light on former president trump's efforts to overturn to 2020 election. the federal judge knocking down mr. trump's argument, effectively saying it's up to the current president, not the last one, to exercise executive privilege, meaning for now, those documents are set to be turned over this friday. overnight, a major set back for former president trump in a legal battle over examining his role in the january 6th insurrection mr. trump had been trying to avoid handing over 700 pages of documents to the committee investigating the riot late tuesday, a federal judge ruling against that request. the former president attempting to claim executive privilege, but the judge writes, president biden is not constitutionally obliged to honor his predecessor's executive privilege assertion. >> if somebody is hollering this hard and this loud, then i am to assume that, undoubtedly, you have something to hide >> reporter: it comes as the house committee is now focussing on 10 former officials, including senior advisers that the committee says had knowledge of mr. trump's actions leading up to and during the violent

capitol attack among the latest targets, steven miller who in the weeks after the election spread false information looking to invalidate joe biden's victory, remaining defiant. >> you're not going to be showing up to testify in this so-called select committee, right? >> first, i don't even have the documents, laura >> reporter: former press secretary kayleigh mcenany who was reportedly with president trump as he watched the capitol siege. also nick luna, one of mr. trump's personal assistants reportedly in the oval office the morning of the capitol attack when the president spoke by phone with vice president pence. mr. trump slammed the committee members as, quote, politically ambitious acts. one of two republicans serving on the committee, liz cheney, arguing the u.s. is confronting a domestic threat it's never faced before. >> a former president who is attempting to unravel the foundations of our constitutional republic aided by

political leaders who have made themselves willing hostages to this dangerous and irrational man. >> so back to these documents, peter, what type of information potentially could be included that would shed like on what congressional investigators are looking into? >> reporter: it's more than 700 pages of documents. they include handwritten notes and white house visitors and call logs as well as drafts of other speeches and other talking points about claims of election irregularities. immediately after last night's ruling, mr. trump's lawyers said they would appeal. we reached out to all ten officials and we did not hear back. the question on them now is will they comply. savannah. >> peter, thank you. now to the nation's ongoing supply chain crisis as the holidays creep closer and closer. the biden administration announcing new steps to get things moving again, both right

now and in the years to come. nbc's sam brock joins us now from the port of miami with details. sam, good morning. >> hoda, good morning. savannah, good morning. this is a problem that has been building up for years, so it is not going to be a quick fix. but the issues we have from harbors connecting to highways could be happening elsewhere, too. that's something we're expecting the president to play up. as our nation's ports slowly grind under the weight of supply chain challenges, the race is on to get things moving in time for the holidays. president biden calling a meeting at the white house tuesday with the ceos on walmart, u.p.s., fedex and target trying to improve. as supplies shrink, orders and packages continue to pile up in the ports for the holiday season. >> if i don't have a strong holiday season, you know, that can spell trouble. >> cam mitchell owns a toy store

in boston. she started stockpiling inventory back in july, but still has to compete with a slinging supply of goods with major corporations. >> they're making a choice between selling 24 to me or 2400 to somebody else. >> reporter: even as ports across the country do record volume, there's still a big bottleneck brought on by production strains, a shortage of warehouse workers and some 80,000 truck drivers. >> it's the worst i have ever seen. >> reporter: the biden administration announcing steps to fast track 17 billion ear marked reports in the infrastructure bill before it's even signed into law. some of the highlights include modernizing ports and marine highways and deepening harbors for larger cargo ships. the administration letting ports redirect grant money saved from other projects to supply chain issues. in savannah, georgia, that means converting five inland facilities into pop-up container

yards where cargo can be stored and loaded on to trucks. still, many of the fixes will take years. some of the worst congestion is in california. l.a.'s port director says staff producing at record levels will greatly benefit from fresh money for information sharing. >> being able to see further in this supply chain to understand how much cargo is coming, what staffing we need and equipment on the ground -- >> as for the 78 ships anchored off l.a.'s port, miami's mayor has a message. >> we are ready and open for business. >> reporter: some ports like miami's have available capacity. although these days, that appears to be the exception, not the rule. and president biden is expected to speak this afternoon at the port of baltimore promoting the bill. as for that backup in southern california, the mayor of miami dade says it would take about 5 to 7 days to get those ships across the country over here where they are sitting out at

sea in some cases for 60 days. >> sam brock, thanks. also this morning, the investigation into that deadly crowd surge at the astro world music festival is moving forward and we're learning now chilling new details about the chaos that unfolded. nbc's morgan chesky is on the story for us again in houston. hi, morgan, good morning. >> reporter: savannah, good morning. we're hearing about a communication breakdown between firefighters and concert organizers. houston's fire chief admitting there was no communication between the event between his department and festival organizers. and we're hearing one story after another from paramedics trying to save one life after another. >> being in this crowd is literally a life threat. that was apparent. >> reporter: this morning, a frightening new glimpse into the astro world tragedy. emt remington richardson detailing how he tried to save an unconscious girl caught in the crowd as a sea of other fans begged for help. >> i did my absolute damndest to provide the best care i could. >> reporter: the music so loud, he says, radio calls for a backup went unheard. the chief of the houston fire department admitting to cnn a

glaring lack of communication with concert organizers during the event. >> no, we didn't have -- on scene, we did not have direct communication with those organizers, no. >> reporter: concert organizers had two security plans in place, but did not respond to nbc's request for comment. the fire chief telling savannah rapper travis scott bears some responsibility. >> do you believe the performer, travis scott, should have called an end to the concert once he saw what was taking place in front of the stage? >> absolutely. look, we all have a responsibility -- >> reporter: now, five days later, some victims still fighting to stay alive, like 9-year-old ezra blunt who fell into the crowd when his dad passed out. >> he's now in a medically induced coma with severe brain damage, severe kidney damage, and severe liver damage fighting for his little life. >> reporter: darius williams

hired his event staff the day before the concert quit before the show began because he says he felt they were undertrained. >> i don't feel like safety was taken into consideration for the staff nor the attendees of the festival. >> reporter: but scott has had problems at his concerts before. at a 2017 concert in new york city, kyle green says he was pushed from a third floor balcony during scott's showing, leaving him partially paralyzed. green sued. in court papers, scott has denied the allegations. that lawsuit is still ongoing. this morning, sources close to travis scott tell nbc news that after performing on stage in astro world on friday, scott went to drake's after party at a dave and buster's and scott was unaware of the tragedy that happened at the stadium at the time. and right now, nbc news tracking more than 30 lawsuits that have already been filed against either scott or live nation, the festival organizer. there is a petition circulating asking that scott be removed from the popular coachella music festival in april. turning now to wisconsin where the prosecution has rested

its case at the murder trying of kyle rittenhouse, but not before showing the jury new high definition drone video from the deadly confrontation during last summer's social justice protests. gabe gutierrez is at the courthouse for us. gabe, good morning. >> reporter: good morning. the defense now taking center stage trying to convince the jury that rittenhouse only shot three people, killing two of them, because he was attacked first. this morning, the trial that is parked in intense debate over the second amendment and vigilanteism is entering day seven of testimony. the prosecution on tuesday playing new high definition drone video zoomed in and slowed down by a forensic imaging specialist shows joseph rosenbaum following kyle rittenhouse and rittenhouse shooting him at close range. it's unclear whether rosenbaum

was grabbing for rittenhouse's gun or trying to pull it away. this forensic pathologist testified the final two shots were at a downward angle. prosecutors says that means rosenbaum was falling forward, but the defense argues rosenbaum was lunging as he tried to attack. rittenhouse grimaced as graphic photos were shown in court. the now 18-year-old killed two men and wounded a third during a night of unrest following last year's police shooting of jacob blake in kenosha. prosecutors tried to present rittenhouse as someone looking for trouble. but at times, their own witnesses bolster his defense of self-defense. >> it wasn't until you pointed your gun at him, advanced on him, that your gun -- hands down pointed at him that he fired, right? >> correct. >> reporter: the defense calling its first witness a man who said he went to the demonstrations to

protect a car dealership. he says he saw rittenhouse shortly after the gunfire. >> he repeats i just shot someone. over and over. and i believe at some point he did say he had to shoot someone. >> reporter: the judge also just dismissed one of the seven charges against rittenhouse, a curfew violation. during opening statements, the defense indicated that the jury would hear from rittenhouse himself, but the timing of that testimony is still unclear, hoda. >> gabe gutierrez, thank you. 7:15, craig joins us. good morning. >> hey, savannah, hoda, good morning. good morning to you, as well. covid vaccine boosters shots for all u.s. adults could soon be on the way after a request for pfizer and with the vaccines now available to younger children, could those mask mandates for schools be coming to an end? miguel almaguer has more on that. miguel, good morning. >> craig, good morning. pfizer's new booster shots for adults 18 and older would widely expand the number of americans who would become eligible. while it's certainly not a guarantee, many experts believe it will get authorization, perhaps even before thanksgiving. a major step closer towards

making boosters available to all american adults, pfizer's submission for emergency use authorization will soon be reviewed by the fda. if approved, it would apply to those fully vaccinated with pfizer for at least six months. and if americans mix and match boosters, as is currently allowed, 156 million could soon be eligible. >> i think what the fda is going to look at is where is the compelling need to give this vaccine to everyone who is over 18 years of age and healthy? >> less than two months ago, the fda rejected pfizer's first request for boosters for all adults. only allowing them for seniors and other select groups. but many experts believe this time it may be approved. even as some question if the added dose is necessary. >> you are likely to benefit if you're over 50 years of age and have a medical condition that puts you in high risk of serious covid. for everybody else, i think you can feel confident that you are fully protected at two dozes. >> done. >> reporter: with children 5 to 11 helping raise daily

vaccination rates by 55%. >> the shot, it was just a little poke and then it was like it wasn't even there. >> reporter: this morning, more schools are making face masks optional on campus. including in pennsylvania where a statewide mask mandate will expire at the end of the year. >> i think it signals that covid or the worst of covid is perhaps in the rearview mirror or close to it. >> reporter: but the american academy of pediatrics says covid cases among kids remain extremely high, even as cases among adults plateau in some areas. >> children absolutely should be

wearing masks inside of classrooms. the numbers have not gotten low enough for us to start removing those layers of protection. >> meantime, miguel, there is a dispute over who should get credit for one of those covid vaccines. what's going on? >> reporter: that's right, moderna is fighting claims by the national institutes of health that some of its scientists were inventors of the key elements of the vaccine and deserve credit on the lucrative patent. moderna has acknowledged contributions from the agency, but argues it alone invented the shot. this has the potential impact to impact the federal government's authored on the production and distribution of the vaccine going forward and ultimately influence the effort to vaccinate other countries. hoda. >> thank you so much, miguel. let us turn to the weather, mr. roker. >> we've got a coast to coast front that's going to be affecting a lot of folks today.

out west, we have another atmospheric front coming in bringing active rate to the pacific northwest. but this front as it makes its way east, we have a risk of severe weather from oklahoma city to dallas and less of a risk, but still one stretching from central texas up to kansas city. we are watching this front pushing through, strong storms, a severe rest from kansas into northern texas. tomorrow, the cold winds change that rain to snow in the upper midwest. ahead of the system from detroit all the way down to roanoke, we're looking at a line of storms stretching down into georgia. by friday, that soaking rain moves into the northeast. last mild day for the northeast, as well, as cooler weather comes in. look for anywhere from 6 to 8 inches of snow in the upper plains. we're looking at heavy rain down into kansas city. here into the northeast from friday from bangor to just north of philadelphia. by the way, we have a tropical system that may be developing, invest area 96l, it would become audria if it does because then

let's take a look. temperatures have been very mild we are going to see a bit of a change right now, we have a strong bermuda high so unseasonably warmer temperatures for the eastern half of the country. chicago, 57. st. louis, 68 degrees. 12 degrees warmer than usual tomorrow, that warmth continues from chicago to rochester down to raleigh out to nashville. everybody 5 to 10 degrees above average. but we have a pattern flip-flop. jet stream drops down to the south. we have a canadian low so temperatures all of a sudden plunging minneapolis, you'll only be at 39 for friday. 48 in st. louis. 57 in louisville 55 in oklahoma city. 7 degrees below average. as we move to the east, by sunday, new york city, we're at 50, 55 raleigh, 41 in columbus. memphis will see temperatures in the low 50s. so it stays cool

national archives from turning over what are hundreds of internal white house records wanted by the white house committee investigating the january 6th capitol attack. mr. trump was attempting to claim executive privilege here, but in her order, the judge writes, presidents are not kings and the plaintiff is not president. effective will i saying it's up to the current president, joe biden, not the last one, to exercise executive privilege. the documents are now set to be turned over on friday. mr. trump's lawyers have said they will appeal. and the committee also subpoenaed ten more former trump aides, including steven miller and press secretary kayleigh mcenany. the question now, will they comply? savannah. >> peter alexander, thank you. moving now to an update on that mix-up at the california fertility clinic that resulted in two women unknowingly giving birth to each other's babies. one couple filed a lawsuit and a lawyer for the other couple says they will be filing one, as well. but this is raising new

questions about what people can do this keep this from happening. erin mclaughlin joins us with more. >> reporter: hoda, good morning. it's been more than 40 years since the first baby was born by in vitro fertilization and since then, it's become a booming industry helping many families have children. but as it continues to grow, so do concerns about whether there are new rules in place to keep mistakes from happening. a nightmare situation for two couples in california now prompting new questions about the fertility industry and in vitro fertilization. >> i was robbed of the ability to carry my own child. >> dafda and alexander say they missed out on a part of their daughter's life after she is a fertility clinic entered her embryo into another woman leading they have to give birth to each other's daughters and raise them for months. the cardinallis say a dna test confirmed the mix-up and revealed they were not related

to their baby girl. >> losing the birthed child that you know for the genetic child that you don't even know yet, it's a truly impossible nightmare that inflicted trauma. that will affect my family for the rest of our lives. >> reporter: the couples later legally switched babies. the clinic and the doctor involved have not responded to requests for comment. in vitro fertilization is a series of procedures in which eggs are fertilized by sperm in a lab before they are implanted in a woman's uterus. according to film data from the cdc, in 2019, more than 80,000 babies were born through ivf or other assisted reproductive technologies. mix-ups like what happened to the cardinallis are rare. but in 2019, ani and oso said a mix up at a different california fertility clinic led to their embryo being implanted in a new york woman. they were not able to meet their baby boy until he was 6 weeks
