be off duty and paid over time by the businesses and not the city, and that meeting is scheduled to begin at 2:00 p.m. we are expected to learn more about the case involving one of the suspects involved in the union square smash and grab. take a look at the video. what one of the nine arrested is facing in hearing today at 9:00 this morning. we will, of course, bring you the outcome of the hearing on air and online. we caught up with mayor breed in

the castro. >> my hope is these people are held accountable and others see it as a lesson. in the meantime, we have officers that are downtown. >> yeah, today is a very busy day, not only in regards to the individual involved with the smash and grab. we will, of course, keep you updated on both fronts. we are live in san francisco, cierra johnson for "today in the bay." >> thank you. happening today, two of the three suspects arrested in the massive flash robbery at the nordstrom's in walnut creek are set to appear in court for arraignment. this follows yesterday's arraignment in the third suspect, and rodney robinson stole $2,000 worth of merchandise and has entered a plea of not guilty.

the omicron variant has been detected in 15 nations, and today in the bay's alice barr live in washington. >> president biden on thursday is going to layout a detailed plan for what exactly that will look like because we are bracing for omicron, but we are already seeing cases rising in many areas because of the delta variant we are still dealing with. and many experts believe it's a matter of time before we start seeing cases of the omicron in the u.s. president biden said travel restrictions put in place yesterday will slow the variant but not stop it. >> the omicron variant, there

are questions about how contagious and dangerous it will be. for now the u.s. is not headed for another widespread lockdown. >> we have more tools today to fight the variant than we have ever had before. >> president biden stressing new travel restrictions for eight south african countries, pressing americans to use this window to get vaccinated and boosted. >> this variant is a cause for concern, not a cause for panic. >> the cdc now strengthening its recommendation to say all adults should get a booster shot, and this morning word of pfizer will seek authorization to boost 16 to 17-year-olds. >> get your booster, get it tomorrow, and get your system revved up because omicron is probably coming here.

>> we have to go as quickly as we can and get good and solid data to base this decision on. >> president biden promising a detailed plan later this week on how the u.s. will fight off the winter surge. new details this morning, a federal judge blocking the white house from enforcing a covid vaccine mandate on thousands of health care workers in ten states. also, the agency cannot have authority to issue the vaccine mandate without congressional approval. developing now, a warning for seniors in the bay area. police say criminals recently targeted older women in four east bay cities that were walking alone.

those thieves were able to steal thousands of dollars of jewelry. one of the victims was 95-year-old francis roberts. she went on a walk on thanksgiving day, when a car pulled up and a man in woman in front and two children in the back, and the woman put a necklace over roberts' head as a distraction. this is while stealing her $2,500 ring and beloved necklace passed down from her mother. >> because we had a pack that she would wear that chain until she died, and that i would wear it until i died. it was our way with keeping up with each other. >> so sad. >> over the past few days, similar crimes have occurred in berkeley, pleasanton and twice in san ramon. cities are required to update the worst-case scenario policies for five years.

today's hearing is scheduled for four p.m. it is 5:06 right now. a live look -- look at that. that's downtown san josé. the tree just sparkling bright this morning. let's get a look at the forecast for you this morning. >> we are talking about the water season update, and we have been lacking for the month of november, and it's half an inch of rain lower than for the month of november. the surplus continued to shrink with all of the dry weather. we are starting out with dense fog in that area, and elsewhere it's mainly clear except for the coast. it will be another nice day with sunshine looking hazy during the middle of the afternoon. these temperatures in the low 60s and 70s will be very enjoyable for all of the outdoor

activities, including all of the tree lightings and festivals we have going on around the bay area. traffic wise it's looking great. the view is having a problem. looks like folks are erasing the bridge, but it's not, these are the low clouds. same thing for our speed sensors. up in santa rosa, that's where things are consistently in the low visibility, about half a mile as kari was showing up there. contra costa looks great, and things will slow down in the next 20 minutes. even out of the altamont pass. back to you. >> thank you so much. one crime costing people thousands of dollars is becoming more common in the bay area. the steps you can take to

good tuesday morning. the time is 5:12. right now temperatures are in the mid-40s and visibility is clear and no fog. we will see a lot of sunshine today. another nice day with temperatures warming up into the upper 60s and low 70s. we'll talk about what is ahead for the rest of the workweek coming up in a few minutes. right now folks getting to work, and here's a look at 880 and all the headlights headed to the south bay. some folks are heading on 280 or 680. we have an incident in oakland.

looks like something we will check out on 580, coming up. and omicron is the word of the week on wall street. interesting trivia for you. we can talk about the futures -- let's talk about the futures. this is where the stock market seems to be going with the dow industrials maybe getting a 370-point hair cut right off the top. they are desperately worried about omicron. some other things going on this morning. we need to hear what the tests say about omicron, but it looks worrisome. jay powell briefing the senate on inflation. top economists and leaders like powell say the inflation thing is temporary. if we can get the supply chain back up and running products will flood into stores and prices will go down.

oil prices are falling because of the worries about the variant. shares in twitter fell slightly after the founder, jack dorsey, said he would step down as ceo. dorsey is still ceo over the company he founded, square, the other company. these negative numbers on the stock don't tell the tale. tim cook, a long time apple executive took over after the death of apple founder, steve jobs, and turned apple into the world's most valuable company. jeff bezos stepped away from leaving amazon after 27 years and amazon is doing fine. microsoft, really the best example of what a nonfounder can do. the growth of microsoft as been incredible from being a has-been to returning it to a global tech power.

our north bay temperatures reaching 69 in novato and in napa today. we do have this very nice weather that continues, and once again for christmas in the park, i don't know if it gets better than this. we will be in the mid-60s around sunset, and in the upper 50s at around 7:00, it will be a nice and clear crisp evening. we have seen so much rain moving across the pacific northwest, and this is what we are missing out on. all of the rain and flooding that has been up and around washington and oregon in the past few days, so what is happening is the atmospheric river is being blocked by high pressure and keeping the rain far to the north and this is the rain we would be getting in on if the high pressure would move out of the way. as we go into the next week or so we are looking at dry conditions. we are in the low 70s for inland valleys. take a look at the weekend, just

slightly cooler. maybe that high pressure will move out of the way for early next week. it will be slightly cooler and we are watching rain that will be moving closer to the coast. for san francisco, more mid to upper 60s and dry weather for at least the next week. mike, you have a new incident in oakland? >> yeah, we have northbound of the nimitz, and southbound heading into hayward. 580 is where we are looking at the incident, just around harrison. no fire crews on the freeway just yet, and they may have to attack it from that side of the fencing. we saw no slowing in either direction. the maze moved smoothly, and so does the approach into the maze. highway 37 starting to show a few blips around this area, and fog in the north bay and through half moon bay, highway 1 will be

thieves seem to be stealing cat -- catalytic converters. >> chris chmura shows how more. >> marking your catalytic converter doesn't guarantee to stop the thief, but hopes it will make them think twice. marking your converter might help police trace it back to you

if it gets stolen. that could save you serious money. replacing one could cost you thousands. detectives recommend your vin. next, how do you put your vin on a piece of metal so it stays there? we found companies selling customized heat resistant labels, and the vin stays behind in little dots. you can etch your vin and that's what we tried to do with the $25 engraver, and a couple notes we have taken about safety with a few precautions. the exhaust area can get hot so we did it while it's cool, and i will wear the stylish but functional safety glasses. we did a practice run.

another really nice day. a repeat in the weather pattern with temperatures reaching in the upper 60s and low 70s later today. we'll see if there are any changes down the line. that's coming up in the forecast. >> thank you. oakland's police chief will respond to city leaders calling for a crackdown on crime. >> bob, mayor libby schaaf is pushing for more police officers to be hired as soon as possible. >> you will recall in june the city council voted to take $18 million allotted for the opd and they now want that money back for opd so that department can hire more officers as soon as possible to combat the recent spike in murders and other violent crimes. later this morning at 11:00,

opd's police chief, armstrong, he will talk to the media to address the recent murders and the deployment of tactical units on the streets of oakland. this comes after the death of a man near lake merritt that was killed while trying to stop somebody from breaking into cars. the victim was eric davis. before he came to the bay area he was heavily involved in church, and he taught bible study and coached basketball, and he his mother and aunt are pleading for answers. >> he was our heart. he cared about everybody and tried to protect everybody. >> he would take up for whoever could not take up for themselves. >> crime stoppers is offering a $10,000 reward for information leading to an arrest in the murder of eric davis.

reporting live for "today in the bay." >> also we hear at nbc bay area and as well as bay area other stations are heartbroken over the death of a security guard. he worked for police departments in hayward and san josé before becoming a guard. a trust fund has been created at oakland's metropolitan bank. 100% of the funds will be given to his wife. the reward has grown to more than $32,000 for information leading to his death. this is the look at what police believe was the getaway car, a

accra. we are hovering around the 2% mark for the past two weeks in the positivity rate. in august we saw 8,600 cases, and this was largely due to the delta variant. it dropped to 5,200 in september, and right now there are 3,400 patients hospitalized, including everybody over 5 years old. 76% of the state is now partially vaccinated. sources tell nbc news that pfizer is pushing booster shots. right now only those 18 and older are eligible for an additional dose and the cdc is now adding summer skwrupb see when it comes to the boosters when it comes to anybody over

the age of 18. the guidelines about timing still apply. six months since the full vaccination for pfizer or moderna, and two months for the johnson & johnson vaccination. the next step in a controversial legal battle playing out in san francisco over a police shooting nearly five years ago. it followed a response for a domestic call. medical examiners determined his death was tied to internal injuries. boudin has charged the officer who is appearing in court today. switching gears. it's 5:35.

today could be another bombshell day in the fraud trial of holmes. she shared emotional testimony about being raped at stanford and abuse by her former boyfriend that was the operating chief at theranos. kris sanchez is live. this is certainly emotional. >> reporter: those revelations about elizabeth holmes were deeply personal, laura, and today we will get a better idea of how the allegations of rape and abuse fit in with the allegations of fraud and the charges she's facing here at court. she claimed she was raped and that was the reason she dropped out of stanford. she testified on starting her own company was the way she coped with that trauma, and her

former relationship was verbally abusive and he controlled her sleep and diet and told her that she needed to work harder and she was mediocre. holmes told the jury that she was responsible for what went wrong at theranos but she was under immense pressure from bell juany. >> it's compelling testimony. she said he was abusive and telling her how to live her life, and was forcing -- she did talk about that she was forced to have sex with him. >> he goes to trial on the same charges next year. he has previously called holmes' abuse accusations untrue. holmes will take the stand again, and it's one thing to be questioned by your own attorney and today she could face cross-examination that could be a little more heated.

visibility is clear in palo alto as we look at 101, and even as you head up further to the north, we have seen patchy and dense fog rolling across the highways. eventually reaching 70 degrees there. another really pleasant afternoon with comfortable temperatures, just a little hazy for the middle of the day. mike, you were saying that the bay bridge metering lights were on a little early for today. >> that's right, kari. i don't think it's because of the volume of traffic. look at the volume, folks. here, i think that's why the metering lights were activated at 5:30 because of low visibility. just on the oakland side. you can see slowing here approaching the toll plaza and over here at the metering lights. the clouds are clear once you hit treasure island and get into san francisco.

it has grown considerably over the last five minutes. look at the view as you look from the emeryville camera. can't see the deck because of the fog. the low clouds swallowed up the eastern span. we will show you your approach for that early backup at the toll plaza out of oakland. one of the most infamous inmates in san quinton no longer there. peterson, convicted of killing his wife, lacey, and unborn sun in 1984. the trial judge was said to explode potential jurors to the death penalty. peterson is fighting his conviction saying a juror was untruthful when filling out the questionnaire. a woman was arrested on the tarmac at l.a.x. the woman exited the terminal and tried to flag down an

aircraft parked at the gate. authorities say she's now being held for psychiatric evaluation. 5:44. another setback for the white house. another court has struck down another vaccine mandate. >> scott mcgrew in this case, it's a demand that health care workers be vaccinated. >> it applies to health care facilities that receive federal money, which is basically any health care facility. the judge's top consideration was not whether vaccines are bad or good, they are good. instead, he was concerned about making a nurse to get a vaccine who would lose their job would cause worker shortages that could be dangerous.

sooner or later we will see cases of the new variant here in the united states. we will have to face this new threat just as we have faced those that have come before it. >> the president met with officials from large stores to talk about the supply chain. we do expect the president to speak about the supply chain tomorrow. senate leader, chuck schumer, says this -- >> i will bring the build back legislation to the floor so we can pass it as soon as possible and send it to the president's desk. our goal continues to be to get this done before christmas. we get a lot of key economic data today including consumer

was more scaled down. it was the first major let's get started as you are heading out for work this morning, and we are starting out with temperatures in the low 40s in some spots. take a look at dublin. 42 degrees. that's the coolest temperature i have on the map here. it's 43 in morgan hill and 45 in san josé. we have mid-40s for much of the north bay. after the chilly and in some spots foggy start, we will see sunshine all across the bay area as our temperatures head for the

low 70s in the south bay. east bay also in the upper 60s and low 70s, and reaching 72 in danville and hayward up to about 68 degrees, and 68 in redwood city and san mateo. the marina district, 61 today. it will be in the upper 60s and low 70s for the north bay. so a really nice afternoon leading into a great evening if you will be in union square for the third lighting of the candle of the menorah. we will see the temperatures in the low 60s. cooling down into the upper 50s for tonight. it looks to stay clear. where it's not clear, take a look at seattle or portland. they are seeing another atmospheric river rolling in, and it has been one of the wettest falls on record or may be the wettest fall on record with another storm system headed that way. we can see the long line of clouds extending in, so it's going to be raining for quite a while. we are going to miss out on the rain once again because it's

high pressure has been stubborn. it is steering all of the storms further to the north and so that's what we have seen recently. as we look back at the month of november in san francisco, we measured about an inch and a quarter of rain, but that's well below normal after that great start to the water year in october. we are seeing our surplus continue to shrink. in san josé, we only measured 0.1 of an inch in month. we are seeing the surplus go down. we are starting into december, one of the wettest months of the year and it's going to be dry, very dry to start. our temperatures in the low 70s and that continues into next week, and we may see a few more clouds moving in on monday. mike, you are seeing the fog impacting the drive. >> yeah, at the bay bridge toll plaza, at least. they turned the metering lights on because the volume was really

manageable. we have add 20 we have had the metering lights on for 20 minutes. by the time you hit treasure island, actually, just shy of treasure island, everything clears up. heading into san francisco, you will hit the low visibility. keep that in mind if you are heading over towards the oakland area. a smooth drive through contra costa county, a light and gentle build here for highway 4 north of the delta, and now creeping down toward antioch. highway 37 moving smoothly. a gentle slowing but there's a crash in vallejo on 29 and should not affect the folks heading over to mare island. daly city, pacifica, and half
