but we do begin in pennsylvania where bill cosby is a free man. in his own home this morning, following that stunning decision by the state supreme court to throw out his sexual assault conviction. we will talk to the special prosecutor in the cosby trials in just a moment, but first, nbc's stephanie gosk has more on the decision and reaction to it. good morning. >> reporter: hoda, good morning. bill cosby waking up in his home for the first time in over three years. his record is clean. he cannot be retried on these charges. his legal team calling it justice but prosecutors say it does not change the underlying facts of this case. nearly three years after the iconic comedian was sent to prison bill cosby is back home. a free man. his conviction thrown out.ld looking frail. speaking out for the first time in a radio interview. >> this is for all the people

who have been imprisoned wrongfully, regardless of race, color or creed. >> reporter: in 2018 a jury found cosby jury of three counts of aggravated indecent assault against andrea constand, a former employee. constand testified cosby drugged and sexually assaulted her in his home in 2004. he has always maintained the interaction was consensual. after the verdict, she described the alleged encounter on "dateline." >> my mind saying, move your hands, kick, can you do anything. i don't want this. why is this person doing this. >> reporter: on wednesday the highest court threw out that conviction saying cosby's due process rights were violated when he was charged because when constand first came forward then district attorney bruce castor decided not to charge him criminally. cosby later gave testimony in a civil lawsuit brought by constand thinking he could speak freely and not incriminate

himself. in that deposition, he admitted he had given quaaludes to women he wanted to have sex with. >> anything you want to say. >> reporter: in 2015, a new district attorney used that same testimony to charge the comedian with sexual assault. the state supreme court calling that an affront to fundamental fairness. prosecutors on the cosby case disagree. >> -- alleged promises in writing and none were approved by any court. >> reporter: more than 60 women came forward ranging from groping to sexual assault to rape. cosby has denied all wrongdoing. many of the women shocked by the court's ruling, emphasizing it was based on a legal technicality not the ruling of the case. andrea constand's attorney calling the ruling disappointing. cosby, who rairned over hollywood for decades, drawing support from his most famous co-star, phylicia rashad,

tweeting "finally a terrible wrong is being righted." cosby has reacted multiple times publicly. he called into a radio show. cosby put a message on twitter. he posted this picture with a statement saying in part, i have never changed my stance nor my story. i have always maintained my innocence. savannah? >> all right, stephanie, thank you. joining us now is kristen gibbons feden, a schedule prosecutor in the cosby's trials now an nbc news legal analyst. good morning. before we get into the particulars of the legal ruling, just your gut reaction when you found out that the court was vacating those convictions that you had helped to prosecute, and bill cosby was free within a matter of hours. >> honestly, i was shocked. i was in disbelief. my co-prosecutors stu ryan texted me and told me and i was just in complete disbelief. particularly since i thought

there was no alleged agreement. he went forward. the common pleas court agreed with us. the superior court agreed. excuse me, the supreme court disagreed, but, yeah, i was just in total shock. >> the court's ruling does not touch on the issue of guilt or innocence. it turns on whether or not there was a valid agreement not to prosecute and whether your office needed to abide by it, but cosby was triumphant. on the radio he said, this is for all who have been wrongfully imprisoned regardless of race, color or creed. your reaction? >> my reaction to that statement, particularly as it is made in conjunction with his other statement, specifically the one that this is justice for black americans, makes me sick to my stomach and absolutely disgusted, because throughout the trial and continuing on now, he is trying to exploit that black americans, including myself, as a former prosecutor,

have for justice in america for black and brown bodies. the other thing i want to also emphasize is three of the prior witnesses, kelly johnson, shalaun -- were black american women, black women. this is not justice for them. and to put himself in the shoes of those wrongfully convicted is just wrong. yes, the conviction has been overturned, but the merits of the case are still in place. he was found to have sexually assaulted andrea constand, he still sits before you as a sexual predator if not a guilty man. >> look, let me ask you and play devil's advocate because the court's ruling turned on this procedural issue, but it was fundamental. there was a prior prosecutor who said he would not prosecute bill cosby criminally based on that cosby then goes and testifies gives incriminating evidence and that is then used later by a

different prosecutor saying i'm not bound by that previous agreement. the court said it was fundamentally unfair. how do you respond to that? >> look, savannah, i 100% respect our esteemed bench here in fa pennsylvania, particularly all the justices on the supreme court bench. but i have to respectfully disagree. i want to emphasize this was a split decision. when we talk about due process rights, one of the things we go back to is the actual testimony given during the habeas corpus hearing for this particular issue, and during that hearing, much testimony came out. number one, we're not even certain that an agreement was made. typically these agreements made are in writing, approved by the court, and there aren't any subsequent indicia of the absence of such an agreement, releasing the press release

where he said i may decline charges now, but i will revisit the decision should the need arise. >> yeah. i've got to cut you off there because of breaking news we have, but, as you said, hotly litigated in the lower courts and a split decision now from the court of appeals, but we appreciate you being here this morning. thank you very much. kristen gibbons feden, thank you for your time. one of the prosecutors in the case. >> take care. breaking overnight also, a major development into the investigations of former president trump and his business empire. d spoken

multiple times with the investigators now predicting mr. trump might eventually face charges. all part of an investigation by the manhattan district attorney and new york attorney general. those indictments against the trump organization and cfo allen weisselberg expected to be unsealed today. multiple sources with knowledge of the case tell nbc news prosecutors have been looking into whether company employees including weisselberg evaded taxes on fringe benefits like cars and apartments as part of a scheme by the trump organization to pay compensation off the

in florida heading to a beachside hotel where he will be debriefed by local officials who have confirmed that search and rest cue efforts were paused overnight due to structural instability. this morning we're getting a firsthand look of the video that may have shown the tower standing in its final moments. the new video seems to show water leaking from the base of the building was posted on tiktok just eight minutes before the collapse. it comes as search and rescue workers refuse to give up hope after pulling the last survivor from the rubble a week ago. >> the guys and gals working on that pile, there are times they are breaking down. >> reporter: rescuers not slowing down. pushed to work day and night by the thought they may be able to bring some of the missing back home. >> you imagine how one person coming out of that rubble, that gets to hug their loved one. that's a totally different type of healing. >> reporter: 145 people are still missing. the death toll rising to 18,

holiday weekend is kicking off, a frightening incident in los angeles wednesday after a bomb squad carrying confiscated illegal fireworks exploded unexpectedly, injuring 17 people. footage of the explosion captured on video by cbs news and by radio station kmax showing a truck carrying some of the fireworks exploding, blowing windows out of nearby buildings and tossing debris into the air and street. police say they received a call about fireworks being stored in a residence in the historic south central neighborhood. >> they identified a stack of what would be commonly described as commercial-grade fireworks. those fireworks were stacked in boxes totaling eight to ten feet high. it was estimated 3,000 to 5,000 pounds of that materiel. >> reporter: the unexplained explosion happening as a bomb squad was attempting to dispose some of the fireworks, detonating hem in a vehicle with a containment vessel designed to

sport the blast. the force of the blast destroying the container. >> protocols were followed and pursued. but something happened in that containment vehicle that should not have happened, and we don't know what, but we intend to find out why. >> reporter: none of the injuries were life threatening. the lapd giving a warning to residents for this upcoming holiday weekend. >> tonight is a clear demonstration of the true and clear and present danger that fireworks in the city pose. >> reporter: a 27-year-old man has been arrested, accused of bringing these fireworks from out of the state to try to resell them for the fourth of july weekend and he faces charges of possession of a destructive device and may face charges of child endangerment because they think his younger 10-year-old brother lived with him in the home. hoda? >> guad venegas, thank you for that. 19 after the hour. a lot more to get to this morning including the extreme

where her battle stands. overnight, a major setback for britney spears. a judge denying her request to remove her father from his role as conservator, signing an order that keeps jamie spears in control of his daughter's finances. the court filing stating that britney is unable to manage his ore or her financial resources and resist fraud or undue influence. the decision coming after the superstar's explosive testimony last week calling the conservatorships abusive and traumatizing. in new legal filings, jamie spears insists he had nothing to do with his daughter's poor treatment and is demanding an investigation into her concerns. since her very public breakdown in 2008, the pop superstar has been under a court sanctioned conservatorship that has given her father and others power over her personal and financial affairs.

during the explosive hearing last week, spears said she had been drugged, forced to perform and prevented from removing an iud meant to stop pregnancy. all decisions, she says, were approved by her father. but jamie spears pushing back, pointing out in new court documents the control of his daughter's personal life and medical treatment isn't currently under his control. he blames jody montgomery, a temporary conservator who was brought on in 2019 to oversee britney's personal affairs. an attorney for montgomery says she's been a tireless advocate for britney and for her well-being and noting decisions about marriage or family planning are not affected by conservatorship. but one expert says the rules and dynamics in a conservatorship are rarely straightforward. >> it's my impression that britney has been under this conservatorship for so long, she truly feels compelled to do what

covid-induced hiatus, dozens of performers returning to the stage determined to show they're back and better than ever. this morning, sin city running at full steam. gearing up for the long-awaited return of live music and shows to the las vegas strip >> welcome to vegas! >> reporter: some of the biggest names in the business playing this holiday weekend. >> as of this coming weekend, we're back. >> reporter: the famed bellagio casino and resort is buzzing cirque du soleil is back tonight marks the relaunch of "o," dubbed an extraordinary homage to the magic of theater set over 1.5 million of gallons for the shows 77 performers, the stakes couldn't be higher. >> the excitement is unbelievable. >> it's going to be a party. it's going to be exciting, and it's going to be just kind of a relief that we're all seeing that bright light of our kind of normal lives coming back to us. >> reporter: it's been a difficult year the pandemic forced cirque to
