let's talk about current temperatures right now at 58 degrees. current temperatures as we head out the door, pretty comfortable in the 50s. upper 60s in los gatos and san jose at 58 degrees. we do have overall moderate to unhealthy air quality for sensitive group. it's going to be so hot outside, what ends up happening is a lot of that smoke can mix down and get trapped at that ozone pollution levels which is why the issue spare the air alert area, it basically means you should limit your outdoor sports, try not to drive everywhere, keeping our pollution down. we are talking about cooler temperatures and a rain chance, a full forecast in just a few minutes. kira. >> that's a tease indeed. rain and cooler temperatures, thank you, vianey, we'll see you soon. governor newsom says all

eligible kids in public, private and charter schools in california will need to get vaccinated to be in class. the mandate will work in two phases with the first students needing to get their vaccinations by january 2022, some parents are fighting this sweeping new rule. here is sergio quintana. >> reporter: governor newsom says everyone is exhausted by the pandemic. his new mandate requires all eligible kids to get vaccinated will help everyone get back to normal. >> i believe we need a first date in america to move forward with this mandate and requirement. i do not believe it will be the last day. >> reporter: the mandate will work in two phases beginning in january 2022. the fda has granted full approval of pfizer vaccines for people 16 and older, emergency use of approval for 12 to 15

years old. the next phase will depend on fda approval of the vaccine for kids 5 through 11 years old. for many parents pushing to reopen schools to in-person learning, this is welcome news. the state needs to reach out under vaccinated group in the black and latino communities. >> i would hope that this is parallel by an effort of health campaign. >> reporter: the governor's news mandate is not welcomed by everyone. some are already suing the state over the order. nicky ford says she's dialing a few first thing monday morning on behalf of her kids. >> i want to say that i fought for you. i fought for you to be able to be free and go to school without having to take a vaccine that you don't want to take. even if i lose, i am still going to fight. >> reporter: public health experts say requiring kids to get the covid-19 shot will help

for the pill. nearly 800 people took part in the trial, they all had covid 19 and were showing symptoms. some patients got the pill and some received the placebo. the drug is effective at cutting the risk of hospitalizations and deaths. if the drug gets fda approval, it will be the first oral medication. water is back on after a water main break shut off service for more than 24 hours in ammo. an eight-inch pipe burst at danville boulevard before 1:00 yesterday morning. water was restored to about 160 homes, schools and businesses within the last hour. the water main break ruptured the pavement. you can see gushing hundreds of thousands of gallons of water down the streets and into the near by san ramon creek.

customers we spoke with say they are willing to pay more to help cover the cost of repairs and replacement. >> the parking lot was just flowing and probably about an hour and a half ago. >> i feel we are fortunate and privileged to be able to bike out or drive out and buy water. so many people are suffering especially during this pandemic. >> the utility says it's working to replace hundred of pipes. a woman was saved. she was trapped in the antioch marina. she says he was out on an evening walk and fell asleep on a near by walk. when she woke up, she found high tides was coming in and she could not come back to shore. they used drone to find the

woman. fortunately she was not injured. a deadly shooting in the east bay. it happened just after hward nee japanese garden. police are releasing little information, we know one person is dead. the shooter remains on the loose. we'll continue to update this story on nbcbayarea.com. san jose is cracking down on sideshows. a judge is ordering promoters to stop organizing it on social media. the location is posted and within minutes, hundreds of people show up. san jose made side shows illegal in the summer. it's the first of isd kind civil suit from the city.

>> reporter: it's illegal to perform or be a spectator at a sideshow in san jose. violators could face up to a thousand dollars fine or six months in jail. police say they are dangerous and reckless. the city's attorneys are cracking down. for the first time filing a civil suit against two of the biggest alleged organizers, one under the instagram name sj boss and one is sj takeover who investigators say run by elijah moore. it had over 15,000 followers and shown drone shots over side show activities with caption that says "appreciate everyone who came out last night." >> it's happening in neighborhoods and nighttime and people are shooting guns during the side show activities.

>> we are trying new things and we are taking this to court. it's a new tool in our tool box. >> reporter: a santa clara county judge granted a preliminary injunction in the case prohibits the accused from posting or promoting sideshows at all. if the city wins, those defendants could have to pay tens of thousands of dollars in fines including money to pay for the police response to the events. >> bottom line is don't come to san jose to do your sideshows. ian cull, today in the bay. a live oracle park this morning. the giants are one game away from clinching the nl west. then after the game, they watched the l.a. dodgers rallied to beat the milwaukeebrewers. the giants can clinch the nl

welcome back, it's just shy at 7:13 on your saturday morning. our camera is pointing towards a hazy and foggy san francisco. we have a warm up and a possibility of some rain. a little something for everyone with our meteorologist vianey arana. this time on capitol hill this morning where roadblocks remained for two significant bills president biden wants to see on his desk. today the house will take up bills again in a rare saturday session at issue now is the massive infrastructure bill tied to president biden's far more ambitious social policies and climate change package. progressive democrats dug on a larger social spending plan.

the president says the infrastructure deal should wait until democrats deal with the social and climb change package first. despite deep divisions, democrats are committed to pass both bills soon. a dramatic increase of food stamp in assistance. monthly payments for food stamps family will rise on average. the increase is permanent. the agency says program participants who used to receive $121 will see a $36 rise in their monthly benefits. food stamps are known as the snap program run by the department of agriculture with 42.3 million people benefiting from it. now to attorneys for theranos' founder, elizabeth holmes. they wasted no time trying to

tear his testimony apart. during cross-examination, defense unveiled e-mails appears to show they were aware in 2014 that the lab had many issues but kept holmes in the dark. that's critical. happening today women nationwide will take to the street to march for reproductive rights. demonstrations will happen in every state and every city here in the bay area. this is in response to the new texas law restricting abortion access for many women. the march in san francisco is on grove and hine street. in san jose the rally will be at city hall. in martinez, it will be at

susana park. all of those marches begin at 11:00 a.m. now to hundreds of santa clara university students gathering to support sexual support survivors. students claim there has been more than two dozen sexual assaults in the past few weeks. most of them reportedly happening at parties near campus and some involving drugging the victims. >> people at parties have witnessed or caught men i know, one man was caught putting something in a girl's drink. >> organizers say the specific person was not a student at santa clara and has been blacklisted from future parties but never been charged. the university tells us in a statement in part, it has received two third party reports of incidents of possible drugging since september 19th. one report of sexual assault but

the victim decline to report it formally. none of the reports had enough information to produce charges. the university is urging anyone with more information to come forward. as bay area home prices continue to climb it means harder than ever to make it in the bay. the median price was $1.1 million. that's a 12% increase over august of last year. alameda county saw the biggest price jump. the median price there is $1.2 million, representing a 24% increase over the last year alone. santa clara county, $1.5 million median price is almost 18% higher. solano county looks like a bargain of $557,000. even that is 16% higher than last summer. a historic drought in california is having a

devastating impact on the state's reservoirs, they're at the lowest levels ever. it's so bad that regulators say water agencies may not get any water from the reservoirs next year. that could be mandatory water restrictions for residents across the state. this year unusually hot and dry conditions meant nearly 80% of the water and the state's reservoirs had evaporated or absorbed by the soils. on a much lighter note, "saturday night live" returns for its 47 seasons. "snl" was the number one entertainment last season and won eight awards. two of the veteran cast members, heidi gardner and ego nwodim

system. new this morning, a woman is safe. police received a call that a woman was trapped in the antioch marina, she says she was out for an evening walk and fell asleep by a near by rock. when she woke, she found high tides and she was not able to swim back to shore. antioch police used drones to find her. fortunately she was not injured. also, new this morning, a deadly shooting in the east bay, it happened on foothill boulevard between hazel avenue in hayward. that's near the japanese garden. the shooting happens just after 12:30. little information is being released except we do know one person is killed. the streets are back open and the shooter remains on the loose. we'll continue to follow this story and update it on our website.

. first, let's get to that air quality outlook. we are for the most part seeing moderate conditions from the forth bay from the coast to bay. when you look at the index numbers, notice in the east bay, unhealthy for unsensitive groups. so what tends to happen is during the warmer months, it traps a lot of that pollution at a lower level and that's a contribution to the spread the air alert. current situation right now before you head out the door, it's pretty warm. we got 60s on our map. we are seeing upper 60s right now in san jose or morgan hill.

we pretty much seeing these 90s the past couple of days and as far as the wind speeds, this tends to help with air quality. at least not right now anyway. it's going to stay pretty calm for the next couple of days. through sunday and monday, we'll see some changes ahead. let's get a look at your forecasted highs today. it looks good. we got temperatures in the 80s and 90s in the forecast. martinez at 91. concord at 93. san jose at 89 degrees. look at san jose and half-moon bay in the mid-70s today. talking about the shower chances. let's look ahead and see what our model runs and have in store for us. thursday and friday and next saturday, there is a possibility we'll see a disturbance and we'll get some shower activities and down to central california. as the system approaches, what's going to happen is it's going to cool us off. we are dealing with a major drought in the state of
