some rain to the sierra and also some snow, not just tomorrow but the next few days, so we'll be watching out for that active weather there, while we get some gusty winds here.> mike, you've some breaking news and a few issues out there, has all of that settled down? >> it's settled down, kari, hasn't cleared completely. i'll back off of the red, we'll leave the signs on red right now for the one report but the sensors on the map have backed off from red, why i'm calming a bit. more orange than red out of the

private businesses can still require masks as well. more than half of all adults there are now fully vaccinated. new this morning, an illinois man driving a tesla is cited for inattentive driving. a wisconsin deputy says the driver appeared to be sleeping at the wheel, after putting on his lights and siren to initiate a traffic stop the driver went two more miles before pulling over. the 38-year-old man denies he was asleep and law enforcement says there was no signs of impairment. tesla says drivers should keep their hands on the steering wheels at all time and i would say maybe stay awake. coming up next, top stories we're following for you today including another sign that most distance learning may soon be coming to end.

investigation into a criminal side, this joins a criminal investigation already under way by the manhattan district attorney who is looking into, among other things, whether trump and his organization lied about the value of trump buildings to avoid paying taxes or to increase the number of loans it could get. the new york attorney general's office told us "we have informed the trump organization that our investigation into the organization is no longer purely civil in nature. we are now actively investigating the trump organization in a criminal capacity, along with the manhattan d.a. " the trump organization would inflate the value of the building to get bank loans. it would deflate the estimated value of the same buildings when it paid taxes in order to pay less. prosecutors add powerful

>> we're heard people talk about that before. scott, thank you. 5:33, new overnight and just into our newsroom, firefighters in the east bay responding quickly to rescuing two people, this is from a house fire in san lorenzo. videos and photos tweeted by alameda county fire. crews responded to that fire around 2:30 this morning on brandon e. avenue in san leandro. deputies were able to rescue one person from a rear window while fire crews say the second person. a dog was also saved. the fire is under investigation. >> that was in san lorenzo. the search is on for the person who attacked and robbed an asian-american woman riding barth in san francisco. this morning she's resting at home. when will the violence stop many

"today in the bay's" cierra johnson is live on the attack and what police are good morning. >> good morning, laura. thankfully the woman didn't sustain any serious injuries and b.a.r.t. police are not calling this racially motivated but as you can imagine, this tack coming after a string of other attacks, as that woman was preparing to go to work. now take a look at the video, we have some pictures of what that woman looked like after she was attacked. right now her name was not being released but those close to the situation say she was riding barth toward the 16th and mission station around 8:00 monday morning a man approached her, the man demanded her phone, yelled curse words at her and hit her in the face. a mentioned, b.a.r.t. police say they were not asian slurs, not describing the crime as an act of anti asian violence. something has to be done so members of the community feel safe. >> let's make sure people who

san francisco state assemblyman phil ting wants to end a waiver that allows for at-home learning. in a normal year schools get state funding for attendance but districts were given a pass at the start of the pandemic. ting is calling for that to end next month saying distance learning has not worked for all students. alameda prosecutors declined to issue charges as there were no criminal accident. fines going up for illegal dumping in san jose. if you're caught, it will cost you $10,000 up from $2,500. the city council approved thein crease last night. san jose has seen a dramatic jump in legal dumping during the pandemic. some new numbers showing you

advisory that will begin later this evening. some of those wind gusts may reach over 50 miles per hour near the coast and in the hills, so we're watching that, as that storm system brings some rain and snow to the sierra. we're going to have cooler temperatures and some breezy winds. we'll talk more about this coming up. mike, what is going upon for the commute? >> we have the alert in san jose and now i'll get back on the red here as we head down there, this is very unexpectedly slow for folks as we still have your right two lanes of northbound 101 blocked by flooding, yes, dry in the sky, flooding on the roadway, i think there's a busted sprinkler at the 880 transition there from north 101. here is the backup by our camera, over near 280, the map shows you the backup starts back here. folks may want to use 280 to 87, sometimes happens as an alternate that may cause the ripple through san jose. crews on the scene in about ten minutes. i don't know how long it will take them to clear the flooding.

included twice in her son's assignment from shasta elementary. the assignment also asked students to look up the slur online and visit a museum for jim crow racist memorabilia. the mother says the family were shocked. >> it has been a word that has come up in school, one that we don't use as a family, one that is again offensive. he knew that it wasn't a word that was okay to use. >> school and district officials did pull that assignment saying it doesn't meet their standards. as for the cheek family, the son is now in a different class but the family is calling for the teacher to be held accountable. that has not happened yet, it's not clear if that happened so far. it is asian-american pacific islander month, and a young bay area fashion designer is using her voice in a unique way to stop hate. ashlyn so is 13 years old and debuted at new york fashion week

meteorologist kari hall of course has been checking out those things and seeing that sunrise behind you, looks like it's going to be a good day. >> it's nice. yes, we're going to enjoy more sunshine today, cool temperatures and also much more of a gusty wind picking up especially later on today. let's take a look at these high temperatures and what you can expect going into the middle of the day. so palo alto heading up to the upper 60s, san jose also upper 60s. livermore reaching 69 degrees, but there will be a few mid-70s, we'll see that in fairfield and antioch and napa today reaching 72 degrees. we'll also have a wind advisory going up for the coastal areas as well as the hills, as we could see some wind gusts anywhere from 15 to 20 miles per hour, and then some of those higher gusts reaching 50 miles per hour, so that's for tonight into tomorrow, going through the wind speed forecast it will be breezy pretty much all day. check out the time and when the

winds will be the highest. here we are at 8:00/9:00 and some of the winds in san francisco over 50 miles per hour, now what's different this time is that we are seeing some much cooler air coming in, as a storm system moves to the east of us, and then the winds gradually warm down headed into tomorrow afternoon, but breezy period of about 24 hours that we'll see with some higher humidity this time around, and that's the reason why this is a wind advisory, and most likely not a red flag warning. humidity levels won't drop low enough for this to be a high fire danger, but the vegetation still very dry, high winds and a fire could get going fairly quickly. we're also watching some rain as well as some sierra snow that will be coming down over the next couple of days, starting tomorrow and continuing into the first part of the weekend, where one to five inches of snow will be falling so we're still talking about snow at the end of may and we are going to have some breezy inland areas in the and warming up early next week,

while san francisco will keep those temperatures mostly in the 60s over the next few days. mike, what's going on right now the morning commute? >> kari, i have breaking news in the good direction i guess you can say, should be improvement for san jose. right now, still jammed. let's take a look at our camera northbound 101 north of the 280/680 overcrossing, things are starting to move better near the clock at the bottom of the screen, it will ripple back from 880 as we look at your map, it's jammed from 880 back to about story road, earlier crash and the flooding have now been cleared. it didn't get an update and suddenly chp cleared that from north 101, that will send much more traffic up in toward palo alto, santa clara mountain view, all those areas that that will be expected to spread out aness long the peninsula. east bay slowing contra costa county more build for vasco road. tracking maybe a crash on the bay bridge and bring that up to you as soon as i get an update.
