asking about documents. the documents don't lie. >> reporter: the news coming hours after mark meadows refused to appear for a deposition on capitol hill. prompting the commission to consider pursuing contempt to enforce that subpoena. former president trump has directed his past aides not to cooperate. citing executive privilege though insiders like bannon were private citizens at the time of the attack. all that as the appeals courts weighs whether the library of congress should turn documents over to congress later this morning. if convicted mr. bannon could face a year behind bars and a fine of up to $100,000. the committee has subpoenaed 16 former trump white house officials for testimony, documents or both, with more expected to come. >> the drama surrounding that continues. i know you're tracking another headline overnight.

president biden dealt a blow on his plan for vaccine mandates for employees at private businesses. what's the latest? >> reporter: a federal appeals court kept its temporary block in place for a mandate for all businesses with over 100 employees to get vaccines or submit to weekly testing. that rule has been on hold while it faces legal battles. the biden administration maintains it will be able to defend it in court. it's one of a set of challenges ahead of the president, on monday he signs the infrastructure bill into law, surrounded by democrats and republicans who were instrumental in its passage. kicking off major upgrades to roads, bridges, airports and water systems nationwide. but debate continues on his larger climate and social spending plan. soaring inflation remains a top concern for the administration as a record number of americans quit their jobs in september.

asian-americans advancing judgment called it inappropriate. during a trial that has clear racial under tones it is inappropriate. the judge has repeatedly clashed with the lead prosecutor. >> is there something i'm saying that draws the face you're making? say what you have to say. >> i have to say, your honor, yesterday i was the target of your ire for disregarding your orders. today the defense is disregarding your order. >> reporter: all of it capping off a week of explosive testimony. on monday each side has two and a half hours to make their closing arguments. so we expect the jury to deliberate on this case -- begin deliberations very early next week. as for the lesser charges the judge said he will make his final decision sometime today. kristen, peter. >> ellison, thank you. negotiators at the climate

just weeks after revelations leaked that gruden used racial and homophobic slurs throughout the course of his career. now he filed a lawsuit claiming through a malicious and orchestrated campaign the nfl and commissioner roger goodell sought to destroy the career and reputation of jon gruden. though legal experts say proving that claim won't be easy. >> even if jon gruden establishes that the nfl or commissioner did leak the emails. he may have to do they did so with the purpose of interfering with gruden's contract. >> they have to address the skill position. >> reporter: an espn commentator from 2009 to 2017 he returned several years ago to coach the raiders, inking a ten year, $100 million contract. now he's seeking damages and awards. his attorney noting, there is no

explanation or justification for why gruden's emails were the only ones made public out of the 650,000 emails collected in the nfl's investigation. the league responding. the allegations are entirely meritless and the nfl will defend against these claims. but any discovery of those 100s of thousands of documents could make public the documents the email has refused to release. >> the nfl has information they did not want to get out. if that's the case, you might see the nfl run, not walk, to reach some kind of settlement or negotiation with gruden. >> reporter: and, guys, the nfl to this day has not released a report yet on its finding of the investigation into the washington football team. as for jon gruden, he can fight to not allow this to be confidential but if that were to happen, the league would have to petition the court to keep the
