>> we are on early because of the olympics. we'll get to that excitement in a moment. it is a drastic move to help flatten the curve. >> governor newsom announced nearly 1/4 of a million people will have to prove they're vaccinated or they're going to have to the positivity rate across california steadily climbs. today the seven-day average positivity rate is 5.3. that's nearly a percent increase from just last week. we are there as the governor lays out his trick new plan. >> we can deal with this disease in a month. >> governor gavin newsom says the fastest way out of this pandemic is californian vaccinated. california will require allstate employees to show their vaccine card or face mandatory weekly testing. >> your choice not to get vaccinated and to listen to

these pundits that are profiteering off misinformation comes at a real societal cost. >> starting august 9th, health care workers and those who work in congregant facilities will have to comply with the governor's rules. the governor says if more unvaccinated people end up in icus, system could once begin be overwhelmed. >> assemblymember buffy wick says the east bay worries. in person learning in the fall could be in jeopardy. those too young to be vaccinated are also at risk of catching the highly contagious vaccinate. >> i come to you as an assemblymember and i also come to you as a mom. i have a 4-year-old and a little girl who is turning 1 today. >> a spokesperson for the governor says the state will not

she just won the philippine's first ever gold medal. that's the first in 97 years competing in the olympics. this is her fourth and likely final olympics. she won a silver. because of covid she has not been able to travel home to the philippines for the past 18 months. when she finally does, there is sure to be a harrowing welcome. >> you know what's amazing seeing her like that because she's so strong physically. that emotion of reaching this gold made her cry. >> you see this. in one second she is so intense, so focused on what she's doing, the next she's in tears. >> flooded by emotion. >> it happens like that. >> they worked their entire life for this. dreams coming true. >> super fan is beyond funny. >> great. >> they need to clone him and take him to every event. he has to be there. >> thanks, garvin. a lot going on after our

there is a growing call for mandatory vaccination of health care workers. the ama says there's an ethical obligation. there is push back where a judge stopped a lawsuit. now mayor bill de blasio is following up that all city workers be vaccinated by mid septemberovid testing. schools are a week away from in person learning. are they ready? others are in a mad dash to make sure the classrooms are clean and safe. we are being shown all the last-minute prep. >> reporter: august 18th is the big day here in allen rock. there will be some changes to the rules this year, but administrators and parents say they're eager to get started.

the custodians at russo are going classroom to classroom. sanitizing every corner after a busy summer. >> we have an amazing team helping us because we're just wrapping up summer school. >> reporter: because of social distancing rules, many unused desks are piled up but schools are loosening some of those social distancing guidelines allowing more students to sit in one classroom. at alec rock the plastic sneeze guards will stay in place and every room is equipped with an air purifier as an added safety measure. >> lucina cruz says last year was tough serving as a teacher's aide at home. she's glad classroom instruction is back but hopes they can find enough teachers by the time the

first bell rings. >> we do, we still have some vacancies but we are very -- we trust that we're going to be able to find the teachers that we need. >> in allen rock, 5% of the students chose not to return to the classroom this fall, that's about 400 children. a superintendant says the program they will attend won't be called virtual learning anymore. it's now known as independent study. for the rest, their rooms are almost ready to welcome them back. >> very excited to see the kids back. >> in san jose, nbc bay area news. a lot to tackle when it comes to masks and how it's going to be enforced. joining us is dr. peter chen hong. thanks for being with us. we backtracked and talked about schools. let's talk about governor newsom's announcement. he will require allstate workers to show proof of vaccination and if not they have to face weekly

testing. the governor being more hard core now. weigh in. >> well, this is hard core. these are hard core times so they require hard core measures. we never anticipated a delta would not only overtake everything else in the state but would cause so much mayhem as it's causing right now, not just in the bay area but in the state and in the country. >> so our positivity rate has gone up steadily. do you feel at this moment with the delta variant and with our positivity rates that we are definitely in a slide back or do you think that we're more point? >> it depends on what your definition is. if you look at sort of people's anxiety and the disappointment of the ones vaccinated and hearing about break through cases, that's one issue that's discouraging to many of us.

as a health care professional looking at the power of the vaccine, keeping our death rates flat no matter how you slice and country's data preventing serious disease and hospital relapses, it's still there. it's causing mayhem in the community. as people get infected you have to do contact tracing, people stay away, it's missed work, missed schools, missed opportunity. >> let me ask you this. we talked, the governor issued his. you have a choice, you have to get vaccinated or be tested. now a lot of bars are saying, you want that does mow, we need to see your covid card. how do you feel about that? >> i'm supportive of that concept. i know it's been used in other places, for example, in france and even in hawaii. for those folks visiting hawaii, you notice you have to show proof of vaccination to get in.

it's quietly passed. no one gets in. bars can open to full capacity. speaking to some bar owners there, people feel more confident. there is more patronizing of bars because people feel like it's a safer place. masking everywhere you go indoors now? >> i'm pretty much masking everywhere i go indoors now, jess. it's a little bit different for me when two weeks ago and even a week ago, you know, our rates more than quadrupled in san francisco. i don't want to have the getting infected even though i terribly or go to the hospital. >> thank you very much, dr. peter. we appreciate your candor and your guidance. thank you. >> thank you, yes, sir. the fbi is joining efforts

to help out in oakland's chinatown. two gunmen were elderly asian m. today community and federal leaders outline what they are doing to stop the violence. >> in response i have allotted overtime resources to address the chinatown issue. so as of last saturday we had additional officers on the ground walking in chinatown to make this area safe. >> the fbi has developed a new strategy to combat the threat of hate crimes. this effort includes training more special agents to conduct hate crimes and civil rights investigations. >> in addition, the atf is creating a regional strike force to prosecute gun-related climbs and stop suppliers. while the dixie fire burning in butte has a new dubious title, cal fire has the 15th largest fire burning nearly

200,000 acres. crews have the fire 22% contained at this point. flames have destroyed 16 structures. some 10 thousand more are threatened and the cause still under investigation at this point. better news out of lake burning. fire officials say there's significant signs of progress. that one, 45% containment which is really good. authorities have lifted the evacuation orders for about 2,000 people. the flames have charred nearly 70,000 acres. lightning sparked the tamarack fire. it started in south lake tahoe and it spread into nevada. jeff, we haven't seen the type of horrible temperatures that would fuel the fires. i can't imagine how bad it would be if we were seeing hotter temperatures? >> everything is so bone dry out there. we have mon soonal moisture. we could get lightning spark fires in the next 24 hours. let's get you into the

microclimate forecast. we are going to start off with the big change after weeks and weeks on end of sunshine, you can see, well, we do have the cloud cover moving overhead for most of us. it's an overcast sky. that's the mon soonal moisture. cloud tops moving through the state. 86 degrees and we'll drop through some 70s. once we hit 7 and 8:00. let's show you what we're seeing with this area of high pressure. the clockwise circulation around this. that's what's happening to push up the monsoonal moisture. some thunderstorms and also the heat. we have a little system off to the house andckse situation is continuing the conveyor belt effect to funnel this activity right through the state. so a closer look at the radar will show some activity off to the south. that's what we're watching. this is what we're concerned about for maybe some thunderstorms tonight and tomorrow. our chance remains low but,

again, we are seeing that develop and up to the north bay around santa rosa.helena. a little bit of a sprinkle. the better chance of that activity is off to the south right now. let me show you what things will look like. 11:00, we have storms over the sierra. a little bit to the south. our best chance it looks like at this point would be early tomorrow morning around 4:30. you could get some for the south bay and the east bay. then a trend as you move throug be getting in on some sunshine with those risk of thunderstorms moving off towards the north. with all of this in play, we're going to start off with plenty of 60s here and the trivalley. some of my coolest weather right there over san francisco in the north bay. we'll begin in the upper 50s. daytime highs tomorrow as that hotter air moves closer, we're

going to see it moveor 100 in b the coast line. high 60s in san francisco and 75 forecast of san francisco, 70s coming our way wednesday and thursday. more 60s for the weekend ahead. the inland valleys it will be hot with mid and upper 90s. eventually by sunday we will start to see things cool off. let's take you out to tokyo real fast. we are following a tropical storm to the north of tokyo. right now they continue to get some rainfall between 1/4 to 1 inch. winds around 15 to 25 miles per hour on average. they miss a direct hit with this, which is great news. certainly some wet weather out there in tokyo which they're used to this time of year. coming up, following the money. how san jose's paypal is working to combat some hate groups next.

if you've driven lately, noy area roads is returning. even before the pandemic, the city's area was looking at a congestion fee. however, only drivers earning more than $100,000 a year will pay the full amount. low income earners will not be charged. mass transit will be increased in those areas. the board of supervisors will understand on this at the end of the year. bay area's paypal is working to track hate groups. they're trying to use the platform to fund the movement. they're partnering with the antidefamation league. they're trying to understand how they leverage platforms to fund their criminal activity.

paypal says intelligence gathered will be shared across the financial industry and with policy makers and law enforcement. overtime pay is causing problems and goat herding. >> california passed an agriculture overtime law requiring goat and sheep herders be paid for 160 hour work weeks because they're on call 24 hours a day. the law only applies to companies with 26 or more employees. companies with 25 or fewer employees will also have to pay their goat herders more. goats and sheeps are often hired to graze weeds, reduce fire danger. the owners say it's less profitable with the overtime requirements and some are forced to sell off their business. >> a turf war at it's a new day. and it's coming afast. it could be the day your workforce do
