"early today" starts right now >> good morning. i'm philip mena. >> glad you could join us. i'm frances rivera we begin in montana where investigators from the ntsb are looking into the cause of the amtrak train derailment that killed three and left seven others hospitalized. our jake ward has the details. jake, good morning >> reporter: good morning, frances. this morning, investigators are on the ground in montana trying to sort it out, how sit that a passenger traiy alone on its tracks, crashed on an otherwise perfect day. it happened around 4:00 on a beautiful saturday afternoon the two engine amtrak train

carrying 141 passengers and 16 crew members suddenly dragged to a halt as eight cars derailed. >> oh, my god. it's on its side it was like this extremely violent force. i'm a pretty big guy and it picked me up and threw me from my chair into the wall >> reporter: jeremiah johnson and his wife rushed in to help >> we were throwing ladders up on the side to get people out. >> they had provisioned jaws of life they did have to cut into one of the cars to extract some of the individuals. >> reporter: the accident took place in a remote stretch near joplin, montana. far enough from help that several helicopters had to carry the most badly injured to hospitals. amtrak confirming three people were killed, dozens more injured. many put up at a local high school past derailments have often resulted from going into a corner too fast, as in this fift derailment in philadelphia or from a section of track

blocked or misaligned. now a team of investigators is on the ground in montana to ask how this train came off a straight section on a clear day. >> why did the cars derail if the track were straight, it will have to do something with the train cars themselves and how they connected with the track or some fault or flaw in the track. >> reporter: on a per mile basis, rail travel is far safer than traveling by car. and recent years have seen safety improvements like positive control systems but rail maintenance is a constant challenge, and the condition of this section of track will be one of several variables investigator also examine, as crews work to clear the wreckage from this rail corridor frances, at this point, investigators say that all passengers are accounted for unfortunately, five are still in the hospital, and of course, there are the three deceased but the ntsb has essentially

over vaccine mandates. all health care workers at hospitals and nursing homes are required to have one dose of the covid vaccine by today and those two refuse the shot without a doctor approved excuse will be terminated without unemployment benefits. a similar mandate for new york city teachers was also set to go into effect but it has been delayed until wednesday when it will be reviewed by a three-judge panel. >> reporter: just hours before a vaccine mandate was set to go into effect for teachers and staff in new york city, a federal judge temporarily blocked its enforcement in the nation's largest school system after mayor bill de blasio announced last month that nearly 150,000 employees would have to get at least their first dose by monday which includes teachers, custodians, and cafeteria workers. mixed emotions from parents on what the pause means for their children >> it should be mandated yes. >> i feel like if the teachers don't want the vaccine, that's

okay, as long as they're safe about it, put the mask on. >> reporter: it's the first no-test option mandate for such a broad group in new york, where there is a similar prerequisite for hospital workers, prompting concern over staffing shortages. with the governor announcing she's ready to declare a state of emergency if thousands of teachers or health care workers don't show up. even preparing for the national guard to step in, if needed. currently, 84% of hospital employees in new york state are fully vaccinated, compared to 77% of nursing home staff. in new york city schools, 89% of teachers have gotten their shots. but the current mandate fight is likely a sign of more to come. >> this is only one in any number of lawsuits that you're going to see across the country because of the polarization and the disinformation >> reporter: the biden administration already bracing for legal battles when it comes to its own requirements for workers nationwide with. the challenge of enforcing some
