breaking right now at 4:30, one person is dead following a police shooting in the south bay. a lot of questions lingering this morning as an active investigation is still under way. "today in the bay" begins right now. good tuesday morning to you and thanks for joining us. i'm kris sanchez. >> and i'm cierra johnson. we get to the breaking news in north san jose. "today in the bay's" sharon katsuda is live at the scene. what do we know so far? >> reporter: cierra and kris, there are still many police units on scene and way down the street here, it's very dark, we

can see there is a command unit set up. let's look at video from what happened last night. this officer-involved shooting we're told started at about 9:45, when police were conducting an investigation, police say that the suspect then confronted them during the investigation and that's when the officer-involved shooting happened. we're told that this person who was shot was pronounced dead at the scene, still need to confirm all of this, and police officers are still here collecting evidence, we just saw them taking pictures. this is all near berryessa road and we're on the 1100 block of tufts drive. at about 6:00 this morning we're told there will be police public information officer to give us more details. for now that's what we have. reporting live in san jose, i'm sharon katsuda, "today in the bay." >> we'll go back to sharon in a bit. we want to talk with vianey arana, good morning to mike,

too, but that weather still hot. >> it's still hot. today we're blue so no microclimate weather alert, the heat advisory was allowed to expire at 9:00 p.m. but excessive heat warning for areas in sacramento. look at the temperatures as you head out the door. another mild start to our day, you're not going to need a jacket again today because it's going to warm up nicely to the 80s and 90s. hayward 58 degrees. san jose 59. let's get a glance of the temperature trend in san jose. another change this morning are the low clouds around the coastline. they made their move in last night which helped cool off a lot of those coastal areas. look by about 8:00/9:00 a.m. in the 60s and eventually right around 11:00 a.m. already in the upper 70s so even though it's not going to be as hot as yesterday, it's another warm day so definitely something to look out for if you have plans to head out the door today. walnut creek 59 degrees right now. over the next couple of hours we'll be jumping into those 70s,

we've got a lot of sunshine ahead. let's send things over to mike. >> the heat advisory on my side, i'm still warm from the heat. look to relief the golden gate bridge as vianey said, low clouds and fog there one of your usual suspects the golden gate bridge, traffic is very light, obviously right now. folks are used to dealing with this. we don't see any slowing on our sensors, a smooth drive across the golden gate bridge with the arrow and the bay bridge the same thing, long drive out of antioch through concourt. the altamont pass has slowing. everything else is fine peninsula and the south bay. back to the south bay for the next bit of news. >> this is just in to the newsroom a fire burning in the south bay just behind lincoln high school. san jose fire department posted this photo to twitter, officials telling us that that two-alarm fire started around 3:00 this morning at wabash and forest. we are following up with the fire department for more details but so far, we have not heard of any injuries.

the cause of the fire is under investigation. we also have new video of an apartment fire about ten minutes south of san jose, also still in the city limits. the fire broke out around 9:00 last night and grew to three alarms before it was contained after two hours of fighting that fire. the fire burned several apartments and we know seven children and seven adults there l have to find a new place to live. no one was hurt, still no cause on that one. covid cases across the nation are tapering off all but four states are nearing the lowest risk tier designated by a group called covid act now. that group looks at several metrics to determine the risk, the four states medium risk colorado, florida, washington and wyoming. employers across santa clara county must comply with the new requirement to obtain records of the covid status of their workforce by today. the county issued that rule two weeks ago. it immediately raised questions about privacy and enforcement,

if a company does not have the records on file by today, it could face fines of $5,000 each day. the county does stress the mandate is not a requirement for anyone to get vaccinated and does not require the businesses to disclose that information. two other people or other agencies also workers they can always choose not to answer. we're learning more about the attack on a san francisco police officer we showed you this video yesterday. the union president said staffing levels are dangerously low, leaving some officers on patrol without a partner to help when trouble surfaces as it did friday night. is homeless. the. the of the police officers association says the officer should not have had to approach contreras by herself. >> this officer was alone, directly related to staffing. we've been in recruitment and retention staffing crisis for years. >> reporter: tony montoya is grateful people jumped in and helped the officer until backup arrived and the orange weapon indicates the officer armed herself with a less than lethal weapon to get him into custody. >> extended range impact weapon, a modified shotgun that shoots bean bags filled with pellets. >> reporter: a witness to the arrest says he took these pictures of officers contacting contreras a few blocks away at portsmouth square. police received calls he was vandalizing scooters. david ye took these pictures.

>> came out of the park lit and throwing cardboard around and shouting, stuff like you know, chinese people don't belong here. >> reporter: once backup arrived, it took several officers to control contreras. the officer who was attacked went to the hospital but the union president says she is back home. police say they are investigating the assault on the police officer as a possible hate crime, contreras remains in custody tonight. in san francisco, jean elle, "nbc bay area news." 4:37 and on the peninsula, investigators in millbrae are trying to track down a mountain lion that was possibly spotted roaming through that neighborhood. the sighting happened around 7:00 along sequoia avenue near mills high school. deputies searched but could not find the big cat. it's possible what the person saw was maybe not a mountain lion after all but you might remember the peninsula is no stranger to mountain lions. a week ago in san francisco, one broke through the window of a

the dow and s&p 500 rising for the fourth straight month benefiting from optimism over the economic recovery and stocks related to reopening. the nasdaq gaining more than 2% last week, its best since april but the tech-heavy index fell manufacturing and construction spending. elon musk says prices on some vehicles are going up because of supply chain disruptions across the auto industry especially for raw materials. musk was responding to a twitter user to w.h.o. says it doesn't like the direction the company is going in by raising prices and he was specific in his criticism about removing some features like the lumbar support for the model y. last month tesla raised prices on the model y and the model 3 for the fifth time in recent months. and fitbit may add snoring detection to its devices, a move

record heat today, at least not through the interior valley. we managed to cool off a bit, the overnight hours we have the clouds that moved in, that helped cool things off around the coastline. right now 60 degrees in san jose, can you believe it? we're not even at 5:00 p.m. yet. over the next couple of hours it's quick to warm again by 10:00 a.m., expect to hit the 70s on the map, livermore going to be another one of the warm spots yet again today, 63 degrees right now. notice in the icons not a cloud in sight, so another afternoon of sunshine, so let's get a look at that fog and visibility, because we see the return of the low clouds around the coastline along with the fog and half moon bay right now seen some dense fog to less than half a mile in through half moon bay so if you're traveling through the coastline this early morning hour, expect to see that fog over the next couple of hours and fog through the north bay as well, so keep that in mind. drive safe. microclimate highs for today, though, if you're wondering how hot we'll be, yesterday we had plenty of 90s and triple digits.

today we drop down into the 80s. san jose 86 degrees. east san jose 88, through the interior valleys in the east bay, oakland 69. walnut creek, danville and pleasanton in the upper 80s/low 90s so a lot less triple digit there is. san mateo 74. redwood city 76 and san francisco in the upper 60s and up through the north bay, we're going to be seeing a nice combination of a little bit of everything, 9 in santa rosa and 80s in sonoma and novato. notice the triple digit heat up through ukiah. we could very well see some of the high pressure dominating and taking over in the area. we have some cooling into the middle of the week, i know that mike enjoys the cooler weather without the triple-digit heat so let's get a check of traffic with mike. how are the roads? >> good. i was watching where the giant red sign that says "hot" is floating around. we have a red banner as well here because vta continues with no lightrail service, canceled

until further notice again continuing with the bus bridges. the number in the orange section in case anybody has questions, vta trying to sort out scheduling. the freeways are moving smoothly throughout silicon valley and santa clara county, no problems up the peninsula. something popped up near berryessa, i think it has to do with the investigation that's going on with the fire there, sharon is watching that. near the dublin interchange no major problems and the early drive out of the altamont pass, so is vasco road at speed. back to you, cierra. happening today a judge is set to hear a motion to appoint legal counsel for peterson in the juror misconduct case tied to his original trial. prosecutor also not seek the death penalty in sentencing retrial, they cited bringing up new pain for lacey peterson's family members. the judge is deciding if the

separate juror misconduct case should move forward. in san francisco another big step in the return to normal. in-person high school graduation ceremonies return. i don't think that's the right video but the events will take place over the next three days at a stadium as well as mcateer high school campus. students can bring up to four guests and audience members will sit in pods six feet apart. >> will we remember how to behave at a graduation, i think so, right? clap? it turns out we have new details something good did come out of this pandemic, a new tradition in palo alto, last year's car parade to celebrate graduating seniors was so popular they're doing it again for this year's class, starting at 5:30 and if it goes like last year, students will wear their caps and gowns and creatively decorate their vehicles.

pat raid precedes the graduation ceremonies starting with events tomorrow. san jose's willow glen did the same thing for their seniors saturday. governor newsom along with other state leader also convene at a task force to study and develop proposals for potential reparations for the descendants of slaves. california is the first state in the country to look into possible reparations. this task force will make recommendations on how reparations could happen whether through compensation or restitution. the task force is charged with educating the public on the history of slavery in california and the u.s. this comes as other states like idaho have banned race theory from being taught in schools, p to return some beachfront property to descendants of a black couple who were stripped of it a century ago. a scare in the sky turns into a scare on the ground. a small plane forced to land on a busy california highway. look at it, what may have gone

"today in the bay" continues right now. good morning i'm cierra johnson. >> and i'm kris sanchez. we'll go tweet that in a moment. first we begin with breaking news. there was a deadly police shooting in san jose and still a very active scene with officers out there. what we know so far, san jose police say officers were kungting a follow-up investigation on tufts drive around 9:45 last night, not far from berryessa road and 680. officers were confronted by the suspect, when the officer-involved shooting happened. we are told the person who was shot by police died at the scene. we'll continue to follow the breaking story and bring you updates as they come in.

changes coming for the vta lightrail service as it remains shut down indefinitely after last week's murder of nine employees. "today in the bay's" bob redell is live in milpitas. it sending the temporary bus bridge this morning. >> reporter: correct. they made this announcement yesterday. good morning to you, cierra. the vta is ending the bus bridge service that they had been running to substitute for the light rail service. the light rail service which has been shut down since last wednesday's shooting, the transit agency says it can no longer officer that bus bridge and the lightrail service will remain shut down indefinitely. so lightrail still shut down indefinitely. the bus bridge service set up temporarily also now shut down and there's no estimated time of reopening for the lightrail service. the vta says it is putting its employees first, wants to give them time to grieve and process what happened, when their
