school today the fight over vaccination and mask requirements are heating up. we're live with a look on how parents stand on the debate. and then seeing proof of your vaccination. reaction from diners. this is "today in the bay." very good thursday morning to you. thank you so much for joining us. i am laura garcia. >> i am marcus washington. and a look at the air quality. >> we have the dixie fire, the glenn fire, the monument fire, and there's a lot putting smoke in the atmosphere that will be settling in as we go through the day. there's an air quality advisory, and if you are sensitive you should limit your time outside. we are going to see some of the

drifts of smoke coming in and some of the worst of it will be in parts of the north bay as we fires burning not only across the state but across the region, and the high pressure will push that down. we will look at the changes and heat in the forecast. that's coming up in just a few minutes. >> thanks, kari. 5:01, the mask debate returns in school as children return for the fall term, and many are starting their first day of class in a few hours. >> and bob riddell is live for us in walnut creek. one of the surveys shows masks are okay but not the vaccine. >> reporter: yeah, as far as the survey is concerned, it comes from the kaiser foundation, they

found a majority, 63% of parents do support mask mandates for unvaccinated students and staff, however 54% do not support mandatory vaccination f students even if the fda were to grant full approval. you will recall last week parents shutdown a meeting over their policy requiring masks on campus. governor in seven states are banning mask mandates in schools, and many are ignoring those. governor newsom announced all teachers and staff at all public and private k through 12 schools in the state of arizona, they all must be vaccinated by october 15th or submit to weekly covid test. the first state in the country to have such a requirement at our schools. an overwhelming majority of teacher unions support this mandate, and last night

california's superintendent of public education and a state surgeon general addressed this new vaccine or test. >> we know those that experience the worst symptoms are those not vaccinated. >> that was the founder of let them breathe, a national group that opposes mask mandate in schools and against mandatory vaccinations, and something governor newsom admitted is not off the table. >> yeah, certainly a hot topic across the board. >> things are going to look a little different just to try and

keep everybody covid safe. >> yeah, that's the whole point. and it's the first day of movement for cal state, and they do not have to show proof of a vaccination or a negative test, and all students have to have a negative test regardless of whether or not they have gotten shots. dorm capacity there in the east bay is limited to 86% to limit the exposure. and students moving in are required to be fully vaccinated, and san jose state is allowing freshmen to live off campus, and that's different. they have a strict no guest policy in the dorms, and that got a couple eyebrow raises in the news room, and you do get to have a couple people help move you in, mom and dad, yeah, and they have to be vaccinated.

and stanford requiring weekly testing for all people coming to campus and that's in addition to providing the proof of vaccination which is required, and the university will provide highly sensitive self tests, they call them, with results within 24 hours. we talked with a student that said a lot of them are already used to the frequent testing. >> not that surprised, because most of the students are already taking the weekly covid test regardless of the recommendation, because people already knew the break through cases were a thing, and it made sense to take the test because they are free anyway. >> berkeley students move in next week, and the university of california also made proof of vaccination mandatory. >> it will be so interesting to see as they all start up in, what, two or three weeks from now? >> yeah. >> there's a grace period, right? >> yeah. >> they will be on campus a

month before they have to provide proof of vaccination. >> thanks. a new cdc recommendation is pregnant women should get the vaccine. a new study showed no increased risk for miscarriage. the cdc also says pregnancy increases the risk of severe illness of covid, and it also extends to mothers who are breast-feeding and women trying to get pregnant. one of san francisco's oldest restaurants going 21st century when it comes to eating inside and outside. they are requiring proof the vaccination at john's grill. owners say they expected some pushback, and they are hoping to better protect employees and customers. >> given the surge, the recent surge in some of our fellow

restaurants in san francisco having to close because of outbreaks in the restaurants, we just want to keep everybody safe. >> some customers venting about this on yell that, including leaving one star reviews and complaining about the policy. there are also five-star reviews supporting it. developing in san jose, police are saying there was a shooting that took the life of a boy near foothill high school. all we know at this point is the victim is under the age of 18. police announcing his death about four hours after the initial reports of gunfire. we know it's being treated as a homicide but no suspect or motive. and then young was killed by a stray bullet as he watched fireworks outside of his family's bay view home on july

4th of last year. police issued a reward, and in january police arrested a 19-year-old, and then identified a second suspect and that man was arrested yesterday. and then recalling the district attorney has come up short. supporters needed more signatures but were 1,700 short. supporters thought they had enough only to discover many were fake. a second recall effort is still in play, and organizers have until october to gather enough signatures. now in the works to help more people make it in the bay. two developers are starting work on a building providing 150 homes. they will include luxury and subsidized units.

construction starts this month and should wrap up in 2023. a live look at free mopped -- fremont this morning. >> before we get to the weekends, a lot of kids are heading back to school across the bay area, and when they go outside to play today it will be a warm one. >> yes, it will be. for the valleys it has been hot. today we are adding in humidity. look at some showers that are very close to the bay area, just off the coast. look at some of the rain that has been moving very close by. also pushing some clouds our way. but we have also been watching out for a chance that the monsoon moisture will bring in a couple lightning strikes. we are watching a few of the storms for today and we are going to see temperatures coming down a few degrees, and still with the humidity it will feel just as hot. take a look at the temperatures today. 74 for a high in oakland and 94 in livermore, and the north bay, we're looking at upper 80s in

napa and mid-80s for san jose. we'll talk more about the changes ahead for the air quality, monsoon moisture as well as the heat. that's in a few minutes. mike, you are looking at oakland? >> yeah, when we took the live shot we saw the flashing lights, and somebody has hazard lights on just past 66 on 880. chp doesn't have it on their blotter, and hopefully the person has roadside assistance, and they are right by the exit and don't have to cross the freeway. that's good news. and then the toll plaza out of oakland, it's up here. i neglected to hit this hard but eastbound 37 is still closed until possibly 6:00 a.m., almost another hour, 45 minutes, and you have to go up and over to highway 29 and back down, and we had to do it last week and we are doing it again this morning and they are doing the paving and they want to make sure they

good thursday morning. it's 5:14. we have more kids headed back to school today. happy birthday for mt. diablo unified school district. it's going to be warming up quickly. we start out at 61 degrees and a few clouds and making it into the low 80s and humidity at pickup time. we will get a look at more microclimates coming up. and yesterday we had a lot of problems and crashes, and this morning we're crash free. more coming up. good morning. it's thursday. we'll get first-time jobless claims data here in a minute. a strange story about that huge

hack of a cryptocurrency deputy, and the hackers returned half of it explaining online they wanted to teach them a lesson about security. southwest is warning its investors covid is hitting its bottom line. the company said it won't require its employees to get vaccinated. we talked earlier this week about how oil prices were falling because more people are staying close to home, and hospitalizations hitting records in some states. that should translate to lower gas prices but so far it really

hasn't. there's a saying that gas prices rise like a rocket and fall-like a feather, but at the white house on wednesday ordered an investigation into why gas prices were not going lower, and the american government also encouraging opec to increase supply. an internal google member obtained by reuters shows the company plans to base pay on where you live, and if you live somewhere with the lower cost of living the company will reduce your paycheck. working in lake tahoe, one man's pay was cut by 20%. twitter and facebook said the same thing. in the bay area, a family of four who has a single earner making $100,000 qualifies for housing assistance, which is

insane. >> as the companies continue to keep the work-from-home policy, they are going to reduce pay. >> yeah. >> thanks. venmo is using another way to get into cryptocurrency. card holders will be able to set up a cryptocurrency audio purchase. analyst see this as the latest step to attract a new way of cryptocurrency users. tyson foods says it can't keep up with the price because of the materials, and it increased the average price for pork by 11%, and the company says they are trying to catch up. this one is trending. you could actually be the next owner of a masterpiece made by

pablo picasso. >> mgm resorts in las vegas plans on selling 11 pieces from the artist in an auction. they are all now being displayed in an eatery called picasso in the bellagio. it's estimated at more than $100 million. that action starts next month. >> all right. now to a follow-up of what you might call a sweet type of story. remember that slice of prince charles' and princess di's wedding cake, more than 40-year-old place of cake sold for more than $2,500. can you believe that? a stale piece of cake something what i would think. the cake has icing blue, red, silver, and it still

80s in san jose, and 94 will be the high in morgan hill. walnut creek, 93. some of the spots yesterday were in the upper 90s and almost close to 100 degrees. but we're not seeing much of a change in daly city reaching 65 today, and san francisco in the upper 60s mostly, and santa rosa expect 83, and ukiah reaching 93. kevin and linda have been hanging out together. kevin is getting weaker out in the pacific, and we are watching those because it has an incidents on our weather. some of the moisture could be picked up and brought closer to the bay area, and we are also watching out for a chance of isolated lightning strikes. temperature wise in napa, it's still going to be hot.

reaching into the mid-90s for the weekend. then check out tuesday, a nice cooldown here with lower 80s, and then mid-80s for the rest of the week. a look at our overall inland forecast. once again the heat continues and then our temperatures dip by next tuesday and wednesday. then looking at san francisco, it's pretty steady here. highs in the upper 60s, and clouds and fog with afternoon sunshine. mike, you were looking at a closure in the tri-valley. >> yeah, that's the new news, and in san jose, capitol at center, there was a deadly crash just before midnight but we have not gotten the notification of the reopening. the freeways through silicon valley are fine. the closure kari talked about here, 680 at mission, and that's mission at the north side there. there's a crash there and we are tracking what is going on. you can use auto mall to the

thanks for sticking around for us this morning. new this morning despite legalized marijuana in california, illegal pot farms continue to sprout up. among the findings the number of illegal pot plants seized by authorities peaked by 4.5 million in 2009 when it was still illegal. last year, 1.11 million illegal pot plants. the state issued more than 13,000 licenses tied to cannabis since it became legal in 2018. and then helping viewers fight bills they feel they do not deserve. >> good morning.

wayne in oakland was charged $176 for a colonoscopy. days later his insurance company told him he should not have had to pay anything. wayne called the health care facility and was told he would get a refund but weeks went by and nothing happened. so he called us. shortly after that the billing department sent $176 back into wayne's account. and then kay got a call from the dmv in june said it looked like the sticker and registration were sent to her old address and she would have to pay $69 to buy new ones. she did not think that was fair and reached out to us, and within days the new sticker was sent to her new address and she dependant have to pay anything.

>> i am marcus washington. now 1,100 structures destroyed because of the dixie fire. that fire has burned more than half a million acres in four counties since it started in july in northern sierra. about 14,000 homes are still threatened. taking a live at the san jose bay smoke from the dixie fire blowing in our direction with an air quality advisory being issued for today. kari hall is tracking the smoke and haze. how is it so far? >> so far good. we have seen smoke and haze higher up in the atmosphere, but there's an air quality advisory due to the spoke and it's below a spare the air day. those that may be sensitive to

the smoke may want to limit their time outside, as we have seen the dixie fire, the largest single fire, and we have the monument fire burning in northern california and some of the smoke may be settling in especially to the north bay. for more on the impacts of how the wildfire can impact your health, let's head over to kris sanchez. >> the haze you are talking about, kari, is nothing like the eerie orange skies we saw for weeks and weeks hanging around the bay area last year when the bay area fires were burning. we had a record number of spare the air days, and we were told to protect n-95 masks to protect ourselves from the smoke, and covid infection rates spiked during the wildfires in 2020,

and there was a correlation between particulate matter and positivity rates. there's a study that is something to look at, where the authors say pollution makes people more susceptible to infection. people most susceptible to wildfire smoke or people with heart or lung disease, children and elderly folks, and keep your home smoke free as possible by keeping the windows and doors closed and your air-conditioner running, and use the n-95 masks that sift out that particulate matter. respirators, also a good idea if you are in the sensitive group. i remember during those weeks and weeks of that orange smoke, we switched those out for a while, and boy, we needed to.

>> yeah. 5:33. to the pandemic, the fda appearing to be one step closer to signing off an additional covid vaccine shot, and so far looks like it will come with a catch. "today in the bay"'s cierra johnson joins thus morning. this would only be recommended for certain people? >> reporter: good morning. that's right. it would be for those immuno compromised, and it's coming at a time when the delta variant is very much present not only here in the bay area but across the country. here's what we know right now about the third shot. fda, we are learning the immuno compromised people are people with a organ transplant and that

on friday a cdc committee is scheduled to vote on recommending which people should get the dose. one doctor says while he believes the first approval will be specifically for those whose body did not have a strong response, he believes the booster will be expanded to include other vulnerable populations. >> my guess is it will be restricted to patients with no imuno compromise, but eventually, that may be widened. >> reporter: the nation's top doctor, dr. anthony fauci, just appeared on the "today" show discussing the third dose, and take aissses how more than the immuno compromised may need more than a booster shot.

>> what we are doing on a weekly and monthly basis is following cohorts of patients to determine if, when and whom should get it, but right now at this moment other than the immune compromised we will not give boosters to people, but we will be following them carefully and if they do need it we will be ready to give it to them. >> that's the nation's top doctor appearing on the "today" show. we will keep close caps on what the fda is releasing in terms of what type of approval there is for the booster shot when that becomes available to us. >> always so much to follow. thank you. california's latest covid case numbers show just how much less at risk you are if you are fully vaccinated. here's the average case rates this week. for the unvaccinated it's 51 per 100,000. for the fully vaccinated, it's a little over about 6 and a half

more cases for those unvaccinated. and in the east bay contra costa health services has a new incentive program offering people $100 for every person they convince to get fully vaccinated. that person must complete their vaccination series using a special promotional link. and there's a new video campaign being created to show how the program works. and then revisiting san jose unified hiring off duty officers as private security guards. in june the board voted to end its school resource officer program and that meeting starts at 6:00 p.m. and includes public comment. and then a big chunk of the bay not reaching the goals tied

to state guidelines. the association of bay area governments say 23 cities and towns filed appealed to lower their goals and that includes santa clara, contra costa, marin and sonoma counties. more than one quarter of the bay area is included among the cities and counties filing those appeals. it's time to get a look at the forecast for you today. meteorologist, kari hall, working hard and keeping up with the numbers for us today. another hot one out there today? >> yeah, it's going to be hot. let's talk about the weekend because i know lot of people are making plans, and sonoma valley, up to 86 degrees tomorrow and 94 on sunday, so it just gets hotter as the weekend goes along. if you plan to head to l.a. this weekend we have low 80s for tomorrow and saturday and then on sunday reaching 84 degrees. if your weekend plans include the beach, and maybe it's the last weekend before the kids head back to school and you are going to see the temperatures a

little warm with upper 70s, but pretty nice for maybe taking a dip in the water for a little while. lake tahoe warming this weekend reaching in the upper 80s for tomorrow and saturday and sunday and a lot of sunshine. we also had the san jose jazz festival happening this weekend, kicking off tomorrow evening and will be in the mid-80s at the start of the festival and then temperatures cool down quickly as we head through the rest of the weekend, and so this is going on all weekend long so a nice event to check out. mike, you have more breaking news? >> we have a couple closures, and it may not seem like a big deal for your commute but it is through fremont, and 80 is still closed because of a crash. washington boulevard to the south, you could loop back and get to the northbound side if that's where you need to go. typical slowing here in san jose.

we're watching the commute adjust. right now this morning i have closures that will affect key parts of our commute. i'll show you the progress coming up. happening this morning, scary moments for a driver in washington state when road rage led somebody to throw a hammer at that car. take a look at this. this happened last month outside of seattle. deputies say a jeep driver actually began honking as he tried to merge on interstate 5. the driver kept honking and the victim took the nearest effort to try and avoid the confrontation. the jeep blocked the roadway and then a man inside threw a hammer at the windshield before driving off, and the driver was arrested and charged with several felonies. a new mental health evaluation is in the works for a man acquitted in the 2016 shooting death on kate steinle in 2014. he is still in custody on

federal gun charges tied to that shooting. >> the shooting became a flash point in the immigration debate. he was deported five times to his native mexico and was awaiting another deportation. he said he had no idea he was holding a gun that he said he found wrapped in a t-shirt under a bench. and then two republican assemblymen petitioned for a review, and a lower court already concluded the governor is acting within his authority. the democrats plan to spend trillions more on new programs, and it passed the senate. some senators said yes even though they had reservations.

>> yeah, we saw two pass in the senate. an infrastructure bill that many senators on both sides agreed to, and then the blueprint that has no support from republicans. and the senate just moved it forward with just democratic votes. >> every parts of biden's proposal will be there in a big robust way. some members in our caucus want more and that is the same in the house, and we'll all come together to meet the goal. >> schumer said he's talking about people like joe manchin, and manchin thinks the price is too high and when it comes back around for a final vote in the senate they will need his support. that will take a while. nancy pelosi is asking her members to pass the two bills together, and that could take months because the wish list bill, this one, hasn't actually been written yet, so a flury of

important census data today. this data will show us who we are as americans. >> we anticipate that there will be a decline in the nonhispanic white population in both california and the nation as a whole, and an increase in the latina population, and the pacific islander population, and it will give us an indication of the population under 18 years of age, which gives us a hint as to what the future is going to look like. >> this data can be used as states redraw voting districts. we know california will lose one member of congress, and not because we are not growing but because other states are growing faster than we are. we are finding out rand paul's wife bought stock in remdesivir. senator paul was supposed to disclose that and for some

information the information was never sent. we'll be tracking what is happening with the census online. you can find me at twitter, i'm @scottmcgrew. and looks like oakland is losing another athletic team, and in this case oakland's loss is san jose's game. the oakland panthers will start play in the indoor football league in 2020 and then the pandemic hit. the panther's season also got wiped out this season. and last time san jose had an indoor soccer team was -- or an indoor team, and i should not say soccer, but it was 2015 when you remember the sabre cats and sabre kittens -- >> no. >> some people do remember, but they folded after 20 years.

and then an elderly man fell while mowing his lawn. first of all, the man is okay. he's 93 years old. still out there cutting his grass. he collapsed last week and he was sent to the hospital after firefighters were called. and then the firefighters came to the rescue, finishing up the lawn work, including mowing the lawn and one neighbor so impressed by this catching it on camera, and the man that collapsed said he was so grateful. >> he was, like, can you edge, too? no, that's right. never met a firefighter i didn't like. and then it's sentimental. it was her mother-in-law's ring and it was handed down to her. she never stopped looking for it. >> new zealand police say the woman's home was burglarized 30

going to feel hotter than where we are headed for our high temperatures reaching in the upper 80s and low 90s. 93 in concord today, and martinez reaching 86 degrees. san francisco reaching the upper 60s. north bay temperatures, look at that, 103. not as hot in santa rosa, 83 degrees there. mill valley reaching 78. we're watching a couple tropical systems out there. we have kevin and linda. kevin continues to weaken and that's what we are expecting as it stays over the open water, but looks like it will get drawn into the monsoon moisture we are feeling right now, and may enhance the chance of seeing a few showers. look at the hour-by-hour tomorrow night at 7:30, that would be great. we just don't need lightning so we are watching out for that chance as well.
