chris, where do lawmakers go from here? >> marcus, if there's no temporary spending bill in place the federal government could shutdown on friday. the nation is one day closer to a federal government shutdown and defaulting on its debts. senate republicans would fund the government and extend the credit until december, and they are hoping to thwart president biden's future spending bill and trying to force democrats to raise the debt limit on their own. >> democrats want to use the temporary pandemic as a trojan horse for permanent socialism. >> our company is staring down the barrel of two total republican manufactured

disasters. >> they are squaring off with each other on passing a trillion-dollar infrastructure bill, and it's not clear if either measure has enough votes to pass. what happens next especially with the government shutdown? democrats in the senate could decide to keep their bill as is with the debt limit in and hope republicans realize they're serious a shutdown could happen on friday and they will vote with them, or the democrats could strip the debt limit out of it and that would give them days to weeks to work on it after that is out of it. >> the last thing we need here in america is a government shutdown. hopefully they can figure it out. >> you got that right. to the pandemic and a lot of eligible people not waiting around to receive their pfizer

nbcbayarea.com/coronavirus. it's up in our trending bar on the top of our home page. 5:03. a federal judge now ordering all california prisons guards to be fully vaccinated. he's giving the state prison leaders and employee unions to come up and vaccine all 66,000 employees, and that mandate applies to any inmate that worked inside or outside the prison grounds and that is despite objections from employee unions. that duh tau shows over 50,000 inmates have been infected in california. 240 have died many during the san quinton outbreak last year. 75% of the state's prisoners have been vaccinated.

sonoma county sheriff died from covid. a procession is planned this morning at the windsor area. a live look at the state capitol on thursday. the law providing supplemental sick leave is set to expire. happening today, workers groups will call for lawmakers to extend it. it covers businesses with more than 25 employees. many argue they cannot afford to leave. this is where today, mayor london breed will join a bill to pay addict to stay sober. the bill is sitting on the governor's desk.

the governor talked about trying to pay for it through medicaid. new relief may be coming for those trying to make it in the bay. governor newsom is scheduled to visit an affordable house unit in the east bay this morning where he will sign new legislation aimed at streamlining affordable housing production. that event is planned for 10:30 in alameda county. now to a peek outside on this tuesday morning, waiting for the sun's arrival. let's bring in meteorologist, kari hall. the sun will not warm things up and we will experience a little taste of fall. >> yeah, the cold front sweeping across parts of the bay area this morning, and yesterday we were watching out for the chance of rain and we can still see the clouds over the region, but the chance of showers still winding down as this front moves across the region. it will be a nice start to the day, although we will have a lot of clouds, temperatures in the upper 50s and a slow warm-up

today. as the sky clears, it's going to be nice and comfortable. take a look at the fall-like conditions we will have today. mid-60s near the coast in san francisco. upper 60s for san rafael. napa reaching 74, and upper 70s for concord as well as antioch, and 75 in morgan hill. we are going to warm up heading towards the end of the week, so we'll talk more about that in a few minutes. kari, there are reports of a disabled vehicle. i did catch the view of flashing lights going slowly into san francisco on the upper deck. i believe the disabled vehicle was in the fast lane just past the tunnel, and i will track that. no slowing shows up on our sensors just yet. it's toward the view of the wall park. that's westbound get into the city. a light flow right now. we still have the closure, north 242 to 680.

meanwhile the rest of the bay shows a smooth flow of traffic, and a light volume of traffic across the bridge. today very clear view across the span from 92 westbound. of course the taillights heading towards the peninsula. if you are going to san rafael over the richmond bridge, the crew is there picking up in the early mornings. coming up, not a fan of shots. what if you could take a pill instead? the experts we talk to say the inflation and high prices are temporary, and they keep changing the definition of temporary. we'll take a look when "today in the bay" continues.

just a tad bit of traffic on the nimitz. and palo alto, 101, there was a little slowing through the area both north and south, and i believe there's one lane blocked. san mateo, no problems. there's a lot going on in washington. big testimony from a very important general. we will talk about that when we talk about politics. secretary janet yellen and jerome powell will be on capitol hill today talking about some of the dangers ahead and our economy. powell in particular worried about inflation. inflation is the most dangerous thing to both your retirement and your family's budget. you have surely seen the affects at the grocery store yourself. powell is expected to say while we still think inflation is temporary, it will be a longer

temporary than we first thought. yellen will talk about covid and how it's hurting our economy. she will testify that significant challenges from the delta variant continue to saw suppress the speed of recovery. do you know who this is? he used to be a designer at apple and just hired at ferrari to help with the upcoming designs of electric cars. if you are not in the market for a ferrari, you may be in the market for something less expensive, say ford versus ferrari, and they also hired an apple executive to help with their cars looking more modern. coming up on the "today" show, tom costello will tell us all about it. ford says it's the most important change since the creation of the model t.

south bay artist is releasing his first book. >> maybe you are familiar with tyler gordon. his portrait of kamala harris went viral, and he painted the cover for "time" magazine. it's portraits of power. he's amazingly talented. >> he really is. i have had great conversations with him, and a great guy. >> paint a picture of the roads for us, mike. >> traffic is relatively light but we have a couple concerns here. overall, the pictures are looking mostly green, and that's the paint i have used right now. we will zoom you over towards vasco. this is a longer drive heading out of discovery bay, and southbound is your commute direction is where a crash is reported so be careful in that direction. from time to time you can see the sensors changing a bit in

both directions. there will be a distraction at the very least. no problems or surprises out of the altamont pass. there's a closure northbound from 680 counter to any commute but the commute starting to build a little bit. we have all the police activity here, and cierra is following the investigation there, stay off campus if you are a student, teacher or employee until 10:00. a clear drive here westbound on the bay bridge. kari, i talked about the disabled vehicle heading over to san francisco, and there could be slowing as they remove the vehicle over to the san francisco side. we'll track it and it's moving pretty well. >> it's still moving and that's a good thing. we're getting a look at good air quality for the bay area as you are waking up and heading out the door. we will keep this for today. a lot of the smoke moving away from us. we are seeing a pretty good breezy wind coming onshore, and

that's where we are seeing the clouds and the system bringing us the cooldown that brought a couple inches -- or about 0.1 of an inch, i should say, for the coastal areas and much needed rain for northern california where we are still seeing the fires ongoing. if you do plan on heading to the beach today, our temperatures will go from the mid-50s to mid-60s. it will be nice breezy winds and be very comfortable. you do want to make sure you are careful because we could see rip currents as well as sneaker waves. we are definitely advising you never turn your back to the water but especially today because we have the beach hazard statement in effect. for inland areas, it's going to be so comfortable today. you will want to enjoy more time outside. we have mid-70s for the south bay and other 70s for antioch and concord, and 75 in martinez today. oakland headed towards 69. we will see low 60s for daly

city. the mission district, 68 degrees. santa rosa heading towards 74. we will see a high of 76 in sonoma. as we head into the month of october if you are wondering how much rain do we normally get? well, it starts on friday but through the month of october in santa rosa we normally get about two inches of rain and this is when we start to see a couple weather systems passing by. san jose on average gets a little more than three quarters of an inch of rain for the month of october. we are going to be heating up and going back to summer for livermore and into the low 90s for the weekend, but check out next week. it will cool off by wednesday and thursday. we are going to see our temperatures going up and down, and this weekend it's going to feel like summer with the low 90s while san francisco will see highs in the low 70s for the weekend as we are still looking at clouds and fog here and there. now let's turn to our climate in crisis. we are looking at a positive

story. wind energy is powering the way towards zero emissions for electricity in california. now, on friday, 23 new high wind turbines were installed as it helps the goal of generating 100% clean energy by 2030. >> this is our first operational local renewable energy resource. we hope it will be the first of many alameda county and san joaquin projects to renew. this facility, which is about 55 megawatts of generating capacity could power about 40,000 homes. >> you can find out more about the turbines and how you can get

as we have been reporting, anybody with a vulnerable immune system can get another dose of the pfizer covid vaccine. >> investigative reporter, chris chmura takes a look at how to get shot number three. >> the cdc says an additional dose of the pfizer vaccine could give more protection to those who are compromised. to get a third dose the cdc says you have to be fully vaccinated with either the moderna or pfizer vaccine for at least 28 days.

if you got the johnson & johnson vaccine, an additional dose is not yet recommended by the cdc. that could change because johnson & johnson is still looking at a dose. pfizer is now testing an oral drug for covid. the company will study a pill combination with a low dose of an hiv drug. the bill is designed to stop the virus from replicating by blocking a key enzyme. if you are planning a trip

to hong kong or a level three advisory due to a high level of covid. only a fully vaccinated person is advised to visit that area. hong kong at a level two indicating moderate levels. napa county is calling bottlerock a victory. 120,000 people jammed into the napa valley expo over the weekend. health leaders say the low number of cases shows the extra measures taken were successful. organizers say 90% of attendees showed proof of vaccination. and then an apartment building with affordable units

how long before kids can possibly roll up their sleeves? >> could be a few weeks, could be several weeks. good morning, laura and marcus. this morning pfizer biontech try to go clear its covid-19 vaccine use for children ages 5 to 11. this was data collected in a test trial of more than 2,000 children. the fda expect to take several weeks to analyze that data and pfizer biontech says it's going to request use for a emergency. the vaccine also caused similar side effects to those seen in adults, which included arm

soreness and fatigue. children face a lower risk of severe covid, but it's important they get vaxxed according to the american academy of pediatrics. more than a quarter of the age of 18. >> bob, thank you. california now leading the way when it comes to covid transmission and this is in a good way. the cdc's latest transition map, california is in the yellow hear and that's the moderate. connecticut in the east is in the orange, and it's the only state in the substantial tier. all other 48 states is in the high transmission category. and california at 2.6%, and this is down from a couple weeks ago. some contra costa business

testing results were so inaccurate he was told to use machines from other companies. today defense attorneys will get a chance to cross examine. and then a sheriff expected to be arraigned on making terror threats. he was attending a small party while off duty last thursday when they say he started to behave erratically, and he was accused of breaking items and assaulting attendees and made threats to return later and shoot others, and he was arrested. and then a pair tied the knot in september in alabama. they were thrilled with the wedding photos, the samples they got, anyway, and the photographer's car was broken into here in san francisco. the wedding photos from alabama

looking at the current air quality sensors, we are all green here meaning good air quality. that continues today. opening up the picture and showing you what is going on, we had the slight chance of rain late yesterday evening. still clouds across the bay area, and a lot of the rain chances winding down. as you are heading out in cupertino, our morning starts out in the mid-50s and a lot of sunshine today. nice warm-up at lunchtime. here, we're in the upper 60s in the south bay and only headed towards 74 this afternoon. 76 will be the high in livermore. we'll see 79 in antioch. in san francisco, reaching 74. we will be warming up and we'll talk more about that in a few minutes. mike, how is it looking for the morning commute? >> let's take a look and we don't usually see this look from san francisco, but here's a great view of the upper deck

getting into san francisco westbound. when i saw the flashing lights from an earlier disabled vehicle, but it may be off the span and that's a nice shot. here's an easy drive where the camera was. the incline shows a little slowing so here's the build here. that's not what is causing this slowdown here. i was concerned we saw slowing in concord. there's a disabled vehicle being moved from the lanes now in concord, and so that could slow you down because of potentially a traffic break. that's what i think happened in the last couple of minutes. there's an overnight crew on 680 blocking a couple lanes for maybe another three to four minutes there at the most. slowing for 101 starts to build in san jose. regular schedule here, still tracking this crash way up there. just a big commute spot starting to build but nothing mayor.

well, coming up. >> thank you. the mayor and city council members rallied in front of city hall, and they accused tobacco companies targeting children and say more children are vaping to stress with the pandemic. if the ordinance passes san jose will be in the largest city in the state to ban flavored tobacco products. the department wants to install a dozen new devices and leaders argue would help fight crime and track down stolen cars. others argue it would violate privacy. leaders held a virtual public hearing yesterday but did not make a final decision. later today the department of homeland security look to publish stronger rules to protect daca recipients. a move comes after a federal

judge in texas ruled the program illegal in july and halted acceptance of applications. the biden administration has appealed that ruling. facing tough questioning today. >> you say deservedly for. >> yeah, more specifically, marcus and laura, for what was revealed in a new book documenting the last few days of the trump administration. general mark milley appointed by donald trump as chairman of the joint chief of staffs is said to assure the chinese we had not lost control of our government. he assured them trump would not order an attack on china as a last-minute way of trying to stay in power. those are reasonable things to assure a nuclear armed enemy

might think we are attacked, but when milley went too far is he said he would warn china if he planned to attack. he will be asked about that. and then trying to figure out what went wrong in the early days in afghanistan. also in the capitol this morning, the republicans were able to block the extension of the debt ceiling and the budget resolution that would keep the government open. you might think the most important part is keeping the government open, and it's important but the government shutdown many times before and it's terrible and people don't get paid but we survived. far worst is the debt ceiling.

the government cannot pay the debt. the debt ceiling deals with existing debt, money we have already spent, not money we spend in the future. it's like a credit card bill, you don't crack down on spending by refusing what you already bought. democrats are trying to spend more in the future, and new programs in the budget resolution and the infrastructure bill. so many things on capitol hill to watch today. we will be tweeting about all of them. you can find me at twitter.

i'm @scottmcgrew. and then one question still hanging in the balance, will andrew wiggins stand his ground against covid vaccinations. that was the big topic following media day. san francisco health department rules would make it ineligible to play games at chase center, and he still believes what he is doing is right. >> my back is definitely against the wall, but i'm just going to keep fighting for what i believe. >> he has all the right information, and access to the right resources to ask all the questions he has on, you know, making that decision. >> we'll just see how everything plays out. we're hopeful that it all is resolved over the next couple of weeks. >> it is estimated wiggins would lose $350,000 per game.

the first pre-season game october 4th is in portland and the regular season game is october 14th against the clippers at staples center. we'll see what happens. and then shark fans, they last saw pro hockey in-person six months ago. kris sanchez joins us outside outside sap this morning. what do fans need to know before they go? >> reporter: the shark tank is a city-owned property and as such city rules apply and the city of san jose enacted a proof of vaccination requirement for all city venues. that means you will have to show proof of vaccination as you enter the sap center, and that could be a vaccination card, a

digital record, and negative covid test will only be accepted from people with documented people or religious exemptions, and this is for fans 12 and older. this is to make sure fans are not caught off guard, and fans looking for tickets on ticketmaster got the same notice to be ready to show proof of vaccination. this is the first game that fans got to attend in person back in april when the city dropped capacity limits and before the city's ordinance requiring proof of vaccination went into effect. there were about 520 fans in attendance. of course we know that we were feeling quite a surge of covid at that point. today is a pre-season game against the l.a. kings and we will have to wait and see whether or not fans choose the show up or not. by the way, all of the rules apply to any city-owned venue,

and that could be libraries or community centers having events with 50 people or more. >> a lot to keep in mind, and to keep the card handy. >> yeah. fans are going to be excited. you got to do what you got to do if you want to see the game. >> there you go. boy, it's 5:49 on your tuesday morning. nice to have cooler temperatures and hopefully clearing skies as well from the smoke that we have been seeing out there. >> looks pretty good for us today. remember yesterday when we took a look at the shot? probably not because we couldn't see anything. it's all clear. the actual clouds are up a lot higher and we are seeing clouds rolling by after the front moved through yesterday. this system kicking up high winds and making dangerous waves near the coastline. today there's a beach hazard statement in effect that continues until 11:00 this evening. never turn your back to the wave if you are going to be at the coastline today. we could see some of the really dangerous waves for today.

looking at our temperatures inland for the south bay, we're up to 74 degrees in san jose and 75 in morgan hill. for the east bay we're looking at some mid to upper 70s. it's still nice and breezy. we're leaving the air-conditioning off for ladle little while. temperatures in redwood city head toward 72, and daly city will be at 62. 67 in downtown san francisco. mill valley reaching 68 degrees. ukiah, we're looking at a high of 75. high pressure will be building and that's going to warm up the temperatures. the storm systems stay well to the north of us so no more chances of rain or cooler temperatures at least not for the weekend. then take a look at the extended forecast for san jose. going from the mid-70s to mid-80s. we will stay in the mid-80s throughout the weekend and into the start of next week, and then
