>> reporter: the edited video shows the 67-year-old resident say something to an amazon driver, who then turns around and attacks the woman, hitting her ten times. it happened thursday night around 6:00. >> she couldn't find it -- >> reporter: the owner of the complex says the woman got an alert her package was delivered, but couldn't find it, so she went out and questioned the driver. a sheriff's report says the driver then said something about white privilege. the resident responded by calling her a name and that's when she was assaulted. deputies tracked down the truck and arrested 21-year-old itsol ramirez. she claims it was self-defense. authorities say the victim suffered injuries to her face and head and likely has a broken nose. >> i don't know -- i just think that the violence we're seeing these days is very troubling and i was very pleased to see the sheriff ahern and his deputies do a quick response. >> reporter: amazon released a statement saying this does not reflect the high standards we have for our drivers who deliver

our packages. we take these matters seriously and this individual is no longer delivering amazon packages. in the east bay, ian cull, "today in the bay." now to a developing story. a federal judge ruled that california's ban on assault weapons is unconstitutional. the federal judge out of san diego overturned the state's three-decade-old ban late last night, saying california's definition of illegal military-style rifles unlawfully deprives law-abiding citizens of weapons commonly allowed in most other states. he went on to compare the ar-15 rifle to a swiss army knife, writing that the weapon is a perfect combination of home defense weapon and homeland defense weapon. governor gavin newsom's office tweeted this statement. quote, this decision is a direct threat to public safety and the lives of innocent californians. comparing an ar-15 to a swiss army knife is a slap in the face to those who have lost loved ones to guns.

we won't back down and we will fight for common sense gun laws. >> california attorney general rob banta also issued a statement reading inwed and we l be appealing it. the state's ban on assault weapons is still in effect for now. the decision is staid for 30 days. more details this morning. we have new surveillance photos. san francisco police want you to see these. investigators say this is gene chang cong fung. they believe she is likely still dressed in these same close clothes, including this puffy pink coat. the 84-year-old vanished after leaving her richmond district home for an afternoon walk. she was last seen at the safeway in the marina. turning now to our coronavirus coverage and so-called breakthrough cases. a fully vaccinated napa county woman has died of covid-19.

and just man from sonoma county also died after getting his shot. "today in the bay's" sergio quintana reports. >> reporter: the covid-19 victim was fully vaccinated. >> this person lived in a congregate facility and was exposed to a staff person who was unvaccinated. >> reporter: her death is tragic, but these cases are extremely rare. in napa county, more than 71 71,000 people are fully vaccinated. they reported 32 breakthrough cases, which is an infection rate of less than 1%. nationally, it's even less. the woman died after being infected with the b-117 variant, which is the one that originated in the uk. it's highly transmissible and can make people very sick. she was in a hospital for about two weeks. public health experts say her death is an example of why they're pushing for more people to get vaccinated. >> senior citizens and those with weaker immune systems from

underlying medical problems may not develop as strong an immune response to a vaccine. so this really points to the importance of increasing immunization rates in the community so we protect those vulnerable individuals. >> reporter: this also raises an important question about employers mandating employees to get vaccinated. workers in assisted living facilities were among the first who were able to get their shots. >> according to employment laws, employers can mandate vaccination of their employees, but at that point, it's going to be up to the employer. >> reporter: the good news in napa, vaccination rates are relatively high. 73% of residents had their first dose of vaccine. 62% are fully vaccinated. sergio quintana, "today in the bay". >> as the bay area moves forward on the road to recovery, businesses soon will have a choice to make. everyone vaccinated or everyone masked up. that's the latest guidance from the california occupational safety and health standards board or cal osha.

the rules are set to begin june 15th, the same day california reopens. cal osha says every employee inside a room must been vaccinated a not, must wear a mask. reaction is divided. one other requirement from cal osha, beginning in august, employers must offer the n95 masks to their employees. today marks 40 years since the first cases of aids were reported in the united states. today is also hiv long-term survivor's awareness day. leaders in the movement will unveil a new 40-block long display of the aids memorial quilt. the public is invited to come see the quilt between 12:00 p.m. and 2:00 p.m., at the golden gate park national aids grove. the public is welcome at 1:15 for 15-minute incremented visits. if you prefer to stay at home and participate, the live stream will begin at 2:30 to honor the

worhal way, moseying through driveways, even going on to somebody's porch. people who live there couldn't believe it. >> i thought it was someone in a costume walking on the corner. and then i said, no, that's a real bear. >> i was just in shock. i couldn't believe it. i've lived her for most of my life and never heard of bears cruising our neighborhood. >> it's a good reminder, bring your pets in at dusk and don't leave food outside. now to new video this morning from inside a plane headed from l.a.x. to nashville. it was forced to divert after a passenger tried to get into the cockpit. you can see people jumping in to stop that passenger. officials say the passenger did not breach the cockpit. the delta flight landed in albuquerque, just after 1:00 our time yesterday afternoon. when it landed, airport police arrested that passenger. the fbi is investigating the innocent. the flight did take off from albuquerque and landed in nashville about eight hours

later than it was scheduled to. turning now to our climate in crisis series. a new report shows all of the pieces are in place for another serious fire season. we want to show you some maps from the northern california geographic coordination center, and you can see pretty much the entire northern part of the state is expected to be at above-normal fire potential throughout this summer. come fall, that zone gets even bigger, to include the bay area. you can see on the left, that includes the bay area. researchers say things are really dry, because the northern third of the state experienced its dryingest rainy season in more than two decades. so perfect timing now to check on any potential rain, although i doubt anything is coming. the sun is definitely shining outside and inside, because our girl, vianey arana is back in studio with our microclimate forecast. >> i am so happy to be here. >> we have been talking and our

director is like, shush, shush. >> i know, seriously. but you know what, keira, i wish we had rain in the forecast. unfortunately, it's not looking too good.now, though, i do w drought and you think, well, how does this impact me? what exceptional drought means for you. this could mean, instead of having a fire season, we have a year-round fire season. usually fire season a couple of months. but because of how much dry brush there is out there, that could turn into a year-round thing. something we definitely don't want to see. water shortages. the sierra snowpack has been completely depleted. and typically once that snow melts, it can help boost our reservoirs. vegetation, which can bring an increase in food prices. and there's not enough moisture in the air to keep a lot of those bigger trees alive and keep them lingering. poor air quality. we started seeing spare the air alerts throughout. now let's get to our daytime forecast, because this shot is so beautiful. it gives you such a fantastic view.

if you didn't have plans to go out today, please make some, because it's just going to be comfortable, overall. we're going to see a mix of clouds, 53 degrees in hayward right now. look at the 24-hour temperature change, a few degrees cooler in novato, santa rosa, about 5 degrees. and let's get a look at how your microclimate highs will be shaping out today. let's get to your allergy forecast. trees and weeds are going to be moderate when it comes to that allergy forecast. and grass pollen will be extremely high. so keep that in mind, if you are going to take advantage of today's daytime highs. take your allergy medicine to go for sure. let's talk about the long-rain outlook. we are going to see a shift in that weather pattern. we'll see some 80s today and over the next seven days, things will cool off quite significantly, especially in through the inland areas. it will be more noticeable. we'll see an uptick in the winds, because we have a dry cold front passing through.

tures and an increase in the wind speeds. 70s in the forecast for monday, tuesday, wednesday, and thursday. that is definitely seasonable and a lot more comfortable. for san francisco, 60s in the forecast for today and tomorrow. we will be continuing to see the fog and that marine layer sort of waking up to it today, a little bit more tomorrow. and notice monday, the wind icon popped up, it's going to get windy out there. now it's time for your climate hack. this is something that's a part of not just women's routine, but men and really just anybody who needs it. take a look. >> here's a part of your routine that you might not even think is hurting the planet. i'm talking about razors. here's the problem, they are tough to recycle because they're made of different materials. for example, the plastic handle and, of course, the plastic frame itself.so instead of recy razors, we throw them out. the environmental protection agency estimates 2 billion razors and refillable blades end

we are only eight weeks away from the opening of the tokyo olympics and many sports are now just finalizing their official olympic teams. one san jose high school grad is representing team usa in table tennis and garvin thomas has his story. >> reporter: for most of the valley christian high school class of 2021, this month's graduation will be the biggest

event of the year for them. most, that is, but not all. and certainly not for mikhail kumar. >> i think olympics is a little bit bigger for me. >> reporter: after a walk across the graduation stage, mikhail is headed across the pacific ocean to play table tennis for team usa at the tokyo olympics. the 18-year-old frp san jose actually qualified for the games a full year ago, before they were postponed. which means he has had plenty of time to practice for and think about his first olympic experience. >> i think i will definitely feel a lot of emotions, starting from the opening ceremony itself, but i think just being able to see all of these other high-level players and knowing that i've been able to compete at the same stage as many of them, it will mean a lot to me. >> reporter: mikhail first picked up a paddle when he was

just 5. his coach told his parents there was potential, but with neither of them having played themselves, it took some convincing by the coach and mikhail to go all-in on table tennis. but go all in they did. mikhail began competing internationally at the age of 12. he balanced academics and athletics all through middle and high school, often having to miss months of school at a time, but always keeping up with his schoolwork. every step of the way, for every major competition, his family was there. >> they've been all in since the beginning, financially or physically, whatever support they gave to me, without that, i don't think i would be where i am today. >> reporter: but they won't be there in tokyo. fans from outside japan are being kept away due to covid concerns. mikhail says not having them at the venue watching from just a few feet away will be strange, but it won't hold him back at all. the kind of support they have provided him is the kind you can

"today in the bay's" damian trujillo has this story that you'll see on nbc bay area. >> reporter: surveillance video captures a brazen robbery of a 72-year-old women as she was out on her daily walk. we are hiding her face for safety reasons. her family remembers when the victim came home after the attack on monday. >> it was like she had seen a ghost or something. >> reporter: the suspect stripped two bangles from the victim.

>> she still has some swelling on her wrist where her bangles were being taken off. >> reporter: police say street robberies a growing trend in san jose and the crime of opportunity. >> robberies involving purse snatches, chain snatches, jewelry stealing. and this is all person-to-person strong arm crimes that these crooks are specifically targeting people who are smaller, perhaps elderly, and perhaps perceived to be less able to put up a fight. >> i think we live in a safe area. we pay a lot of money to live in this area for the schools. you just don't think something like this happens to a vulnerable population. >> reporter: the family says the victim doesn't wear jewelry while walking anymore, and she no longer walks alone, but it's important that she keep her routine. >> it was important that she keep going. we are encouraging her to go out. >> reporter: damian trujillo, "today in the bay." napa county health leaders are reporting their first covid-related death of someone who was fully vaccinated. they say the woman who died was

for more information. and now to a live look in the south bay where a final portion of a new park is opening today. the city of san jose is opening the final phase of tamien park. the grand opening ribbon cutting is at 11:00 a.m. covid protocols will be in place. and the sonoma raceway is gearing up for an action-packed weekend. nascar fans are returning for the first time in more than a year for the general tire 200 at 2:00 p.m. today. it's a smaller race before tomorrow's main event, the savemart 350. the number of fans will be limited to about 15,000, but guess what? it's completely sold out. this is the largest crowd for a sporting event in the bay area since fans were allowed to start returning over the last couple of months. because of nascar's covid restrictions, this year's event will be a one-day event without

former president trump is stepping back in the spotlight today. he will be speaking at the north carolina republican state convention. this comes after facebook announced it is suspending him for two years. that's the ruling facebook announced yesterday. the company had indefinitely suspended trump's facebook and instagram accounts following inflammatory and false statements leading up to and after the u.s. capitol attack. the accounts will be eligible for reinstatement in january, 2023, facebook announced yesterday. the company says that's when it will review the risks to public safety. the former president continues to perpetuate lies about the election. his response to yesterday's

good morning. it's 7:56. and i don't have my regular plant background, but i have this great shot of san francisco right now. it's a little gloomy around the coastline, but a really nice day. waking up to a mild temperatures, but it is going to be a little bit cooler. i also wanted to show the twin bridges, sierra, a nice little look at how the sierra is doing. not much snow and not much rain. and we've seen those drought conditions only worsen. let's get a look at the extended forecast, as well. right now, as you head out the door, 58 degrees in san jose. 51 in san francisco. these temperatures have been so comfortable in the overnight hours, i've been sleeping with the windows open. it's been really nice to see and we'll get even cooler over the next several days. san carlo is about 4 degrees cooler. napa, santa rosa, similar conditions as well. once we get into the afternoon, though, we're going to get a mix of sun and clouds. so let's take a look at our daytime highs in san jose. 78 degrees, morgan hill, 82.

in through the east bay, if you live in oakland, going to keep that cloud cover a little bit longer around the bay and the coast, but further inland, expect to see plenty of sunshine. antioch, still in those upper 80s. one of our warmest spots for the day. san mateo, 70 degrees. if you're going to be in san francisco, though, definitely a windy day ahead. we have wind from the west blowing in at about 21 miles per hour right now. there might be a windchill factor if you're visiting us from out of town. always, always take a jacket from san francisco. a little chilly around the bay. microclimate highs, upper around the north bay, santa rosa, 83. sonoma, 82. i want to make sure you're prepared if you're going to be heading out and allergies, we are going to see a pretty high pollen count when it comes to grasses, so take that medication to go, just in case, to go out and enjoy your day without having to deal with all of that. saturday and sunday, today and tomorrow we'll stay in the 80s. but notice what happens on mondays and tuesday. we've got this dry cold front that's going to just sweep by.
