alvarado niles and slowing 280 past el monte and los altos hill. i think they cleared the overnight crew, we'll check on that. >> unanswered questions in the aftermath of a deadly police shooting that sparked protests last night in san jose. >> "today in the bay's" bob redell is live outside of the san jose police headquarters this morning. police are going to talk a little bit more today about what happened, give us more info. >> reporter: that is the expectation. news conference scheduled with san jose police chief anthony motta to share more details why his officers initially made contact with the man they shot and killed and what happened leading up to the moments. 50 protesters shut down the northbound lanes of highway 87 chanting the name demetrius stanley, the man killed by two san jose police officers earlier this week. police released surveillance photos from the moments just

before the shooting they say shows stanley was armed. this happened monday night at around 9:45, on topps drive near 680 and berryessa. the two officers were in plain clothes and were in the neighborhood to collect information about an armed robbery. one of demetrius stanley's friends questioned why police were there that late at night. >> that was the man defending his home by some people that were in plain clothes that came with weapons and ammunition and he defended himself like he was supposed to with the constitution that we were given as americans. >> we were not there last night to arrest him, to try to capture him. we had two officers at that location gathering information. it was related to an armed robbery that the suspect, he was the suspect in that armed robbery. >> reporter: san jose police released three pictures from the surveillance camera on stanley

with the gun and another one shows stanley pointing the gun at officers and third close-up of the handgun itself. it's unclear if the officers had body cameras on at the time because they were no uniform, they were plain clothed. police met with stanley's family for at least an hour last night. police chief anthony motta scheduled to hold a news conference sometime later this morning. bob redell, "today in the bay." >> we'll keep tabs on what's going on there, thank you. oakland police chief laron armstrong will follow up on last year's george floyd protests, they suggest officers may be facing disciplinary action. the protests happened exactly one year ago and at times got out of hand. you may also recall law enforcement from across the state assisted oakland police in trying to get a handle on things. chief armstrong will hold a news conference this morning which will be also viewable on

facebook. when covid vaccine booster shots start rolling out the type of shot you got for your initial vaccination may not matter. new this morning, federal health leaders look at what happens when fully vaccinated adults later receive a booster not produced by the same drugmaker. say for example getting a moderna booster after receiving a pfizer vaccination. the new trial comes as likelihood increases for a booster dose dune the road or maybe a new shot each year like the flu shot. if you live in contra costa county, and your child still needs vaccinations of any kind before next fall, the county has you covered. they're now offering no toss tdap immunizations at the same school campuses offering covid shots. the tdap is a required immunization for students entering the seventh grade, boosters will be offered in clinics through the summer, three schools started offering the booster yesterday. alkalinis and kenny high school and dallas ranch middle school.

firefighters will remember two comrades what died in the line of duty ten years ago. they caught fire at a four-story home in diamond heights. at 9:00 in the morning the fire department will transmit a radio message and following that each of the city's fire station also ring their bell to remember the pair. new details this morning and as fire danger really increases, people in alameda county will have a new system telling them when to evacuate. it's called zone haven and scheduled to go live on june 15th. all alameda county residents have been divided into zones. in two weeks residents can enter their address to learn their zones. during an emergency, emergency alerts will be released showing which zones are in danger. parts of san francisco and santa cruz are already using this system. in the meantime in san mateo county, leaders are talking about what's being done to

reduce fire risk along the peninsula, holding a virtual forum tonight at 7:00 held on zoom and livestreamed on youtube. to our climate in crisis and a looming decision today that may impact bay area air quality. here is a live look at the skies above in san francisco this morning, there it is and bay area air district leaders will vote on new rules for local oil refineries. it could require new cleaning technology to, excuse me, to rules for the local oil refineries, and could also require new clean technology installed that reduce particulate matter up to 70%. the federal government requires it useed athe the valero refinery in benicia chevron and expensive and may force them to shut down their facilities. time to get a look at the forecast. vianey is in for kari this

morning, and cooler temperatures are certainly nice, are we going to be spoiled at all today? >> i think we will and the good thing is because of microclimates, if you want to get away from the heat, there is a couple of areas are going to be significantly cooler compared to the interior valleys. now that coastal fog once again in the picture, we've got this onshore flow hanging on tight to that high pressure that brought those record-breaking temps over the past couple of days, that moved out east and today we're seeing 60s, 70s, 80s and maybe even a couple of 90s. so quite a range there. 84 degrees in concord. 85 in livermore. 80 degrees in san jose. oakland 66. i'll talk about the mike? >> vianey, looking at the current commute where traffic is still flowing smoothly, only 5:08 right now. we look at the maps, update we have for 280 is a much better speed flow of traffic down here south 280 past el monte. the full closure wasn't marked anywhere. there was some construction in the area, still is for a couple of lanes so watch for those

biggest and most viral meme on the internet. and cher's in samsung's publishing arm which owns a part of another company that owns the rights to the "baby shark" video rose 10%. i'll say that again, musk tweeted a video, the company that owns the rights to the video became more valuable, there's no hidden message in the sweet. tesla isn't buying samsung. sorry for putting this song in your head all morning. futures call for a stronger opening this morning but it's hard to tell what the markets will do. ♪ do, do, do, do, do ♪ the hacks against one of the world's largest meat packers was worse than the company indicated. earlier yesterday the plant owned by jbs here in america would not close but close they did, at least for a day. this is the second major hack against american infrastructure, though not nearly as bad so far as we understand as the colonial pipeline hack.

they'll take a closer look at how vulnerable american companies really are, coming up on the "today" show. >> what we know is that companies of all sizes, large and small, are vulnerable to cyber attacks. so every company needs to be thinking about what it should be doing to be more resilient and to be doing the basics. >> protecting against hacks is important but the bigger issue, cierra and laura, it looks like the criminals behind the hack were based in russia. what actions if any russia is going to take and what actions we should take against russia remain to be seen but clearly we've got to do something. >> all right, so you just hang out right there, scott. we want to bring in mike inouye as well because have you noticed a little something different? after more than a year of all three of us working from home, we're back in studio, finally together, at least with a little distance here. what's it like for you, scott, to be back? >> the drive in was very strange and also i'm wearing dress shoes which i can't say i really enjoy at all. maybe i'll take them off under

my desk. >> are you wearing slippers, too, mike? >> no. and this is my view from home, literally a corner in an office in a small part of our house, where we set up here so we have a lot more space here and a lot more people to help out and so once we're in the same room, i'll consider pants but for now -- a shirt and jacket on and apparently that's helping people social distance from me. laura, we had fireside chats with you before. >> that's right. i changed my look a few times. you saw different angles of my house. this is when i sat in that big chair, this is when i first started out, it was in my living room so i tried to -- it was hard to make space for my family and then of course all the news equipment that we had, setting up like a studio there. i have to say, the number one thing that i miss this morning is my little dog and he was literally following me around this morning, i think he knew something was up that i was leaving so pip, i'll be back. mama is going to come back home.

>> it's great having you all here. it was getting lonely in the studio. >> it's probably different. >> it is. >> having so many of us. >> it's great, awesome. i love it. >> well, here we go. getting back to a little bit of normal. >> good to be back. >> vianey is filling in for kari as well, haven't seen you in ages. >> my first day back was monday. kari is still working from home for now but it is nice to see everybody. this is the most people we've had on set in over a year. i can tell you that much, even though we're at a distance. hour by hour forecast 40s and 50s right now so it's a mild start. it's not really cold, cold, however you might think differently if you're around areas of fog because there is that fog factor. look at the temperature difference, livermore running eight degrees cooler this morning and this is going to set us up for a lovely more seasonable week ahead and what do i mean by seasonable? it means that more normal for this time. more summer. we had the official start of summer yesterday. less than two miles in terms of visibility in half moon bay, we

have that fog as well around san francisco so keep that in mind because we're going to continue to see coastal clouds at least for the first half of our morning, a lot slower to clear around the coastline, 64 degrees in san francisco, but look at this. 70s up in the north bay, so no more heat advisories, those were allowed to expire as of two days ago but it's still pretty warm in inland areas, for example, if you lived down in the south bay, san jose, we're going to be in the 80s, morgan hill, the gilroy area still in the mid and upper 80s for sure but this is going to set us up for a couple of changes ahead. the long range outlook that high pressure is what brought some of that record heat the past few days. that one continues to move east and then we get a little bit of cooling, but then here comes this big "h" behind it headed into saturday and sunday, don't worry, it looks like it's just going to warm us up by a couple of degrees because by next week and i mean the next monday, we're going to see temperatures only hit high 70s for inland areas, so it will be a nice change in the weather pattern

there. i'll send it over to you. >> we're looking at a change in the traffic and i don't want to say nice change, the predictable change as we look out on the roadways. let's look at our speed sensors on our maps and the live shot as well. we'll talk about i can take a map. noticed some changes in our rundowns here. we look at traffic flowing 101 nice easy drive with the taillights moving north toward san mateo and no major slowing on 280 has cleared up as well. if we can get over to the map systems albany issue there behind where it says berkeley a disabled vehicle for i-80, no major concern there. zooming toward the tri-valley, 84 cleared from the construction and 84 has cleared from that major slowing we saw at vallecitos, narrowed toward sunol, from the early burst we see, traffic feeding in out of the altamont so the build starts about now. as we talked about 280 just about clear from the earlier slowing we had through the construction zone through los altos hills and using transit

welcome back. develop in southern california an outpouring of grief after a deadly workplace shooting inside a firehouse, happened 50 miles north of l.a. authorities say the gunman bass an off-duty firefighter who later returned home, barricaded himself inside and set his home on fire. he was eventually found dead from a self-inflicted gunshot

wound. last night dozens gathered to remember the 44-year-old firefighter engineer killed by the gunman. >> we are a family. we live, we work, we cry together, and just don't think something like this will happen. >> the station's fire captain was also shot. he is said to be in critical but stable condition. in about two months the fraud trial starts for former theranos rceo elizabeth holmes. her lawyers want to use a lengthy questionnaire to weed out jurors. the proposed questionnaire is 41 pages and lists 112 questions, prosecutors are calling it "deeply intrusive." holmes legal team says extensive media coverage may make it hard to find impartial jurors. scheduled to begin august 31st. ohio's second round of vax a million drawing is tonight.

always just sitting down hanging out, waist up, i wasn't ready for the full body shot, okay? so morning clouds, we've got a cool coast, plenty of fog once again, but look, that's what's helping keep our temperatures cooler. in addition to that, even though it's sunny in inland areas, we're still going to be a lot cooler compared to the past few days because that ridge of high pressure is going to move out east and 80s and 90s still possible for the tri-valley, but the good news is looking out ahead, we have an approaching system that is going to bring additional cooling to the area to more seasonable, so if you live in the tri-valley, you don't have ac, when will i get relief? i'll have that answer in a few minutes. >> we miss binx and laura pices pipsqueak. bay bridge more traffic, starting to build on schedule. a crash near the berkeley curve. the live shot looked fine but

slowing down as you approach the area, emeryville toward the berkeley curve for west 80 at the merge with 580. watch for one lane to possibly be blocked. chp crews are on the scene, no major injuries. the rest of your commute shows a standard drive the south bay, the peninsula, they move at speeds. back to you, laura. >> thank you very much, mike. hard to believe, one week ago today the unthinkable happened, a gunman took aim at his co-workers in the vta rail yard mass shooting and now we see it from a different perspective showing deputies and police officers as they converged in to try to stop him. >> that's right, "today in the bay's" kris sanchez is live at the memorial in san jose city hall. this is difficult four minutes of video to watch. >> reporter: yes, i'll tell you, cierra and laura i found it emotional to watch having been at the scene just a week ago, but we're not going to show you the gunman, we're not going to show you the victims. we want to show it to you from the perspective the sheriff's deputy and the other officers who arrived there within

moments. this is from the perspective of one of the santa clara county sheriff's deputies wearing a body camera. he and another deputy along with three police officers went into the building, looking for that gunman, after getting a key card from his supervisor who managed to make it out safely. they pause on the third floor when they hear one gunshot, then another which we know was the gunman turning the gun on himself. >> i see the gun. >> stand by, stand by. hold it. hold it. >> i got it. >> i got the subject. i got somebody down here. get the gun. >> reporter: sheriff lori smith tells us she released that body camera video to show the community how well sheriff's deputies and san jose police officers worked together nearly without words because of their active shooter training. >> i thought it was important to show that this protocol i believe saved lives.

there are over 100 people in that area. we a lot of additional ammunition. >> reporter: and the officers did respond quickly, according to their time line, 6:43 is when dispatch got the first call and officers were sent within one minute. within three minutes they were on scene, within nine minutes they are on that third floor of the building, where the gunman then is. >> in the meantime, kris, you know, the victims families are still trying to heal. >> reporter: you know, it's never going to be the same for them. we know that. but they are starting to make funeral arrangements and some of them were so young that there's no way the families were planning for a funeral or memorial service like this, so there are community funds set up to help. they are set up through vta and working partnerships. we can link you to those sites through our website, nbcbayarea.com. but we also know that the denny's restaurant chain is

trying to do something to help as well. all restaurants in santa clara county are donating half of their profits for today so as you head out to lunch today, maybe just another way that you can help those families start to move forward. >> yes, our hearts go out to them. thanks for the latest, kris. as these families of the victims continue to mourn, reality is setting in that there are so many events that they're going to miss their loved ones, not a part of. the son of paul megia is celebrating his eighth grade graduation as well. his father grew up in san jose, lived near mountain house, in tracy with his parents, wife and kids. friends and family gathered yesterday for this milestone for his son, gavin. family tells us paul did everything for his kids. >> i've been feeling sad, lately, down, having anger but trying to push that to the side and think of the happy things in life and just be happy about what's happening with me right now.

>> i hope he doesn't push it aside because that is tough. he lost his father. now after he celebrates his graduation his own father's funeral will be held on sunday. our coverage continues online as well, learn more about the victims and how you can help their families and we posted the four-minute body cam video as well to see the deputy's response to that shooting, that horrific day, all on our website, nbcbayarea.com. as of this morning, all bay area counties are officially out of the red tier. if you live in solano or marin counties you wake up to loosened restrictions. solano county is officially in the orange tier, it's the final bay area county to qualify. marin meanwhile is moving into the least restrictive yellow tier that's effective today. under that tier, indoor capacities for businesses like restaurants and gyms can be expanded while bars can reopen indoors at 25%. sonoma county has run out of time to move on from its current covid restrictions, and will remain in its orange tier status

until the state reopens on june 15th. and happening today, windsor's town council begins a new chapter following the resignation of its embattled mayor. councilmembers will hold the first meeting since dominic foppoli stepped down against numerous sexual assault and harassment claims. the first is how to fill his position. the "press democrat" reports councilmember also weigh appointing a new mayor or calling for a special election to fill the seat. if you're looking to rent and just make it in the bay, now might be the time to find a place. rent is on the rise, according to a report from the apartment list, the average national rent price increased by 2% from april to may and in the bay area, big three cities, rent is up as well. from april to may san francisco rents increased nearly 4%. two-bedroom apartment just over $2,600. san jose rents increased by nearly 2% and in oakland went up by 1.6%.

a follow-up right now and a live look outside marin water night, grappling with new water restrictions that many argue would impact new home construction because it would include a ban on new water service hookups to homes. the board did not reach a decision last night and will pick up the conversation next week. meanwhile, tri-valley water customers are the latest being urged to voluntarily cut water consumption. the water agency is asking everyone to cut usage by 10%, with this being the region's second straight dry year. and new this morning, water levels at lake sonoma are reportedly getting so low it's starting to expose underwater hazards, according to "the press democrat" the low water levels prompt a new set of rules for boaters including extending so-called no wake zones to all but the widest and deepest parts half of its seasonal capa there.

forecaster vianey arana is in for kari this week and the ongoing drought having a significant impact on the snowpack in the sierra. >> we count on the sierra snowpack for a third of the water supply. when the snow melts during the spring it replenishes the reservoirs, brings up the levels in the rivers and the lakes but right now we're at zero percent of average. it does not mean that there is zero snow in any of the regions. it does mean that the snow where the snow levels are typically measured to equate to the water levels is melted in those areas, where they tend to measure the snow. so far, it looks like we are not really going to see much in the way of that melting snow to help boost our reservoirs. where are we currently standing at in terms of the reservoirs. south bay 29% of historical average so we're running below

three degrees cooler in san francisco but more noticeable in areas like livermore and fairfield, how are things going to be shaping up? it is only wednesday but i have a look at your weekend, coming up in a few minutes. >> a smooth flow of traffic, things are starting to go out there, a live look outside san jose shows that first slowing, we expect to show you how things are shaping up close to the bay bridge, unexpected slowing near the berkeley curve. a new report from the fbi says california has seen more active shooter incidents than any other state. in the report, it looked at the number of active shooter situations over the past two decades between 2000 and 2019, california had 42 active shooter incidents. in florida, 27 attacks were recorded. texas came in third with 25 shootings. nationwide over the past two decades there have been more than 330 active shooter incidents and nearly 3,000 people have died. happening today a hearing that

may greatly reduce the population of san quentin's death row by reversing hundreds of death sentences. california's supreme court justice also hear arguments on the constitutionality of how the death penalty has been applied. it's part of an appeal by a death row inmate convicted in 2004. the case raises the question about whether prosecutors bypass state laws in obtaining the death sentence. the last time an inmate was executed at san quentin was 15 years ago. 5:43. president biden is giving his vice president, yes, another tough task. >> scott mcgrew, kamala harris was already in charge of solving the problems at the southern border. >> that's right, now she's going to be in charge of pushing back against new restrictions on voting. that's one way of phrasing it anyway. president biden calls it defending american democracy, and warns it will be "a hell of a lot of work." vice presidents have taken on bigger roles over the last couple of decades. mr. biden was a major part of president obama's foreign policy initiatives. the new assignment for vice

president harris comes as texas moves to further restrict voting in that state. now defending democracy in the right to vote was a major theme for the president, as he spoke at the commemoration of the tulsa massacre yesterday, saying america must learn the truth of what we must know, not just the facts we want to know. >> we do ourselves no favors by pretending none of this ever happened, or it doesn't impact us today because it does still impact us today. we can't just choose to learn what we want to know and not what we should know. >> biden is the first sitting president to visit tulsa on that anniversary which marks one of the worst if not the worst racial attack in american history. other news, the president has suspended the leases sold to oil companies to drill in a protected part of the arctic. it's a temporary suspension as washington examines the environmental impact, but it

it all morning long. >> so catchy. have you ever done something later and wondered what i was i thinking? >> spur of the moment. a southern california girl listen. did you see her there just charge that bear? 17-year-old hailley mornico fought off the bear to protect her dog, very too close for comfort encounter, happened monday near duarte in southern california, just on the edge of the angeles national forest. it was a black bear and her young little cub. the mama bear had tried to grab one of those little dogs there, you see the family's yorkie. >> in that split second i decided to push the bear, like it was nothing apparently, and when i pushed the bear, she falls back and that's when my, the dog she grabbed runs away and i picked up my other dog and

but by about 2:00/3:00 notice the temperatures warm up through concord, livermore and especially out through tracy. still a couple of 90s there, but this does a really good job of showing you what we mean with microclimates, just how different everything can be when you just drive a couple of miles inland. long range outlook right now, we are going to see that initial high pressure move out, this is what got our cooling going on into thursday and friday, and over the weekend, we get a little bit of a warmup, just slight into saturday and sunday, we keep the sunshine but then we've got this approaching system and that's going to help cool us off even more heading into monday and tuesday of next week. so much so we're looking to see highs in the 70s. let's talk about temperatures headed into the weekend, 85 degrees into saturday. 83 into sunday. notice we drop a little bit on friday and warm up into the mid 80s by monday and tuesday of next week, 70s are in the forecast, let's take a look at how san francisco is going to

shape up. san francisco has been seeing this onshore flow, we've seen the fog around the coastline and kept temperatures in the 60s and into the weekend we're going to see a little bit more clearing when it comes to the fog, plenty of sunshine, 65 degrees on sunday and into the next couple of weeks, we drop down into the low 60s thanks to the arrival of that system, so all in all, cooler trend ahead, still no rain in sight, we're still in the serious drought so a lot of factors to consider. i guess i'll send it over to mike now, he said he wouldn't fight the bear. i get it. >> i apologize. you can always interface with me on social media, twitter and facebook, i welcome the conversation. let's look at the view from our emeryville camera, where we talk about this. there was an issue on the berkeley curve, looks like things at the curve itself have started to clear up, the taillights moving over off to the right, toward the bay bridge, and look at the map approaching the berkeley curve a little bit slow around albany down into shy of the emeryville

border there, the earlier crash had been cleared from lanes. the build on the bay bridge slowing on the span. we should see the backup at the toll plaza start soon. concord shows a little bit of slowing coming off of highway 4 and 880, the slowing started down out of hayward and union city. the slowing clears for san jose for that first burst we typically see and see another burst of traffic in about half an hour. back to you. happening now, a major step in moving the cruise industry forward. the cdc just gave disney cruises the okay to embark on a test sail from port canaveral. the ship will sail with volunteer passengers and test newly developed health and safety protocols and it's required as part of the cdc protocol for vessels to receive approval to resume normal cruises. so far, only royal caribbean has received its cdc approval to do a similar test sailing. much more ahead on "today in the bay," including an all-new pandemic related problem, the unexpected worker shortage now impacting wait times for covid

that landed on busy 101 freeway earlier this week, we now know experienced a loss of oil pressure. you may recall the heart-stopping video we showed you yesterday morning near west lake village. the pilot was on a training flight and the flight instructor managed to safely land the plane with cars that were whipping by, remarkably no one was injured. to the pandemic now and laboratory scientists have been on the front lines since day one testing specimens to see if you have covid. but there's a national shortage not only are lab scientists hard to come by but part of an aging workforce requiring specialized training, and it turns out fewer schools are offering programs due to low interest. one scientist says because of the shortage, she's working longer hours. >> running the covid tests, running the regular tests we have and also trying to cover the shortages that we have, so we're sometimes running multiple departments at one time. it's a lot to manage for one
