sighting. the third houmorning. good morning to you. thanks for joining us. i'm marcus washington. >> and i'm laura garcia. first a live look in san jose, santa clara county is moving into the least restrictive yellow tier. but with a twist. the county requires employers to determine the vaccination status of all employees and contractors. "today in the bay's" kris sanchez joins us live in downtown san jose with one of the top questions about this new policy. good morning, kris. >> reporter: good morning to you, laura. a lot of people are wondering can my boss do that, ask my vaccine status? we're going to talk about that in a moment but the rest of santa clara county's yellow tier restrictions were pretty straightforward. so we'll start there. starting today, gyms can reopen at 50% capacity indoors, same for restaurants. bars can also reopen at 25% capacity indoors. live outdoor venues can welcome

people back at 67% capacity. this is new, santa clara county is requiring vaccine verification for all employers, public and private, they have to determine the vaccine status of all of their employees within the next 14 days. workers can decline to state whether or not they're vaccinated but have to follow the same rules as unvaccinated people related to masking, social distancing and quarantine upon close contact with someone who is covid positive. the county is providing a form for all businesses and agencies through their website and also choose to use their own tracking system. a former santa clara university law school dean says health privacy allows allow for this. >> that would not prevent, in my opinion, prevent an employer from asking their employees, are you vaccinated, even do you have proof of vaccination. we want to see that. >> reporter: the county maintains this is not a mandate for people to get vaccinated.

however the law professor says under the law, businesses could require workers to get vaccinated before returning to the work site. >> so kris, workers could actually be restricted from working if they don't get vaccinated. >> they could actually be fired under the law. however, businesses would have to make accommodations first, firing would not be the first step. however, they could offer a furlough, they could offer a leave of absence, they could offer remote work and if none of that works out, ultimately the employee could be let go for not getting vaccinated. >> wow. that's really interesting. thanks so much, kris. more details, majority of california voters say businesses should be allowed to require proof of vaccination from their customers, according to aeley s of venues, sports stadiums and casinos should be allowed to check vaccination cards and a majority say businesses should be allowed to

require negative covid tests to allow customers inside. a new reward to help solve the party bus shooting that killed two teenagers in oakland. "today in the bay's" bob redell is live for us this morning, covered the story since yesterday and the big question people had, do police have any leads. any word on that this morning? >> reporter: good morning to you, marcus. no word and if police do have any leads, they aren't saying. we know they are looking for at least two suspects in yesterday's shooting of a party bus in oakland. on board that bus a group of young women who were celebrating their friend's 21st birthday. two teenagers killed, several injured, including one in the hospital in critical condition. oakland police and chp believe this was not a random crime, that the shooters targeted the bus. it started 12:20 yesterday morning. the bus was returning to oakland from san francisco. the suspects were in another

vehicle, shot at the bus as it drove off eastbound 580 onto seminary avenue and again fired at it near foothill boulevard and 68th avenue. at least two shooters fired about 70 bullets into that bus. the bus eventually made it to east oakland's police substation. one of the women killed was a 19-year-old mother from oakland whose child turns 3 on saturday, the other zoe hughes of me dose toe just 16 years old. >> she deserved a lot more than 16 years and i want everyone to know it's a nightmare, what's happening. and that i love her so much, and i wish that i could just hug her one more time. >> reporter: that was zoe's cousin. oakland police and crimestoppers are offering a $40,000 reward for information leading to an arrest of the suspects. chp and crimestoppers have their

own respective tip lines, too, people can call into. reporting live, bob redell, "today in the bay." >> thank you, bob. 6:06 right now. developing right now, the search is on this morning for the driver involved in a deadly hit-and-run crash in san francisco. one person died at the scene, another victim in extremely critical condition. it happened at about 7:00 last night on polk and hayes near the civic center plaza. police say after the two vehicles collided, one of the drivers ran from the scene. happening in washington today, the house votes on whether to form a 9/11 style commission to investigate the january 6th capitol siege and some argue that the vote is coming down to partisan politics. the commission would include five democrats and five republicans with leaders from both parties approving any subpoenas. some house republicans led by the central valley's kevin mccarthy are now deciding not to support the bill. >> this is driven solely by politics and nancy pelosi, but we should not be a part of that.

>> disappointing but not surprising on the part of the republican side not to want to find the truth. >> reporter: gop representatives are struggling to deliver a unified message about what happened january 6th and the recently ousted third in command liz cheney for saying president trump lost the election. it's not clear what senate republican also do but senate democrats say they will take up the bill if it is passed in the house. neighbors on alert in san francisco keeping a watchful eye out for a mountain lion. it's been spotted several times this week on security cameras in portola, this one is on gavin street near the 280/101 interchange. fish and wildlife say the cat has a tracking collar and this isn't the first time that it's visited the city. in two previous instances that cat left on its own. >> we're obviously doing increased patrols and hopefully

the mountain lion has actually turned around and gone back to the peninsula. >> i don't know, he's making his visit. the cat was also spotted early tuesday in vernal heights and if it's spotted again and police can set up a perimeter, they'll decide how to safely remove it. new impacts from the bay area's extreme drought conditions. more north bay residents are asked to conserve water. last night, santa rosa councilmembers adopted a 20% voluntary reduction in water use, the move comes after a recent drought declaration for mendocino and sonoma counties. a live look for you this morning in dublin, as we take a beautiful look at that sunrise, but you can also see there along the hillside, the brown we've been dealing with a lot of the dry conditions, kari, out there. definitely concerning as we still monitor the drought but enjoying the sunrise as well. >> yes. we are in the extreme drought

category, and we've also seen at times some gusty winds picking up. today it will be breezy as we wake up for most of the bay area all clear skies and temperatures slightly cooler today, but a wind advisory will go up this evening, as we could see some wind gusts reaching over 50 miles per hour near the coast, as well as the hills, and there will be a storm system but it stays to the east of us, bringing some rain and snow to the sierra, as we go through our forecast, notice the temperatures today, mostly in the 60s, but a few of us still in the 70s today. so we'll talk more about that wind advisory as well as the reason why we're not under a red flag warning, talk about that. mike, what's going on right now the breaking news? >> [ muted ] -- crash in san jose cleared and there's good recovery there. i'll show you that on the map. the bay bridge backup an the toll plaza suddenly getting a lot worse for a few minutes and now a little slowing but look the hov lanes are also slowing.

there's something going on at the toll plaza itself. that may be new, as we look at the map there was also reports of a crash at treasure island and your bus lane is blocked there. they may have changed the metering lights in the last couple of minutes to keep traffic from building up at treasure island, that may add to the backup at the toll plaza, sorting out a couple details there. we see more slowing early there concord out of bay point, pittsburgh, may be a disabled vehicle in the backup. i circled 101 through san jose nearlily completely recovered from the early crashing and bashup, the flooding is cleared out of lanes. back to you. >> thanks, mike. san francisco mayor london breed is on the verge of providing much relief for those struggling to make it in the bay. "the examiner" reports she's allocating money in the city's new budge tote further subsidize rents for one group of 2,800 tenants in permanent supportive housing. it will boost 30% of income.

right now at 6:14, as you get ready to head out the door, heads up a windy day and this evening a wind advisory in effect for the areas shaded in the amber color in effect through early tomorrow morning. we're watching that as well as a bit of a cooldown for parts of the bay area, coming up in a few minutes. >> an unusual pattern at the bay bridge. oh, darn it, we have the focus shifting but in the distance you can see one of your lanes is

clear but their hov lane is backed up. treasure island flows smoothly. south bay great recovery from the earlier backup, starting to see another build on schedule for your south bay commute coming up. well, good morning, very happy wednesday to you as well. it turns out those dark side hackers were far more successful than we first realized, they're the eastern european or possibly russian group that held computers at colonial pipeline for ransom. colonial paid them off. now a security company called the liptick, dark side received $90 million in ransom over the last eight months from 47 different corporate victims. taking you out to the markets this morning, target says the sales hit all-time continue to worry about

inflation. prices are up on all kinds of commodities. we talked yesterday about how the number of new homes built in america fell last month because builders said it was hard to get their hands on lumber, price of lumber, up something like 400%. there is an old saying the solution to high prices is high prices, it brings in more supply and the price of lumber is in fact falling. they trade lumber futures on the chicago mercantile exchange. the price of lumber falling so fast, it fell faster than the exchange allows, past the limits, and that should continue. you know what else is falling is tipping. reporter j.j. mcharvey at the "wall street journal" did an analysis of how we tipped during the pandemic. i overtipped, and americans tipped at places they don't normally tip like subway or other takeout and why not? restaurants were suffering and wait staff were really

suffering. i can only speak for myself but when i talk about overtipping i'm talking about way, way overtipping and honestly that's not sustainable and this is one of the things where wait staff have to get used to going back to 15%, 20%. >> it would be nice if they could raise their pay up. i didn't realize until some time ago most servers make a little amount of money because they rely on tips. >> from the restaurant itself. i'll tell you, though, marcus, i used to wait tables through high school and college. my first two jobs in television i made more money as a waiter than i did as a television reporter. television is famously low pay when you start. >> we all know. thanks, scott. >> got to work your way up. new this morning, the ease which one news group had finding president biden's venmo account

allman viewers across the country saw her, not to mention the viral video. i saw it yesterday, by the way we can laugh because the woman was doing fine. funny. also trending this morning, look at this, a gator with a taste for fast food caught hanging out at a parking lot next to wendy's in ft. myers, florida. check out the photos posted by local deputies. the six-footer chased a few customers before deputies caught him. the sheriff quoted "he may have been hangry for a cheeseburger but gave quite the scare." look at that. wow. >> i wonder if deputies have different training in florida than they do in the bay area, like "in case you come across a gator." >> jump on its back, grab its head. >> no kidding, it's so easy to do. ha, ha, ha. let's take a look at the forecast for this wednesday morning. kari, how are we looking for

today? >> it's going to be another beautiful day. take a look at our view as we check out the mission district in san francisco. another clear sunrise this morning, the fog kind of hanging back a little bit, and our temperatures will actually be cooler today as we get a cold front sweeping across the region, and we'll see our temperatures today only reaching the low 60s there, some low 70s for the north bay, and some upper 60s for the tri-valley. head down to santa clara county in the upper 60s as well. so it's also going to be very windy as that system passes to the east of us. take a look at our wind speed forecast. here we are at 9:00 this evening, ooh, those winds coming in to san francisco 50 miles per hour, maybe even a little bit higher at times. we see winds rushing in as the system moves on through as well as the santa cruz mountains and we know that we've had some very dry vegetation. the brush has completely dried out so we have to be careful. even though they're not under a

red flag warning there could be quickly spreading fires because of these conditions. what is working in our favor is that we've had some much higher humidity and then the winds will start to calm down headed into tomorrow. so humidity higher and we're also going to see some rain moving across parts of the sierra, even some snow, yes, we're going to see snow up above 8,000 feet for tomorrow into friday as well as saturday, and then things calm down on sunday, but that's when we start to warm up here in the bay area. so take a look at this seven-day forecast. our inland areas in parts of the north bay, the tri-valley down to the south county see low 70s and mid-70s in the weekend, low to mid 80s and it will warm up next week so enjoy the natural air conditioning while it lasts. let's head over to you, mike, what is it looking like for the morning commute to work? >> kari, the bay bridge is backed up, a little differently than we saw a normal

florida, an 11-year-old girl fighting off a man trying to kidnap her, near pensacola. she won that fight. the man eventually gave up, drove off. police say that suspect, a 30-year-old, has been arrested. the brave girl says the same man had approached her before. new details this out of north carolina, deputy also not face criminal charges in the recently deadly shooting. prosecutors say all actions were justified in the shooting of andrew brown, jr. deputies tried to serve a drug warrant last month in elizabeth city. he refused their orders and drove his car directly at one of the officers before shots were fired. new this morning, illinois man driving a tesla is cited for inattentive driving. a wisconsin deputy says the sleeping at the wheel, after putting on his lights and siren to initiate a traffic stop the driver went two more miles before pulling over.

"today in the bay" continues now. good wengs wednesday morning. thanks for joining us. i'm marcus washington. >> and i'm laura garcia. a major turn of events for former president trump. scott mcgrew is tracking the overnight developments for us. >> good morning to you, laura. the trump organization is under another criminal investigation this time from the new york state attorney general, that prosecutor had already built a civil case, now attorney general james says she's expanding that fraud investigation into the criminal side, this parallels or joins a criminal investigation already under way b manhattan district attorney who is things, whether trump and his organization lied about the value of trump buildings to avoid paying taxes or to

increase the number of loans it could get. now the new york attorney general's office told us "we have informed the trump organization that our investigation into the organization is no longer purely civil in nature. we are now actively investigating the trump organization in a criminal capacity, along with the manhattan d.a." the allegation is the trump organization would inflate the value of the building to get bank loans. remember, the trump organization had a tough time getting loans after defaulting on several, but it would deflate the estimated value of the same buildings when it paid taxes in order to pay less. prosecutors have powerful witnesses to that. dump's own lawyer at the time, michael cohen says, the trump organization did that when testifying before congress back in 2019. law camera, the house is already

moving on to other news this morning, just in, fire crews are working on a house fire in san francisco. this was video that was just posted to citizen app, it's happening on schrader street in the cole valley neighborhood. firefighters say it's burning the roof and upper level of a three-story home. no word on any injuries. we'll continue to follow this developing story and bring you updates as soon as they come in. new overnight, firefighters this is from a house fire in san lorenzo. videos and photos tweeted by alameda county fire. crews responded to that fire around 2:30 this morning on brandon e. avenue in san leandro. deputies were able to rescue one person from a rear window while fire crews save the second. a dog was also saved. the cause is under investigation. the search is on for the person who attacked and robbed

an asian-american woman riding on a b.a.r.t. train in san francisco. this morning she's resting at home. when will the violence stop many are asking. "today in the bay's" cierra johnson is live with details on the attack and what police are saying. >> reporter: good morning, marcus. thankfully the woman didn't sustain any serious injuries and is resting at home after that attack. b.a.r.t. police are not calling this is racially motivated but the string of attacks we've had nationally and the bay area, many members of the community unsettled by what played out here. take a look at the screen, these are pictures of that woman after she was attacked at the b.a.r.t. station. her name is not being released but those close to the situation say she was riding b.a.r.t. train toward the 16th and mission station around 8:00 monday morning. that's when a man approached her, the man demanded her phone, yelled curse words at her and hit her in the face.

right now b.a.r.t. police say the words used were not asian slurs and as i mentioned, not describing the crime as an act of anti-asian violence. many advocating for protection of those in the aapi community say something has to be done so members of the community feel safe. >> let's make sure people who are victimized, survivors of violence get the full range of support and that we move any barriers associated with that. >> reporter: so right now, b.a.r.t. police are combing the surveillance and anyone who was on the train to contact them to help pinpoint the suspect. we're live, cierra johnson for "today in the bay." >> thank you, cierra. new progress is being made in the fight against covid. daily u.s. infections have continued to drop dipping below fully vaccinated.nationwide.

also more than half a million 12 to 15-year-olds have now received their first pfizer covid vaccine shot, less than one week after the fda and cdc approved it. if you're not vaccinated yet, you still have the opportunity to do so in the east bay today. pleasanton teaming up with satisfy way to give up pfizer doses on the pleasanton senior center on sunol boulevard, for 12 and older. head to nbcbayarea.com for more information on how to find a vaccine near you. there's a new push in sacramento to end distance learning for students and soon. san francisco state assemblyman phil ting wants to end a waiver that allows for that at-home learning. the normal year schools get state funding for attendance but districts were given a pass at the start of the pandemic. ting is calling for that to end next month saying distance learning has not worked for all students.

fines are going up for illegal dumping in san jose. if you're caught, it will cost you $10,000, up from $2,500. the city council approved the increase last night. san jose has seen a dramatic jump in legal dumping during the pandemic. got to clean it up, keep the bay area as beautiful as it is. let's take a live look outside overlooking san francisco this morning. kind of a cool start to our morning, sun's up, right behind kari hall. she's our little ray of sunshine this morning, bringing us the forecast. how are we looking? >> it looks like another beautiful day for the bay area. nice and cool, but we are also going to have some gusty winds and by this afternoon, you'll notice it will be a little bit cooler compared to yesterday, as those winds increase. we could see some of those gusts over 50 miles per hour, wind advisory going up for the coast and hills, and there will be a storm system passing just to the

east of us, with some rainsierr. mike, how is it looking for the commute? >> kari, i was woried a second crash reported in san jose. show you on the map talking about north 101 at 880, at that transition ramp where we had the earlier flooding record. chp gave more detail. they activated the old incident in their blotter but it was because another vehicle was spotted at the gish off-ramp. it's all right. light slowing there. another incident north 880 at dixon landing road leaves one lane closed but there's light traffic northbound there so it's light backup there. no problem at the bay bridge toll plaza now but we have that bus lane reported blocked at treasure island so there is the backup coming off of the berkeley curve and still slow san pablo to cutting boulevard for west 80, the crash should be moved to the shoulder shortly. back to you. >> thank you, mike. ahead of fire season, much of the state is already dealing

"today in the bay's" kris sanchez is live in downtown san jose moving forward with what's new today. kris? >> reporter: hi there. a lot of us have been asking each other have you gotten your shot yet? have you been vaccinated, but in santa clara county the next person who asks you might be your boss. that is one of the new guidelines that starts today in santa clara county. the rest are straightforward. gyms can reopen indoors at 50% capacity, same for restaurants. bars can reopen at 25% indoors. live outdoor venues can welcome people back at 67% capacity. but now, starting today, santa clara county is requiring all employers both private and public to determine the vaccine status of all employees within the next 14 days. workers can decline to say but they have to follow the same

rules as unvaccinated people related to masking, social distancing and quarantine upon close contact with someone who is covid positive. we talked with a former santa clara university law school dean who says that health privacy laws do allow for this. >> that would not prevent in my opinion prevent an employer from asking their employees, are you vaccinated? even do you have proof of vaccination? we want to see that. >> reporter: the county maintains this is not a vaccine mandate. they just want the information so that everybody is on the same page, the law school professor says that employers can require vaccination before returning people who refuse could lose their job in some situations. in san jose, kris sanchez,

"today in the bay." members of the president's own party are pushing him to push for a cease-fire in the middle east. >> but all of this is coming after the worst bloodshed in years, this morning the bombing and air strikes continue on both sides. gaza leaders say at least 217 palestinians have died and israel authorities say 12 people have been killed. nbc's richard engel is in tel aviv with more. >> reporter: marcus, laura, as long as bombs are still dropping and rockets are flying, a lot could change quickly, a lot of the things could go wrong. there is talk now about a cease-fire. israeli media reporting that a cease-fire in internationally mediated cease-fire could come as early as tomorrow or friday but so far, we are not seeing signs that the conflict is slowing down >> a defeat for hamas is a victory for people who want to see peace and stability in the middle east.

me, i apologize about that, didn't mean to scare anyone. time to look at the forecast for you this morning. kari, you're better with the numbers than i am when it comes to the weather. >> well, it's been nice and cool, so not too much to juggle here and it's been also very comfortable for our afternoons and we're going to see those highs reaching up to 76 degrees today in fairfield, 67 in san jose, and in palo alto, so i think making some plans to get outside today once again. but if you are going to be out there, it's going to be super windy especially this evening. i'm taking the time line through 9:00 tonight, take a look at these wind speeds in miles per hour, we're going to see these winds rushing in, san francisco 50 mooil. er 50-mile-per-hour winds and 32 in livermore. the vegetation is dry so small sparks could get things going rapidly. one thing in our favor, we have

help solve the party bus shooting that killed two teenage girls in oakland during a birthday celebrate that took an unthinkable turn. bob redell is live. do police any information about leads? >> reporter: they haven't reported to us about what leads they may or may not have. they do say that they are looking for at least two suspects in connection with yesterday's shooting of that party bus in oakland on board a group of young women celebrating a friend's 21st birthday. two teenagers were killed, several more injured, including one who is still in the hospital in critical condition. oakland police and chp believe this was not a random crime, that the shooters targeted the bus. it started around 12:20 yesterday morning. the bus is returning to oakland from san francisco. the suspects were in another vehicle. they shot at the bus at the bus drove off eastbound 580 an a seminary avenue and again near foothill boulevard and 68th avenue, fired at least 70 bullets into that bus. the bus eventually made it to
