home when their car was hit by a stray bullet. >> chp investigators say this is the car six family members were riding in when it was hit by gunfire. a family member did tell me the child did struggle to survive but unfortunately died. the family shared several details about the child and what happened but did not want to speak on camera. they told me the toddler, the 23-year-old month jasper was in a car seat when his mother was driving at the time, and two other adults and children at the time were not injured. the family is already getting support from the local asian-american community. >> i imagine what the family is going through right

now, and what they have to deal with with years to come. >> the family is changed forever. we have not been able to protect our people in the city and in our state at all. >> chp investigators have not released any details on the possible shooter, and oakland police told the family it could be gang related. detectives do not believe the family was targeted. there's evidence the child may have been hit by a stray bullet. new overnight, another deadly shooting in the east bay. it happened just after 9:00 p.m. in the city of oakley. inside the garage, two other people suffering gunshot wounds. no word on the conditions of those two. police are investigating whether one of those people are loose.

now to san francisco, a string of violent crimes happened there. sfpd added foot patrols and has cars parked on each block. on thursday we reported two people were shot at the corner of haight and masonic, and one person died. turning now to a setback for president biden's vaccine mandate for large companies with more than 100 employees. a u.s. federal appeals court blocked the mandate for now, at least 27 states filed lawsuits against the new rule. the three-judge panel ruled in favor of the lawsuit saying there are constitutional issues with the vaccine mandate. it would have forced private companies with at least 100 employees to be vaccinated by january 4th or face weekly

testing. a legal battle is continue over the next few months. as the bay area moves forward with vaccinating young children, counties are coming up with creative ways for people to vaccinate their 5 to 11-year-olds. the atmosphere, you can see there. despite the nerves, there was excitement and relief. >> it means they are safer. we have elderly parents in our home, and we want to make sure that they stay safe as well. so this enables one more step so that our family, and other family members can't get sick.

>> if you are unable to find an appointment with your clinic, pharmacies are taking appointments beginning today. health leaders on the peninsula rolled out the red carpet literally to make kids feel at ease while getting their covid shot. the clinic with superhero themes. there were 300 appointments for yesterday and all booked up, and they have two more clinics coming up this week. in the east bay, berkeley took the clinic to the children. malcolm x was one of the locations where hundreds of kids lined up to get their dose. >> i am extremely relieved that the last person in our household is able to get vaccinated, and we have been waiting for this day for a while and we're glad

to see it. >> there still continues to be a lot to keep track of, where it comes to now kids and the vaccine. our twitter page is a good source of information. the fda has confirmed that visitors who have full doses of the six approved international vaccines from the world health organization will be allowed to enter the u.s., and that includes fully vaccinated travelers from the uk, and most of the eu, china and brazil and india will not enter the u.s.

without quarantining. san francisco is moving closer to a new housing project moving forward near google's planned downtown village. it's slated near dupont just off bird avenue. the project calls for the demolition of 64,000 square feet of existing industrial building on mcavoy in order to build the housing units. this is an artist rendering of what that project will look like when it's completed in three to four years. first community housing known for affordable housing development is building the apartment, and they will be in the shadow of google's planned downtown project, and furthering the plans to build more

affordable housing. >> overall there will be 13,500 new units. in google, in the google projects alone, there will be 4,000 units, and 1,000 of them will be affordable. that's in addition to the mcavoy affordable. >> we spoke to some people that live in the area, and they tell nbc bay area their concerns that the additional apartments will create new challenges. >> this is affordable housing and senior housing, and the city has eliminated so many street parking spaces that it has gotten really tight, and it's frustrating for visitors and residents here. that's just going to make it worse. >> we know that work is expected to begin sometime next year on november 16th, and that's a tuesday. there will be a community meeting at 6:30 that is called the mcavoy project. taking you to a look at

welcome back. it's time for our weekly discussion of chuck todd, nbc news director and moderator of "meet the press." always good to see you. i will not begin by asking about the kerfuffle and your beloved green bay packers.

but president biden has the build back better package to get done, and i know there's no crystal ball. what will happen before thanksgiving? that's the date nancy pelosi hopes will be the backstop. >> right. well, kira, perhaps the house may pass something that they will say is the build back better bill, that they say will have all these things in it and then it goes to the senate where they added a whole bunch of stuff that a week ago we were told would not be in it, like paid family leave, issues having to do with creating some protections for some undocumented folks that have been in the country over a decade. those things were added in order to get progressives onboard passing the bipartisan bill on friday. these were things that manchin or sinema, the two democratic senators have been a bit of a

stumbling block for progressives, they have not been in favor of. while they may pass a house version of what we described, i believe week weeks if not months away from what the final social bill will look like. >> and this is something we saw last week, and we saw election turnouts sway, and virginia, for example, and new jersey's governor hung on for a close race, and nearly a dozen house democrats won't run for re-election signaling mid-term fears. does that indicate that republicans will take over in 2022, or will it be close across the board? i know it's another crystal ball question. >> i can go back to just 1990

and the last 30 years, where there has been a divisive advantage for one party in the off year elections, and that party flipped at least one chamber in the mid-term. the question is, can the democrats buck this history. the question you have is in the second headline you gave to me, haley barbour, he was a former mississippi governor, and he said good gets better and bad gets worse was his saying, and all of a sudden the democrats had a bad night and veteran democrats think, i have seen this picture before and i am not going to run for re-election, and then it's an open seat and easier for the other party, and that's the thing the democrats have to prevent in the next three months. how does what happened on tuesday not create a death spiral. >> that's a great quote that i will keep in my back pocket.

crowd for some reason surged forward. many of the victims were in cardiac arrest when being squeezed so tightly. >> there was just too many people. at some point the barricades became a hindrance, and people could not get over, people were trapped. >> the tragedy is also an active criminal investigation. travis scott tweeted saying he's absolutely devastated by what happened and wants to help, of course, the victims' families. this morning a pandemic side affect that is causing mayhem across the country, not toilet paper, but another staple you may have taken for granted until now. nbc's kerry sanders explains. >> indoor cash registers are

mashed potatoes. alaska enjoys stuffed mushrooms. minnesota and missouri have a thing for shar cute re trays. let's turn to our girl, vianey arana, for a look at the microclimate forecast. >> yeah, it's going to be a nice day. you can head outdoors and enjoy the sunshine, because we have a storm on the way. we always enjoy the rain when it makes its way here because we need plenty of it. our temperatures could start out chilly in some spots. we have a couple low 40s. 40 degrees right now, and santa rosa, 41. we have got the 50s around the coastline. let's talk about what we have got brewing out in the pacific.

we have the next storm system making its impact tomorrow evening. of course, we also have our mobile doppler radar up and scanning, and today is going to be a beautiful day. temperatures comfortable and partly cloudy skies. low to mid-60s. down through the south bay, take a look. 63 degrees in hayward, and then a couple 60s around the coastline. let's get to the timing of the storm because i do want to show you the hour-by-hour outlook. it's going to be a late storm on monday, so again, this moves in late monday, and so here's the timing. ukiah, santa rosa, and napa, and you will be the first to get the rain. then you can start to see some of the heavier pockets really pick up around 7:00 or 8:00, and that's when you will see the yellow and red, especially up

through portions of the north bay. the concern will be how much rain falls and how quickly it does. even down to the south bay late monday night, we will see heavier pockets through there, and overnight into early monday morning, we keep the rain in the forecast. this could mean runoff and also storm impacts on our road. so turning windy in addition to that, keep in mind if you live in the north bay, you will seat rain first. you want to prepare for that initially. 20 or 30-mile-per-hour winds with 40 or 50 plus possible gusts heading into monday night and tuesday morning. as far as how much when it comes to the rain totals, the higher totals will be up through the north bay, and possibly two inches including areas along santa cruz and then a little less everywhere else. tahoe, a beautiful shot there of the snow. we'll be right back after this. stay with us.

take a look at the temperature trend. we will see a combination of sun and clouds. by 11:00, 12:00, we will be in the upper 50s. walnut creek, 42 degrees. temperature trend will be in the mid-60s. this is more monetary in what we are looking out for. we have rain, wind and more sierra snow on the way, so i will take you through the timing of that in just a few minutes. police in the east bay are searching for the people that shot on the freeway killing a baby boy. a family was just driving home when their car was hit by a stray bullet. >> chp investigators say this is the car six family members were riding in when it was hit by gunfire. the child was rushed here to the

good sunday morning. it's 7:41. i hope your day is off to a fantastic start. we are seeing beautiful conditions right now, and a live look inside san francisco. enjoy today's cloudy with a little sunshine conditions because we are going to get rain on the way. i'll get to that in a second. 44 degrees in san josé. 50 degrees in san francisco, and low 40s down through morgan hill. let's talk about what we have in coming as well as today's daytime highs. this is the next storm system brewing just off the coast and that's expected to impact us with rain and gusty winds headed into monday evening. we have our mobile doppler radar, and it's partly cloudy, a nice and cozy day. 64 degrees in palo alto. 65 in san josé. 64 in concord, and low 60s up through the north bay. if you live in the north bay,

you will be the first to see the rain head into monday, so let's take it through the timing of this so you are not caught off guard. if you are wondering about the time stamp, this will be your best option to see where you can pinpoint your location. the red and yellow, these are the heavier pockets of rain. around dinnertime, it will come down heavy. san francisco, half moon bay as well. and the santa cruz mountains also expect to get a good amount of rain as well. this is going to continue all the way into tuesday, so some of the impacts that we might see out of this is run off the road impacts as far as the wind, and it will be getting gusty, and so prepare your backyard and get everything that could potentially fly away inside, because as the cold front pushes

through, look at the wind gusts. 30 and 40-mile-per-hour winds expected, monday into tuesday. if you are wondering about rainfall totals, notice the santa cruz mountains to get an inch half to possibly over two inches, it will be a nice boost. also for the sierra, expect to see sierra snow if you have plans to travel. monday night into tuesday, the most dangerous day, potentially up to a foot of snow. after we get the monday and tuesday storm out of the way, we will get high pressure to roll back around and bring back the return of dry conditions as well as slightly warmer temperatures into the bay area. enjoy today's sunshine, rain and then sunshine again. >> love it. a little bit of everything. thank you so much. it's 7:44 coming up, nbc bay area political analyst larry

the u.s. navy christened the "uss harvey milk." did you know milk was forced to resign as a navy officer because he was gay? his nephew says the ship's naming shows that the military has come a long way since then. >> what we are celebrating today is that the navy not only recognizes but honors those. there's a difference between tolerance and celebration.

this navy ship sends an important message to the world. >> it's the second ship in the navy's new john lewis class of oilers. the ships will each be named after civil rights leaders and activists. president biden recently issued an executive order for covid vaccinations or weekly testing for companies with more than 100 employees. we just reported a few minutes ago that a u.s. federal appeals court has blocked that mandate for now. we turn to nbc bay area political analyst, larry gerston. can you outline who is suing and why? i assume i know why, but can you go over that for us, please?

>> yeah, the president just decided on the idea a couple weeks ago and it is already to the district court and now it's in the fifth circuit court. the opposition comes largely from southern and rural republican-led states. they have two basics of opposition. number one, if you have this kind of a rule it should come from congress and not the president. and the other idea is, quite frankly, federal government should not be involved in it at all, and there were two supreme court cases filed 100 years ago that states could do this, and never any discussions about whether or not the federal government could do this. >> what is the biden administration's defense, then, for pursuing the mandate? >> a come things here, kira. number one, we have osha, and

that was passed about 50 years ago, and the biden administration said this falls under their purview, as far as they are concerned. and the federal government has the job of protecting the general welfare, and you are trying to keep people from getting sick and perhaps dying. there you have it. you have convicting situations, both relying on court cases in the constitution. something has to give. >> i seem to be full of crystal ball questions for you and chuck todd, so how will this all get sorted out? >> the fifth district court of appeals is similar to the way u.s. supreme court thinks. this is a fast-track case. just consider how fast it has gone and how far it has gone in the past few weeks.

i suspect the supreme court will take it up sooner rather than later, and i was the biden administration i would not be too satisfied that the court would automatically go along. we will have to see how it turns out, but somebody is going to win, and of course, somebody is going to lose. >> and soon, and the deadline is january 4th, and that's coming up quickly. up neck, the bay area moving forward with vaccinating children 5 to 11. wanting to show off the great view of tahoe. we'll go over the headlines and the rest of the week coming up. stay with us.
