recall vote and keep his job, but that's not something he's taking for granted. this is video from last night when the governor brought in president joe biden to campaign on his behalf at a rally in long beach. he praised the leadership in protecting californians from covid and his stance standing up for science. at another campaign stop yesterday, larry elder, the leading replacement candidate, questioned how the governor has made life better for californians, especially when it comes to things like crime and public education. business and republican john cox, another replacement candidate campaigned yesterday at the famed french laundry restaurant in yountville to remind voters governor newsom went to the dinner party at that restaurant during the pandemic while most people and businesses were on lockdown. that became the flashpoint that jump started this effort. kevin kiley, he's from rockland, tweeted this message saying whatever happens tomorrow we're just getting started.

another replacement candidate caitlyn jenner encouraged people to vote. jenner says she will be casting her ballot in person at beverly hills city hall. now research by politico data incorporated shows 39% of ballots statewide have been returned and if you look at the ballots measured out to democrats, 43% of registered democrats have returned their ballots, 42% of registered republicans have returned theirs, 30% for independents. republicans are hoping for a strong showing of in-person voting today. in a poll released friday by uc berkeley shows 60% of people surveyed favored keeping newsom in office. 38% want him removed. the rest undecided. reporting live here in dublin, bob redell, "today in the bay." here's a look at what to expect as the recall election plays out. 8:00 tonight is when polls close. then after that over the next few hours the election could be called if the margin is wide enough. it has to be more than 50%.

"today in the bay's" chris pollone live in washington breaking down the bold, new spending proposals. good morning, chris. >> good morning, laura. the brunt of this $3.5 trillion tax and spending plan would be

borne by the nation's highest earners. it calls for higher corporate tax rates and individuals making over $400,000 a year would also pay higher rates and includes a 3% sir tax. the legislative posturing as president biden makes his trip to the west coast, traveling to colorado where he will tout both of his plans at the national renewable energy laboratory. supporters say the proposal would generate enough revenue to expand child care, paid leave and universal pre-k not without its share of detractors. some republicans say that they are not on board. democrats as well, say they're not on board with that type of price tag and one no vote from a democrat in the senate would kill the whole thing. >> we got a lot of negotiations to do over the next couple weeks. i am optimistic we're going to get it done.

>> also in washington today, secretary of state antony blinken back on the hill for another day of questioning about the biden administration's handing of the afghanistan withdrawal. blinken testified before a house committee yesterday. republicans slammed the withdrawal and several calls for blinken to resign. >> everybody still following it. thanks so much. turning to our pandemic coverage now, california,'s latest covid surge is declining. 6800 new cases reported yesterday, far less than half of what it was one month ago and nowhere near the nearly 35,000 per day cases from mid january. nationally, though, a different story. johns hopkins university says the seven-day average is up 10% over the last month. >> is a covid booster necessary? that's a question many have ahead of possible fda approval

friday. at least two regulators argue the average person will not need the booster. regardless, the white house wants boosters available to all by next monday. one infectious disease specialists believe only the immunocompromised should get them and suggests we instead target communities across the globe. >> one can also do other strategies to increase vaccine supply around the world, sharing the recipe, sending the know how, to the vaccine, but what i do know is that it's not an emergency for a general person to run out and get a booster. >> the santa clara public health department is gearing up for the boosters but points out september 20th may be unrealistic since the cdc has to approve it as well and the meeting is scheduled for the end of the month. we talked about labor shortages, but berkeley schools are trying to get the word out about being short staffed they are. the berkeley side reports berkeley unified is trying to fill

positions in areas including substitute teachers, after school care and special education. the district currently has 129 vacant positions, which is a 50% increase from before the pandemic. there are two vacant full-time teaching positions, both of them in special education. we know other districts are struggling too. >> massachusetts is calling in the national guard in order to help get kids to school. this is the video. 90 members of the guard will begin training to drive school busses because of a pandemic related shortage in drivers. across the country, it's not just a shortage of workers, experts say the increased costs for metals, plastics and wood could last into next year. covid cases overseas are leading to a backlog in shipping and causing supply chain issues. the cost increases are also hurting supermarkets. >> you this morning a 3.8

earthquake shaking southeast of the bay area in the central valley. it happened a little past midnight near san benito and monterey and fresno counties. no reports of any damage. a live look at surfside beach in texas along the gulf coast close to where hurricane nicolas made landfall a short time ago. the category 1 storm touched down between galveston and corpus christi on the peninsula with winds up to 75 miles per hour. even before landfall, the storm brought a huge deluge of water. more than a foot of rain is expected to fall in some places and power is out for at least 150,000 customers. nicolas has been downgraded to a tropical storm, but concerns remain with a lot of flooding. >> always great to hear about the downgrade but does that not mean it's not dangerous. >> this storm is slowing down and going to remain over parts of texas and louisiana over the

next several days. parts of louisiana still recovering from ida and now they're dealing with all this rain and some estimates are up to 25 inches of expected rainfall. so that would be very catastrophic there. we're going to continue to monitor that. as we bring it back home we're looking at some smoky skies and moderate air quality as we see these yellow dots here that indicates moderate air quality. if you are sensitive to the smoke another day of having to limit your time outside as we are going to see our temperatures today head back to the low to mid 90s in some spots. we'll have more on that in a few minutes. the improvements we'll see heading into the weekend. mike, you're tracking the toll plaza. >> i am. because those are chokepoints and everybody comes together. fewer lanes across the bay bridge, fewer than 20 over here, the toll plaza, where you see the backup, the effect of the metering lights for under five minutes filling in the middle. word of a crash in the area. we didn't see it on the camera and we'll check on it from chp. a little slowing through

richmond. we had richmond toll plaza had a little build. highway 37, look at highway 4, pittsburgh, bay point, concord, showing that slower drive build up through contra costa county. also slowing for 84, 880 a little bit through hayward and a recovery from the first slowdown in san jose. a note train number one is delayed. i misspoke. number 3 is still on time. train 1 about 40 minutes delayed into fremont. back to you. >> thanks so much. 6:10. all this week nbc bay area and telemundo 48 are working to clear the shelters, helping animals find their forever homes. for karen michaels her adoption story is because of the pandemic. he said she wasn't looking for a dog when she volunteered at san francisco's spca. that's when it happens. when the pandemic hit the shelter closed and she actually fostered a dog. you know what happened then. no way that dog was ever going back. now look at the hugs. certainly family. well this saturday our big event is happening at the berkeley humane.

tri-valley we're getting a clear start and cool temperatures, but it's going to be another warm one going from 59 now to 90 at 1:00. hot day. we'll talk about that air quality and also how animals are being able to adapt to climate change. that's coming up in a few minutes. >> you're going to have to adapt to this, not oakland, moving smoothly but did hear from bart in pleasant hill, the pleasant hill station trains are not stopping because of some sort of power issue in the area. bart trains not stopping at the pleasant hill station. we'll talk about your alternate and what else is going on in the area. >> good morning. happy tuesday to you as well. apple is pulling the fire alarm this morning on a critical vulnerability in its iphones. a way to spy on you using the microphone and camera. the method was created by an israeli software company discovered by good guy hackers. but may have been around for months. it's part of an effort we've reported on before called pegasus. spy software discovered on

activist phones and journalist phones, even the president of france has been spied on with similar software. here's one of the good guy hackers who discovered it. >> the hacking campaign has been going on for some time and we've seen evidence of the exploitation of the vulnerability for months and months. we see the phones getting hacked, but we haven't been able to capture the code that was being used to hack the phones. capturing the code, we get it to apple and apple can fix the flaw so it can no longer be exploited. >> and they have fixed the flaw working around your clock. on your phone go to settings and general and a software update you can install, ios 14.8. this is what it looked like on my phone. you need a full battery or plug it in. don't forget ipads and watches and mac books are all vulnerable. we don't know if tim cook will speak about that today at the previously scheduled apple event.

we expect he will show off improvements to the iphone though don't expect anything huge. once again, this event is taking place as a video conference, not in person. night skies over southern california lit up last night with the spacex launch. this rocket carrying more satellites to space. spacex will launch a crew of four private citizens into space tomorrow. steve wozniak in hawaii, reports say he will announce his own space program. the word is the company won't send people into space. instead it will work on cleaning up lower earth orbit full of orbiting space junk. some good news, we got the latest inflation data showing price hikes are slowing down. price increases month to month is 0.1, much less than we were thinking and fearing. that's core inflation when you take out gad and food prices. people care about gas and food prices, but they're not a good

measure of overall pricing. a single storm in the gulf does cause gas prices to go higher, but we don't count that as inflation. >> that is a good explainer. thank you so much, scott. >> this is interesting. your hand could soon become your ticket to concerts. amazon signing a deal with entertainment giant aeg to bring its palm recognition technology to the red rock's amphitheater in denver. it will roll out at other venues over the coming months. >> facebook is under fire after new reports claim that it has different rules for different people in a vip program. according to the "wall street journal" the tech giant keeps a list of profiles that don't have to follow the company's rules allowing posts that would otherwise be taken down. the program reportedly includes 5 million politicians, celebrities and journalists. facebook says the program was developed to give certain accounts, quote, a second layer of review.

please stop the music. >> from michael meyers to mike. >> let's hope that's a change-up. what's really scary during a movie when the power suddenly goes out. let me show you what happened on transit, you guys. this is an issue for bart right now. pleasant hill station is not being -- is not servicing bart right now because there's some sort of power outage in the area. typically bart is on a separate grid so we're checking out what is going on here. that is a problem. use the concord or the walnut creek stations to the north or south on that yellow line. we're looking at no other delays. the ace train did have the first train delay. but we recovered for the other trains. the backup at the bay bridge toll plaza despite a fender-bender reported in the area, the backup forms and an unusual flow of traffic. a traditional pattern out there. >> we're waking up to a beautiful sunrise. this live view. a little bit of fog rolling across san francisco and it's been a very nice sunrise across

the bay area. so as we're walking out the door if you're sensitive to the smoke you're able to smell it. if it bothers you, you've had breathing problems limit your time outside. some of the same air quality we've seen recently as our temperatures heat back up again today. headed toward 87 in east san jose as well as los gatos and 90 today in morgan hill. seven-day forecast is up at the bottom of the screen. it does show a cool down headed our way. this is the last day we're going to deal with temperatures like this for a while. concord heading up to 95 degrees and 83 in hayward. still cool near the coast. as you head over to redwood city, palo alto, we're in the low 80s and some low 70s in san francisco today. up to 92 in sonoma. 99 in ukiah. as we go through the forecast we are going to see a storm system moving into the pacific northwest and look at how it moves into northern california. this is very late saturday into sunday. this could also bring in some rain near the fire zone so

that's going to be some good news. it just kind of dries up before it gets here. it will bring some cooler air so going from the low to mid 90s through the 80s this weekend. san francisco will go from 70 today to the mid to upper 60s. our climate in crisis. scientists and scientists are looking at animals and finding about animals and plants becoming more extinct at an alarming rate due to their inability to adapt to our rapidly changing climate. some estimates are that 47% of local species have become extinct in recent years and the studies are done around the world. scientists are finding that plant and animal species are found at higher elevations and higher latitudes and the outlook is pretty grim for the future. as temperatures do continue to warm, but we do have the power to change how many more species will disappear. >> keep climate change below 1.5

a new york woman disappeared while taking a cross-country road trip with her boyfriend. 2-year-old gabrielle petito was reported missing on saturday. last known to be in the grand teton national park in late august. police say that's when she stopped communicating with her family. she had been documenting her cross-country trip on youtube and social media. investigators are looking for

her boyfriend. turning back to the pandemic, as new york city is returning to in-person learning it's starting to enforce its vaccine mandate for restaurants and gyms. some are preparing for a possible slow down in business there. tomorrow, four civilians will lift off in the spacex launch. one 53-year-old amputee believes he may follow. >> philippe croizon has no arms or legs because of an electrical accident ten years ago. after tweeting elon musk to send him into space he says it will happen one day. >> he is on his way to cape canaveral to watch tomorrow's liftoff inden state.

>> laura and kris, these republican claims of voter fraud so far are unsubstantiated. while campaigning with president biden governor newsom pointed out the republicans have been propelling this myth that presidential election was rigged since president trump lost his re-election. the leading replacement candidate in the recall race being today, larry elder, he is already launched a website that lets users sign a petition to ask if this election be audited and people to report election irregularities. the claims are unsubstantiated. the election is not finished and votes have yet to be counted. he was noncommittal yesterday when asked if he will accept the results of the election. >> let us all work together no matter what results are to make sure that results are valid and legitimate let's all do that together. >> is that a commitment -- >> let's all work together.

>> you saw what will happen on election night. the big l defeated donald trump but we have not defeated trumpism. trumpism is still on the ballot in california. >> reporter: another republican candidate in the recall election kevin faulconer, the former mayor of san diego, he was asked about election security by a politico reporter. faulconer said he's seen no evidence of larry elder's claims and he would accept the recall results. meanwhile, those making sure your ballots are safe they've been working for weeks to make sure there are no irregularities. registrar voter offices have similar rules and regulations in place to make sure ballots are secure. in contra costa county, the registrar of voters requires all staff members to pass background checks and they also keep two people with the ballots at all times. the secretary of state says california has the nation's strictest voting system security

despite growing concerns around the delta variant and more covid cases nationally, more than 3 million people were checked through tsa this weekend. the cdc is adding several locations to its very high travel risk list including albania, belize and serbia. it recommends avoiding all international travel until you are fully vaccinated and check covid requirements of course ahead of time. proof of vaccination now required at san francisco's chase center. while the warriors won't return for a few weeks, the venue is about to get its first big test run. "today in the bay's" cierra johnson live inside the chase center to tell us about it. negative test results won't be enough anymore. >> yeah. good morning, laura. that's exactly right. the negative tests will not be enough. you need to show that proof of vaccination and as you mentioned we're a couple weeks away from the preseason game. i believe it's october 6th. starting tomorrow the start of the concert series.

you can see behind me the screen, human nating those artists that will be set to perform tomorrow. tame and pal la, when staff will get the first test run of having to show proof of vaccination. starting today for any event with more than 1,000 people you need to show the proof of vaccination. fans can use the clear app, the health feature app or show that physical card and masks will also be required inside those venues and those events are taking place. now the chase center joins other facilities requiring that proof of vaccination. san francisco, that proof is now required to enter any indoor restaurants, bars, gyms, theaters and other entertainment venues like san jose's sap center. they have also implemented that proof of vaccination so again, if you're coming to see any of the shows like tomorrow, you will need to bring that vaccination card and there's a long list of other artists, i saw bell biv devo, simone biles, a lot of performances, you will

need to come correct with proof of vaccination. live inside the chase center, cierra johnson for "today in the bay." >> bell biv davoe that's a flashback. developing this morning, the judge overseeing pg&e's criminal probation is digging deeper into what sparked the massive dixie fire. as of this morning the fire is 75% contained but yesterday, a pg&e crew member spent two hours answering questions about the power line now suspected in sparking it. a judge is considering tighter conditions on pg&e before his authority ends early next year. president biden says the caldor fire shows why boosting america's infrastructure is so important. he made the comments after taking an aerial tour of the damage yesterday with governor newsom. biden also argued climate change is the driving force behind these kinds of massive fires. the caldor fire is now 67% contained. >> we are looking out our window

over san jose where the morning is off to a mild start. although we could see haze there, maybe. what is that? >> we are going to start to see a little bit of haze to the sky. we've been dealing with this moderate air quality because there are nine fires burning across northern california and some of that smoke is drifting in as we're starting out our tuesday. where you see the yellow dots that indicates moderate air quality. people with breathing problems need to limit time outside. into today much more of the smoke moving into the north bay where you see the light blue, the hazy sky. some of the brighter colors, the greens and yellows indicate where we could still see some of that moderate air quality continuing today. we are going to see some changes ahead. we'll talk about that in a few minutes. what changes are you seeing for the commute? >> folks in contra costa county could not use the pleasant hill station, it's not closed but bart trains are not stopping because of a power problem for that station. we're looking at mutual aid

corporations to 25.6%. as far as what you would pay, families that make more than $450,000 a year or an individual making 400,000, would see their income tax rise by a bit. their capital gains would increase. under this number no new taxes for you. more than $5 million a year, good on you, you will see a hike. these are proposals. secretary of state an tony blinken will be in front of a senate committee answering questions about the withdrawal from afghanistan. yesterday he spoke to a house committee. no question the withdrawal started poorly but by the end blinken points out the largest air lift in history. we did learn from yesterday's testimony there will be two more flights of americans and refugees later this week. blinken says there are still americans in afghanistan who are telling the state department they're not ready to take those

>> thank you. 6:47 now. los angeles is facing a new legal challenge for its city worker covid vaccination st. joseph. six lapd officers are request a judge overturn that mandate. a council member approved the new ordinance requiring city employees to be fully vaccinated by early october unless they're granted an exemption for medical or religious reasons or they can be tested weekly instead. >> another round of stimulus checks going out to californians next week. in the latest batch 2 million are expected to receive payments. nearly two-thirds of california taxpayers will receive a payment of $600. qualifying families with children will receive an additional $500. to qualify residents might have filed 2020 taxes by october 15th, 2021, and have an adjusted gross income of under $75,000.

kind of fun to see. what do we wear here in the bay area today? kari has a look at our forecast. >> yeah. the best i could do is like puffy sleeves or something. yeah. not even close. >> stunning. >> live look outside in fremont, we're waking up heading out in the east bay and our temperatures are in the mid 50s. you want to wear maybe a sparkly jacket or something for the start of the day and as we go into the rest of the day, warms up quickly. at 1:00, 80 degrees. the seven-day forecast at the bottom of the screen. we're going to go back to where we were yesterday in the south bay, reaching into the mid 80s. 90 in morgan hill. gilroy reaching 89 degrees there. we'll see still some mid 90s for parts of the inland east bay and oakland reaching 75 degrees. 78 in san mateo and in san francisco, the marina district, 63, 71 in the mission district and 91 in novato. ukiah still hot and smoky
