explaining why the proposal stands. cierra? >> reporter: yeah, good morning. that proposal right now will be voted on by the members of that board. if approved it would add sheriff deputies off duty to protect the businesses, in turn protecting shoppers and the general public. this is what it means for the folks here in the city of san francisco. the legislation was introduced at the end of september and a vote is expected today. the deputies would be off duty and paid overtime by the businesses and not the city and they would be armed and wear their standard uniforms. that meeting is going to continue at 2:00 this afternoon. and we are learning more about one suspect union square smash and grabs.

it's hard to forget the swarms of people running and stealing from the high-end storms, and one of the nine arrested is facing a judge today. callaway is scheduled for a hearing at 9:00 a.m. this morning and we will be sure to bring you the outcome of the hearing on air as well as online. despite proposals for deputies to serve as security in light of recent thefts, mayor london breed said the city is still safe. we caught up with her with the tree lighting ceremony in castro, and this is what she had to say. >> my hope is that these people are held accountable. >> reporter: today is a very big day, not only in terms of the legislation. we will know whether it passes later this afternoon, and also in regards to the fate of the individual, we will bring you what comes out of that hearing

both on air and online. >> thank you, cierra. on the heels of that happening today, two or three suspects arrested in walnut creek are set to appear in court for arraignment. this follows yesterday's court appearance by a third suspect. in that case, prosecutors alleged rodney stole $2,000 worth of merchandise. those charged include robby and violent threats against nordstrom workers. now the omicron variant has been detected in 15 nations, and the latest case reported overnight in japan. alice, the president promised stepping up efforts this winter. >> yes, good morning, marcus. we are expected to hear more

about the details on thursday. that's when president biden says he will layout the battle plan to wart off a winter surge omicron in mind and delta. cases of omicron was detected in japan and in canada, and the president said the travel restrictions he put in place yesterday will slow the variant here in this country but that alone won't stop it. as the concerning new omicron covid variant spreads in countries across the world, scientists are racing to answer critical questions about just how contagious and dangerous it will be. one question appears answered. for now the u.s. is not headed for another widespread lockdown. >> we have more tools today to fight the variant than we ever have before. >> president biden stressing new travel restrictions buy us time,

6:05. moderna ceo proving existing vaccines will be much less effective at tackling the omicron variant compared to other strains. it could take months before pharmaceutical companies could manufacture a new variant-specific jab at scale. developing for you this morning, this is a warning for seniors here in the bay area. criminals have recently targeted older women, at least four east bay cities all of them walking along and then they lost thousands of dollars in jewelry. one of those victims, 95-year-old francis roberts said she was walking in berkeley on thanksgiving day when a car pulled up with a man and woman in the front seat and two children in the back. the woman got out of the car and put her necklace around her head as a distraction and stole her

$2,500 ring and her necklace passed down by her mother. >> we had a pact that she would wear the chain until she died and then i would wear it when i died, and that was our way of keeping up with each other. >> over the past few days, similar crimes have occurred in berkeley, brentwood and twice in san ramon. and then public feedback on the water contingency plan in water shortage pz that. in june, customers were asked to cut water usage by 20% because of the current drought. downtown san josé this morning, the tree is sparkling bright for us this morning as we get ready for this tuesday. meteorologist, kari hall, has a look at the forecast for us as we start out nice and cool. >> nice and cool, in some spots foggy. let's head back to santa rosa. we did get nearly three inches

of rain but that's half an inch below where we normally see our rainfall for the month. we do have a surplus since october 1st. that has been shrinking every day, and we are dealing with the fog as you head out, san francisco down to half moon bay. we have seen very low visibility there as our temperatures start out in the low 40s in some spots this morning. it's going to be a nice day with a lot of sunshine. it will still be hazy as our temperatures reach into the high 60s, low 70s. mike, you are seeing the fog on the bay bridge camera? >> yeah, and that's focusing from the east bay over towards san francisco. the metering lights were turned on early, about 5:30 this morning, typically about 5:45 on a tuesday. we're looking at the backup on the camera as well as heading up over the metering lights. the fog right about in this section right here.

in the meantime, you can see the affect on the future. fed jay powell briefing congress on the conditions, and inflation will be a topic. leaders like powell say the inflation thing is temporary. if we can get the supply chain back up and running, products will flood into stores and prices will go down, they say. shares on twitter fell slightly after the founder, jack dorsey, said he would step down as ceo. really, these negative numbers on your screen don't tell the tale. in the past when a founder hands power to a nonfounder, good

things happen and not bad. tim cook was a long-time apple executive when he took over after the death of the founder, steve jobs, and cook turned apple into the most valuable country. jeff bezos stepped away from amazon handing it over to his long-time deputy and amazon is doing fine. and the growth of microsoft has been extraordinary after being handed over. dorsey seems to think that twitter is ready for that transformation, appointing a long-time co-worker but not founder. i did an interview with a much, much younger and clean-shaven jack dorsey many years ago, and i posted that to twitter, which

cool down. it will be a nice evening out there. if you have travel plans, it has been raining all throughout the season. it's still raining. another atmospheric river headed for seattle and portland. that's where all of the rain will steered to the north, high pressure is blocking that. for us it continues, the dry weather, as the rain stays to the north of us so we are not seeing changes here. now that we are wrapping up the month, we are looking at how much rain we measured. in san francisco, it was well below what we get for the month. we are still in the surplus for the water year thanks to the big month in september. going into the next few months, we are entering into what is usually one of our rainy seasons, rainy months of the water year, and so it's starting out very dry. we will see if we can flip this

pattern and get some of the rain they are getting up around seattle to move in. our temperatures will be in the low 70s for the next few days, and slightly cooler in time for the weekend. mike, you are seeing more fog for the drivers? >> yeah, and it's focused at the bay bridge. as the fog rolled in, they had the metering lights turned on. once you get past the metering lights, you will also see lower visibility. this crash off 580, chp drove through the area and said it looked like there was a crash and that's cleared so that's great news headed towards the maze. a little slowing for vasco here but nothing out of the ordinary, and lighter for the south bay. coming up next on "today in the bay," "nbc bay area responds." if thieves steal your car's catalytic converter, police may

you know, thieves seem to be stealing catalytic converters nonstop. state farm saying claims for stolen converters shot up last year. >> some departments are saying to label your converter. and consumer reporter, chris chmura, shows us how. >> marking your converter doesn't guarantee it will stop a thief but may help police trace it back to you if it gets stolen, and that could save you serious money. replacing one could cost thousands. first, what do you put on a catalytic converter to say it's yours. you can put your vin. next, how do you put your vin on a piece of metal so it stays there? you have a few options.

some companies sell customized heat-resistant levels. if the thieves try and peel off the sticker, the vin stays behind in little dots. you can etch your vin. this is what we tried to do with the engraver we got at a hardware store. we have read the directions that came with the etcher. we are doing this on the car while it's cool because the exhaust area can get hot, and we set the emergency break and i will wear these stylish safety glasses. we realized it was a two-person job. my colleague will read the vin to me while i crawl under and scratch it into the converter using the stencil. this takes a little bit of maneuvering.

head for the upper 60s and low 70s. i'll let you know if there are any changes down the line. that's coming up in a few minutes. oakland's police chief responding to city leaders asking for a change in city policing and crackdown on crime. >> the mayor libby schaaf is asking for more hiring of police officers as soon as possible. >> reporter: you will recall this past june oakland's city council put money allotted for opd into other places, and now the mayor wants that money to go back to opd so they can hire new officers immediately to combat the recent spike in homicides and violent crime on the streets of oakland. as a matter of fact at 11:00 this morning, opd's chief of police will talk to the media to discuss the additional staffing

of tactical staffing and the recent murders. of course we are talking about what happened this past weekend, the death of a man near lake merritt, killed while trying to stop somebody from break into cars. the victim was 28-year-old eric davis. he worked construction before he came to the bay area. he was heavily involved in his church in los angeles, and we spoke with his mother and aunt who are heartbroken and pleading for answers. >> he was our heart. he cared about everybody. he tried to protect everybody. >> eric is going to take up for whoever can't take up for themselves. >> crime stoppers now offering a $10,000 reward for any information leading to the arrest of the suspect in the

death of his murder. >> thank you. we here in nbc bay area heartbroken over the death of a security guard while protecting the news crew. he was working in oakland when shot during an attempted robbery. a trust fund has been created the a oakland's metropolitan bank. 100% of the funds will be given to his wife. the reward has grown to $32,000 for information leading to the arrest. this is what police believe was the getaway car, a white abga raw. california's case numbers are not moving in the right direction. here's the snapshot in the past three weeks. we are hovering around 2% for

the past two weeks. the latest update has our positivity rate jumping to 3%. right now there are 3,400 patients hospitalized, including everybody over five years old, 76% of the state at least partially vaccinated. pfizer is pushing to open booster shots for 16 and 17-year-olds, so the drugmaker expected to ask the fda to authorize those shots later this week. right now only those 18 and older are eligible for an additional dose, and they are adding urgency when it comes to boosters for everybody over 18. it will be six months for the

full vaccination for pfizer and fda, and two months for the johnson & johnson vaccination. holmes faces cross-examination one day after the emotional testimony about being raped at stanford and then abuse from her ex-boyfriend, who is also the chief operating officer of theranos. kris? >> reporter: this case has been a very high-interests all along, but just to give you an indication about today, this line of reporters and other members of the public waiting to get in was about 30 people deep at 4:00 this morning, and the line has continued to grow. holmes' allegations were deeply personal and we will have to see how the allegations of rape at stanford and abuse at the hands of her ex-boyfriend play into the accusations of fraud, those

federal claims. during her day on the stand, elizabeth holmes testified that she was raped at stanford at age 19 claiming that was the real reason she dropped out of school. she testified focusing on starting her own company was the way she coped with the drama, and her relationship with sunny balwani controlled her sleep and was abusive and told her she was mediocre and needed to work harder. she said she was responsible for what happened at theranos but she was under extreme testimony because of what happened of balwani. >> it was very strong testimony. she said she was forced to have sex with him. >> reporter: balwani goes to

trial on the same charges next year and has previously called holmes' abuse accusations untrue. the questioning she was facing was at the hands of her own attorney yesterday and today it's cross-examination and we expect things could get more heated. our colleague, scott budman, is in line right there and will be in the courtroom later this morning and we will be getting details from inside. >> that's right. scott has been there since the beginning of the case, and you can get the latest on the trial by following him on twitter @scottbudman. 6:38. a live look for you at walnut creek as we get started for the day. meteorologist, kari hall, has a look at what to expect for today. >> starting out chilly and a clear sky for the east bay, and the north bay in deep with the fog in the low 40s. we will see the temperatures go from the low 40s to the 60s today.

night, and an airport spokesman said the woman exited the terminal and tried to flag down an aircraft parked at the gate. she's now being held for a psychiatric evaluation. scott mcgrew, there was a demand to be vaccinated. >> yeah, a federal judge listened to the states that sued to block that mandate that applied to any health care facility that receives federal money, which is basically any health care facility. the judge's top consideration is not whether vaccines are good or bad. they are good. instead, he was considering if making a nurse get a vaccine or lose their job would cause staffing shortages and would be

harmful to patients. a temporary travel ban from some countries might give us more time for the variant, omicron. >> we will see cases of the new variant here in the united states sooner or later, and we threat. >> and then the white house canceled the talk about the supply chain perhaps to keep the focus on covid. congress has a lot in front of it. they need to fund the government so it keeps running and maybe pass build back better in the senate. chuck schumer says that will happen before christmas. >> i will bring the president's build back better legislation to the floor so we can pass it as soon as possible and send it to the president's desk. our goal continues to be to get

kari? >> yeah, i have been watching the fog drifting through, and it has been mainly clear for drivers heading across the golden gate bridge. i just saw a cruise ship passing under the bridge. we will see the fog clear out as well. temperatures reaching 72 in cupertino today, and 73 in gilroy. the 7-day forecast is coming up at the bottom of the screen. check that out while we move over towards the east bay. hayward reaching the 60s today. mid-60s for san francisco. low 60s in the outer sunset. 68 degrees in mill valley, while clearlake will reach up to about 72 degrees. nice weather again tonight in union square for hanukkah. we will see the temperatures go from the low 60s to upper 50s. bundle up out there if you are going shopping and enjoying the sights of the city. there has been a lot of rain up around the pacific northwest,

and it has been so dry and this is where all the action is happening. there has been so much rain it's wracking up to be the wettest fall on record for the northwest. here's the atmospheric river, and it will continue to stream to the north of us and that's because high pressure is blocking it. it's keeping this from moving our way and it's not going to move anytime soon. we could see a few clouds moving in by early next week, but still not expecting much in the way of rain. now that we are wrapping up november, we are looking at how much rain we measured. it was still less than what we have for the month. we had such a big start with the rain in october, and we are still at a surplus for the water year. looking at san josé. we measured 0.1 of an inch all month long, and that's well below normal. we are seeing our surplus shrinking. right now we are half an inch

above what we normally see. we are going into one of the wettest months of the year, december, and of course, january, the wettest months. over the next couple of weeks, hopefully we will see a change in the weather pattern but for now we will be warmer than normal into the next few days. mike, you have been watching the fog at the bay bridge. >> at the toll plaza, right now, still having low clouds. starting to change from fog to low clouds. it did smack down on the east shore freeway. you see the ships clearing across the span. things are moving out on the approach, but still developing now for walnut creek. that fog descending down here. the golden gate bridge, still a

recent flash robberies. cierra johnson live in san francisco. >> reporter: good morning, marcus. right now we are just hours away from a vote on that proposal, that legislation would allow sheriff deputies to work off duty as private security for businesses. that vote taking place today. if approved deputies would be off duty and their over time would be paid by the businesses and not the city, and they would wear their standard uniform and would be armed. that meeting is scheduled to begin at 2:00 this afternoon. we are also expecting to learn more about the case in the smash and grab, the video hard to forget as folks were running after stealing, and one of the
