his failure to testify about the january 6th capital. and another case, britney spears on friday a judge ending her conservatorship. plus the judge in the kyle rittenhouse trial set to rule today on lesser charges. let's begin with the charges against steve bannon. monica alba is at the white house for us. good morning. >> reporter: good morning, a law enforcement official tells nbc news mr. bannon is expected to turn himself in on monday to face the criminal contempt charges and will appear in court that afternoon. all stemming from his refusal to cooperate with the house committee investigating the january 6th attack on the capitol. this morning, former trump adviser steve bannon under indictment by a federal grand jury. charged with two counts of

contempt of congress for failing to come buy with a subpoena issued by the january 6th investigators. after bannon refused to testify before the panel or turnover requested documents about his role in the leadup to the riot. lawmakers want to question him about comments made the day before. >> all hell is going to break loose tomorrow. >> reporter: this is the first time they have issued this kind of indictment. attorney general garland saying they want to show the american people by word and deed that the department of justice is running by clear rule and law. and the chairman saying they want to make it clear to anyone trying to stone wall the investigation no one is above the law. >> we're not only interested in asking him questions, we're

asking about documents. the documents don't lie. >> reporter: the news coming hours after mark meadows refused to appear for a deposition on capitol hill. prompting the commission to consider pursuing contempt to enforce that subpoena. former president trump has directed his past aides not to cooperate. citing executive privilege though insiders like bannon were private citizens at the time of the attack. all that as the appeals courts weighs whether the library of congress should turn documents over to congress later this morning. if convicted mr. bannon could face a year behind bars and a fine of up to $100,000. the committee has subpoenaed 16 former trump white house officials for testimony, documents or both, with more expected to come. >> the drama surrounding that continues. i know you're tracking another headline overnight.

president biden dealt a blow on his plan for vaccine mandates for employees at private businesses. what's the latest? >> reporter: a federal appeals court kept its temporary block in place for a mandate for all businesses with over 100 employees to get vaccines or submit to weekly testing. that rule has been on hold while it faces legal battles. the biden administration maintains it will be able to defend it in court. it's one of a set of challenges ahead of the president, on monday he signs the infrastructure bill into law, surrounded by democrats and republicans who were instrumental in its passage. kicking off major upgrades to roads, bridges, airports and water systems nationwide. but debate continues on his larger climate and social spending plan. soaring inflation remains a top concern for the administration as a record number of americans quit their jobs in september.

for an immediate end to the conservatorship. there were a series of documents accusing him of mismanaging her money. >> britney could not have someone in the privacy of her house without those three people knowing. >> reporter: jamie's legal team did not comment on friday's hearing, but said he didn't do any wrong doing. whether the singer's attorney pursues an investigation is now entirely up to britney. >> britney, as of today is a free woman. and she's an independent woman. >> reporter: and you heard matthew rosengard there talking about britney's support system. we're told the accountant is staying on in an administrative role to help transfer britney's assets to a trust. her personal fairs her former co-conservator said she's happy it's over and is willing to help in any way possible.

>> the start of an era for one of the world's biggest pop stars. we want to go to wisconsin where tensions are high with hundreds of national guard troops on stand by ready to assist local police as the city prepares for the conclusion of the kyle rittenhouse trial. nbc's alisyn barber is there with more on all of this. good morning. >> reporter: good morning, kristen. the governor has activated national guard members to come to kenosha should they need help after the jury finishes deliberation. there have been over 30 witnesses testifying at the trial but at times it was the judge who stood out. this morning national guard troops are on stand by, court is in recess and the jury set to decide kyle rittenhouse's face will likely face lesser charges.

he faces five felony charges plus a misdemeanor weapons charge. if allowed the jury could consider lesser charges in some instances like reckless instead of intentional homicide. >> by having a lesser included offense included you're raising the risk of conviction although -- >> reporter: closing arguments are set to begin monday but as the case comes to an end it's the judge many are talking about. the longest serving active circuit judge in wisconsin raising eyebrows with his comments. on thursday he asked the courtroom to applaud a witness who was also a veteran. at another point he commented on lunch. >> i hope the asian food isn't coming, it isn't on one of those boats. >> reporter: the president of

asian-americans advancing judgment called it inappropriate. during a trial that has clear racial under tones it is inappropriate. the judge has repeatedly clashed with the lead prosecutor. >> is there something i'm saying that draws the face you're making? say what you have to say. >> i have to say, your honor, yesterday i was the target of your ire for disregarding your orders. today the defense is disregarding your order. >> reporter: all of it capping off a week of explosive testimony. on monday each side has two and a half hours to make their closing arguments. so we expect the jury to deliberate on this case -- begin deliberations very early next week. as for the lesser charges the judge said he will make his final decision sometime today. kristen, peter. >> ellison, thank you. negotiators at the climate

conference in scotland are working over time as talks wrap up, trying to reach an agreement to accelerate efforts to tackle climate change that's already impacting all parts of the planet. matt bradley is following the latest developments this morning from london. good morning. >> reporter: good morning. there is some reason for pessimism, these talks are going into something like double over time if you will. there was a draft agreement distributed just this morning, and it contains some important language but words that our ears would probably sound pretty mild. but if this latest draft passes, it would be the first time an international climate change agreement included a direct reference to fossil fuels, which are the root cause of climate change. it's a climate emergency. but for many activists talks here in glasgow haven't gone far enough to avoid ka tas row fee.

>> after weeks of negotiations the haggle has gone into over time. the sticking points, fazing out coal and fossil fuel sub diddys, helping workers who will lose jobs and helping poorer countries. there have been key agreements like the u.s. and china agreeing to work together. 100 countries working to end deforestation. but there were also big disappointments. >> it was particularly discouraging to see the leaders of two of the world's largest emitters, china and russia, decline to even attend the proceedings. >> reporter: india, the world's largest emitter said it would cut emissions by 2070, 20 years later than the deadline

who took the little boy last night. police thought yuego headed to san jose, we are waiting to see whether he's in police custody. the city approved sending a 200 foot support pile down into bedrock as soon as monday. you may recall the fix was halted in august when engineers discovered it was making the building sink faster. the high-rise is leaning 2 feet to the west towards fremont street. weekly data released shows the building sank another inch last week after drilling resumed. experts tell us it's close to the rate of settlement which prompted the work back in

brendon hunt who plays coach in the soccer themed show there. also former las vegas raiders coach jon gruden is now suing the nfl. gruden claims the league selectively leaked emails he sent in an effort to force him out of his job. sam brock is following this story for us that has certainly caused a lot of controversy. sam, good morning. >> reporter: no doubt it has, peter. good morning. all of these emails you're talking about come from an investigation into the washington football team of alleged misconduct that had nothing to do with gruden. legal experts say he faces an uphill battle having to prove not only the nfl leaked the emails but did so specifically with the intent of costing him his job. this morning jon gruden going on offense against the nfl.

just weeks after revelations leaked that gruden used racial and homophobic slurs throughout the course of his career. now he filed a lawsuit claiming through a malicious and orchestrated campaign the nfl and commissioner roger goodell sought to destroy the career and reputation of jon gruden. though legal experts say proving that claim won't be easy. >> even if jon gruden establishes that the nfl or commissioner did leak the emails. he may have to do they did so with the purpose of interfering with gruden's contract. >> they have to address the skill position. >> reporter: an espn commentator from 2009 to 2017 he returned several years ago to coach the raiders, inking a ten year, $100 million contract. now he's seeking damages and awards. his attorney noting, there is no

explanation or justification for why gruden's emails were the only ones made public out of the 650,000 emails collected in the nfl's investigation. the league responding. the allegations are entirely meritless and the nfl will defend against these claims. but any discovery of those 100s of thousands of documents could make public the documents the email has refused to release. >> the nfl has information they did not want to get out. if that's the case, you might see the nfl run, not walk, to reach some kind of settlement or negotiation with gruden. >> reporter: and, guys, the nfl to this day has not released a report yet on its finding of the investigation into the washington football team. as for jon gruden, he can fight to not allow this to be confidential but if that were to happen, the league would have to petition the court to keep the
