rain will be tapering off in the next hour or so. right now for the most part just proving through the tri-valley and parts of the south bay. the rest of the day is clear and sunny with temperatures only reach into the mid 50s. it could be freezing in some inland spots as we go into tonight. the rest of the outlook is dry for the weekend. some spots really cold tonight.

we're getting ready for more rain as we go toward the end of the weekend. we'll talk more about that coming up. today, the public memorial service honoring kevin nishita, the former police who was killed while guarding a news crew. family, friends and colleagues are gathering while the certainly continues for the gunman who took his life. >> reporter: good morning to you, marcus and laura. the celebration of kevin nishita's life will happen at the san jose auditorium. he was by all accounts a good family man, a good cop who served his family well. he was decorated san jose police department where he started and later hes award for

department's highest honor. after retirement, he worked as security for tv news crews. nearly two weeks after he was gunned down, the search continues for his killer and that possible get away car. this is a white acura four door sedan with no license plate that was seen in the area at the time. the reward for information is now $38,000. he was one of 129 people murdered in oakland this year. oakland city leaders voted to unfreeze 60 officer positions and to launch two extra police academies. however,the talk of offering bonuses of up to $50,000 to draw veteran officers is now on hold. the memorial service is open to the public, but because san jose civic a city owned property, people have to show proof of

vaccination. a negative covid test will not serve as a substitute. we will stream it on nbcbayarea.com as well. a group of east bay health workers are part of alameda county's largest covid cluster. kaiser permanente announcing 11 of its oakland medical center employees have tested positive for covid after attending the same wedding in wisconsin. five have the new omicron variant. testing is underway to find out if the outbreak has spread to kaiser patients. all 11 people are vaccinated and evenboosters. their symptoms are mild and they are quarantining at home.

an east bay medical leader raising concerns about what she believes are bullying tactics by anti-vaccination activists. christina lawson was stalked and harassed by four men at her home and office in walnut creek monday night. she posted photos on social media claiming the same men were flying a drone over her home. all of this concerns contra costa county supervisor. >> unfortunately we're seeing in this country this increased polarization where people now are attacking others personally. they're bullying others. we're seeing that as part of information about covid, unfortunately. >> lawson says the men claimed affiliation with america's front line doctors, an anti-vaccine group investigated by congress. we reached out repeatedly to the group and got no response. police tell us they found no evidence of a crime but are classifying it as a suspicious circumstance. developing in the central valley, stockton police have still not identified the man shot and killed after firing his gun outside of police headquarters. they con inadvertently --

converged on a man firing wildly in the air. after tackling the man, officers say he got up and charged those officers with the gun still in his hand. that's when officers killed him. no one else was injured. lawmakers in washington focusing efforts on protecting children online. instagram's leader got a grilling on capitol hill over social media's negative effects. alice barr live in washington. some of the heat surrounds a custom made app for kids. >> that's right, laura. that idea was put on hold after outrage about the idea of marketing instagram specifically toward children 10-12. senators were none too happy to hear yesterday that while that idea was paused, it's not going away. >> too little too late. >> reporter: a tense first appearance before congress for instagram's ceo, in the hot seat after a whistleblower leaked documents showing the social media platform knows it can be

harmful to teens. >> social media can fan those flames and fuel the fire of the mental health crisis that we face among teens. >> reporter: the u.s. surgeon general issuing a rare public health advisory, warning of a youth mental health crisis during the pandemic and calling on social media companies to counter the damage some users report. >> it makes everyone, especially girls, feel bad about themselves. >> reporter: instagram announced new controls for young users including encouraging them to take breaks. starting this spring, letting parents see how long their teens spend on the app and set limits. the company also calling for federal regulation. >> we believe in more transparency and accountability and more control. >> reporter: senator mike lee said his staff created a fake account for a 13-year-old girl

and said instagram suggested inappropriate content. >> after we followed a famous female celebrity it changed and it went dark fast. >> if we recommended something we shouldn't have, i'm accountable for that. >> he said he would not stop developing a kids version of instagram, insisting it's more responsible to offer an age appropriate option. the push to regulate social media platforms is gaining ground with bipartisan support on capitol hill. but still, getting any legislation through congress would be a challenge. just about all tahoe ski resorts are closed, but mount rose will open for business tomorrow. only palisades tahoe has limited runs open right now. heavenly and north star among those still waiting to announce

opening day. they're hopeful next week's forecasted storm will change things quickly. a lot of people are hoping the same thing, kari. >> yeah. it looks like it's going to be a great christmas present. over the next couple of weeks we have a lot more snow in the forecast. we have light spotty showers right now. some snow for the sierra, about 2-6 inches with this storm, but we do have am atmospheric river coming in sunday and early next week. some of the initial runs of the computer models show huge amounts of snow next week. king vale could get 94 inches of snow next week. >> that's a lot of snow. over here this is a lot of cars

layers. it's going to be a cool day. the rain is moving out. we have so many changes in our forecast from cold weather to dry conditions and very wet coming up in a few minutes. looking at palo alto. the volume of traffic starting to build up right on schedule. nothing unexpected for this portion. the buildup in the south bay is starting to clear out. good morning. happy thursday. alice barr was talking about that testimony from instagram in the newscast. lawmakers very suspicious about what we're doing in silicon valley and how it may hurt teenagers. there's an interesting new bill that would force social media companies to turn over their data to researchers. that may well make its way through congress. for instance, a researcher who wanted to know how many people saw posts that encouraged diet habits that led to anorexia or bulimia, that researcher could

ask facebook for the data on those posts and how often they're shared and facebook would have to provide it. more up arrows on the stock market. traders a bit nervous about that chinese real estate giant evergrande which defaulted on its debt this week. we just got the latest figures on first-time jobless claims and they are fantastically low. here's the thing. data points show good news on the economy. the number of people who lost their jobs and went to the unemployment office looking for benefits fell to a 52-year low last week. the last president to see those numbers was lyndon johnson. you can understand why companies are reluctant to lay off workers they already have. it's hard to find workers. there are a record number of job openings. since the beginning of the year on the left showing the number of jobless claims, you want to see this decline as quickly as possible and that's e's happeni.

we haven't added the last number, but it continues to trend. even gas prices are going down. inflation is still high. that above all else has the attention of the american consumer and the american voter. we get key data on inflation tomorrow. that will be a very important number. but if we set inflation aside -- and there are some economists who argue we should -- the rest of the numbers are very rosy indeed. trending this morning the future is looking pretty bright, at least what color experts are saying. >> they're revealing the color of the year for 2022. take a look at this. it's called very peary. it's described as periwinkle blue with a violet red undertone. pantone says the color is meant to evoke, quote, the transition

continuing into next week. we're talking about the possibility of setting some new record low temperatures tonight. we're all going to be talking tomorrow morning about how cold it is. here's how you prepare. make sure you're dressed in layers especially if you work outside. wear a hat to help keep some of that warmth in your body and also check those plants. for my plants that i set outside to get some water, i need to bring those in this afternoon. also, never leave your pets outside, especially with the rain and cold temperatures coming in. bring them in, give them somewhere nice and warm to stay. and your tire pressure may go down in this very cold weather we'll see. we talked about the record low temperatures we'll see for tonight. we're looking at a forecast of 33 in santa rosa. the record is 43 so wore going to go way below these records as we go into night as well as for the next few days. then we turn our attention to

heavy rain set to move in sunday afternoon and continuing through at least the middle of next week. this is going to bring us a big boost in our rainfall as well as sierra snow. it looks to slow down a bit in our forecast as we've seen rainfall totals. the timing is sunday through tuesday with more rain coming in on wednesday and we'll see rainfall totals up to 4 inches in some spots, maybe higher with winds about 20-40 miles per hour. we will see the potential for flooding and sierra snow. some of these models are putting down 7 inches of rain in the santa cruz mountains. mike, what are you watching for the morning commute? >> that was a great note about the tire light for folks. if you're fortunate enough to have the tire sensors, your light might come on because of the low temperatures. add a little bit of air. it might not mean a puncture. do your due diligence.

we're looking at san jose with your typical build. more traffic coming underneath the 280 and 17 interchange. that's pretty standard. 101, we see some more slowing. typically what happens is about 5:35 we see a burst of traffic up through the area. it calms down and the second one comes in about 20 minutes. the backup over at the bay bridge has started, the metering lights are on. typical patterns, not so bad for contra costa county. coming up next, the surprise of a lifetime. >> one day earlier this year i got a message from ellie. so i scrolled down and it said daughter. >> a test an east bay woman that changed her life forever.

morning. how are we looking now, kari? >> starting to taper off just a little bit. for the most part, some of the measurable rain moving out. still spotty sprinkles left behind through the south county and continuing to move away from the bay area. the rest of the day we'll see our sky clearing. walnut creek, we do have a chance of a spotty sprinkle or two. but our temperatures is in the low 50s and it really doesn't warm up much today. we have some cool air in our forecast with highs only reach into the mid 50s today. we'll see some sunshine, but then some cold, frosty conditions tonight. we'll talk about all of that coming up. bay area schools facing the stark reality of empty december desks coming up because of the proof of vaccination deadline. >> some of those districts

moving forward with mandates. >> reporter: that update will come from inside of this building. it will be virtual. if you recall, it was back in october when governor newsom made the announcement that students in grades 7 through 12 would be required to show proof of vaccination. the caveat was that it wouldn't kick in right away. it would have to be phased in once the vaccines got full fda approval. that isn't expected to happen until about july of 2022, after the school year ends. meantime, new numbers show right now thousands have yet to show any proof of covid vaccination. take a look at your screen. several bay area districts have thousands of students without that proof. 6,000 in oakland, 1600 in west contra costa. statewide 44,000 at l.a. unified

and 12,000 at sacramento unified. today at 4:00 p.m. marin county office of education will host an online public health update for school staff, teachers, administrators, parents and guardians. the event is virtual and speakers like dr. matt willis will help answer questions for the community. organizers say they will record the event and put it up on the learning portal. a lot of districts looking to educate folks as some districts have that looming vaccine deadline. live in san rafael, cierra johnson. with one victory in hand, scott peterson's attorney is focusing on freeing him all together. it was a dramatic day in court yesterday when peterson was resentenced to life in prison without the possibility of parole.

at one point laci's mother looked directly at peterson, calling him a coward. laci's sister and brother talked about the pain and devastation left behind by the murders. the judge denied peterson's request to speak, but he could be granted a new trial in february when the judge hears arguments over jury misconduct. his lawyers say they have no evidence that exonerates peterson. >> we know that the burglary that occurred across the street which police originally stated occurred on december 26th, we now can present evidence it occurred at the time laci disappeared. >> peterson continues to maintain his innocence. watch the interview coming up on the "today" show. new details about a deadly shooting in oakland. police have released this photo. this is the vehicle investigators believe was used in the shooting of 28-year-old

eric davis, who was trying to stop a car theft near lake merit. that shooting happened on november 28th. davis moved to oakland two years ago. his death left a lot of family members devastated. a $10,000 reward being offered for information leading to an arrest. the drama in the elizabeth homes criminal fraud trial will build for next week after testimony wrapped. the final hours yesterday finished with holmes in her seventh day on the witness stand. the focus centered on her relationship with former theranos business partner and boyfriend sunny balwani. closing arguments take place one week from today. after that, the jury should begin deliberations. another water district could soon be ready to declare an emergency. bob redell has a look. >> reporter: good morning. if this ordinance goes into

effect we're not talking about the rationing of water but the alameda county water district are considering an ordinance that would declare a water shortage emergency and get customers to reduce water usage by 15% through mandatory conservation measures. they are forecasting that next year demand for water is expected to exceed the water supply by 15%. this ordinance would limit irrigation to one day every other week in the winter, once a week in spring, twice a week during summer time, hosing off sidewalks would be prohibited, no draining or refilling of swimming pools. there will be a public hearing tonight at 6:00. the water control board is

proposing regulation for the entire state that would prohibit excessive irrigation, forbid irrigation within 48 hours of a rainstorm and ban the use of potable water for street cleaning. this after governor newsom has asked californians to voluntarily cut back water usage by 15%. odd numbered addresses can irrigate mondays and thursdays, even number addresses tuesdays and fridays. watering must take place before 10:00 a.m. or after 8:00 a.m. this only applies to sprinkler systems not drip systems or hand held hoses. this is prior to that city's effort to cut water use by 15%. people in marin face more water restrictions. residents are prohibited from turning on outdoor sprinklers or drip irrigation systems.

they can not refill drained swimming pools. they could face fines of $250 as well as other penalties. the public utilities commission is asking all of its customers to cut back water use by 10% based on what you used from july of 2019 to june of 2020. it also means your bill is going up. the commission issued a drought surcharge. the average customer will pay about $6 more a month starting in april. taking a live look outside from downtown san jose. christmas in the park. so festive this time of year. finally winter making a little bit of an appearance with a storm coming through overnight. we thought it was just

trapped -- >> i know we wanted to give an update on the reservoir levels and the drought. before we get to the weekend forecast, we are looking at very low water levels for the south bay especially. in the east bay, capacity at 74%. across the state we're only at about half the normal amount for capacity at some of our largest reservoirs. we still have the exceptional drought for the east bay and central valley. in san jose temperatures very chilly this weekend. it will be a clear weekend, but some spots will be very cold.

happy thursday. the rain is clearing out. now it's just chilly out there. in napa we're at 48 degrees. we warm up a few degrees today but it's also going to be a chilly afternoon. we could see some freezing temperatures in spots tonight. we'll talk about that in just a few minutes. commuters, look at your screen. the bay bridge backup filling in the toll plaza. in san jose, look at all these headlights. a crashed car spun around in the center divide right now. california could soon become a sanctuary state for women seeking abortions. that's the idea governor newsom says he supports after the recent supreme court arguments over mississippi's abortion ban. 24 states are either certain or likely to follow if the high court approved.

in support of democracies around the world. >> there are those who criticize the idea of a summit on democracy, but that may say more about the critic than the summit. the house has voted 428-1 to strengthen laws to prevent american companies from importing goods made by forced labor in china, specifically by the ethnic group the uyghurs, a group the chinese are accused of rounding up into camps. it is already illegal to import and sell items made by slave labor. right now companies sometimes look the other way. there's a chance you own something made under those conditions. speaker of the house nancy pelosi saying, quote, if the u.s. does not speak out for human rights in china because of commercial interests, we lose all moral authority to speak out for human rights any place in

the world. all democrats, all republicans who voted voted yes except for one person, thomas massey of kentucky. he was the one no vote against the ban. we have reached out to his office to find out why. president trump's former chief of staff asking the courts to block a subpoena and perhaps a charge of contempt after he refused to answer questions about the white house's role in attacks on the capitol. mark meadows had originally agreed to testify but withdrew that agreement shortly after he published a tell-all book. congress has threatened to charge him for contempt. the 49ers head to the jungle on sunday in a quest to save their playoff lives. the jungle the nickname for the cincinnati bengals' home stadium. the niners will try to get back

overall this storm system is moving on out of here, quickly passing by, bringing about a tenth of an inch of rain or less for many of our micro climates. a lot of dry weather in our forecast for the next couple of days, but chilly temperatures. then the atmospheric river set to arrive on sunday. once again, we do see basically the storm doors open. we're going to see round after round of rain. that atmospheric river is going to tap into deep subtropical moisture and enhance the amount of rain as it slows down over the bay area early next week. this is going to be followed by another round of rain in the forecast on wednesday. it's looking pretty wet here. a look at the timing for the atmospheric river moving in on sunday afternoon, continuing through tuesday. we could see three quarters of an inch of rain up to 4 inches and gusty winds as well. the lower totals will be in our

valleys like san jose and livermore. the sierra could see 2 to 6 feet or more of snow. one computer model is showing santa cruz mountains with oven 7 inches of rain and as much as 5 inches in parts of the north bay. get ready for a chilly weekend with morning temperatures in the 30s. next week, of course, we'll all be talking about the rain coming in. >> remember plugs drains caused flooding last time. right now there are flashing lights south 101 and northbound 101. not presenting a problem. northbound, that crash still reportedly blocking one lane at oakland road. back to capital expressway, some folks choosing to get over to
