i'm laura garcia. >> i'm kris sanchez. marcus washington is off this morning. first, as californians head to the polls today for the recall election, some republicans are already making claims of voter fraud. >> "today in the bay's" bob redell joins us live on one ballot drop-off site in the east bay. any truth to the claims, bob? >> no. they are unsubstantiated and as far as the polls go with regards to governor newsom the polls show that governor newsom should be able to defeat this recall vote and keep his job, but he is not taking that for granted. the governor brought in president biden to campaign on his behalf at a rally in long beach. the president praised the governor's leadership in protecting californians from covid and for standing up for science. at a campaign stop yesterday larry elder, the leading replacement candidate, questioned how the governor has made life better for californians, especially when it comes to crime and public education. businessmen and republican john cox he campaigned yesterday at

the famed french laundry restaurant in yountville to remind voters that governor newsom went to a party there during the pandemic while most people and businesses were on lockdown. that became the flashpoint that started this recall effort. kevin kiley from rockland tweeted this message saying whatever happens tomorrow, we're just getting started. that was a message he put out yesterday. another replacement candidate caitlyn jenner eb couraged people to vote. she says she will be casting her vote at beverly hills city hall. research by political data incorporated shows 39% of ballots state wide have been returned. of the returns 42% from registered democrats, excuse me, 43, 42% from registered republicans and 30% independent. republicans are hoping for a strong showing of in-person voting today. a poll released friday by uc berkeley shows 60% of people

"today in the bay's" chris pollone is live in washington breaking down the bold, new spending proposals. tell us about them, chris. >> laura, good morning. the brunt of this $3.5 trillion spending plan that the president and democrats favor would fall on the super wealthy and top earners, raising corporate tax rates and on individuals making over $400,000 a year, includes a 3% sir tax on individuals making more than $5 million. the legislative posturing as president biden makes his first official trip to the west coast, will travel to colorado where he will tout both of his spending plans at the national renewable energy laboratory. supporters say the proposal would generate enough revenue to expand things like child care, paid leave and universal pre-k. not without its share of detractors.

some republicans are calling out the high price tag and one no vote from senate democrats could kill the whole thing. >> we got a lot of negotiations to do over the next couple weeks. i am optimistic we're going to get it done. >> [ inaudible ]. >> also in washington today, secretary of state antony blinken will face another tough round of questions about the biden administration's handling of the afghanistan withdrawal. republicans in a house committee yesterday slammed the withdrawal and the biden administration's handling of it, some called for blinken to resign. laura. >> chris pollone, live from washington, thanks for the latest. turning to the pandemic coverage, california,'s covid surge is starting to decline, about 6800 new cases reported yesterday is less than half of what it was just a month ago and nowhere near the nearly 35,000 per day we saw back in says th

seven-day average is up 10% over the last month. a covid booster shot necessary? that's the question many have ahead of possible fda approval on friday. at least two regulators argue the average person will not need the booster. regardless, the white house wants boosters available to all by next monday. one infectious disease specialists believe only the immunocompromised should get them and suggest we instead target communities across the globe. >> one can also do other strategies to increase vaccine supply around the world, sharing the recipe, sending the know how, to the vaccine, but what i do know is that it's not an emergency for a general person to run out and get a booster. >> the santa clara public health department is gearing up for the boosters but points out september 20th may be

unrealistic since the cdc has to approve it as well and the meeting is scheduled for the end of the month. berkeley schools are trying to get the word out about being extrding substitute teachers, after school care and special education. the district currently has 129 vacant positions, which is a 50% increase from before the pandemic. there are two vacant full-time teaching positions, both of them in special education. new this morning a 3.8 earthquake shaking southeast of the bay area in the central valley. it happened a little past midnight near san benito and monterey and fresno counties. no reports of any damage. we've got a live look in texas along the gulf coast. >> hurricane nicolas made landfall a short time ago. the category 1 storm touched down midway between galveston and corpus christi on the

peninsula with winds of up to 75 miles per hour. even before landfall the storm brought it deluge of water. more than a foot of rain is expected to fall and we know the power is out for at least 150,000 customers. nicolas has been downgraded to a tropical storm. >> kari, you're keeping your eyes on this. >> we take a look at some of the areas there being affected that just had hurricane recently move through parts of louisiana, so it's really dumping a lot of rain across southwestern louisiana. they're looking at some spots that could reach up to 25 inches of rain. so this is going to be a big headline maker. we'll be watching that. as we take a look at our air quality today, we're still going to have drifts of smoke coming in. moderate air quality across the bay area with the hazy look to the sky. this is our last hot day before we start to cool off. our temperatures still heading towards the mid 90s for concord,

microphone and camera. created by an israeli software company discovered by good guy hackers. it's part of an effort we've reported on before called pegasus. spy software discovered on activist phones and journalist phones, even the president of france has been spied on with similar software. here's one of the good guy hackers who discovered it. >> the hacking campaign has been going on for some time and we've seen evidence of the exploitation of the vulnerability for months and months. we see the phones getting hacked, but we haven't been able to capture the code that was being used to hack the phones. and we capture the code get it to apple and apple can fix the flaw. >> they've done. the folks at apple have been working around the clock to fix the vulnerability. go to settings, general, show there's a software update to install ios 14.8, ipads,

watches, mac books are vulnerable. we don't know if tim cook will speak about that today at the previously scheduled apple event. we expect he will show off improvements to the iphone though don't expect anything huge. this will take place as a video conference not in person. night skies over southern california lit up last night with the spacex launch. this is carrying satellites to space, will launch a crew of four private citizens into space tomorrow. steve wozniak in hawaii, reports are he will announce his own space program. the word is the company won't send people into space. instead it will work on cleaning up lower earth orbit full of orbiting space junk. speaking of things that go up, critical inflation data with the latest read on the consumer price index. inflation has been a major issue lately. economists continue to say it's likely temporary.

like for kids this year. i don't think we're going to trick-or-treat. >> we didn't last year. i like to dress up. >> my girls are sending me costume ideas already. feel like fall today. >> we're going to talk about that in a little bit. let's get a look at the traffic map as mike heads over here and tells you what's going on this morning. >> thank you for that wonderful introduction, kari. we'll take a look at most of the roadways looking just fine right now. easy flow. we did have that spot near sfo. still a little slowing but we've gone from red to orange and now the northbound side showing slowing. typical when they have the crew which blocks a couple lanes in either direction overnight. they start to clear. you should be able to get through with about a couple minute delay max getting through sfo area. use your patience. getting toward the bay bridge no problem. no delays yet. it's 5:18. we should see a little slowing on the incline and the short bit. the richmond bridge there is an incident, a disabled vehicle reported around the toll plaza. we don't see a problem as the

lanes come toward us. a smooth drive. we could see the silhouettes of the trees in the background. that's the closest i get to show the cool sunrises. there you go. a silhouette of trees. >> as we wake up this morning get ready to head out, maybe heading out in oakland and our temperatures are nice and cool. jacket for the start of the day. it's not so much for the afternoon. but we are going to see that trend heading up as we'll start out with a few clouds. by 8:00, 9:00 starts to clear out. nice by noon. it will look hazy in the north the greens and blues that indicate some moderate air quality. still fires burning to the north of the bay area. we're going to see that impacting how much smoke we will see especially for areas in parts of lake mendocino counties as the smoke pushes off to the east. really smoky there. not so bad for the rest of the bay area. as we go into not only today but the next few days as we see changes in our wind pattern.

looking at temperatures today headed toward the mid 80s. this is where we were yesterday. it's basically a repeat of yesterday for many of our microclimates still a wide range in temperatures with redwood city heading up to 80 degrees, 70 degrees downtown in san francisco, and our north bay temperatures reaching 90 in sonoma and 96 in clearlake. as we get closer to the weekend we're excited to see how this will pan out. a chance of showers moving close to the bay area, but it could move over some of the fire zones and help out especially with the dixie fire with some scattered showers passing by. for us it's going to cool off our temperatures. take a look at saturday and sunday with low 80s and that's coming out of the mid 90s we're starting the week with. for san francisco expect temperatures in the 70s today. but then mostly 60s. for the weekend we are going to see a lot more clouds possibly mist and drizzle so keep in mind that it will be a chilly one near the coast and city.

turn to our climate in crisis, what scientists are finding about animals and plants becoming more extinct at an alarming rate due to their inability to adapt to our rapidly changing climate. some estimates are that 47% of local species have become extinct in recent years and the studies are done around the world. these scientists are finding that plant and animal species are being found at higher elevations and latitudes than in the past. they're moving around trying to adapt. while the outlook is grim for the future as temperatures continue to warm up we have the power to change how many more species will disappear. >> climate change below 1.5 degrees celsius, down that that level, maybe losing only one in six species, which is horrible but better than some of the alternatives. there are scenarios we could lose half thement and animal species on the planet.

"today in the bay's" cierra johnson joins us live from inside the building with more on a look at the new policy.

good morning, cierra. >> yeah, good morning. although that first preseason game isn't until next month, the folks here at the chase center wanting to spread the word early that to get inside of these doors you will need to show that proof of vaccination. they made that announcement today that that proof of vaccination is required for any event at the chase center that has more than 1,000 people. that proof of vaccination applies to anyone 12 and older. fans can use the clear app, the health feature, or show that physical card and masks are required inside of the venue. now, the chase center joins a long list of other facilities requiring that proof of vaccination. here in san francisco, that proof is now required to enter any indoor restaurant, bars, gyms, theaters and other entertainment venues and it's also expanded outside of the city of san francisco. san jose's sap center does require that proof of vaccination and this policy will

really get a test run as early as tomorrow. that's when musical artist has a show here at the chase center. coming out to see that show it is important to bring your app and card because you will not be allowed indoors without it. live at the chase center, cierra johnson for "today in the bay." >> all these things to remember. thanks. let's take you live to the federal courthouse in downtown san jose. that is where today testimony resumes in the criminal fraud trial of elizabeth holmes. the trial has been on hold for nearly a week because of covid concerns. shortly after opening statements a juror told the judge that he might have been exposed. over the labor day holiday. the theranos founder and former ceo faces wire fraud and conspiracy charges and prosecutors say she misled investors about her company's blood testing technology. holmes could face 20 years in prison if she is convicted. joo stick with nbc bay area for continuing coverage of the elizabeth holmes trial. we will walk you through every step of the way with team

coverage and analysis. some of the stuff is scientific and could be complicated. we're following the latest on nbcbayarea.com. developing this morning, the judge overseeing pg&e's criminal probation digging deeper into what sparked the massive dixie fire. as of this morning the fire is 75 contained but yesterday, a pg&e crew member spent two hours answering questions about the power line now suspected in sparking it. a judge is considering tighter conditions on pg&e before his authority ends early next year. president biden says the caldor fire shows why boosting america's infrastructure is so important. he made the comments after taking an aerial tour of the damage yesterday with governor newsom. biden also argued climate change is the driving force behind these kinds of massive fires. the caldor fire is now 67% contained. we know our weather not just

the climate long term but the weather is a factor in the fire fights and kari has been tracking that. >> it's been smoky there and hard for them to see if they're trying to attack that fire by air. we are also seeing a lot more of that smoke moving into farther to the north in parts of the north bay moving into the sacramento valley and we're seeing some of these yellow dots indicating moderate air quality as well in the south bay and tri-valley. if you're sensitive to the smoke you need to limit your time outside. as you're heading out for your commute this morning in brentwood, nice cool, clear start to our morning, upper 50s. at noon in the upper 80s. and we're headed toward the upper 90s today. we'll talk more about all of our microclimates coming up. mike, you're checking back at the richmond toll plaza. >> we've seen traffic fill in the toll plaza and then clear out. i believe what happened was there was a minor fender-bender or just a disabled vehicle, but a couple of vehicles did have to end up being cleared from the toll plaza just under our camera.

dollar plan to expand medicare and pay for elder care and child care, free preschool and two years of community college. as we've said it's one of the biggest social programs. video of the senate in session after a vacation. the house is not back until next week. both sides of the capitol, senate and house, have to deal with that bill. the other infrastructure bill and the debt ceiling and do this all before the end of the month. now we're getting some details on the new taxes that would be needed to pay for all of those expensive social programs. we mentioned the proposal to increase taxes on american corporations to 25.6%. what you would pay, families that make more than $450,000 a year, or an video making 400,000, would see their income tax rise by a bit. their capital gains would increase. if you're under this number no new taxes for you. though, if you make more than

that, $5 million a year or better, you will see a significant hike. again, these are all proposals. secretary of state antony blinken will be in front of a senate committee answering questions about the withdrawal from afghanistan. yesterday he spoke to a house committee. no question the withdrawal started poorly but by the end blinken points out the largest air lift in history. we did learn from yesterday's testimony there will be two more flights of americans and refugees later this week. blinken says there are still americans in afghanistan who are telling the state department they aren't ready to take those flights. >> we're in constant contact with americans in afghanistan who have told us they wish to leave. each has been assigned a case management team to offer specific guidance and instruction. some decline to be on the first flights on thursday and friday needing more time to make arrangements, wanting to remain with extended family or medical issues that precluded traveling last week.

households statewide. in totals the state has received more than 243,000 applications for assistance and in all, there's more than 7 be there available in rental and utility assistance. another round of stimulus checks going out to to californians next week. in the latest batch, $2 million are expected to receive payments. nearly two-thirds of californian taxpayers will receive a payment of $600. qualifying families with children will receive an additional $500. to qualify residents might have filed 2020 taxes by october 15th, 2021, and have an adjusted gross income of under $75,000. you must be a state resident and cannot be claimed as a dependent by another taxpayer. taking a live look at sfo this morning, despite the growing concerns around the delta variant and the surge, more cases nationally, more than 3.3 million people were checked through tsa this weekend alone.

to wear, regular stuff. nothing like that. a look at our air quality as we are going to see some smoke coming in again today. moderate air quality we've been dealing with the fires across northern california and we also do have the heat. when we get these really hot temperatures for the inland areas, being really pushing down on that smoke so we're going to see our temperatures today in the tri-valley headed towards the low to mid 90s and then the inland parts of the east bay, notice napa today at 4:00 we'll be in the mid 70s while 80 in santa rosa. tonight we're coming back down to the 50s and tomorrow it won't be as warm. going through the rest of the forecast, the cooling trend will continue. here's why we'll see a storm system approaching the pacific northwest and for the weekend starts to move into far northern california, but a lot of showers break apart before moving into the bay area. even though we're missing out on this rain it looks good for some of the fire zones if they get a

few of those showers moving through that could help hopefully with some more containment, especially near the dixie fire. between saturday night and sunday morning. we're looking at a cool down here for the most part we're going to go from the low 90s in the inland areas to the mid 80s by the end of the week. then some upper 70s and low 80s for the weekend. with more clouds. san francisco may stay cloudy throughout the weekend with mist and drizzle throughout the day. highs in the upper 60s. a big cool down and much less sunshine for the weekend. how is it looking driving through the tri-valley. >> a look first of all, there's plenty of traffic flow westbound with the headlights. eastbound as well out of dublin and livermore. in your commute the westbound drive a minor crash reported between a big rig and pickup truck, from what chp has told and that is on the shoulder, though. safely out of the lanes. i was concerned because of the larger vehicles but 580 moves smoothly past the scene.
