welcome back to "today." thanks for joining us on this saturday morning. how about that scene in hawaii? surfs up and so are the snow totals in that state? >> it's going to be make for interesting for surfing for sure. we are following developing stories this morning, including the breaking news of the parents of 15-year-old ethan crumbley now in police custody discovered in a building in detroit overnight, miles from the canadian border they're facing charges for failing to keep a gun out of their son's hands despite warning signs. also overnight, more states identifying the omicron variant. the numbers are still low and cases seem to be mild so far, but health experts say there is still a lot we do not know about it and it appears to be

spreading more than twice as quickly as the delta variant. we want to get to our top story the overnight arrest of the warrants in the deadly school shooting. megan fitzgerald is following all of it from michigan. good morning. >> reporter: good morning. the couple of was arrested just a few hours ago after a massive man hunt and even a $10,000 reward. this morning, james and jennifer crumbley are in custody after an hours long manhunt led to their arrest overnight. >> vehicle is a black kia. it's the possible vehicle of the two parents of the oxford situation. >> reporter: the couple of found hiding in a commercial building after police received a tip. >> they certainly appeared to be distressed. >> reporter: authorities say they failed to show up for their arraignment friday before they were captured hours later. they're each charged with four counts of involuntary manslaughter in connection with

tuesday's attack at oxford high school. but the attorneys said they planned on turning themselves in. all this as new details about the couple of's action in the leadup to the shooting. >> the facts of this case are so egregious. >> reporter: the prosecutor saying 15-year-old ethan crumbley was with his father last week when he purchased a handgun. his mother saying on social media it was her son's, quote, christmas present. authorities say there were warning signs earlier in the week. his parents allegedly ignoring calls from the school. his mother texting her son, quote, lol, i'm not mad at you. you have to learn not to get caught. and then the day of the attack, a teacher discovering disturbing drawings made by the suspect. >> a drawing of a handgun pointing at the words, quote, the thoughts won't stop help me, end quote. >> reporter: both parents were called to the school and shown

the drawings but they never searched their son's backpack or told the school their son had access to a gun. >> the notion a parent could read those words and know their son had access to a deadly weapon, that they gave him, is unconscionable. and i think it's criminal. >> reporter: the suspect was allowed to return to class. hours later investigators say he went on a shooting spree. not long after an alleged text from jennifer crumbley to her son saying, quote, ethan, don't do it. meanwhile, after hearing about the incident prosecutors say james crumbley went back to his home to search for the gun. realizing it was missing he called 911 saying his son may be the shooter. now the school superintendent is defending the school's decision saying disciplinary action against the suspect wasn't warranted but prosecutors say their investigation isn't over and it's possible school officials could face charges. >> megan fitzgerald in michigan

this morning. thanks very much. we want to bring in legal analyst danny se val losers. thank you for being here. the parents fled, they were found overnight. how might that impact the case against them? the fact that they didn't turn themselves in? >> unquestionably. the prosecution in this case is going to use that fact in an argument for at least higher bail or arguably no bail. but, of course, the defendants are going to argue instead something like hey, we were going to come in but we were just trying to lay low because there was so much negative publicity out there. the prosecutor probably won't buy that explanation and will ask for higher bail when the time comes. >> the parents here are charged with involuntary manslaughter meaning they are held accountable for those four deaths. how rare is that? how strong is the prosecution's case here.

there's no law in michigan that says they must lock up any gun in their home. >> it's uncommon but not unprecedented, certainly in michigan. a few years ago the michigan court of appeals upheld a similar liability involuntary manslaughter for a parent who left an unsecured gun around children with tragic results. so the prosecution here has a path to conviction because in michigan courts have interpreted involuntary manslaughter to encompass this kind of behavior but it is rather novel to hold parents responsible for their children getting access to a firearm and then atrocities lik allegedly occurred here. but i expect we may see it as a trend moving forward for prosecutors in a state like michigan which may not have gun securing laws to apply it to traditional theories of homicide like involuntary manslaughter

which is not gun specific. >> you talk about liability and a lot of people are focused on the school, because something extraordinary happened the morning of the shooting the school called in the alleged shooter and his parents, urged the parents to get him counseling immediately. but then, he was allowed to go back to class. he apparently was even wearing a backpack where they believe the gun was being i think a lot of people are o wondering could the school be held liable as well. >> based on the prosecutor's statements at her press conference yesterday, i don't think that the story is over i think that it is just beginning as to the investigation of the school. traditionally when it comes to civil liability, it is much harder to hold a public school or a government entity responsible than it is a private corporation or private individual however, that certainly a possible if they did something egregious enough and i think we're only just beginning to look into what

happened at that school and with a administrators did and most importantly what they knew and when they knew it about this child >> the case continues to unfold. danny, thank you so much for your insights. now to the coronavirus pandemic and the very latest on the omicron variant that has been identified in at least 11 states there are still so many unknowns about omicron but health experts say that it does seem clear that the strain is spreading more quickly than the delta variant kathy park is at the jaf avits center and health officials are racing to contact everyone who was there at the same time >> reporter: good morning. that's right contact tracing is now under way for the more than 50,000 people who attended and anime conventio here last month after a minnesota man who was fully vaccinated tested positive for the new variant. health officials say omicron is

cause for concern but we shouldn't panic. this morning cases of the omicron variant on the rise, found in at least 11 states as health officials brace for more infections nebraska among the latest to join the list with one person showing symptoms after returning from my gearnigeria. >> i would consider the cases to be mild to moderate. most of them are on the recovery end and we'll be back up and running soon >> reporter: and hawaii's first omicron patient never left the state. >> there was no travel history outside the state signifying that community transmission of the omicron strain has already occurred in hawaii >> reporter: the world health organization says as they wait for more data, they have not seen any deaths linked to the new strain but scientists in south africa say it appears that omicron spreads more than twice as quickly as the delta variant posting their finding on twitter, noting their research has not yet been peer reviewed

the white house covid task force says that the nation is ready to fight the new variant but says that we all need to do our part. >> notably we are urging prye providers to get all americans boosted right away >> reporter: with omicron detected in roughly 40 countries so far, the biden administration is stepping up to help increase vaccination rates abroad >> the president announced that we're accelerating the delivery of more vaccines around the globe, 200 million deesoses in next 100 days, 9 million to africa africa. bringing our total doses donated to africa to 100 million. >> reporter: to further stem the spread of omicron, starting monday travelers entering the u.s. will need a negative covid test the day before they board their flight. and pfizer and moderna are working to determine the effectiveness of current vaccines against the variant. it will likely be weeks before

talker and this big mystery this week at joel osteen's texas mega church hundreds of envelopes found stashed with cash. >> it comes seven years after the church reported someone stole $600,000. morgan chesky is in dallas with more on the mystery. good morning. >> reporter: it is quite a mystery. good morning. and the investigation into that reported threat seven years ago still ongoing and now police saying this cash is connected. joel osteen known for his speeches and sermons has yet to comment on this incredible discovery. >> we love you. we're praying for you. >> reporter: the inspirational messages pack his houston church with thousands. but this morning pastor joel osteen in the spotlight with a money mystery. >> i mean, it was just like unbelievable the things he was telling us that they found in the wall. >> reporter: during his morning radio host george lindsey took a

call as by a man who identified himself as a plumber who worked recently joel osteen's church. >> there was a loose toilet in the wall, they removed the tile, went to remove the toilet and i moved some insulation away and about 500 envelopes fell out of the wall. >> envelopes full of cash, checks and money orders. >> i went ahead and contacted the maintenance supervisor that was there. and i went ahead and turned it all in. >> reporter: the church confirmed the find in a statement writing an undisclosed amount of cash and checks were found adding they notified police but lakewood has no further comment at this time. houston police wouldn't share how much was recovered but stated friday evidence suggests this november case is connected to a march 9, 2014 theft report of undisclosed amounts of money at the church. that money disappeared at the
